Abstract

Balinese society local wisdom had a high potential for the legal development, both in the legal substantive development and the legal structure, as well as legal culture. It was a social reality was understood and implemented in their life, in fact, a very functional in the society. Therefore, it needs to be revitalized and transformed into national legal development. The revitalization of the local wisdom potential of Balinese society in legal development. It was conducted by way of leveraging the performance of Desa Adat organization unlike Bendesa policy, Kelihan, Pecalang with doing a cooperation and coordination towards government agencies, especially the state of legal enforcement in carrying out the task in a manner with the wise and prudent, a good attitudes and no arrogance as well as a violence. Therefore, the attitude of legal enforcement officials would be role models for the societies. Thus, the Bali image as the island was safe, orderly, and peaceful, with the population-paced of harmony could be preserved. The transformation of Balinese local wisdom was done by accommodating in the local regulation, even the regulation of provincial level regional as well as the regency and city level.

Abstract

Hinduism developed in Central Kalimantan. It was evidence of Hindu kingdom. It could be seen from the existing history of the oldest Hindu kingdom, namely Kutai kingdom in East Kalimantan in the 4th centuries AD. There was the Yupa-shaped stone found on the banks of the Mahakam River in East Kalimantan. The Yupa stated that the Kutai kingdom. It was a victim pillar stone that was used to bind sacrificial animals during the ceremony. It was provided evidence of the oldest Hindu in Indonesia. It used the Pallawa letter, Sanskrit (Team, 1996: 14). In accordance with the existing evidence of Hindu kingdom in East Kalimantan, it was also seen in Central Kalimantan. The emergence was Hindu Kaharingan teachings. The emergence of Hindu Kaharingan teachings was a religious system in Dayak society at that time. It was the existence influence of the oldest Hindu kingdom in East Kalimantan. It was developed Hindu Kaharingan teachings in Central Kalimantan. There was inseparable from the belief system that exists in the local Dayak society. One of the local religious elements that were very necessary to be preserved was Basir. Due to Basir was the heir of ancestral teachings from ancient times. It has been determined in Dayak Hindu Kaharingan society in Palangka Raya City. The media was to preserve local religions teachings, one of them was by holding a ritual ceremony led by Basir in the religious system of Dayak Hindu Kaharingan society, especially, in Palangka Raya City. The study was intended to examine Basir in the Religious System of Dayak Hindu Kaharingan society.

Abstract

The study of masatia tradition transformation towards Hindu in Bali was a study of religion and culture using qualitative research with religious and cultural approaches. The study emphasized on the more background, process, and impact of the transformation of masatia traditional in the pitra yadnya ceremony in Bali. The phenomena raised and discussed lead to the transition of tradition, the customary law of the kingdom and its impact on the society and responses from the Dutch colonial government particularly in Bali. The masatia transformation was occurred in Bali for the 1908-2014 period due to the transition of the colonial rule which in this case was Dutch colonialist. The masatia tradition has been known since 1597 to 1843 and was formally abolished in 1908. The masatia tradition was banned in Bali by the Dutch written agreement with the king of Bali. Although it has been banned, there was only a government to practice masatia in secret until the 1920s. The process of transforming the masatia tradition for each castle in Bali takes place slowly. For the Buleleng castles since 1849 might be stated that there was no more masatia, then followed in the kingdom of Jembrana, Badung, Tabanan, Bangli, Karangasem, Gianyar, and finally in Klungkung. The process of substituting masatia of the fire occurred the transition process. But, in the end, as a successor was approved by the kings in Bali substituted for masatia rambut. The masatia rambut was used as a substitute due to Hindu community in Bali especially, the hair was considered the most sacred. The hair that was located on the head and as the center was the crown. As a result of the masatia transformation involved the term of tatwa, deeds, ceremonies, and upakara (offering tools).

Abstract

The research was conducted to find out why Buddhist ethics important for the economic system, to know the ethics according to Buddhism and the benefits of Buddhist ethics in the global era of the economic system. The data of the research was collected to identify the texts from the Scriptures of the Tipitaka/Tripitaka related to the main problem. All collected data were analyzed and dissected using the theory included structural, hermeneutic, and paticcasamuppada functionalism. The theories were used to compile the role of the Buddhist ethics in the economic system, the hope was through the role and implementation of the Buddhist ethics in the future will be a living condition for being happy and welfare. Regarding the household (micro) economic system, the Buddhist ethics were used to create a happy and prosperous household life. Thus, the householders were free from poverty with the right livelihood, to use wealth properly, and to develop spiritual virtues. Related to the government/state (macro) economy, the Buddhist ethics play an important role in creating happiness to live together in the nation and state. The Buddhist ethics in the economic system offered a middle way system between capitalism and socialism. The Buddhist ethics contributed greatly related to the development of the economic system. It was very relevant in dealing with the current situation, especially, in human character building, developing tolerance, and service culture, social independence building, building, and work ethic enhancing, building an openness spirit, motivation to do better, as an accommodative step facing of the free competition.

Abstract

This research was focused on reviewing the post-divorce Hindu women’s regarding socio-cultural pressure in Denpasar city. The analysis results found that the high dominance of the patrilineal culture caused Hindu women to experience social and cultural pressure after the divorce. An oblique labeling was often related to Hindu women after a divorce due to patrilineal culture dominance. The field findings indicated the fact that the divorce rate was increasing. The number who were widowed also increasing. Even those who were widowed classified as young due to they were early marriage. The pressure on socio-cultural after the divorce included first, the dominance of the patriarchal culture that was still strong in Bali. The men (purusa) have a strategic position in Balinese culture. This can be seen from people’s view of the men rather than women. In this case, the decision-making authority was still on the husband. Second, having to accept social stigma, Hindu women who are experiencing divorce will also be faced with a more religious stigma. A divorce in religion was actually not permitted, due to marriage was a very sacred procession. This causes divorce to be considered a family disgrace. However, the bad stigma was more predominantly directed at women, not men. Third, the social-cultural pressure for the Hindu women can be seen from the lack of protection and protection provided by traditional institutions in Bali, whether in village regulations (awig-awig) towards Hindu women, resulting in divorce cases increase.

Abstract

In carrying out the obligations of the state (dharma negara) the Hindus who are designated as heroes to get the rights to the hero’s cemetery are permanent. It means that they have a strong legal basis and their bodies are handed over to the state to be buried there. According to the concept of the death ceremony (pitra yadnya), the body must be immediately cremated (aben) to return the five basic elements (panca maha bhuta) to God. The study was intended to find why the pitra yadnya is importantly implemented for Hindu heroes in hero’s cemetery Kalibata. A qualitative method was applied in the present study, structural functionalism theory, religious theory, symbol theory, and legal system theory. Pitra yadnya ceremony was important to be carried out for Hindu heroes in the hero’s cemetery Kalibata, namely theologically accelerating the return of the panca maha bhuta to the Creator, sociologically involving the family, the community so that social interaction occurred, and family psychology was happy due to it can carry out pitra yadnya for the deceased. In this case, it was carried out in two stages, namely military ceremonies, and pitra yadnya. Sociologically, it was always involved family and society, therefore, social interactions occurred. The family psychology was happy to be able to carry out pitra yadnya ceremony hoping that the late was happy in the heaven (amor ring acintya). Juridically, the government accommodated in its implementation, while economically there was an economic turnaround, thus, the welfare of the community increased.

Abstract

The research is aimed at exploring how the belief system of Bali Aga community? how the strategy for retention the identity of the Bali Aga community? and (3) how the implications of preserving the identity of the Balinese Aga community?. The grand theories used in the present study included structural functionalism, phenomenology, and religious. Data were collected through observation techniques, in-depth interviews, and document studies. Having analyzed data is conducted interpretive description techniques. Based on the results of the research conducted in Pedawa Village, it was found that the people currently still preserve their ancestral cultural heritage in the sense that the traditions and religious systems. They inherit are still functional in managing their socio-religious life. The adjustments are indeed conducted in order to preserve the continuity of the traditions that they do. The concept of AGIL namely Adaptation, Goal, Integration, and Latency shows its existence in the field. The study also found that there was an exciting kind of awakening to strengthen the religious system and traditions. They inherited unlike reviving the sacred dances they had, and the tradition of planting of gaga rice had been increasingly difficult to find. It is one of the important facilities in the Bali Aga ritual system.

Abstract

Saat ini terkait dengan salah satu dari hak tradisional desa adat di Bali dalam mengurus rumah tangganya sendiri melalui hak untuk membentuk aturan hukum adat sebutan lainnya di Bali disebut awig-awig desa adat terjadi pergeseran akibat diterbitkannya Peraturan Daerah Provinsi Bali Nomor 4 Tahun 2019 Tentang Desa Adat di Bali. Pergeseran dimaksud disini, dari awalnya pembentukan awig-awig desa adat berdasarkan tata cara kebiasaan masing-masing desa adat (desa mawacara) bergeser ke arah penyeragaman yang dibuat pemerintah dalam hal tata cara penyuratan dan pendaftaran awig-awig desa adat di Bali (Bali mawacara). Tujuan penelitian ini adalah untuk mengetahui dan mengkaji tata cara penyuratan dan pendaftaran awig-awig desa adat pasca terbitnya Peraturan Daerah Provinsi Bali Nomor 4 Tahun 2019 Tentang Desa Adat di Bali dikaitkan dengan otonomi yang dimiliki oleh desa adat di Bali. Penelitian ini termasuk ke dalam penelitian kualitatif dengan metode deskriptif menggunakan pendekatan peraturan perundang-undangan dan pendekatan konseptual. Data bersumber dari data sekunder berupa data kepustakaan termasuk peraturan perundang-undangan terkait kemudian dikumpulkan dengan metode kutipan dan dianalisis secara deskriptif dan kemudian disimpulkan.Hasil penelitian menunjukkan terdapatnya pedoman penyuratan dan pendaftaran awig-awig pada Peraturan Daerah Provinsi Bali tentang Desa Adat dan Peraturan Gubernur tentang Pelaksanaan Perda Desa Adat di Bali menunjukkan terjadinya pergeseran dari desa mawacara ke Bali mawacarasehingga dapat mengurangi kadar otonomi yang dimiliki oleh desa adat di Bali, khususnya terkait dalam pembentukan hukum adat terutama pada desa adat Bali Aga yang secara turun-temurun memiliki cara sendiri membentuk hukum adat masing-masing

Abstract

Harmony between religious communities in Indonesia is now experiencing many problems, many conflicts occur which are actually triggered by religious issues by carrying religious flags and shouting sacred words they carry out actions that are very far from the behavior of a religious person. In handling cases of violence in the name of religion are almost all opinions say that law enforcers are seen as very weak and indecisive. If law enforcement officials remain weak and slow. It is very possible that cases of violence in the name of religion will spread to other areas. Local Law Wisdom has the potential and can contribute to anticipating religious violence in the midst of the current dynamics of socio-cultural change, policy steps in the development of national law need to be designed by Interpreting the Functions and Wisdom of Local Law in anticipating radicalism in the name of religion. Transforming Wisdom Local Law into Legislations related to Religious Issues, integrating, and adapting Local Law Wisdom in resolving Inter-religious Conflicts, and revitalizing Local Law Wisdom in maintaining security, order, and Inter-religious Harmony.
