Abstract

Waqf is a form of Muamalah Maliyah (property) which has long been known by the community for a long time. Excess assets owned by a person, should be a positive tool that can be used in social interaction to help each other and help each other. Regarding the issue of waqf, the government seriously issued Law Number 41 of 2004 concerning Waqf to become the momentum to realize waqf productively, because in this Law, waqf contains a very broad dimension, covering immovable assets including cash waqf, not limited to establishments places of worship and social religion. In the Balerejo sub-district, the management of productive waqf is still very minimal. Broadly speaking, the management of waqf is only used for places of worship. This fact has become an encouragement for the MWC NU Balerejo sub-district in developing the economic development of the people through waqf assets. So the MWC NU Balerejo is trying to manage a plot of land waqf in Sumber Bening Village which was originally in the form of paddy fields for the construction of MWC buildings and minimarkets in order to empower the waqf land to become productive waqf land for the welfare of the community. in Sumberbening Village, Balerejo District, Madiun Regency (2) What are the driving and inhibiting factors for productive waqf management in Sumberbening Village, Balerejo District, Madiun Regency. This research was conducted qualitatively with observation, interview and documentation procedures. Based on data analysis it was concluded that the productive waqf management mechanism of MWC NU Balerejo is by collecting assets (capital), productive and developing waqf assets and the last is distributing the waqf proceeds to the community. In order to achieve waqf management that provides benefits for improving the welfare of the community, especially business actors, orphans, the poor and the dhuafa. Factors supporting the management of this waqf are the existence of professional nazirs in managing productive waqf, while the inhibiting factors are the lack of public understanding of waqf, geographical factors and lack of support costs.

Abstract

In this digital era, with the frequent advancement of technology and information, people tend to be more interested in everything that is practical, effective and efficient in every activity they carry out. The same applies to buying and selling transactions in the community economy, where the majority of people choose the easy and hassle-free option in order to increase their purchasing power. Therefore, many shops or shopping malls offer membership cards or Member Cards which are referred to in Arabic as Bithaqatuat Takhfidh. With the formulation of the problem: (1) What is the mechanism for using the Alfagift Member Card in buying and selling at Alfamart Ponorogo. (2) What is the view of Islamic law regarding the use of the Alfagift Member Card in buying and selling at Alfamart Ponorogo. This research is a qualitative type of research that is descriptive in nature. The sources of information for this research are Alfamart and Alfamart consumers. Data collection techniques carried out by this researcher included observation, interviews, and documentation. Analysis techniques use data collection, data reduction, data presentation, drawing conclusions and verification. The results of this study are the use of the Alfagift Member Card at Alfamart Ponorogo. Based on the results of interviews with Alfamart consumers, it was found that the presence of Alfagift member cards made it easy for their owners. Alfagift card member users will get various benefits, such as discounts, collection of points, shopping vouchers, gifts, and others. Alfagift member card users will also collect points that can be exchanged for various offers provided by the company. So that the existing data states that the essence of buying and selling transactions using the Alfagift member card has fulfilled the trading requirements and does not contain elements of gharar (uncertainty), speculation and fraud. There is no element of coercion between buyers and sellers, and the goods sold are clear and provide benefits to consumers.

Abstract

Regulations and sanctions are two things that cannot be separated from Islamic boarding schools. One of the sanctions applied at the Al-Kholily Ma'unah Sari Islamic boarding school is the confiscation of students' items that are not placed in their proper place, in which the confiscated items will then be sold by the management. According to Syafi'iyah's fiqh study, it is required that goods that can be traded must be one's own property. While the practice of buying and selling confiscated goods carried out by management is still questionable about their ownership rights, whether the goods still belong to the santri or have become the property of the Islamic boarding school. The purpose of this study was to find out the review of Islamic law on the ownership status of confiscated goods at the Al-Kholily Ma'unah Sari Islamic Boarding School as well as to find out the review of Islamic law on the contract of sale and purchase of confiscated goods at the Al-Kholily Ma'unah Sari Islamic Boarding School. This type of research is field research using a qualitative descriptive approach. data collection obtained from observation, interviews and documentation. the results of this study show that the ownership rights of the goods traded by the management of the Al-Kholily Ma'unah Sari Islamic Boarding School belong to the boarding school. This can be seen because there was an agreement made by the management with the students so that the agreement indicated the willingness of the students if one day the goods were confiscated by the management and then sold. In this way the ownership rights of the confiscated goods are also automatically transferred to become the property of the cottage. Because the ownership status of the goods already belongs to the Islamic boarding school, the sale and purchase contract for confiscated goods at the Al-Kholily Ma'unah Sari Islamic Boarding School is legal. Because seen from the pillars and conditions have been fulfilled. In addition, this policy is also in line with the rule which states that the policy of a leader, in this case the management of the Al-Kholily Ma'unah Sari Islamic Boarding School for students, must be able to bring benefits. Abstract

Indonesia is a very broad country. Each region has diverse and beautiful natural potentials and unique local culture. The beauty of nature and local culture is a great potential to be developed as a tourist attraction and managed as one of the community’s economic resources. In some ways, tourism also contributes to reducing poverty. Just like the tour that just opened in November 2023, namely the Tumpak Lego Hill tour which is located in Ngrayun Ponorogo. With the formulation of the problem as follows: 1) What is the process of developing Tumpak Lego Hill tourism in improving the economy of the people in the village of Krajan Ngrayun Ponorogo?; 2) How is the review of Islamic law related to the development of the Tumpak Lego hill tourism in improving the community’s economy in the village of Krajan Ngrayun Ponorogo?. The research method used in this research is field research with the aim of knowing the data directly. According to Bogdan and Taylor, qualitative research is a research procedure that produces descriptive data in the form of written or spoken words from people and observed behavior. With data collection techniques consisting of: 1) observation; 2) interviews; 3) documentation. The results of the analysis show that 1) the tourism development process uses tourism product development, promotion development, spatial management, humam resource empowerment and environmental management. 2) the management of these tours is in accordance with maslahah dhoruriyyah with efforts to maintain environmental sustainability (hifzh al-bi’ah) and the existence of these tours has positive impacts such as employment, increasing people’s income and opening opportunities for people to develop Micro Enterprises, Small and Medium Enterprises (MSMEs).

Abstract

Sacrifice is one of the worship activities in the Islamic religion which is prescribed by Allah SWT. Ulama have agreed that as a devout Muslim you should also carry out sacrifices and distribute the meat from the slaughter to the community. In practice, the implementation of sacrifice also has problems that need to be examined. One of these issues is regarding who is entitled to benefit from the slaughter, considering that in civil society life is not only inhabited by Muslims, but there are also people from non-Muslim groups. There are differences of opinion among Islamic school scholars, especially the Hanafi and Syafii schools, regarding the law on distributing sacrificial meat to non-Muslims. The Hanafi school of thought is of the opinion that it is permissible to give them meat, but there are quite a few opinions among the Shafii school of scholars who expressly forbid it. With the method of library research, which examines data based on material information obtained from the library, be it arguments, books, books, or other library works that are in the library or outside it. The approach used in this writing is a normative approach based on the theory of Thâriqâh Lafziyah and Thâriqâh Ma'nawiyyah. Based on the research conducted, there are similarities and differences that the author finds in the Hanafi and Shafii madhhabs. Both of them allow non-Muslims to get meat from sacrifices with certain conditions. While the differences in opinion that exist between the two are in the methods used. The Hanafi school emphasizes the 'urf method approach by holding the value of muamalah, while the Shafii school approaches it by expanding the meaning of the text.
