Abstract

Indonesia, a nation with a Muslim-majority population, holds significant potential for implementing Islamic legal concepts in handling conflicts and physical clashes. These concepts, such as tabayyun (verification), tahkim (arbitration), musyawarah (deliberation), islah (reconciliation), and amar ma’ruf nahi munkar (enjoining good and forbidding wrong), offer a comprehensive and value-based approach. This paper aims to analyze these Islamic legal concepts in depth and explore their application within Indonesia’s diverse social context. The analysis will draw upon primary Islamic sources like the Quran and Hadith, alongside secondary literature from Islamic scholars and legal experts.This research aims to:Analyze the concepts of Islamic law in dealing with conflicts and physical clashes in Indonesia.Develop a framework for applying these Islamic law concepts in the context of Indonesia’s pluralistic society.

Abstract

The phenomenon of abstention from voting, known as golput, which refers to the behavior of not voting in elections, is a significant concern in the context of political participation in Indonesia. Muhammadiyah, as one of the largest Islamic mass organizations in Indonesia, holds a substantial influence in the social and political life of Muslims. This article examines the role of ulama and Muhammadiyah figures in countering golput from the perspective of fiqh siyasah, a branch of Islamic jurisprudence that governs public administration and policy. The research method used is descriptive qualitative with a literature study approach and in-depth interviews with ulama and Muhammadiyah figures. The findings indicate that ulama and Muhammadiyah figures play a strategic role in raising political awareness among the ummah through da’wah, political education, and persuasive approaches based on Islamic values. From the perspective of fiqh siyasah, political participation through elections is viewed as a collective obligation (fardhu kifayah) that must be carried out to achieve public welfare. Thus, the role of ulama and Muhammadiyah figures in countering golput not only contributes to increasing political participation but also strengthens democracy and socio-political stability in Indonesia.

Abstract

This article analyzes the value of maslahah mursalah in the marriage dispensation for pregnancy out of wedlock. This research study is a type of library research with a normative-empirical legal approach. Meanwhile, the type of data analysis is qualitative-descriptive. This research found that the phenomenon of out-of-wedlock pregnancies for minors is still widespread in social life institutions. One way to get married is to apply for a marriage dispensation. In the marriage dispensation there are maslahah mursalah values, including the community getting legal certainty and justice at the same time as minimizing harm.
