Abstract

Salah satu faktor yang dapat mempengaruhi keharmonisan keluarga adalah kondisi keseimbangan antara calon suami dan calon istri. Fenomena di pesantren Pamekasan menunjukkan hal baru dalam penerapan sistem perkawinan sekufu. Banyak diantara para kyai menjodohkan dan menikahkan putra-putrinya dengan orang-orang terdekat ataupun dari anak keturunan kyai pula. Penelitian ini menggunakan metode deskriptif kualitatif dengan menggunakan teknik pengumpulan data observasi, interview, dan studi dokumentasi untuk memperoleh data. Hasil yang diperoleh dari penelitian ini yaitu: dalam proses pemilihan jodoh terhadap putra-putrinya, para kyai sebagai orang tua lebih memilih dan menitik beratkan pada faktor nasab/keturunan kyai. Tujuannya adalah agar perjuangan pesantren terus berjalan, terciptanya hubungan kekeluargaan dengan kyai lainnya, seseorang yang bernasab kyai sedikit banyak akan sama dengan anak turunannya, dan sebagainya. Menurut perspektif maslahah, perkawinan semacam ini dapat dibenarkan. Pertama, karena ada dasar al-Qur’an dan hadis yang berafiliasi dengannya. Kedua, tujuan perkawinan dengan pertimbangan kesepadanan akan menimbulkan banyak kemaslahatan. Ketiga, konsep mas}lah}ah sendiri menghendaki agar manusia mendapat kemudahan dalam suatu hal, dan menghindari kesulitan-kesulitan yang menghalanginya kelak.

Abstract

Tunisia is one of the many Muslim countries that continue to strive to build a family law system which is a permanent rule of law for Muslims. Both before and after Tunisia's independence, legal reforms were intensively carried out, including legal reforms in the field of family law. One of the laws implemented in Tunisia is the Tunisian Code of Personal Status (CPST) or other names Majallah Al-Akhwal Ash-Shakhshiyyah. The legal reforms carried out by Tunisia cannot be separated from the progressive thoughts that have colored family law policies which in the next stage will become state policies. This article is presented in a descriptive form using a literature study approach as the study material. The results of the study concluded that the Tunisian State carried out many Islamic family law policies based on the development of family law in the world and the needs of its citizens.

Abstract

One of the factors that can influence family harmony is the condition of balance between husband and wife. The phenomenon in some Islamic boarding house (pesantren) in Pamekasan show new things in the implementation of kafaah in a marriage system. Many of the kyais (the figures) mate and marry their sons and daughters with the closest people or from the same level and class. This research uses descriptive qualitative method and observation, interview, and documentation study to obtain data. The results obtained from this research are: in the process of choosing a mate to their sons, they as parents prefer and emphasize on the factors of the same nasab. The goal is for the struggle of continuing their Islamic boarding school, the creation of kinship with other kyais and so on. According to the perspective maslahah, such marriages can be justified. First, because there is a basis of the Qur’an and the hadiths affiliated with it. Second, the purpose of marriage with consideration of comparability will lead to many benefits. Third, the concept of maslahah itself requires that human beings get ease in a matter, and avoid the difficulties that hinder it later.

Abstract

This article deals with the understanding of Moslem fundamentally critisizing an interpretation assumed as contradictive with a certain group or community. Thus, it is continuously said that it is out of Islamic philosophical rule, and so on. Basically, these viewpoints were proposed by a great Islamic clergy, besides he was a companion of Prophet Muhammad saw, Umar who had a capability to interprete “nash” and was also contradictive with most of the companions, eventhough with the text itself.

Abstract

Democracy often become ' victims ' of some dissatisfaction among internal impingement Muslims in administering a legitimate Government. Democracy is a Western product may be very weak basic law. He is deemed to have no religious dimension at all, even look does not correspond to what is taught by Islam in the process of implementation of the system of Government. Many more assumptions assumptions are less responsive and based on the basic law. This is confirmed by the figures of moderate Muslims who argued that Islam and democracy is indeed a unity that can not be separated. Both have ties dahir and inner when adopted as a central system running. Democracy is Islam, and Islam is democracy.

Abstract

Abu Hanifah as one of the grand fuqaha who is believed to think in the world at the time, now even for an unlimited time is interesting to read. His thoughts are tinkering with the rational logic of Muslim thinkers after competing to find out the basic laws that affect his mindset. Abu Hanifa was the only fiqh scholar who put forward his mind on a problem that was not found in the Qur'an or hadith seen by the Prophet Muhammad. If explored further, it will be known factors that influence the mindset, as well as what is taken into account are social factors. Social factors in this paper such as community factors when Abu Hanifah lived, intellectual factors, professional factors, political dynamics that occur and others. This commentary is important so that the next generation of Muslims knows about the establishment of Islamic law not only having one dimension, but many dimensions that influence it. Abu Hanifah from several existing literature. From this normative study, conclusions from sociological roots that debate the law of Abu Hanifah are needed by several factors, namely geographical-sociological factors, intellectual factors, professional factors, political factors and renewed personal support.

Abstract

Thetradition of angonan sapeh cooperation is common among the people of the Larangan Luar Pamekasan Village. This traditionis still well maintained until now, because in it there are noble values, namely the attitude of helping and brotherhood. The purpose of this study is to find out the tradition of angonan sapeh cooperation carried out by the people of Larangan Luar Pamekasan Village in a fiqh perspective. This study uses a qualitative approach with the research subject being the people of Larangan Luar Village who collaborate with angonan sapeh. Data collection techniques using interviews and documentation. The data collected was then analyzed using a descriptive method. The results of the study show that the people of Larangan Luar Village not only view the angonan sapeh tradition as only business cooperation, but the reareal so values of mutual help and brotherhood. This tradition is in accordance with fiqh, withusing a contract.

Abstract

Abstrak: Abdullahi Ahmed An-Na’im adalah seorang tokoh Muslim yang cukup berani untuk menolak konsep-konsep yang telah ditetapkan dalam Islam. Konsep pemikiran yang selalu ia tawarkan ialah perlunya dilakukan reformasi syariah. Reformasi syariah yang diinginkan olehnya adalah harus disesuaikan dengan kebutuhan zaman dan masyarakat dalam kehidupan bernegara. Formulasi pemikirannya bersifat menyeluruh dan menyentuh tataran sosial, politik, hukum pidana, hukum internasional, dan hak-hak asasi manusia tak terkecuali dalam konteks konstitusionalisme Islam. Dari sekian banyak pemikirannya, tulisan ini hanya akan mengungkap satu pemikirannya tentang konstitusionalisme Islam modern. Artikel ini sangat penting mengingat Naim sendiri sebagai tokoh Islam mampu mengkritik keras terhadap penafsiran yang dianggap bertolak belakang dengan konsep-konsep umum yang terjadi di dunia. Dari sisi metodenya, tulisan ini menggunakan teknik analisis deskriptif dengan pendekatan kepustakaan. Berdasarkan hasil analisis dapat disimpulkan bahwa konstitusionalisme Islam modern menuurut an-Na’im harus lebih bersifat aspiratif, egaliter, dan tidak diskriminatif. Konstitusi Islam modern harus sejalan dengan konstitusi publik yang diakui di dunia internasional. Sebagai implikasinya maka konstitusi Islam berada di level ke dua setelah konstitusi internasional Kata Kunci: konstitusionalisme Islam, Abdullahi Ahmed An-Na’im Abstract: Abdullahi Ahmed An-Na'im is a Muslim figure who dared to reject the concepts that has been specified in Islam. The concept of thinking that he always offers is the need for reformation of sharia. Shariah reforms desired by him is to be tailored to the needs of the times and communities in the life of the state. The formulation of his thinking is comprehensive and touches the social, political, criminal, international, and human rights levels in the context of Islamic constitutionalism. Of his many thoughts, this article will only reveal one of his thoughts on modern Islamic constitutionalism. This article is very important considering Naim himself as a Muslim figure able to criticize hard against interpretations that are considered contrary to the general concepts that occur in the world. In terms of method, this paper uses descriptive analysis techniques with literature approach. Based on the results of the analysis can be concluded that the modern Islamic constitutionalism menurut an-Na'im should be more aspirational, egalitarian, and non-discriminatory. The modern Islamic Constitution must be in line with the internationally recognized public constitution. Abstract

Nahdlatul Ulama merupakan salah satu intitusi keagamaan yang bergerak dalam banyak bidang, seperti sosial, keagamaan, pendidikan dan ekonomi. Institusi ini dalam baiatnya berafiliasi pada manhaj al-fikr ahlussunnah wal jamaah (aswaja). Salah satu bidang yang memiliki peran vital dalam perjalanan sejarahnya adalah masalah-masalah seputar hukum suatu benda dan suatu perkara. Salah satu lembaga yang fokus menangani problematika kehidupan umat Islam di bidang hukum adalah Lajnah Bahtsul Masail (LBM). LBM didirikan dengan tujuan untuk mengetahui status hukum yang melekat pada suatu perkara dan benda dalam perspektif hukum Islam. Terlepas dari pro-kontra produk-produk hukum Islam yang dihasilkan, fatwa-fatwa yang muncul dari hasil ijtihad ini menjadi satu acuan masyarakat muslim melaksanakan kehidupannya secara sosial, bernegara dan beragama. Tulisan ini merupakan kajian yang bersifat normatif dengan mendiskusikan literatur-literatur relevan terkait metodologi penetapan hukum Islam dalam kerangka pemikiran Nahdlatul Ulama. Penelitian ini menghasilkan sebuah kesimpulan bahwa berdasarkan metodologinya Nahdlatul Ulama mempunyai tiga macam metode, yaitu: qauliy, ilhaqi, dan manhaji. Tiga metodologi tersebut merupakan satu upaya yang dilakukan oleh institusi NU dalam rangka menghormati pemikiran-pemikiran ulama terdahulu. Abstract

Amina Wadud as a feminist activist is considered to widen the context of gender equality for women on the one hand. But on the other hand, she is labelled as having made a "new interpretation" of the Qur'anic texts relating to women. Her thinking and understanding eventually had an impact on the position of women in the context of family law. Where a woman has equality that is not much different from a husband. The study in this paper wants to know the extent of Amina Wadud's thoughts on the rights and position of women as wives. The study method used is descriptive qualitative with documentation data collection. Based on the results of the discussion and data findings, it can be concluded that every woman regardless of status has equal rights and position in family law. A woman as a wife is given the same opportunities such as filing for divorce, working, prohibiting her husband from polygamy, inheritance rights, testimony and so on. The gender equality offered by him lies in the position of men and women who are in the same condition or situation in order to fulfil their needs.
