Abstract

Lingga Regency has an area of ​​45,508.66 km2 with a land area of ​​2,235.51 km2 and an ocean 43,273.15 km2, with 531 large and small islands. There are still many small islands that have not been exploited for their natural resources and marine resources. Regarding the management of coastal areas, currently it has been regulated in Law no. 27 of 2007 in conjunction with Law no. 1 of 2014 concerning the Management of Coastal Areas and Small Islands (UU PWP3K). The formulation of the problem is how to implement the PWP3K Law and the obstacles faced by the Lingga Regency government. Based on the research, the results show that the implementation of the PWP3K Law has not run properly, because there is no regional regulation (Perda) on the Zoning Plan for Coastal Areas and Small Islands (RZWP3K) by the Riau Islands Province which is the legal umbrella for the Lingga Regency Government in managing coastal areas and islands. small island. The Lingga Regency Government currently prioritizes agricultural/agro-industry development programs even though developments in the marine and fisheries sector should require more special attention because most of the people work as fishermen and the area itself is included in the category of Coastal and Small Island areas. Another obstacle faced by the Lingga Regency Government is the limitation of authority between the Provincial Government and Regency/City Governments in Law no. 23 of 2014 concerning Regional Government in terms of marine, coastal and small island management.

Abstract

Forest fires are a form of environmental damage, this occurs due to illegal burning or due to human treatment, therefore forest areas need attention. Recovery of the situation as a result of environmental pollution, the government forms a responsibility that is imposed on actors or businesses that can cause environmental pollution, this is called strict liability as stated in Law no. 32 Year 2009 About the Environment. This research uses normative law research methods. The purpose of this study is to find out how strict liability in forest conservation is regulated in a law. Article 88 of the Law on the Environment, explains that the concept of absolute responsibility is imposed on the perpetrator whose actions or efforts cause environmental pollution without having to prove an element of guilt, which means that the concept of the environment in the case of forest fires is to restore environmental conditions, not to take action. punish the perpetrator first. This study concludes that the concept of Strict Liability has been properly regulated in the UUPLH to restore a polluted environment and in the case of forest fires the concept of Strict Liability mandated by UUPLH has not been implemented considering the need for rapid environmental recovery, therefore the government acts as the person in charge which is not mandated by UUPLH. but this denial has a good purpose to protect the community from environmental pollution due to smog.

Abstract

Nominee agreements related to land ownership in Indonesia occur a lot in terms of land ownership by foreign nationals. Until now, there is not a single statutory regulation that prohibits the existence of a nominee agreement if the legal subject is a fellow Indonesian citizen, thus giving birth to a norm vacuum (rechtsvacuum). This study analyzes the validity of nominee agreements with land objects made between Indonesian citizens. This research is normative legal research using a statute approach and conceptual approaches. The results of the study indicate that the nominee agreement made by fellow Indonesian citizens with an object in the form of land legally applicable in Indonesia is valid and binding for the parties bound by the agreement if it is carried out in accordance with the legal terms of the agreement stipulated in the Civil Code. As mentioned above, the provisions of Article 26 paragraph (2) of the Basic Agrarian Law, if interpreted as a contrario, can be concluded that it is not prohibited if the nominee agreement is made between Indonesian citizens.

Abstract

Tersangka adalah orang yang belum tentu bersalah menurut asas praduga tak bersalah sehingga ia harus diperlakukan layaknya orang yang tidak bersalah. Penggunaan upaya paksa harus dilakukan menurut dan berdasar hukum acara pidana yang berlaku, tidak boleh secara sembarangan. Dewasa ini, dalam praktik ditemukan tindakan penegak hukum menghadirkan tersangka pada saat konferensi pers. Artikel ini bertujuan menemukan relevansi kehadiran tersangka pada konferensi pers dan berguna secara teoritik dan praktik hukum. Dengan menggunakan metode yuridis normatif, berdasarkan kajian hukum dapat disimpulkan bahwa meski ada relevansi dari segi praktis, secara yuridis, tidak ada dasar hukum untuk menghadirkan tersangka pada konferensi pers. Dengan demikian, tindakan tersebut dapat dikualifikasi sebagai tindakan melawan hukum atau abuse of power dan dapat pula dikualifikasi sebagai upaya paksa sehingga dapat diuji di sidang pra peradilan.

Abstract

A cooperative is a legal entity that is structured as a joint effort based on the principles of kinship and economic democracy. One of the cooperative organs is the management, which in the management of the cooperative, the management can appoint managers who are given the authority and power to manage the business. The use of the term Manager is intended to cover a broader understanding and provide an alternative for Cooperatives. Thus, according to its interests, the Cooperative can appoint Managers as managers or directors. This study analyzes criminal liability for letter falsification by the management of the Cooperative. The research method used is normative legal research using a statutory approach and a conceptual approach. The results showed that the act of counterfeiting letters carried out by cooperative management could be subject to criminal liability if it was proven and fulfilled all the elements in Article 264 of the Criminal Code in conjunction with Article 64 paragraph (1) of the Criminal Code, namely the existence of a criminal act (against the law), above a certain age can responsible, has a form of error in the form of intentional or negligence and there is no forgiving reason.
