Abstract

This research is motivated by the many conflicts in the household which have an impact on the increasing number of divorces each year, domestic violence, child neglect and various other negative impacts. This is not in line with the ideals of marriage itself. This study aims to determine the thoughts of Shaykh Mahmud al-Misri about the concept of the sakinah family in the book Al-Ziwāj al-Islāmi al-Sa'īd. The formulations of the problem are: (1) What is the thought of Shaykh Mahmūd al-Miṣri in the book Al-Ziwāj al-Islāmi al-Saīd regarding the concept of the sakinah family? (2) How are the efforts to implement the concept of the sakinah family of Shaykh Mahmūd al-Miṣri in forming a happy family in society? This type of research is a library research with a qualitative descriptive approach. In analyzing data sources, researchers used steps, among others; formulate the problem under study, cite parts of the book content and data sources that are the object of research, describe and analyze in depth to draw conclusions. The results of this study are; first, the concept of the sakinah family of Shaykh Mahmūd al-Miṣri is a process of family formation based on the guidance of Islam both from the aspects of fiqh and social ethics as basic human guidelines both individually and socially and by taking into account applicable laws and regulations as a guarantee of family safety and recognition. which is legal in the community. Second, efforts to implement the sakinah family of Shaykh Mahmūd al-Miṣri are a series of preparations before marriage, among others; asking for the blessing of parents, selecting partners selectively by seeking good potential partners (pious /  salihah), seeking kafaah, especially aspects of religion and age equality of partners, sermons according to the guidance of the Prophet's sunah supported by istikharah, following marriage procedures both religiously and legally invitation, complement each other in the effort to fulfill rights and obligations accompanied by sincerity, prioritize the principle of mutual willingness, qana'ah, manage conflicts with mu'asyarah bi al-ma'ruf, maintain good social ethics and efforts to nurture and educate children with assistance and uswah hasanah in educating childrenPenelitian ini dilatarbelakangi oleh banyaknya konflik dalam rumah tangga yang berdampak semakin meningkatnya jumlah angka perceraian disetiap tahun, kekerasan dalam rumah tangga, penelantaran anak dan berbagai dampak negatif lainnya. Hal ini tidak sejalan dengan cita-cita pernikahan itu sendiri. Penelitian ini bertujuan untuk mengetahui pemikiran Syaikh Mahmud al-Misri tentang konsep keluarga sakinah dalam kitab Al-Ziwāj al-Islāmi al-Sa’īd. Adapun rumusan masalahnya adalah: (1) Bagaimana pemikiran Syaikh Mahmūd al-Miṣri dalam kitab Al-Ziwāj al-Islāmi al-Saīd tentang konsep keluarga sakinah? (2) Bagaimana upaya implementasi konsep keluarga sakinah Syaikh Mahmūd al-Miṣri dalam membentuk keluarga bahagia di masyarakat? Jenis penelitian ini adalah penelitian kepustaakaan (library research) dengan pendekatan deskriptif kualitatif. Dalam menganalisis sumber data, peneliti menggunakan langkah-langkah antara lain; merumuskan masalah yang diteliti, menukil bagian-bagian dari isi kitab dan sumber data yang menjadi objek penelitian, mendeskripsikan serta menganalisis secara mendalam untuk menarik kesimpulan. Adapun hasil dari penelitian ini yaitu; pertama, konsep keluarga sakinah Syaikh Mahmūd al-Miṣri merupakan sebuah proses pembentukan keluarga berdasarkan tuntunan agama Islam baik dari aspek fikih maupun etika pergaulan sebagai pedoman dasar manusia baik secara individu maupun sosial serta dengan mempertimbangkan peraturan perundang-undangan yang berlaku sebagai jaminan keselamatan keluarga dan pengakuan yang legal di masyarakat. Kedua, upaya untuk mengimplemenasikan keluarga sakinah Syaikh Mahmūd al-Miṣri adalah dengan serangkaian persiapan sejak sebelum menikah antara lain; memohon restu orang tua, memilih pasangan dengan selektif dengan mengupayakan calon pasangan yang baik (saleh/salihah), mengupayakan kafaah, terutama aspek agama dan kesetaraan usia pasangan, khitbah sesuai tuntunan sunah rasul ditunjang dengan istikharah, mengikuti prosedur pernikahan baik secara agama maupun perundang-undangan, saling melengkapi dalam upaya pemenuhan hak dan kewajiban disertai dengan ketulusan, mengedepankan prinsip saling rela, qana’ah, mengelola konflik dengan mu’asyarah bi al-ma’ruf, menjaga etika pergaulan dengan baik serta upaya mengasuh dan mendidik anak dengan pendampingan dan uswah hasanah dalam mendidik anak.

Abstract

This study aims for the first, analyzing Perma No. 1 year 2016 on the procedure of conducting mediation whether in accordance with the implementation of mediation in the Jepara Religious Court. Second, the effectiveness of mediation in divorce cases in the Jepara Religious Court. This research uses normative approach, using qualitative research type and using field research method, namely applied research or field research. To obtain the data is used documentation method. The results of this study stated that, first, most of the ones contained in Perma No. 1 of 2016 have been applied in the Jepara Religious Court, but there are some articles that are not in accordance with the latest Perma, for example the parties that must be in good faith at the time of mediation. Second, the effectiveness of mediation in the Jepara Religious Court, especially in divorce cases is very low, even many cases are entered but mediation can not be carried out. This is the need for socialization to the community the importance of carrying out mediation, whereas mediation is the most important process because to suppress the divorce rate in Jepara Regency.

Abstract

This study aims to understand the views of the Syafi'i and Hambali Schools about the conversion of the object of waqf and understand the comparison of the views of the two schools. This research uses descriptive normative method, qualitative research type, descriptive analysis approach. Data collection methods are primary data and secondary data. The results of this study are that, first, in the Syafi'i school, it is not permissible to sell waqf objects in the form of mosques on the grounds that the land can still be used for prayer and iktikaf, while the object of waqf other than mosques there are still differences of opinion among the Syafi'i schools themselves, some allow some are not. According to the Hambali school, it is not permissible to sell the object of waqf, but if the object of waqf is no longer useful, it can be sold even if it is a mosque. Second, the meeting point of the two schools of thought is that basically it is not permissible to sell the object of waqf because of its eternal nature, however, the Hambali school adds that if it can still be used, if it cannot then it can be converted or sold so that it can bring benefits and benefits as the purpose of waqf.

Abstract

Along with the development of civilization and the demands of the times, all will experience challenges to be able to lead to the goal and the peak of benefit. Just like the Law will also experience development along with the times and civilization. This development can be described in terms of progress. More familiar is the progressive law; Satjipto Rahardjo. How the law is able to provide answers to problems and solutions to the problems of life. Laws that have been running in Indonesia must be strengthened in an effort to achieve justice and humanity. As has been mandated in Pancasila, which is the basis of the state. The law is advanced and harmonized with the values of Pancasila is an effort to realize a just law, in the sense of the word commensurate with the violation committed. The progress of the law in responding to problems that cannot be separated from the values of Pancasila is expected to contribute to efforts to improve the law in the State of Indonesia. The law which is the basis of the Indonesian state must be pursued as much as possible so that it becomes a country that truly upholds what it believes in and is made the basis of the state.  Seiring berkembangnya Peradaban dan juga tuntutan zaman semua akan mengalami tantangan untuk mampu mengarahkan kepada Tujuan dan puncak kemanfaatan. Sama seperti halnya Hukum juga akan mengalami perkembangan dengan seiringan zaman dan peradaban. Perkembagan ini bisa dibahasakan dengan istilah kemajuan. Yang lebih familiar adalah hukum Proresif; Satjipto Rahardjo. Bagaiamana hukum mampu memberikan jawaban atas permasalahan dan solusi dari problematika kehidupan. Hukum yang sudah berjalan di indonesia harus di kuatkan dalam upaya mencapai keadilan dan kemanusiaan. Seperti yang sudah di amanahkan didalam Pancasila, yang menjadi dasar negara. Hukum maju dan diselaraskan dengan nilai-nilai Pancasila adalah usaha untuk mewujudkan hukum yang adil, dalam arti kata sepadan sesuai dengan pelanggaran yang di lakukan. Progresifitas hukum dalam menjawab permasalahan yang tidak lepas dari nilai-nilai Pancasila diharapkan memberikan kontribusi dalam upaya perbaikan hukum di Negara Indonesia. Hukum yang menadi dasar negara indonesia harus diupayakan semaksimal mungkin agar menjadi negara yang memang memegang teguh apa yang di yakini dan di jadikan dasar negara.

Abstract

Having a happy and harmonious home life is certainly a dream for everyone. But in the journey of marriage life is not always smooth and without obstacles. Married life is sometimes tricky and full of sharp pebbles or not always happy. So many have to stop in the middle of the road but many are able to pass to the end.This happened to the inmates at the Jepara Detention Center where out of the fourteen inmates in the Jepara Detention Center, nine of them had experienced divorce or were unable to maintain their married life. The reasons are different.For this reason, it is necessary to have an understanding and knowledge of the concept of a sakinah family that can be used as a guide in carrying out domestic and married life after serving a sentence.The concept of the sakinah family is very relevant because the concept of the sakinah family is in accordance with Islamic teachings and can be applied in an effort to realize family resilience. In order to be able to produce a quality generation and of course useful for the nation and religion.Memiliki kehidupan rumah tangga yang bahagia dan harmonis tentu menjadi dambaan bagi semua orang. Namun dalam perjalannya kehidupan pernikahan tidak selalu mulus dan tanpa hambatan. Kehidupan pernikahan terkadang ebrliku dan penuh dengan kerikil tajam atau tidak selalu bahagia. Sehingga banyak yang harus berhenti di tengah jalan namun banyak juga yang mampu melewati hingga akhir. Hal ini terjadi pada WBP Rutan Jepara di mana dari empat belas jumlah WBP yang ada di Rutan Jepara, sembilan di antaranya pernah mengalami perceraian atau tidak bisa mempertahankan kehidupan pernikahannya. Alasannya pun berbeda-beda. Untuk itu perlu pemahaman dan pengetahuan tentang konsep keluarga sakinah yang bisa dijadikan pedoman dalam menjalankan kehidupan rumah tangga dan pernnikahan setelah menjalani masa hukuman. Konsep keluarga sakinah sangat relevan karena konsep keluarga sakinah ini sesuai dengan ajaran Islam dan bisa diterapkan dalam upaya mewujudkan ketahanan keluarga. Agar mampu menghasilkan generasi yang berkualitas dan tentunya berguna bagi bangsa dan agama.

Abstract

Adoption of children according to laws and regulations in Indonesia in a procedural manner through a court order, this is in accordance with Government Regulation Number 54 of 2007 concerning Adoption and the definition of adopted children in the Compilation of Islamic Law. However, in the life of the people in Demaan Village, Jepara District, Jepara Regency, researchers found cases about adopted children without a court order. The focus of this research problem formulation is to find out the position of adopted children without court order in Demaan Village and about the legal protection obtained by adopted children whose adoption without the decision of a case study court in Demaan Village with the perspective of Islamic Family Law. This research uses qualitative research with a sociological juridical approach with the object of research of 2 families in the Demaan Village, Jepara District, Jepara Regency. Data collection techniques through interviews, observation, and documentation. The analysis used is the technique of analyzing data that has been collected from several research objects and figures in the Demaan Village. The results showed that the position of the adopted child did not break the blood relationship with the biological parents. The legal protection is that the rights of the adoptive parents are given to the adopted children such as care, given wills or grants, along with the belief of the community as evidence that the child is considered a child who deserves to get his rights.Pengangkatan anak menurut peraturan perundang-undangan di Indonesia secara prosedur melalui penetapan pengadilan, hal ini sesuai dengan Peraturan Pemerintah Nomor 54 Tahun 2007 tentang Pengangkatan Anak dan pengertian anak angkat dalam Kompilasi Hukum Islam. Namun dalam kehidupan masyarakat di Kelurahan Demaan Kecamatan Jepara Kabupaten Jepara, peneliti menemukan kasus tentang anak angkat tanpa penetapan pengadilan. Fokus rumusan masalah penelitian ini untuk mengetahui posisi anak angkat tanpa penetapan pengadilan di Kelurahan Demaan dan tentang perlindungan hukum yang diperoleh anak angkat yang pengangkatannya tanpa penetapan pengadilan studi kasus di Kelurahan Demaan perspektif Hukum Keluarga Islam. Penelitian ini menggunakan penelitian kualitatif dengan pendekatan yuridis sosiologis dengan objek penelitian  2 keluarga di Kelurahan Demaan Kecamatan Jepara Kabupaten Jepara. Teknik pengumpulan data melalui wawancara, observasi, dan dokumentasi. Analisis yang digunakan dengan teknik menganalisis data yang telah dikumpulkan dari beberapa objek penelitian beserta para tokoh di Kelurahan Demaan. Hasil penelitian menunjukkan posisi anak angkat tidak memutuskan hubungan darah dengan orang tua kandung. Perlindungan hukumnya ialah diberi haknya dari orang tua angkat kepada anak angkat seperti perawatan, diberi hak wasiat atau hibah, beserta keyakinan masyarakat sebagai alat bukti bahwa anak tersebut telah dianggap sebagai anak yang sepatutunya untuk memperoleh haknya.
Cerai Tanpa Putusan Pengadilan Agama Dalam Islam dan Hukum Positif Miftahul Jannah

Abstract

This study examines underhanded divorce, namely divorce that is carried out by someone without going through legal channels or without a divorce process in the Religious Courts. Whereas in the law it is clear that divorce can only be done before the court.From the description above, problems arise: First, what is the status of divorce without a decision by the Religious Courts. Second, how is the marital status of those who do not have a divorce certificate. Third, how important is the divorce certificate for divorce actors. To solve these problems, a library research method is used where the data are taken from existing books related to the titles that have been taken by the author to find answers to existing problems.The results of the study indicate that divorce without a court decision is not valid, in accordance with article 39 paragraph 1 of Law no. 1 of 1974 concerning marriage that divorce can only be carried out before a court session after the court concerned has tried and failed to reconcile the two parties. Therefore, people who divorce without a court decision are not valid but are legal according to religion only. Meanwhile, marriage without a divorce certificate is also invalid because the divorce certificate is authentic evidence as well as the marriage certificate. The divorce certificate is proof that the person has completed the divorce. 1 of 1974 that a marriage can be annulled if it does not meet the requirements to marry. So important is the divorce certificate to carry out a marriage, which is no less important, namely to ensure the management of child support rights from husband and wife, Gono Gini assets and marriage.AbstrakPenelitian ini mengkaji tentang Perceraian di bawah tangan yaitu perceraian yang dilakukan oleh seseorang dengan tidak melalui jalur hukum atau tanpa proses perceraian di Pengadilan Agama. Padahal dalam Undang- Undang sudah jelas bahwa perceraian itu hanya dapat dilakukan didepan pengadilan.Dari uraian di atas timbul masalah: Pertama, bagaimana status perceraian tanpa putusan Pengadilan Agama. Kedua, bagaimana status perkawinan yang tidak mempunyai akta cerai.Ketiga,sejauh mana pentingnya akta cerai bagi pelaku perceraian. Untuk menyelesaikan permasalahan tersebut, digunakan metode penelitian studi pustaka (Library Risearch) dimana data-data yang diambil dari buku yang ada yang berhubungan dengan judul yang telah ambil oleh penulis untuk mencari jawaban atas masalah yang ada.Hasil penelitian menunjukkan bahwa cerai tanpa putusan pengadilan itu tidak sah, sesuai dengan pasal 39 ayat 1 UU No. 1 tahun 1974 tentang perkawinan bahwa perceraian hanya dapat dilakukan didepan sidang pengadilan setelah pengadilan yang bersangkutan berusaha dan tidak berhasil mendamaikan kedua belah pihak. Orang yang bercerai tanpa putusan pengadilan tidak sah secara hukum positif tapi sah menurut agama saja. Akta cerai merupakan bukti bahwa orang tersebut sudah selesai melakukan perceraian, apabila sudah melakukan perkawinan maka harus dibatalkan sesuai dengan pasal 22 UU No. 1 tahun 1974 bahwa pernikahan dapat dibatalkan apabila tidak memenuhi syarat untuk melangsungkan perkawinan karena berkaitan dengan terjaminnya pengurusan hak tunjangan anak dari suami istri harta gono gini dan perkawinan.

Abstract

This research is motivated by the presence of some people in Bangsri District, Jepara Regency who practice polygamy but do not meet the requirements set by Islamic law and law so that their household is not harmonious. This study aims to determine effective polygamy according to Islamic law and law. This research is a field research by collecting data directly from the people of Bangsri District, who practice polygamy. The sample is 10 families taken by qualitative research methods. Qualitative method is research conducted by collecting words or sentences from individuals, books or other sources. The results showed that the practice of polygamy that occurred in Bangsri District, Jepara Regency was not effective. This happens because people who are polygamous have not met the requirements set by Islamic law and law, one of which is being fair in matters of livelihood, both physically and mentally.Penelitian ini dilatar belakangi oleh adanya sebagian masyarakat di Kecamatan Bangsri kabupaten Jepara yang melakukan poligami tetapi tidak memenuhi syarat-syarat yang sudah ditetapkan Undang-undang dan Hukum Islam sehingga rumah tangga mereka tidak harmonis. Penelitian ini bertujuan untuk mengetahui poligami yang efektif menurut Undang-undang dan Hukum Islam. Penelitian ini merupakan penelitian lapangan dengan mengumpulkan data secara langsung dari masyarakat Kecamatan Bangsri, yang melakukan poligami. Sampelnya ada 10 keluarga yang diambil dengan metode penelitian kualitatif.Metode kualitatif merupakan penelitian yang dilakukan dengan mengumpulkan kata-kata atau kalimat dari individu, buku atau sumber lain. Hasil penelitian bahwa praktik poligami yang terjadi di Kecamatan Bangsri kabupaten Jepara tidak efektif. Hal ini terjadi karena masyarakat yang poligami belum memenuhi syarat-syarat yang sudah ditetapkan oleh Undang-undang dan Hukum Islam, salah satunya yaitu bersikap adil dalam persoalan nafkah,baik secara lahir maupun batin.

Abstract

This study was conducted on the fact that in Bumiharjo Village, Jepara Regency, the number of unregistered marriages in 2017 was ± 14 couples. This reality is contrary to Law no. 1 of 1974 concerning marriage, that marriage must be recorded by a Marriage Registrar from the Office of Religious Affairs. This study was conducted using a qualitative approach with a descriptive type of study, to analyze the factors behind unregistered marriages, and a review of them in sadd al-dzari`ah. The results of this study can be stated that the practice of unregistered marriage is motivated by family, economic, and environmental factors. As for sadd al-dzariah's review that in practice, unregistered marriage has the potential to pose risks, because it does not have permanent legal force that can harm the wife and child in the event of a divorce, child's relationship with parents, and inheritance.Kajian ini dilakukan terhadap fakta bahwa di Kelurahan Bumiharjo Kabupaten Jepara jumlah perkawinan siri pada tahun 2017 sebanyak ± 14 pasangan. Realitas tersebut bertolak belakang dengan Undang- undang No. 1 tahun 1974 tentang perkawinan, bahwa perkawinan harus dicatat oleh Pegawai Pencatat Nikah dari Kantor Urusan Agama. Kajian ini dilakukan dengan menggunakan pendekatan kualitatif dengan jenis kajian deskriptif, untuk menganalisis faktor yang melatarbelakangi nikah siri, dan tinjauan tentangnya dalam sadd al-dzari`ah. Hasil kajian ini dapat dinyatakan bahwa praktik nikah siri dilatarbelakangi oleh faktor keluarga, ekonomi, dan lingkungan. Adapun dari tinjauan sadd al-dzariah bahwa dalam praktiknya, nikah siri berpotensi memunculkan risiko, karena   tidak mempunyai kekuatan hukum tetap yang dapat merugikan istri dan anak apabila nanti terjadi perceraian, hubungan anak dengan orang tua, serta kewarisan.

Abstract

This study was conducted in relation to the provisions of protection by the state for women who are going through the divorce process, who often face risks that can threaten the safety of their lives. This study was conducted using a qualitative-library approach, to analyze the provisions of state law on the protection of women during the divorce process and protection efforts in the perspective of Islamic law and positive law. The results of this study indicate that legal protection for women has been regulated in Law no. 23 of 2004 concerning the Elimination of Domestic Violence. The government's efforts in dealing with Domestic Violence are formulating policies to eliminate domestic violence, providing information, communication and education as well as conducting socialization on domestic violence, providing gender-sensitive education and training.Studi ini dilakukan terkait ketentuan perlindungan oleh negara terhadap wanita yang sedang menjalani proses perceraian, yang tidak jarang  mendapat  risiko yang dapat mengancam keselamatan jiwanya.  Studi ini dilakukan dengan menggunakan pendekatan kualitatif-kepustakaan, untuk menganalisis tentang ketentuan hukum Negara terhadap perlindungan perempuan selama proses perceraian dan upaya perlindungan dalam perspektif hukum Islam dan hukum Positif. Hasil  studi ini menunjukkan   bahwa   pelindungan   hukum terhadap  perempuan tersebut telah diatur dalam dalam  Undang-undang No. 23   Tahun   2004   Tentang Penghapusan   Kekerasan   Dalam   Rumah   Tangga. Adapun upaya pemerintah dalam menghadapi Kekerasan Dalam Rumah Tangga ialah merumuskan kebijakan penghapusan KDRT, menyelenggarakan informasi, komunikasi dan edukasi serta menyelenggarakan sosialisasi tentang KDRT, menyelenggarakan pendidikan dan pelatihan sensitif gender.
