Abstract

Salafi pesantren is a conventional Islamic educational institution which rooted deeply at Muslim society in Indonesia, especially in Banten Province. Its ability to keep existing and competing with modern pesantren is extraordinary, even though challenges and obstacles coming from competition with both modern pesantren and public schools are very hard, not to mention a stigma given to it directly or indirectly as a place to train radical and militan Islam, has trully destroyed salafi pesantren‟s popularity in society. This research intended to disclose the essential values of salafi pesantren‟s organizational culture along with its influence on its own existence in the society. Research result found out that organizational culture such as value, conviction, custom, and life philosophy is built and maintained by kiai (Islamic scholar, usually also a head of pesantren) as a central figure. Manifestation of pesantren‟s culture includes cultural kinship, solidarity and helpfulness, quality, honesty, and responsibility. These cultures remain sustainable due to the existence of cultural adhesive which are: obedience, familiarity, honesty, and santri‟s (students of pesantren or madrasah) responsibility towards kiai that interpreted as an act of tawaddu‟ (humility), observance, and sincerity.

Abstract

Legal capacity is one of the major topics in Islamic law on personal status. The Qurʾān deals with this subject, for example in Q 4: 5-6. However, it only discusses the issue of legal capacity in relation to orphans and minors. Based on the loose Qurʾānic concept of orphans and minors, the jurists of the classical period attempted to understand what was meant by legal capacity in Islam and how ought to operated in a Muslim society. One of the most remarkable jurists who tackled this issue was Ibn Rushd (520/1126-595-1198). In his celebrated collection of fatwā, the Fatāwā Ibn Rushd, he explored the issue of legal capacity based on questions brought to him, who at a time sit as a qāḍī in Sevilla and Cordoba. Abstract

The purpose of this study is to determine the economic role of housewives as workers in the informal sector and to recognize the economic characteristics of households related to the role of housewives as workers in the informal sector. This study uses a qualitative descriptive research methodology approach with a case study. The results of the study prove that: 1) The economic role of housewives as workers in the informal sector is to meet family needs; flexible informal sector employment allows housewives to prioritize the work of their domestic sector; positive values that support the economic role of housewives according to the concept of Islamic economy is the level of consumption satisfaction not on desires, but on the needs and considerations of benefit. 2) Economic characteristics of family households related to the economic role of housewives as workers in the informal sector are as follows; suppressing primary needs for allocation in prioritized secondary needs, such as education and transportation, saving is saved not for investment purposes but for the reserve of extra expenses, current expenditure is not always equal to current income, but is also based on expectations of future income.Keywords: Women, Informal Sector, Household Economy, Islamic Economy, Syariah, Banten

Abstract

In Banten, traditional elites who frequently appear in every political event besides religious leaders (kiai) and jawara are pemuka adat (community leaders) in Kasepuhan Banten Kidul. In the era of decentralization and regional autonomy and along with the implementation of direct elections and regional elections, the involvement of adat leaders by political power and power has also increased. Not only as spiritual advisers, but also as actors of political communication for the sake of certain political forces and powers. In the perspective of the theory of social action, the involvement of the adat leaders as political communicators is a form of social action or is also called a rational action that has a goal to achieve. This goal refers to two things. First, the role and involvement of the adat leaders in Kasepuhan Cisungsang as political communicators is based on the awareness of making changes in the community which is motivated by the marginalization and neglection of development in their region due to the regulation and impartiality of the government. Secondly, the role and involvement of adat leaders as political communicators has a meaning as an effort to uphold the existence of adat      due to marginalization and impartiality as well as an influence to government policies that can have positive implications for the development and welfare of the community, including in terms of legal recognition by the state in the form of regional regulations (perda).

Abstract

This study discusses the empowerment of productive zakat aimed at fostering the welfare of mustahik. This research is a programme on the implementation of the Zakat Amil Agency in the distribution of zakat. This research uses qualitative method in order for it be relevant to the results achieved. The sources of the data in this study are relevant literature both in the form of books, journals and articles used to compile theories about problems that are the objects of the research. Based on our findings, the mustahik receive zakat from the Zakat Amil Agency with the scheme of productive zakat. In relation to the data compilation in this study, the techniques used include the activities and the development of the Zakat Amil Agency in daily activities to manage zakat and mustahik’s productive zakat in organizing the programmes. Data analysis was conducted by structuring data in the form of compiling, classifying and testing data during the research. Data analysis was carried out to describe the processes and results of examinations from transcripts and notes and other materials. In relation to the qualitative approach, the data analysis is conducted in three steps, namely data reduction, data presentation, and reduction of conclusions.

Abstract

Theology, in practical, appears into two poles: first, exclusive based normative theology; second, inclusive based socio-anthropocentric. Both of these exclusive and inclusive ways of thinking can be a paradigm in every belief of school of thoughts (Madzhab) or social groups (mass organizations). These two ways of logical reasoning (exclusive and inclusive) afoot each other, and they frequently do not come together at one point; indeed, both of them are often contradictive and clash each other. Theology constructed for the present context is the one that is completely living among the members of religious community and that may give motivation to act in the reality of human life. Theology is practically hoped to be an ideology that realty functions for practical needs of human, especially for the backward community. Abstract

This paper discusses the context of the written text of al­Jawahir al-khamsah by Syaikh al-MuhammadAl-Gaus al-Hindi and its relation to a number of other texts which become the source of reference teaching institutes Syattariyah. It also discussed the important position of al-Jawahir al-khamsah text for the followers of the Syattariyah congregation, as well as a general overview of the distribution of copies either in India, Haramayn, and the archipelago. Kitab Al-Jawahir Al-khamsah is a practical book for the followers of Syattariyah congregation the most popular, because it was written based on the author's experience of spiritual exercises tauGt by the teacher, Syaikh Zuhur al-Haji Huduri, for more than 13 years at the top of Mount Janar (Cunar), North India. Kitab al-Jawahir al-Khamsah is a complement of the book of reference Lata'if al-Gaibiyyah and Risalah Syatariyah. So called, because the book of al-Jawahir al-Khamsah contains concepts the idea of founders Syattariyah (Syaikh 'Abdullah al-Syattar} and his followers (Syaikh Baha'uddin), but in a more practical form. Syaikh al-Mufammad Al-Gaus called it asa ''jewel" (الجوهر ) consisting of 'compassion' ('ibadah) and the procedures, zuhd and the procedures, and the procedures creations of prayer, remembrance and the procedures, as well as about the legacy of truth and 'a 'mal al-muhaqqiqin (deeds experts nature) and how to take it. Until now discovered at least five copies of the manuscript al-Jawahir al-Khamsah scattered in various regions, such as India, the Archipelago, Leiden (Netherlands), Saudi Arabia, and Tunisia as one of the countries in the area of North Africa. The manuscript consecutively numbered and each code: 189 خ- ج ; A 37; A 42; Cod.Or. 7201; and A-MSS-07150. This limited findings certainly do not rule out the existence of a copy of the manuscript al-Jawahir al-Khamsah other in other countries, particularly in India and Pakistan as well as Asean countries other than Indonesia.

Abstract

The beauty of nature in Cisarua Puncak sub-district of Bogor Regency has been recognized by the Arab travellers for a long. Many of them were coming to this sub-district for a tour. It has both positive and negarive effects. Their presence leads to the growth of local economy, but on the other hand, it also leads to the emergence of marriages contract. Even, a changing trends is founds there, a trend what is known as a hidden prostitution and this practice has become disturbing. This qualitative research was conducted to elaborate the phenomenon of contract marriages practice and prostitution in Cisarua Puncak sub-district of Bogor Regency, stratted from the history, the process, the actors, and the community and local authorities response. This research also analyzed the violations of law and indications of crimilan acts. The research result succeded to describe a detail information of the phenomen of marriages contract and “dawar” protitution. The research also concluded that the marriage contract and its derivates, namely “dawar” prostitution, is a violation of religion norm and law. But admittedly, its really no easy to directly eradicated, but it could be disciplined gradualy. The recommendation of the research are: legal and religious aproach are strongly necessary; economic approach also needed by doing skill trainings for those who involved in contract marriage and “dawar” prostitution. So they will have any competences and opportunities to work in legal fields.
