Abstract

The establishment of Law Number 26 of 2000 concerning the Human Rights Court aims to deal with human rights violations in Indonesia to protect human rights. However, in practice the handling of human rights violations always creates differences of opinion between institutions / human rights enforcement apparatuses, both the National Human Rights Commission, the Public Prosecutor and the competent authorities in addressing human rights violations that occur in Indonesia, which can be seen from the process of several human rights violations from the process investigation. Based on these problems, conducted a descriptive analytical study using a normative juridical approach, namely testing and reviewing secondary data with the library research stage and field studies, then the data were analyzed by qualitative juridical analysis. The results of the study indicate that the concept of handling human rights violations based on the principle of justice through the criminal justice system in Indonesia is carried out by the integrated criminal justice system. That in order to integrate the criminal justice system, one of them is by providing full authority to the National Human Rights Commission in handling cases of human rights violations both at the stage of investigation, investigation and prosecution.

Abstract

The Indonesian Government has encouraged the development of village-owned business as an alternative utilization of village transfer fund. The trust of the Indonesian government in the village government has been seen from the transfer of funds given to the village. This fund aims to develop their village. Building village-owned business should certainly be counterbalanced with a public accountability mechanism. This research aims at describing the capacity of public governance in the accountability system performed by public sector organization. This research also explores public capacity in supporting the accountability of BUMDes management from a cultural perspective. Village communities have distinct characteristics where not all systems can operate without local wisdom. This research employs both quantitative and qualitative approaches and use questionnaire and interview guide as its instruments. This research is conducted in Banyumas and takes 41 village business units and informants consisting of village business manager, village official and villager elements as the samples. The data and information are analyzed using quantitative descriptive analysis method with support of information analyzed using interactive analysis method. The research results show that public governance capacity in the accountability of village business management is still low. The opportunity of stakeholders’s involvement in public accountability system is not yet created by public organization. This is due to the strong patrenalistic culture among Indonesian society. The village community tends to give full trust and to the village government, especially the village head. This kind of patrenalistic culture opens opportunities for not optimal accountability horizontally. Consequently, the accountability only applies vertically. This research suggests improving the capacity of public governance in the accountability system of village-owned business management through optimizing stakeholders’ role in the accountability of Village-Owned Enterprise’s management. Keywords: Accountability, local wisdom, public governance capacity, stakeholders, Village-Owned Enterprise.

Abstract

This research delves into a poverty alleviating way of life of the Ilocanoes- the Tagnawa System. This practice is the coming together of men and women around the neighborhood to help one another during times requiring voluminous work, without thinking monetary remuneration in return. It identified the segment of population that had been practicing it and the occasions in their life as a community that have made this system very fructifying. Data gathering was done through interview with senior citizens in the locality, and reinforced through readings and internet blogs. The tagnawa system was practiced among the Ilocanoes’ of yesteryears: a) on various farming activities, b) on special events like weddings or burials, and c) for house construction, renovation and repair. Focusing on the interview with senior citizens who experienced these three occasions, the researcher was able to identify and appreciate innate Ilocano values and original Iloko terms which are already seldom used nowadays. This research tries to revive their use for the present generation to ponder upon. Indeed, Ilocandia is a place where conscientious people once lived. Let it be forever!
