Abstract

This article tries to answer the question of whether the idea of the state underlying the amendment of the 1945 Constitution? Then how to put this need in the context of (re) construction of statehood in the future. This writing is a description of the analysis with the normative approach of philosophical and juridical. The conclusion of this article states that the amendment of the 1945 Constitution, which was originally expected to improve the state administration system and state life, has actually reduced the ideas of the state that had originally been arranged systematically and directed by the founders of the state. The fifth amendment of the 1945 Constitution should be placed as the great effort of the Indonesian nation to restore the 1945 Constitution to its authenticity, as the document of the establishment of the State, the milestone of the nation's achievement / goal, the ideals and goals of the state, as well as the philosophy, values, a fundamental constitution.

Abstract

Land is one important element for humans. That is how importance of land, the government needs to make special arrangements regarding use of the land. In general, land arrangements are regulated in Law Number 5 of 1960 concerning Basic Rules on Agrarian Matters, which stipulates that the authority in the field of land is the authority of the central government. In addition, Indonesia as a unitary state also adheres to the principle of decentralization, it means that the central government gives authority to the regions to regulate their own regional affairs, including of land matters. The regulation regarding of land authority for regional governments is described in Act Number 23 of 2014 concerning Regional Government. However, the application of its authority is not yet optimal, because there is no balance of relations between the central government and regional governments in regulating land. The problem discussed in this study is how the division of authority between the central government and regional government of land matters. The approach used in this research is normative juridical. In the other word, this study examines the problem based on applicable laws and regulations, especially regulations regarding land. The data is collected by using literature study, then analyzed and described systematically. The result showed a norm conflict in the division of land authority in the UUPA and the Regional Government Law. Therefore, it is hoped that there is a clear division of authority between the central and regional governments which is not only contained in the Regional Government Law.

Abstract

Perkawinan merupakan perbuatan lahiriah dua insan manusia yang ingin membentuk keluarga sakinah, mawaddah dan warahmah. Perkawinan sebagai peristiwa hukum dimuatdalam Undang-Undang No. 1 tahun 1974 tentang Perkawinan dan Kompilasi Hukum Islam yang mengatur secara jelas syarat-syarat perkawinan yang harus dipenuhi oleh mempelai laki-laki maupun perempuan. Tujuan dari penelitian ini adalah untuk mengetahui dan menganalisis Alasan Permohonan Dispensasi Kawin oleh Pemohon Ditinjau Dari Hukum Negara, Hukum Adat dan Hukum Islam serta untuk mengetahui dan menganalisis serta untuk mengetahui pertimbangan Hukum Pengabulan Permohonan Dispensasi Kawin. Penelitian ini menggunakan penelitian yuridis normatif, dengan mengutamakan data sekunder berupa bahan hukum primer yang bersumber dari peraturan perundang-undangan berkaitan dengan kajian yang dibahas, serta mengunakan bahan kepustakaan yang relevan dengan kajian ini. Hasil penelitian menunjukan bahwa alasan-alasan permohonan dispensasi kawin yang diajukan oleh orang tua pemohon ada 2 (dua) yakni belum cukup umur dan mempelai wanita telah hamil. Sedangkan dasar pertimbangan hukum dikabulkannya permohonan dispensasi kawin oleh majelis hakim pengadilan agama baubau adalah didasarkan atas pertimbangan yuridis dan pertimbangan psikologis. Saran dari tulisan ini adalah perkawinan anak dibawah umur melalui proses dispensasi kawin menurut perspektif UU No. 1 Tahun 1974 tentang perkawinan, Kompilasi Hukum Islam dan Hukum Adat perlu menetapkan kriterium dasar dan pembatasan dispensasi kawin oleh anak dibawah umur.

Abstract

The election of the Regional Head of Pekanbaru in 2017 generally went smoothly, but at the beginning of the implementation of the Pilkada stage there was a nomination dispute between the regional head candidates who did not qualify with the Pekanbaru City General Election Commission (KPU). The nomination failure was the basis of the dispute over the nomination of the regional head, because there was a reason for disability in one of the prospective candidates which resulted in the failure of the candidate to become the regional head candidate for the Pekanbaru City Election in 2017. This research is sociological juridical legal research, in the form of how to deal with applicable laws and regulations are then associated with the reality that occurs in the community. The results of this study were in the form that Pekanbaru City KPU was asked to include the H. Dastrayani Bibra- H. Said Usman Abdullah as a participant in 2017 Mayor and Deputy Mayor Election, the interpretation of disability carried out by the KPU was refuted by the decision on nominating disputes issued by Pekanbaru City Election Supervisory Committee (Panwas). The conclusion in this study is in the dispute over the nomination of the Pekanbaru regional head that the Pekanbaru City Election Commission Decision was canceled with a Decision from the Election Supervisory Agency.

Abstract

This study sought to find forms of discrimination in the Law No. 40 of 2008 and Law No. 13 of 2003, and compares them with the Civil Code. This research is using library method. The results show that there are 24 chapters in the Civil Code which are discriminatory. Meanwhile, there are six forms of discrimination in the Law No. 40 of 2008; 17 forms on Law No. 7 of 1984, and 22 form the Law No. 13 of 2003. Discrimination in the Civil Code is contained in 13 forms and 20 articles, in line with 6 forms of international human rights formulations, 22 out of 27 forms of national human rights formulations. The Civil Code in the perspective of human rights can be seen that there are still articles that are discriminatory. This is not in accordance with democracy which contains the principle of non-discrimination.

Abstract

The constitutional dual judicial review of the Constitutional Court and the regulation in the Supreme Court has created legal uncertainty in the legal system of Indonesia. The application of graded judicial review has a negative impact on the guarantee of the constitutional rights of the community. The hierarchical model of the prevailing law-enforcement regulation is the abandonment of the legal norms of the constitution in every level of legal product downward. Disconnection of constitutional norms only up to the level of the Act will be a denial of the rights of the people of Indonesia at all levels of statutory legislation under the law. As a rule of law, legal products have a value of truth and justice that refers to the source of the main legal order, namely the Constitution, so that Indonesia's constitutionalism can be tiered up and down down. Thus, there is no differentiation of the "legal certainty" between the 1945 Constitution and the KMPR, as well as the Act as an implementation product with various derivatives such as the Perpu, PP, Perpres, Provincial Regulations and Regency / City Regulations. The general nature of the constitutional arrangements becomes the standard of truth so that every act of government can be controlled and evaluated by the constitution. This situation is different from what is happening now, where the justice of regulation embodied by the Supreme Court is often biased toward the interests of "securing" the contents of the regulation rather than granting legal justice rights, not to mention the long waiting periods of unclear ends. MA finally failed to bring about legal justice for the community. This is where judicial review or judicial constitutional should be placed on the shoulders of the Constitutional Court so that the conception of the Indonesian legal state not only applies only at the national level, but also becomes a backbone for the community in each region through the granting of the right of the people to obtain justice through the examination of legal products that harm the constitutional rights community.

Abstract

The judiciary is a system consisting of elements of judges, prosecutors, police, lawyers and correctional institutions. The judge is the last figure expected to realize the values of justice. Judges as agents of change can totally change attitudes and views and patterns of relationships between citizens towards social change through their decisions. Judges are expected to be able to find laws that can be used as social engineering, namely as a tool to change Indonesian society. A judge in the general court environment through his decision must be progressive and have values in a just society. Moral constancy and the attitude and professionalism of a judge must always be attached to each judge.

Abstract

Revolusi Media telah melahirkan percepatan teknologi yang sangat dahsyat terhadap perubahan perilaku manusia berdampak juga terhadap kebutuhan hukum terkait penegakan hukum. Penggunaan Internet dalam aktivitas di ruang siber banyak menimbulkan berbagai persoalan hukum dengan berbagai bentuk pola komunikasi dengan penggunaan kebebasan berekspresi. Akibat penggunaan kebebasan berekspresi yang keliru dengan alat media elektronik oleh  masyarakat di ruang maya berhadapan dengan hukum. Di dalam penegakan hukum terkait penggunaan internet untuk membuktikan atas perbuatan pidana, bukti elektronik mendapatkan pengakuan dan dapat digunakan sebagai perluasan dari alat bukti di ruang persidangan. Kitab Undang-Undang Hukum Acara Pidana alat bukti elektronik tidak diatur, tetapi dalam beberapa kasus hukum, sudah menerapkan alat bukti elektronik sebagaimana terdapat dalam ketentuan Undang-Undang Informasi dan Transaksi Elektronik maupun dalam pembuktian  Pemberantasan Tindak Pidana Terorisme dalam proses hukum di Indonesia.

Abstract

The village as the basis of national development in upholding new constitutionalism found a bright spot as the birth of the Village Customary Institution (LAD) which had a noble task. Village customary life is determined, mobilized, and controlled by institutions in the village. Village life loses its identity as a village, individuals, communities and villages move in conditions of individualism. Customary law is a term that is given legal knowledge, as guidelines, reality that governs groups, and disciplines people's lives in Indonesia. Indonesian people living in remote areas need order and guidance as rules they make themselves. Thus the existence of customary law to date still has an important role, especially in the formation of future national laws, especially in the field of family law. Customary law will be one of the main sources in the formation of written law, so that written rules are automatically a reflection of community law. And of course with the expectation that when the written law is enacted, there is no gap in practice in the community.

Abstract

Penelitian ini bertujuan untuk mengetahui proses pembuktian tindak pidana kekerasan psikis dalam kasus kekerasan dalam rumah tangga dan faktor yang menghambat proses pembuktian tindak pidana kekerasan psikis dalam kasus kekerasan dalam rumah tangga. Berdasarkan analisis terhadap data dan fakta penulis berkesimpulan bahwa proses pembuktian kekerasan psikis pada kasus kekerasan dalam rumah tangga wajib menggunakan Visum Et Repertum yang mempunyai daya bukti yang sah/alat bukti yang sah dalam perkara pidana sesuai dengan teori pembuktian psikis. Jenis Visum et Repertum yang digunakan adalah Visum et Repertum Psikiatrik. Hal ini terbukti dari beberapa putusan yang diteliti, bahwa hakim senantiasa memutus dengan berdasar pada Visum Et Repertum yang diajukan ke persidangan. Faktor penghambat pembuktian kekerasan psikis pada kasus kekerasan dalam rumah tangga dilakukan dengan menggunakan teori sistem hukum yang dikemukakan Lawrence Friedmen, dan hasilnya adalah masih terdapat perbedaan pemahaman dikalangan aparat penegak hukum tentang penerapan hukum kekerasan dalam rumah tangga (substansi Hukum), sehingga terjadi pula perbedaan persepsi tentang pembuktiannya. Selain itu, terdapat rentang waktu yang cukup lama antara kejadian dan pemeriksaan Visum Et Repertum, sehingga hasil visum menjadi kurang mendukung terhadap proses hukum (struktur hukum).
