Abstract

This article aims to answer whether vaccination is a right or an obligation and how criminal law and Qiyas Shafi’i Mazhab views the basic provisions of criminal law against vaccination objectors. By combining doctrinal and socio-legal research method, this article concludes that vaccination is an obligation because a person's personal right to choose health services, especially COVID-19 vaccination has turned into a public right. Vaccination is the government's obligation to protect public health as part of meeting health needs, following the mandate of the constitution and human rights. According to the relative punishment theory, the application of criminal sanctions is an effort made to maintain public order and peace of society, not as a means of repaying the perpetrator's mistakes. Thus, the sanctions imposed on the perpetrator are solely to provide fear so that they do not repeat their actions and other people do not follow them. There are three main objectives of relative theory, namely prevention, prevention, and reform. Whereas Qiyas Shafi'i Mazhab puts forward the application of qiyas as a justification for imposing criminal sanctions against vaccination objectors. Because a person is prohibited from doing something that endangers himself and others, punishment according to the Qiyas Shafi'i Mazhab can be applied. There are similarities between criminal law and Qiyas Shafi'i Mazhab to a view of the obligation to vaccinate, that is, both allow the reduction of individual human rights for the sake of common interests. Ultimately, this article recommends the need to regulate the handling of COVID-19 vaccination objectors through act so that vaccination and law enforcement can run comprehensively, not partially

Abstract

This study aims to analyze the meaning of philosophy in the court decision "For Justice Based on God Almighty" in a Judge's Decision based on the Law of the Republic of Indonesia Number 48 of 2009 concerning Judicial Power in the era of the Covid-19 pandemic. This research is normative juridical research with primary legal materials, secondary legal materials, and tertiary legal materials. The methods and tools for collecting legal materials use the method of documentation and document study. Data analysis was carried out qualitatively on the legal materials owned. The results of the research and discussion explain that the meaning of "For the sake of Justice the Almighty" is very closely related to respond to God Almighty, the creator of life, not only related to justice seekers. Not only within the scope of the judge's responsibility to justice seekers and the general public but spiritually it is the spiritual judge's responsibility to God Almighty.

Abstract

Legal Protection for Investors in the Capital Market. Supervision in the financial services industry capital markets experienced a change of control by Bapepam-LK be supervised by the Financial Services Authority. Institutionally, Bapepam-LK is responsible to the Minister of Finance, as Bapepam-LK is under the auspices of the Ministry of Finance, while the Financial Services Authority is responsible to Parliament or the public. Crucial aspect on which the formation of the FSA is not maximum protection of the interests of consumers of financial services. In accordance with the problems that occur as above, the authors feel the need to examine the legal protection in the capital market. This writing will also examine the parties are entitled to legal protection based on Law No. 8 of 1995 and the Capital Market Law No. 21 of 2011 on the Financial Services Authority. Keywords:Legal Protection, Consumer Interests, The Capital Market

Abstract

The resolution of dispute over election results of regional head experienced a dynamic movement rate, in line with the dialectic of the implementation of election regional head itself. Whereas in the past, based on Article 34 Paragraph (1) of Indonesia Law Number 22 Year 1999, the filling of the position of regional head and deputy head of region shall be conducted by the Regional House of Representative by a peaceful election. However, since the enactment of Indonesia Law Number 32 Year 2004, in Article 24 paragraph (5) determined the filling of the position of regional head and regional representatives implemented through direct election by the people in the region concerned. This direct election which eventually became part of the election law regime based on Article 236 C of Indonesia Law Number 12 Year 2008. In line with the development of the election, there was also a mechanism for dispute resolution of the results of General Election based on Article 157 paragraph (3) of Indonesia Law Number 8 of 2015 becomes the absolute competence of the Constitutional Court where one of the reasons for the filing of a petition is based on an election crime.Keywords: Crime of Elections, Dispute on Results of General Election of Regional Head

Abstract

The lack of knowledge possessed by Indonesian labor abroad gives rise to some vulnerability. An urgent problem to solve is the formulation of village regu-lations on the protection of the Pamijen Village workforce in order for Indonesian workers from Pamijen Village to be protected for safe migration and to ensure that abandoned families can educate abandoned children well. This research uses a qualitative approach because it has advantages in constructing social reality, cultural meaning, focusing on interactive processes and events. The authors discussed with Pamijen Village Government to get inputs related to improving the capacity of the village apparatus through training on the formulation of Village Regulations on the Protection of Indonesian Workers and then conducting public hearing activities through focus group discussions. Abstract

West Nusa Tenggara Province received 3 (three) awards at The World Halal Tourism Awards 2016. The government then appointed West Nusa Tenggara as one of the national halal tourism destinations and as one of 10 priority destinations that have a vision of "World's Best Halal Tourism and Cruise Destination". Local Government take steps by passing Regional Regulation No. 2 Year 2016 on Halal Tourism. This study is an empirical law study, with a statutory approach, a conceptual approach, and a sociological approach. Based on the results of the research, the implementation of standardization of halal tourism services in West Nusa Tenggara on destinations conducted by the Department of Culture and Tourism through the fulfillment of public facilities according to halal tourism. The standardization of halal tourism industry is done by the Department of Culture and Tourism, the Department of Industry and Commerce and the Health Service, and the Ulema Council of Indonesia-West Nusa Tenggara as the institution authorized to issue halal certificates. Factors affecting the standardization of halal tourism services are legal factors (legislation), legal structure (law enforcement), supporting facilities or factors, community factors and cultural factors. Keywords: Implementation, Standardization, Halal Tourism.

Abstract

Kekerasan terhadap perempuan dan anak adalah segala perbuatan yang berakibat penderitaan fisik maupun psikis terhadap perempuan dan anak. Tindakan kekerasan terhadap perempuan dan anak merupakan kejahatan yang dapat dikenakan sanksi pidana.Pemerintah berupaya maksimal untuk memberantas dan menghapuskan tindakan kekerasan terhadap perempuan dan anak, dengan mengundangkan Undang-undang Nomor : 23 Tahun 2002 sebagaimana telah diubah dengan Undang-undang Nomor : 35 Tahun 2014 tentang perubahan pertama Undang-Undang Nomor : 23 Tahun 2002 tentang perlindungan anak, yang diubah lagi dengan Perpu Nomor : 1 Tahun 2016 tentang perubahan ketiga Undang-undang Nomor : 23 Tahun 2002 tentang perlindungan anak, dan Undang-undang Nomor : 23 Tahun 2004 tentang Penghapusan kekerasan dalam rumah tangga.Ketentuan peraturan perundang-undangan sebagaimana tersebut diatas, meskipun memuat sanksi hukum yang berat, tetapi kenyataannya masih banyak terjadi kasus kekerasan terhadap perempuan dan anak. Penelitian ini menggunakan metode pendekatan yuridis normatif atau penelitian kepustakaan. Simpulan hasil penelitian bahwa sanksi hukum yang berat, tanpa adanya kesadaran etis aparatur penegak hukum untuk berkomitmen menegakkannya tidak akan membuat jera para pelaku dan orang lain untuk tidak melakukan tindak kekerasan terhadap perempuan dan anak. Pemberantasan atau penghapusan kekerasan terhadap perempuan dan anak diperlukan upaya komprehensif dari semua komponen bangsa, dimulai dengan melakukan tindakan preventif formal maupun non formal. Kata kunci  : Sanksi Hukum tindak kekerasan

Abstract

Lombok has Pearl attraction that has been known to foreign countries. The large potential is not yet widely realized to be given protection from legal aspects, so many countries that sell pearl products on behalf of / hijacked by the name of Mutiara Lombok. This research was conducted by normative juridical method. Using primary, secondary, and non-law material as the study. The results show that the potential of Lombok pearl law protection through geographical indication is very open. Forms of legal protection can be done in 2 ways, namely protection of preventive law and repressive law protection. The implications of Lombok Pearl protection through IG can at least be used as a) product marketing strategy at domestic and foreign trade; b) Provide added value to the product and improve the producer's welfare; c) Enhance the reputation of IG products in international trade; d) Equality of treatment as a result of promotion from abroad; and e) IG protection as one means to avoid fraudulent competition.Keywords: Legal Protection, Lombok Pearl

Abstract

The result of this research showed that universalism put human right (HAM) as universal values as formulated in International Bills of Human Rights. Human rights have been naturally owned by an individual. This is the universal nature of those rights where human rights are a natural rights theory and apply to anyone and everywhere. These rights cannot revoked by anyone, and also cannot be transferred from human to other human or regulated by the state. The State is obliged to fulfill those rights. In contrast to cultural relativism, which rejects the view of universal rights. Human rights must be placed in a particular cultural context in each country. Culture is the only source of legitimate rights or moral rules.

Abstract

Competence of religious courts increasingly complex, but the more ques-tionable also about the existence of Islamic personality as a principle inherent in the Religious Court.  Therefore this paper discusses the paradigm of Islamic personality in Religious Court. In order to analyze this issue then used the his-torical approach and conceptual approach. Based on the analysis, the exis-tence of religious court is directly proportional to the needs of Muslims and ru-lers in this country. Nevertheless, the Islamic personality has not been fully applicable to the religious court, since it is not yet clear that the policymakers to provide competencies that were previously the competence of other courts.Keywords: Islam, Islamic law, Islamic personality
