Abstract

Pilgrimage of fame to well-known foreign brands is common in Indonesia and there is still insufficient protection of the rights of well-known foreign brands. Based on this description, the following problems are formulated: 1. What are the things that cause disputes over the ownership rights of well-known foreign brands in Indonesia? 2. What are the criteria for proving ownership of a well-known foreign mark in the Supreme Court's decision from 2018-2020? 3. How is the application of law in legal protection for well-known foreign brand owners in Indonesia? The type of research used in completing the thesis is normative juridical research, namely an effort to study the legal rules as written. The data collection technique was carried out through library research, which was obtained through document studies and collecting the decisions of the Supreme Court of the Republic of Indonesia. The results of the study show that there are 2 (two) things that cause ownership rights disputes for well-known foreign brands: 1. Bad faith in the registration of well-known marks, namely business actors who register brands and imitate brands that have a high selling value in the market, 2. Bad faith both in the famous trademark license agreement, that is, if the parties making the famous trademark license agreement terminate the agreement unilaterally, besides that the use of a new mark by the licensee is detrimental to the owner of a well-known foreign mark. The criteria for proving ownership of a well-known foreign mark in the 2018-2020 Supreme Court Decision, the Panel of Judges to determine the criteria for a dominant well-known mark using Article 21 paragraph (1) letter b of the Trademark Law and Geographical Indications and Article 18 paragraph (3) Regulation of the Minister of Law and Human Rights No. . 67 of 2016. However, there are several judges who made a mistake in deciding their case and did not apply the law using the articles above, even though these articles were already in effect when the case of a well-known foreign brand was in court. The Application of Law in the Legal Protection of Famous Foreign Marks The Supreme Court Decision From 2018-2020 uses Law Number 20 of 2016 concerning Marks and Geographical Indications Article 20, Article 21, Article 74 paragraph (1), Article 76 paragraph (1), Article 77 paragraph (1) and Article 181 of HIR in the form of cancellation of trademark registration, deletion of marks, and payment of court fees charged to the losing party.

Abstract

The service was carried out in Dusun 20, Klambir Lima Kebun Village, as the object of implementation, namely housewives. This service carries the processed banana heart (banana flower) into shredded with various flavors. Banana plants are very easy to find around us, even the results of this plant in the form of bananas are one of the foods that are in demand. In addition to bananas, banana plants also produce banana leaves and flowers as agricultural commodities that are worth selling. However, discarding bananas or banana hearts can be processed into very delicious, nutritious and even selling food, one of which is shredded banana heart. This preparation is the main topic of community service activities in 20 hamlets of Klambir Lima Kebun village. The service method used is socialization, training and mentoring. The results of this activity can add insight to housewives about the existence of alternatives to processed banana flowers/hearts that are worth selling.

Abstract

One of the business activities that must be carried out to keep the company running and growing is sales. Decisions taken by corporate responsibility holders will affect the company in the future. One of the decisions that must be determined is the product to be sold for the next period. In determining the decision, a method is needed so that the decisions to be taken can be right on target. The technique used to predict the situation in the next period is called prediction. This study proposes the development of a clothing sales prediction application. The method used is the classification with the K-Nearest Neighbor algorithm. The results of data mining calculations using classification techniques with the K-Nearest Neighbor algorithm are the most predominant, it can be predicted that the number of clothing sales in the next period will increase with an average prediction of 14,900 per month and the most popular clothing brand is Cardinal.

Abstract

Decision Number: 25 PK/Pdt/2019 which is a re-examination of Decision Number: 222 K/Pdt/2017 which determines Zainul Arifin as the winner of the mortgage auction where in the implementation of the credit agreement and binding the mortgage there is an unlawful act where the object of the mortgage is joint property which in its implementation there is no agreement from either side of the wife, but the judge's decision ratifies the object of dispute in the auction that is carried out. So that it raises the question of how the legal provisions provide guarantees for joint assets that are carried out after a divorce that does not share joint assets. How is the validity of the Auction of Mortgage Objects for Joint Assets where one of the parties is not regulated according to laws and regulations. What is the law on the judge's consideration in decision No: 25 PK/Pdt/2019 regarding the auction of mortgage objects carried out by the husband without the wife's consent. Which was finally entitled "Juridical Review of the Execution of Auction Objects Derived from Joint Assets (Study of Decisions) No: 25 PK/Pdt/2019). This type of research is normative legal research, namely research conducted by analyzing written laws from library materials or secondary data and reference materials in the field of law or references in the field of law. The data used to answer the problems in this research is secondary data that comes from library research. The legal provisions for the provision of guarantees for joint assets carried out after divorce that do not share joint assets cannot be carried out if there is no agreement between the divorced husband/wife. The execution of the Mortgage Rights gives authority to the first Mortgage holder to sell the object of the Mortgage on its own power through a public auction and take activities from the proceeds of the sale. The issue of joint property must be carried out in the Religious Courts because both spouses are Muslims and have the authority and authority of the Religious Courts to resolve marital problems in Indonesia. The auction of mortgage rights on joint assets that is carried out is legally valid even without the wife's consent because of the executive power of the mortgage. The good faith committed by the auction winner who needs to be protected in this case excludes the unlawful acts committed by the debtor who negligently did not seek approval from the plaintiff as his ex-wife. It is recommended for husband and wife to immediately carry out the distribution of joint assets so as not to injure the rights of others, then the implementation of mortgage auctions on joint assets must also be carried out carefully. returns where the good faith that was carried out must also apply to the auction seller, where the auction seller is responsible for the goods to be auctioned.

Abstract

With the development of technological advances that greatly affect the development of information in an educational or academic field and in various other fields, one of which is the selection of student councils in schools during the covid 19 pandemic. The election of student council leaders is something we have often done in junior high and vocational / high school but because still manual, often slows down the process of selecting the student council chairman. During the pandemic, the teaching and learning process will continue to be carried out online or online as well as the selection of the student council chairman and his deputy, Smk Yapim Taruna Marelan is a high school that wants to realize the technology development process to improve quality and quality. Therefore, the author wants to build a website-based online system, in order to make it easier for employees and students at Smk Yapim Taruna Marelan to speed up the processing of data on the results of the vote. In order to be easily accessed by other teachers and students to choose the student council chair, anywhere and anytime the Yapim Taruna Marelan Vocational School can access this system as long as it is connected to the internet.

Abstract

Artificial neural networks are a branch of AI (Artificial Intelligence). Artificial neural network is an information processing paradigm which is inspired by the human brain system in receiving information and solving problems by carrying out the learning process through changes in the weight of its synapses. Motorbikes are one of the important land transportation at this time like a pkok thing which can help them do their activities, especially at work. Therefore, motorcycle manufacturers are competing to create motorbikes with different advantages and advantages so that in the market the number of motorbikes is very large and varied. Motorcycle sales, using motorcycle sales data for 4 years, from 2015 to 2019. Sales data will be processed by the network, in the form of the number of motorcycle sales each month. The data needed in this artificial neural network analysis process is the result of a pure database by taking the input variable in the form of motorcycle sales with the Honda brand and the number of motorcycle sales for the following month as output. In other words, the prediction of motorcycle sales predictions for 3 years is processed into the matlab using the GUI facility, to produce information on the prediction of motorcycle sales that has increased with an average prediction of 27.5185 per month from old data with an average of 25, 75 per month

Abstract

Quality management is an effective system in operation management to develops, maintains, and improves quality from groups of companies that allow marketing, production, and service at the most economycal level as well as ensuring customer satisfication. Many companies are practicing quality management to improve their bussiness performance. One of performance measurement is through measurement of efficiency. One of the tools can be used to assess efficiency of companies performance is Data Envelopment Analysis (DEA). The aim of this paper is using Data Envelopment Analysis (DEA) model to assess efficiency of quality management. In this paper will be explained CCR, and BCC models to assess efficiency of quality management. From the example of problem given, it’s proven that DEA is a reliable method for modeling operation process with multiple input and multiple output from a set of Decission Making Units (DMU), and then measure its efficiency both financially and nonfinancially.

Abstract

Mobile learning is a learning process that utilizes technological developments through electronic devices such as smartphones or mobile phones. Currently learning hijaiyah is still mostly done by meeting directly with the teaching staff, through Iqra or other print media. With this it is considered less effective and inefficient and causes boredom for children. Because of this, we need an efficient, effective and interactive hijaiyah letter learning media that can increase children's interest in learning anywhere and anytime. The application will be designed with a system design tool, namely UML (Unified Modelling language) which is easy to describe so that it can assist in system design. The application will be implemented on android-based mobile devices.

Abstract

Land has a very important role for human life because land is a place to carry out life activities, because of its large role it can also cause legal problems, such as the existence of Land Use Rights Number 1 on behalf of the Regional Government of Nanggroe Aceh Darussalam Province which was granted in 1989 by The Ministry of Basic Chemical Industry based on the Grant Charter No. 566/DJ.KD/VIII/1983 dated August 3, 1983. It is located in Simpang Kelaping village, Kala Pegasing, Kung, Pegasing District, Central Aceh Regency, better known as Belang Bebangka, with an area of ​​122 Ha. The land is partly from State land and partly from customary-owned land, initially the land will be built by the Takengon Paper Project by the central government in this case the Ministry of Basic Industry/Mining. 1 since it was handed over by the Ministry of Basic Industry in 1989 until now, what has happened is that people who claim to be Penghulu Gading, namely groups of heirs and those who claim to have rights to the land on the land, manage directly, and even some have transferred their rights by selling buy. The problems that have occurred in this area have been going on for years until now there has not been a meeting point between the Aceh Provincial Government, Central Aceh District Government and the community. In this regard, the guarantee of legal capacity is very necessary.
