Abstract

AbstractThis paper examines the Plain Packaging Policy on tobacco products that has been implemented by Australia since 2012. Indonesia has sued Australia in the WTO DSB forum based on the provisions of GATT, TBT, and TRIPs. However, Indonesia lost the dispute along with several other tobacco-producing countries. Seeing Australia’s victory, various countries – especially countries that are parties to the Framework Convention on Tobacco Control – followed Australia and implemented a similar policy. As a result, there are various objections to the Plain Packaging Policy, both from tobacco producing countries and the tobacco industry itself, because it is considered to cause discriminatory treatment of trademark protection. This paper will contain an analysis of the basis of Indonesia’s lawsuit from the perspective of the TRIPs and the Paris Convention and include a comparison between several countries that have implemented the plain packaging policies. AbstrakTulisan ini mengkaji Kebijakan Kemasan Polos pada produk tembakau yang sejak 2012 lalu mulai diterapkan oleh Australia. Indonesia telah menggugat Australia di forum DSB WTO berdasarkan ketentuan GATT, TBT, dan TRIPs. Namun Indonesia kalah pada sengketa tersebut bersama dengan beberapa negara produsen tembakau lainnya. Melihat kemenangan Australia, berbagai negara – terutama negara-negara yang menjadi pihak dalam Framework Convention on Tobacco Control – mengikuti Australia dan turut menerapkan kebijakan serupa, Akibatnya, terdapat berbagai penolakan terhadap Kebijakan Kemasan Polos tersebut, baik dari negara produsen tembakau, maupun industri tembakau itu sendiri, karena dianggap menimbulkan perlakuan diskriminatif atas perlindungan merek dagang. Tulisan ini akan memuat analisa terkait dasar gugatan Indonesia dari perspektif TRIPs dan Paris Convention serta memuat perbandingan antara beberapa negara yang sudah menerapkan kebijakan kemasan polos.

Abstract

AbstractDigital breakthroughs in addressing societal concerns as a solution and sovereignty for the security of virtual asset owners underlie the idea of forming a Central Bank Digital Currency or CBDC. Using a normative juridical method based on literature research, complemented by deductive thinking analysis, as well as a descriptive method with supporting data from primary and secondary sources. The aim is to examine the existence of circulating cryptocurrencies in the presence of CBDC. The result of this research is the need for technology infrastructure readiness and governance to establish a central bank capable of supervising the movement of virtual money in Indonesia, preventive actions related to legal protection are necessary to ensure justice, security, and civility in the nation. However, conflicts arise from Article 2 of Law No. 7 of 2011, Article 34 letter a of Regulation No. 18/40/PBI/2018, Article 62 of Regulation No. 20/6/PBI/2018, and POJK 13 of 2018 refer to the prohibition of using other types of currency as a medium of exchange. In the end, CBDC is positioned to monitor risks to financial stability, monetary stability, and the global financial system. AbstrakKetidakadaan otoritas yang bertanggung jawab, membuat cryptocurrency digunakan sebagai sarana kejahatan seperti pencucian uang, kejahatan siber, kejahatan ekonomi, dan lain sebagainya. Terobosan digital dalam menjawab keresahan di masyarakat sebagai solusi dan kedaulatan bagi keamanan pemilik uang virtual, mendasari gagasan pembentukan Central Bank Digital Currency atau CBDC. Dengan menggunakan metode yuridis normatif didasarkan penelitian kepustakaan, dilengkapi analisis pikir deduktif serta metode deskriptif dilengkapi data-data pendukung dari sumber primer dan sekunder. Bertujuan untuk melihat eksistensi mata uang kripto yang beredar dengan adanya CBDC. Hasil dari penelitian ini adalah dibutuhkan kesiapan infrastruktur teknologi dan tata kelola untuk membentuk bank sentral yang mampu mengawasi pergerakan uang virtual di Indonesia. Dianggap hanya sebagai barang komoditas, seiring dengan perkembangan zaman dan berkaca dari beberapa negara pendahulu yang memberikan ruang bagi penggunaan cryptocurrency, maka tindakan preventif terkait perlindungan hukum agar rasa keadilan, keamanan, dan keadaban tetap terjaga dalam berbangsa dan bernegara. Namun, pertentangan dari Pasal 2 UU No. 7 Tahun 2011, Pasal 34 huruf a PBI 18/40/PBI/2018, Pasal 62 PBI 20/6/PBI/2018, dan POJK 13 Tahun 2018 merujuk pada larangan penggunaan jenis mata uang lain untuk dijadikan sebagai alat tukar. Pada akhirnya, CBDC diposisikan untuk memantau risiko terhadap stabilitas keuangan, stabilitas moneter, dan sistem keuangan global.

Abstract

This article aims to analyze the juridical implications of not registering marriages for legal protection for the community, because the existence of the PKDRT Law has not been fully able to guarantee legal protection. The writing method used is juridical-normative using a reform-oriented research typology, namely evaluating applicable rules by providing recommendations on these rules. This study concludes that there is a blurring of legal subjects that can be protected in the PKDRT Law due to differences of opinion regarding the validity of marriage based on the provisions in Article 2 of the Marriage Law. Moreover, there are differences in judges’ views on the validity of a marriage which are not recorded in several decisions of cases of domestic violence causing legal uncertainty. However, there is still an alternative for self-protection for victims of domestic violence whose marriages have not been registered, namely using the articles in the Criminal Code.

Abstract

AbstractThe development of transnational business has had an impact on the emergence of international business transactions in which it is possible for legal subjects to own assets, both in the form of assets and liabilities in several countries. One area of law related to international business transactions is transnational bankruptcy law. The importance of regulating transnational bankruptcy law as a solution that can resolve various problems of transnational bankruptcy law has made many countries wish to form an international agreement that specifically regulates transnational bankruptcy, including the regional organization of the Association of Southeast Asian Nations or better known as ASEAN. So that the existence of transnational bankruptcy law arrangements in the ASEAN region is needed to resolve bankruptcy cases involving every ASEAN member country in it. This research is legal research using several problem approaches, namely statutory approaches, comparative approaches, and conceptual approaches. The results of this study indicate that ASEAN Cross Border Insolvency can be formed immediately as a bankruptcy regulation in the ASEAN region to ensure legal certainty for the parties. AbstrakPerkembangan bisnis transnasional telah berdampak terhadap adanya transaksi bisnis internasional di mana dimungkinkannya bagi subjek hukum dimilikinya harta kekayaan, berupa aktiva serta pasiva pada beberapa negara. Termasuk bidang hukum berkaitan dengan transaksi bisnis internasional, yakni perihal hukum kepailitan transnasional. Pentingnya pengaturan hukum kepailitan tranasional sebagai sebuah solusi yang dapat menyelasikan beragam permasalah hukum kepailitan transnasional, menjadikan kebanyakan negara berharap suapaya dibentuknya suatu perjanjian internasional khususnya aturan kepailitan transnasional, tidak terkecuali organisasi regional Perhimpunan Bangsa-Bangsa Asia Tenggara atau yang lebih dikenal ASEAN. Sehingga adanya pengaturan hukum kepailitan transnasional kawasan ASEAN sangatlah dibutuhkan guna menyelesaikan perkara kepailitan yang melibatkan setiap negara anggota ASEAN di dalamnya. Penelitian ini adalah penelitian hukum dengan menggunakan beberapa pendekatan masalah, yakni pendekatan perundang-undangan, pendekatan perbandingan, serta pendekatan konseptual. Hasil penelitian ini menunjukkan agar dapat segera terbentuknya ASEAN Cross Border Insolvency sebagai regulasi kepailitan kawasan ASEAN guna menjamin kepastian hukum bagi para pihak.

Abstract

Many discussions about the Right to Food (RTF) and international trade have concluded that international trade has always aided in realizing the RTF. This is reflected in the FAO’s 2004 Right to food Guidelines. It emphasized the importance of international trade in promoting global economic growth and food security, as well as the commitment of states under the WTO Agreement on Agriculture to avoid market restrictions and distortions. The narrative has shifted with the advent of the Russian-Ukraine War. Ukraine and Russia supplied a quarter of the world’s grain before the war. Russia’s blockade of Ukraine’s Black Sea ports has prevented the country from realizing its export potential, contributing to a global food crisis, raising food prices, and putting pressure on global trading systems. Despite sanctions that further restricted international trade, Russia remained defiant until the Black Sea Grain Initiative emerged. This article examined the inter-legal links between the RTF and other fundamental rights, making it indispensable in international trade, humanitarian, and maritime law. The doctrinal legal research method is adopted to analyze the legal position and propositions underlying this topic in the context of the Russia-Ukraine war. The author finds that the state’s duty to respect, protect, and fulfil the RTF is a powerful tool for ensuring international peace and economic order. The work further draws on the Black Sea Grain Initiative to demonstrate that global trade can be preserved and revitalized by promoting the RTF. In conclusion, the article suggests improving and expanding this initiative while submitting that despite being viewed as a partial solution to risks posed by the war, the humanitarian agreement has provided eternal hope of encouraging states to explore diplomatic channels towards future crises, given their commitment to protecting the RTF and freedom from hunger.

Abstract

In recent times, legal experts in Indonesia have engaged in widespread discussions on restorative justice. This is because the country’s criminal justice system has been unable to deliver justice to society, with many cases deemed unworthy of trial, let alone convictions and sentencing. Most institutions that make up the criminal justice system, including the police, prosecutors’ offices, and courts, cannot be held solely responsible for this issue as they simply enforce existing regulations. Therefore, a new approach is necessary to resolve cases that prioritize mediation to reach a consensus based on social justice values, in which the concept of restorative justice plays a role. Restorative justice is not a new concept as it has been used by society for hundreds of years to solve problems that are not in line with social norms. Many customary practices prioritize technical solutions through local wisdom and emphasize forgiveness. Such practices include Gotong Royong, Tepo Seliro, Tego Lorone Gak Tego Patine, and others, all of which are foundational to society’s way of thinking about problem-solving. Based on these basic norms, Indonesian Founding Fathers incorporated these practice into Principles 2, 4, and 5, which are part of the Pancasila (Five Principles of Indonesian) norm. However, law enforcement may not fully understand these basic norms while implementing them. To anticipate the existing concept, criminal justice system institutions have created rules that are yet to reflect the approach of restorative justice. These institutional rules appear poorly integrated, potentially leading to normative conflicts that ultimately result in uncertainty within the criminal justice system.

Abstract

AbstractThis article aims to appreciate the design of the dispute mechanism embodied in the draft of the public procurement bill. Nonetheless, many important issues have not been successfully clarified; those shall be addressed by the National Public Procurement Agency as the initiator of this bill. Moreover, to ensure the principle of meaningful participation, it is encouraged to provide more public discourse by inviting wider stakeholders to scrutinize the bill. To support the idea, it is essential to provide preliminary information on the debate that occurred on the task force team for dispute mechanisms. This paper also discusses problems which shall be addressed and clarified. It is argued that many problems highlighted here due to the point/essence discussed on the preliminary task force were not accommodated in the bill. Moreover, this research also found some norms on the draft that can be questioned from the conceptual point of view; some also can be doubted on its feasibility for implementation. This lacking may be caused by the time constraint for preparing the bill or because the government does not really concern on the matter. Nonetheless, as an essential issue, they have to be addressed. The conceptual and practical suggestions embodied in this paper may be considered as a recommendation to be utilized by the legal drafters. AbstrakTulisan ini bertujuan untuk memberikan apresiasi terhadap desain penyelesaian sengketa hukum yang telah berhasil terbadankan di Rancangan Undang-Undang (RUU) Pengadaan Barang Jasa Publik (PBJP). Namun masih banyak hal dan substansi yang harus dilakukan oleh Lembaga Kebijakan Pengadaan Pemerintah (LKPP) sebagai inisiator RUU. Guna memastikan RUU ini tetap menjadi regulasi yang mengindahkan asas partisipasi yang bermakna, maka diskusi yang lebih luas dengan para pemangku kepentingan perlu lebih didorong. Tulisan ini juga bertujuan untuk memberikan informasi pada pembaca mengenai perdebatan yang telah terjadi saat mendiskusikan desain penyelesaian masalah hukum di RUU PBJP. Dibahas pula mengenai hal-hal yang masih perlu dipertimbangkan untuk dibadankan dalam RUU PBJP; misalnya ada aneka substansi yang telah didiskusikan oleh tim kecil yang membahas konsep penyelesaian sengketa hukum, namun tidak berhasil terbadankan dengan optimal dalam draft RUU. Selain itu, ditemukan pula norma di draft RUU yang dapat dipertanyakan rujukan konseptualnya; ada pula yang dikhawatirkan fisibilitas-nya untuk dapat diterpakan di lapangan. Aneka permasalahan ini mungkin terjadi karena terbatasnya waktu dalam penyusunan draft atau karena Pemerintah tidak terlalu fokus pada isu ini. Namun mengingat masalah yang ada esensial, maka perlu segera diperbaiki. Untuk itu, aneka masukan konseptual dan teknis telah terbadankan di tulisan ini sebagai rekomendasi.

Abstract

Indonesia is committed to accelerating the achievement of Net-Zero Emissions by 2060. The Carbon tax is a new instrument that it believes could encourage the achievement of carbon neutrality. Through the Harmonisation of Tax Regulations Act, the Government regulated several carbon tax provisions, which were initially going to be implemented on April 1, 2022, and then postponed to July 1, 2022. Unfortunately, the carbon tax implementation has been delayed until an undetermined time. Implementing legal interpretation, this research comprehensively analyses carbon tax provisions in the Harmonisation of Tax Regulations Act. The research will examine the ability of current carbon tax arrangements to accelerate the achievement of Zero Emissions. This work uses normative juridical methods with a conceptual and statutory approach to provide recommendations. The results show that the carbon tax arrangement does not contain substantial clarity, and various implementing regulations are needed. Article 13 of the Harmonisation of Tax Regulation Act contains vague norms that need to be elaborated. The paper recommends the urgency of legislative review mechanism for the Harmonisation of Tax Regulation Act, especially Article 13, and the need to harmonise it with related laws.
