Abstract

Abstract: God has ordained the waiting period, the waiting period because there is some wisdom that is priceless and is a source of life such regularity is as if in the woman’s assertion that still contained the seeds of the fetus or not, so that later nasabnya not stir. Similarly, to give them an opportunity to refer to her husband and aware of the excesses of blindly, having thought out and considered deeply. Also the waiting period, it will be seen how the mercy of God to man, because the wait was going to find out how good a person is married or unmarried, and how unfortunately divorce so that the act was lawful but hated by Allah. The waiting period for a woman who left her husband dead, then it is a time when it appeared in mourning, so that increasingly felt tribute to her husband.

Abstract

This article describes that since the ruling of the Constitutional Court No. 46/ PUU-VIII / 2010 concerning the status of children out of wedlock, there are pros and cons in the community in responding to the decision. Because this decision is on the one hand different from the provisions in Law No. 1 of 1974 and contrary to the fatwa of the Indonesian Ulama Council No. 11 of 2010 concerning the position of adultery children and treatment of them, on the other hand in their implementation requires implementation regulations which up to now do not yet exist. In the decision of the Constitutional Court it became clear the legal position of zina children or children born without going through the door of marriage, as illegitimate children, he only had a civil relationship with his mother and his mother's family. For men who cause their birth to be subject to ta'zir punishment, by providing a living and living necessity, the punishment is solely to provide protection for the child, so that the child gets the proper life insurance. The civil relationship of the child of adultery results does not cause a nasab relationship, but requires the biological parents to provide a guarantee of life for their child. If an adultery child is a woman, if she wants to get married, then the right to become a guardian is the guardian of the judge, while her parents, in this case her biological father is obliged to hold the marriage ceremony.

Abstract

Academics and practitioners of Islamic financial institutions, are not enough just to know the fiqh of muamalah and its application, but more important is to understand the fiqh proposal of each product in financing in Islamic financial institutions, for example in submitting financing capital for a business. For Islamic Financial Institutions, with the provision of this financing capital, they can play capital funds into the real sector and can help those who need business capital. Baitul Maal Wat Tamwil for example, in its operation the institute is projected to manage funds developed for micro-enterprises and manage virtue funds or social funds (Zakat, Infaq and Sedekah). This paper aims to explain the urgency of the fiqh proposal in the development of sharia financial institutions in determining the amount of infaq for financing at BMT Nurul Husna Batanghari in East Lampung, and outlines the solution to improving financial institutions (BMT Nurul Husna Batanghari) to be truly in accordance with Islamic law. . This study uses descriptive qualitative research methods, with data collection techniques using interviews, observation and documentation. As a result, in the development of Islamic financial institutions in determining the amount of infaq for financing at BMT Nurul Husna Batanghari, East Lampung, until now it has not been in accordance with Islamic law. The BMT stipulates the infaq amount of 10% of the amount of financing to customers. This is contrary to the provision of issuing infaq in Islamic law which is not determined and is voluntary. The implementation of the infaq to win mutual agreement between the customer and the BMT and not violate the provisions of Islamic law, can be done by the BMT when making contracts to customers in financing transactions, preferably voluntary, does not specify the amount of infaq that must be issued by the customer, and BMT must provide explanation of the distribution of infaq funds to customers when financing contract transactions

Abstract

Ijtihad Method of Ibrahim Hosen, Ijtihad as the innovation of Islamic law brought theJurist in to the zenith during age of Abbasid Caliph. But the results of ijtihad often led to the pros andcons among Islamic scholars. Such as Ibrahim Hosen, his thought always contradicted to the otherislamic scholars, which caused many Islamic scholars presumed that Ibharim Hosen thought isnounsen, the Islamic scholars presumed that his thought is not through the research from the books ofmu’tabar and nor processing them correctly. Therefore, he is entitled as fake scholar, opportunistic andmatrealistic, by the other Islamic Scholars. However, Ibrahim Hosen is not the like, it is important toreview the thought of Ibrahim and his contribution in Islamic Law

Abstract

Imam al-Ghazali seperti diketahui adalah seorang teolog, filosof, sufi, dan juga fakih. Walaupun sisi intelektualnya dalam filsafat lebih tersohor ketimbang yang lainnya, namun sumbangsih yang ia berikan dalam Ilmu Fikih terutama Usul Fikih tak dapat dinafikan. Usahanya dalam memadukan Ilmu Mantik dan Usul Fikih adalah pengejawantahan sebuah gerakan pembaharuan. Tulisan ini berusaha memetakan usaha-usaha yang dilakukan oleh Imam Ghazali untuk mencapai tujuannya tersebut. Diantaranya adalah menyingkap beberapa metode yang ia terapkan dalam buku-bukunya yang berkenaan dengan mantik dan usul fikih, seperti Mi’yar al-‘Ilmi, Mahak an-Nazhr, dan karya monumentalnya dalam usul fikih, al-Mustashfa min ‘Ilmi al-Ushul. Termasuk respon beberapa kalangan terhadap idenya tersebut. Kata kunci : Mantik, Usul Fikih, Asya’irah, Imam al-Ghazali.

Abstract

Kajian bagaimana hubungan antara zakat dan pajak sangat perlu dilakukan, karena subjekkeduanya adalah sama, yaitu kaum Muslim. Berbeda dengan jizyah dan kharaj, subjeknya adalahnon-Muslim. Zakat dan pajak adalah dua kewajiban sekaligus terhadap agama dan negara. Zakat danpajak adalah dua kewajiban yang sama-sama wajib atas diri kaum Muslim. Hanya saja pajakdiberlakukan untuk kondisi tertentu. Dari segi sejarah Islam, zakat adalah pendapatan negara utamasetelah ghanimah, fay’i, kharaj dan jizyah. Ghanimah, fay’i, kharaj dan jizyah tidak diperuntukkankhusus untuk fakir miskin, melainkan sebagai peruntukan umum. Zakat bukan hanya dijadikansebagai biaya sosial yang sifatnya sukarela namun zakat jugamerupakan hak negara yang diwajibkanatas kaum Muslim yang mampu, sebagai bentuk jaminan kehidupan bagi kaum yang lemah (dhu’afa).

Abstract

Islamic financial institutions in their operations require legislation. In addition, practitioners of sharia economics also need a fatwa from the National Sharia Council-Indonesian Ulema Council (DSN-MUI) to guarantee the implementation of Sharia principles in sharia financial institutions. Although the fatwa is basically an advice that can be carried out or ignored, but the DSN-MUI Fatwa if it is related to positive law, the position is the same as the doctrine that is as an amplifier in the legal ruling of a qadhi in a case. The DSN-MUI fatwa also has authority and an important role in making legislation binding, and is used as a positive law in enhancing the development of sharia economics in Indonesia. The legal aspects contained in the DSN-MUI fatwa, can be seen from the absorption of the DSN-MUI fatwa in various regulations relating to the operations of Islamic financial institutions, and have been transformed into the form of laws. Thus, the legal strength of the DSN-MUI fatwa becomes binding in the operations of Islamic financial institutions

Abstract

Abstract: Book of syarah is one form of creativity of ulama thought in writing of book. Like the work of matn, hasyiyah, ta’liqat or other, syarh has a certain degree of authenticity that deserves to be appreciated as a work of thought. Preciselythrough the tradition of writing syarah the writing of the book developed very rapidly. Therefore, the syarh book dominates and outperforms the work in other forms of quantity. This happens because a single book of matan can be passed into several books, as happened in the mat-at-Taqrib. In terms of weight of content, the book syarh basically provides a wider discussion to the reader who also mark the level or increase in the level of learning process. However, it must be admitted that the book of syarh has some weaknesses, such as a high degree of plagiarism, imitative nature and takes a long time to learn it. However, the weakness does not make the book shrug of urgency in the tradition of Islamic scholarship that highly appreciate the work of the previous scholars. Book of syarh by the pesantren is received with honor and respect as the fruit of creativity of pthought and berijtihad.

Abstract

Perilaku seks bebas, sudah menjadi gaya hidup orang zaman sekarang, bahkan ada yangberpandangan “zina” sudah diangap zamannya. Akibat perilaku tersebut banyak remaja yang hamildiluar nikah. Dalam kajian fiqh, permasalahan “menikahi wanita yang hamil akibat berzina”memang masuk dalam perkara yang diperselisihkan, ada yang mengatakan boleh secara muthlak,ada yang mengatakan boleh bersyarat, dan ada pula yang mengtakan haram. Setiap pendapatmengemukakan alasan-alasan yang menguatkan pendapatnya masing-masing. Terlepas dariperdebatan di atas, pada kesempatan ini penulis ingin mengkaji persoalan tersebut melaluipendekatan ushul fiqh. Diharapkan dari kajian ini didapatkan pemahaman yang mendasar tentangpersoalan ini. Berdasarkan pada suarat al-Thalak ayat 4, beberapa hadis terkait persoalan ini, danbeberapa kaidah yang dapat dipedomani dalam menyikapi persoalan ini, dapat disimpulkan bahwamenikahi wanita yang hamil akibat zina adalah tidak boleh dan bila tetap dinikahkan, maka hukumpernikahannya tidak sah.

Abstract

To rip up the static Ijtihad in the construction of social jurisprudence. Recently there aremany growing issues to be solved in many sectors such economic, social and culture, within thecontemporary Islamic law. Therefore it is important as mujtahid to be eye catching to see the currentissues and to review the decission law in according to the need of the people. Ijtihad is one of methodsto analyze the islamic law logically and rationally according to the social movement, trying to analyzeand examine the law that should be developed in the society. And it is important to examine thatijtihad is allowed by the scholars. Ijtihad is a dynamic activity which is developing with thedevelopment of the human thought and activities. Though Ijtihad is done for the sake of peoplewelfare but the Mujtahid should consider of deciding the law though two methods, Ijtihad Intiqa’ orInsya’i Ijtihad. When solving the issues one should aware of the ijtihad jam’i and maqasid syar’iyyah.And thus the ijtihad will be able to solve the problem in society.
