Abstract

It is widely accepted that employing armed forces will successfully accomplish the objective of maintaining peace. However, these solutions are not always effective in bringing lasting peace. In order for peace to become deeply ingrained in societal lives, it is frequently necessary to look deeply into the social and moral foundations of a society. This particular study was designed to investigate the functions and applicability of conventional moral values and practices in upholding peace. Specifically, the paper was intended to study the practical and potential benefits of Sidaama moral ideals and principles for maintaining peace focusing on Halaale principle. To achieve this objective several key informants were interviewed as primary data sources besides a compressive literature review on the matters of peace maintenance, conflict resolution, ethics and moral principles and practices of Sidaama people. Accordingly, the analysis was made on the data collected from the informants and contents of the references. Finally, it was found that “Halaale” principle of Sidaama People has both a preventative role in conflicts and maintaining harmony by binding the members of the community to the communitarian good. Based on this, it was recommended that, the diligent attention should be paid both at policy and society levels to make use of the fruits of traditional moral principles rather than lessening them as obsolescent practices.

Abstract

As national politics continues to have influence on human rights both in practice and theory globally, Indonesia also finds itself in a conundrum of human rights challenges. Like other legal entities that have ratified international instruments that deal with human rights, Indonesia has ratified, acceded to and domesticated relevant human rights instruments. At national level, Indonesia also has Legislation Number 39 of Year 1999 (hereinafter referred to as Law No. 39 of 1999) which deals with human rights. This research examines the failure or inability of this law to control the political elites over the years. It examines the influence of the Indonesian society on this legislation. Its ius constitutum is analyzed and thereafter, points out the ius constituendum as a prospect for a progressive society. In this research, a normative research method is used through analysis of authentic secondary data. This, therefore, reaches a finding that Indonesia’s international human rights diplomacy should be strengthened at the level of Ministry of Foreign Affairs with technical support from the Ministry of Law and Human Rights. Going forward, strong advocacy policy on human righs across all the regions in Indonesia also needs to be in place by the government.

Abstract

Slavery has existed in many countries of the world, and it continues to cause a lot of untold hardships to its victims. Modern day slavery manifests through forced labour, sexual exploitation, human trafficking, neocolonialism etc. These widespread problems across Igbo land and globe are still in existence despite Government efforts to curb it through the 1999 Constitution at article 34.1(b) which declares that no person shall be held in slavery and in the criminal code Act which criminalizes slavery dealing under section 369. Also National Agency for the Prohibition of Trafficking in Persons (NAPTIP), Legislation providing for the rights and protection of children in Nigeria- Child Right Act (2003), the ugly situation has been on the increase. This paper therefore, sees the use of Igbo language as a tool to curb modern day slavery in Igbo land through various agencies like the family, school and church via mass media, folktales etc. The paper further looks into the negative effects and consequences of modern day slavery in the society. The study adopts qualitative research design because it identifies and structurally analysed the use of Igbo language in curbing modern day slavery in Igbo land. The method of data collection include: primary and secondary sources. The primary sources include: introspection i.e. the researcher’s intuitive knowledge of Igbo language and culture, oral interview and observation technique while the secondary sources include: data from relevant books, journals, and internet materials. Finally, the paper gives some recommendations that can help check and contain slavery in this modern time.
