Abstract

ABSTRAKPemberian hukuan mati bagi pengedar narkotika merupakan salah satu bentuk keseriusan Negara terhadap penanganan kasus narkotika di Negara ini. Hukuman mati yang dijatuhkan merupakan bentuk hukuman penjeraan agar pelaku tindak pidana pengedar merasa jera. Eksekusi mati ini dilakukan demi kepentingan dan pelaksanaan hukum yang lebih efektif. Permasalahan yang akan dikupas adalah bagaimana landasan pembentukan Undang-undang atas penerapan hukuman mati terhadap pengedar narkotika, bagaimana prosedur penjatuhan hukuman mati bagi pengedar narkotika serta bagaimana konsep Hak Asasi Manusia (HAM) dalam konteks penjatuhan hukuman mati. Tujuan penelitian ini adalah untuk meneliti dan mengkaji landasan pembentkan Undang-undang atas penerapan hukuman mati terhadap pengedar narkotika, prosedur penjatuhan hukuman mati bagi pengedar narkotika serta konsep Hak Asasi Manusia (HAM) dalam konteks penjatuhan hukuman mati.Metode yang digunakan dalam penelitian ini yaitu Metode Yuridis Normatif, yaitu melakukan pendekatan berdasarkan bahan hukum formil dan materil dengan cara menelaaah teori-teori, konsep-konsep, asas-asas hukum, serta peraturan perundang-undangan yang berhubungan dengan penelitian ini. Peneliian ini juga bersifat deskriptif analitis, yaitu dengan mengumpulkan informasi secara rinci dilapangan, mengidentifikasi masalah yang ada kemudian mengevaluasi masalah-masalah yang ada.Landasan pembentukan peratian mengenai urgensi penjatuhan pidana mati terhadap pelaku tindak pidana narkotika adalah karena tindak pidana ini menimbulkan korban yang masif, membutuhkan biaya untuk rehabilitasi dan penegak hukumnya, merusak generasi muda, dan melemahkan sendi-sendi kehidupan bermasyarakat dan bernegara. Dalam perspektif hukum, prusedur penjatuhan sanksi pidana mati telah diatur dan diakui eksistensinya baik didalam KUHP maupun undang-undang diluar KUHP. Dalam konteks Hak Asasi Manusia, sanksi pidana mati tidak bertentagan dengan instrument hukum nasional maupun hukum internasional, sperti Undang-undang Dasar 1945, Undang-undag No 39 Tahun 1999 tentang Hak Asasi Manusia, Universal Declaration Human Right 1984, maupun Internasional Convenant on Civil and Politica Rights 1966. Didalam instrument tersebut dinyatakan bahwa hak untuk hidup dijamin namun terdapat pembatasan-pembatasan yang ditentukan oleh Undag-undang.

Abstract

Indonesia is a maritime country in Southeast Asia that has a total area of ​​5,180,083 km2 which includes land and sea. Among these areas, 2/3 of Indonesia's area is an ocean, and 1/3 of its territory island. Indonesia's land area is 1,922,570 km2 which spans an area of ​​3,977 miles. Meanwhile, Indonesia's ocean area is 3,257,483 km2. The sea area compared to the land area makes Indonesia's main strength in the fisheries sector. Indonesia's geographical condition in the form of an archipelago and directly adjacent to a number of countries results in many threats and challenges. Therefore, Indonesia is called a maritime country. The breadth of Indonesia's marine area makes the majority of the income of the residents of coastal communities or near the sea lip work as fishermen. The benefits of the sea are unavoidable for coastal communities, thus this maritime must be maintained for the sake of security, benefit, and prosperity and the welfare of coastal communities will be maintained, both downstream and upstream or in government. The purpose of this research is to enforce the law forcing it like what happened, especially in the coastal area of ​​Pengandaran where there is physical evidence of the shipwrecked illegal fishing vessel. Thus, what is the problem in this research is related to illegal fishing or fishing without a permit with stages and a descriptive-analytic juridical approach based on positive laws and regulations and other rules related to illegal fishing, exclusive economic zones (EEZ), The law of the sea, the crime of illegal fishing.

Abstract

The development of the era in the Revolution 4.0 era where there was a leap of progress towards digital, the world of justice was also required to follow the developments of the era, coupled with the occurrence of the COVID-19 pandemic which required people to avoid direct interaction. Electronic Judiciary or E-Litigation is a solution for all which is a form of implementation of the legal principle of costante justitie (quick trial and low cost) and it is hoped that this E-Litigation can penetrate the barrier to the effectiveness of the judiciary and is expected to overcome geographical constraints and reduce the high cost of litigation. and become a solution during a pandemic. This study aims to find out how the implementation of E-Litigation in the Majalengka District Court is based on supporting theories and Supreme Court Regulation (PERMA) 1 of 2019, and the Civil Procedure Code, and what impacts occur after the implementation of E-Litigation. The method used in this study is descriptive analysis by analyzing existing regulations regarding E-Litigation and their application in the field, with a normative juridical approach, which basically uses the rules in the applicable legal provisions such as the articles in the legislation. invitation and expert opinion (doctrine), The results of this study indicate that most of the implementation of E-Litigation in the Majalengka District Court is in accordance with the existing PERMA, but if you look at the Civil Procedure Code there are many differences and contradictions in it which are one of the obstacles and also the lack of public knowledge about the procedures. trial with this E-Litigation system. However, the Majalengka District Court continues to actively carry out socialization not only to the general public but also to other legal practitioners.

Abstract

The economic crisis triggered by the COVID-19 pandemic has an impact on the employment situation in Indonesia. Seeing this situation, the Central Government through its policies made several efforts to deal with this problem. One form of government policy through the Minister of Manpower issued a Circular Letter of the Minister of Manpower No.M/3/HK.04/III/2020 concerning Protection of Workers/Labourers and Business Continuity in the Context of Prevention and Control of Covid-19, but almost all business actors or companies in responding to the government's policy by limiting social activities, including many companies that have taken the policy to lay off and cut wages for their workers/employees. The research method used is a research specification that is descriptive analytical using a Sociological Juridical Research approach. The research stage is through research that uses primary data and secondary data. Data collection techniques are document studies and interviews. The data collection tool uses library data and field data. In accordance with the approach method applied, the data obtained for this study were analyzed in a qualitative juridical manner. deductions from the wages of workers/laborers by employers and finally wage cuts can be made through the agreement of both parties due to the spread of the covid-19 virus as regulated based on the Circular Letter of the Minister of Manpower of the Republic of Indonesia Number M/3/Hk.04/III/2020. In resolving the issue of unilaterally cutting wages, it can be done by means of Bipartite and Tripartite. However, the recommendations issued by the labor agency mediator in this case do not have coercive power for the parties to carry out.

Abstract

Everycitizen has the right to a decent job and livelihood for humanity, but the willingness of employment is so limited that not everyone gets the same luck in getting a job, especially in the field of formal work such as factory workers, office employees, people with professional work and others. With the Covid-19 pandemic in Indonesia, there are so many terminations carried out by employers, so that more and more citizens do not have jobs. This research uses a normative juridical approach andthe current research is descriptive analytical. Data collection is carried out through literature studies in order to obtain secondary data, both in the form of primary legal materials, secondary legal materials, and tertiary legal materials. The technical analysis used in this study is a qualitative analysis technique. Based on the results of the study, it is known that termination of employment can be carried out if the company closes due to compelling circumstances caused by the spread of Covid-19, but fortermination of employment must be carried out inaccordancewith the provisions of Article 164 Undang-U ndang Number 13 of 2003 concerning K Employment, but if a company experiences difficulties that can have an effect on employment, then termination must be a last resort. Arbitrary layoffs of workers in any situation, including in the covid-19 pandemic situation, are basically not allowed and legal remedies that can be made in the settlement of industrial relations disputes include through bipartait settlements, mediation, conciliation, arbitration, and industrial relations courts.

Abstract

The right to life is the most important element in Human Rights so that not only oneself and others have maintained this right but the state has also made a set of rules to guarantee and protect everyone's human rights. Currently, it is undeniable that there has been an increasing prevalence of human beings committing crimes including crimes related to human rights, especially in the form of crimes against the right to life, namely in the form of abortion crimes. The research method used in this study is a normative juridical approach, namely by studying or analyzing secondary data in the form of secondary legal materials by understanding the law as a regulatory device or positive norms in the statutory system that regulates the problems in this study. After the secondary and primary data are collected, thenthere is a qualitative analysis related to the phenomenon of the Right to life: Abortion in the Perspective of Human Rights and Islamic Law. Based on the results of data analysis, it was concluded that positive law allows abortion on medical grounds and this is not contrary to the right to life, and in Islamic law it is also known to be able to perform abortions both at the stage of fetal creation and at the time of blowing the spirit on the fetus, and if the reason is that it is the doctor who determines that if the fetus is maintained as to its existence to remain alive, grow and develop in the womb of a woman then it may result in the risk of death to the mother and in such case abortion when the fetus has been blown away can be performed for shari'a reasons.
