Abstract

Menjalani aktivitas kuliah dibarengi dengan bekerja bukan merupakan hal yang mudah untuk dijalani. Kuliah sambil bekerja tidak hanya dilakukan mahasiswa yang lemah dalam ekonomi, karena pada kenyataannya biaya hidup sehari-hari sering sekali tidak sebanding dengan uang saku yang diberikan oleh orang tua. Fenomena ini sangat menarik, apalagi ditambah adanya peluang kerja bagi mahasiswa. Namun kuliah sambil kerja memilki pengaruh positif dan negatif. Pengaruh baik dan buruk tersebut dihadapkan pada prestasi kuliah. Yang pada akhirnya timbul pertanyaan, apakah mahasiswa yang kuliah denganyang bekerja sambilan mampu mengikuti kegiatan kuliah dengan baik atau malah kuliahnya terabaikan? Diperlukan pertimbangan-pertimbangan yang matang ketika mahasiswa memutuskan mengambil kuliah sambil bekerja, namun di sisi lain kuliah sambil kerja memiliki keuntungan bagi mahasiswa yang mempunyai masalah finansial, dengan bekerja akan memberikan tambahan biaya untuk kuliah. Bekerja sambil kuliah juga dapat dijadikan curi star (mendahului) / menambah pengalaman, sehingga ketika lulus kuliah tidak hanya mendapatkan ijazah, tetapi juga mendapatkan pengalaman kerja serta relasi yang biasanyadijadikan persyaratan untuk melamar disuatu tempat pekerjaan. Hasil penelitian terdapat dampak yang posisitif terhadap Indek Prestasi IP/IPK mahasiswa yang kuliah sambil bekerja mulai dari 3.00 - 3.50 ke atas dengan persentase 70 % dan memiliki nilai di bawah rata-rata berjumlah 9 orang yang dipersentasekan berjumlah 30 %. Terdapat dampak yang positif terhadap organisasi yang dijalani mahasiswa tersebut dapat dibuktikan 30 orang yang bekerja sambil kuliah 18 orang mahasiswa aktif berorganisasi. Oleh karena itu meskipun mahasiswa tersebut kuliah sambil bekerja, mereka mampu untuk tetap mengikuti organisasi kampus dan memiliki dampak yang negatif terhadap bukti penulisan karya ilmiah, dilihat dari 30 orang mahasiswa yang bekerja sambil kuliah terdapat 2orang yang menghasilkan karya ilmiah, namun hanya karya non ilmiah (fiksi). Jadi dari sisi penulisan karya ilmiah mahasiswa kurang aktif untuk diterbitkan. Alasan yang menyebabkan kurang dalam penulisan karya ilmiah dikarenakan sulitnya mahasiswa membagi waktu antara bekerja dengan menulis karya ilmiah.

Abstract

Informan yang menjalankan teknik undercover buyadalah dari personil kepolisian yang menjalankan tugas sebagai penyidik dalam proses penyelidikandan apabila dibutuhkan sekali menggunakan petugas yang di tunjuk berdasarkan pemilihan perekrutan sebagai berikut: 1) Perekrutan informan siapa dan ciri-cirinya dirahasikan oleh pihak kepolisian;2) Tidak dalam perkara atau telah dijatuhi vonis kasus tindak pidana oleh Pengadilan;3) Sudah dewasa;4) Menyetujui dan bersedia tidak dengan paksa, mentaati kode etik. Sedangkanperaturan internal kepolisian yang melindungi setiap tindakan yang dilakukan penyidikdalam pelaksanaan pembelian terselubung di lapangan adalah Surat Keputusan No.Pol SKep/1205/IX/2000/11 September 2000,“tentang revisi Himpunan Juklak dan Juknis proses Penyidikan Tindak Pidana”.Kendala–kendala yang di temui dalam pelaksanaan pemberian perlindungan hukum bagi informan pada teknik pembelian terselubung,justru bersal dari faktor kurang nya kualitas(tidak menguasai teknik penggunaan alat dalam mengungkap kasus, kesulitan dalam berkomunikasi jika menghadapi pelaku yang berkewarganegaraan asing) dan kuantitas sumber daya aparat penegak hukum(polisi), seringna terjadi penggantian anggota I reserse narkotika, keterbatasan sarana dan prasarana dalam menjaring pelaku yakni dalam penyediaan perangkat teknologi dan dana operasional, faktor masyarakat yakni paradigm masyarakat yang justru menjadikan peredaran narkotika sebagai bisnis yang menguntungkan serta transformasi budaya barat yang tidak sesuai dengan budaya bangsa melalui pariwisata dimana kebiasaan menggunakan narkotika di Negara mereka tidak dilarang.Kata

Abstract

The State of Indonesia emphasizes the principle of social justice explicitly. Article 27 paragraph (2), Article 28H paragraph (3) and 34 paragraphs (1), (2), (3) and paragraph 4) of the 1945 Constitution of the Republic of Indonesia mandate government responsibility in the development of social welfare. The Central Government provides regional autonomy to improve the welfare of the people within the framework of the Unitary State of the Republic of Indonesia. Local Government shall be given the right and authority to arrange and manage their own community welfare based on Law Number 12 Year 2009 regarding Social Welfare. One Billion One District Program is one of the Jambi Provincial Government's programs for the social welfare development of rural communities. This program was implemented by delegating some tasks and authority of the Governor of Jambi to the regent as head of the district administration. This research was conducted in Siulak Mukai Subdistrict with interview technique to get research data. In Siulak Mukai sub-district the success of this program in 2014-2015 is inseparable from the role of the sub-district head through the activities of home surgery, the cost of education of poor students / students, the procurement of agricultural machinery and non-agricultural equipment for farmer groups, business capital assistance, labor training and Health Insurance Area. However, in the implementation of this Samisake program there are several obstacles experienced by the subdistrict head, such as incomplete document of program beneficiary and limited operational fund.

Abstract

Land is very important for human life. Given the importance of the function of land for human life, then to provide legal certainty for the holder of the right to land, the land needs to be registered. The official authorized to register the land is the PPAT which has a very important role in maintaining the land registration data, ie making evidence about the occurrence of legal acts concerning a particular plot of land which then becomes the basis for registering the change of juridical data caused by the legal act. PPAT also assists the head of the land office as the executor of land registration, by providing evidence that will be the basis for registration of changes in land registration data. In addition, PPAT has the main duty to carry out part of land registration activities by making deed as evidence of certain legal acts. This research is empirical research with primary data as main data collected through interview technique, and also supported secondary data collected through literature study / document.

Abstract

Article 197 Law number 36 of 2009 concerning Health stipulates that "everyperson who intentionally produces or distributes pharmaceutical preparations and / ormedical devices that do not have a distribution permit is given criminal sanctions andfines". For this matter, it is necessary to grant permits in the distribution ofpharmaceutical preparations, to protect the public from pharmaceutical preparations thatdo not meet the requirements, protect the public from misuse and misuse of pharmaceuticalpreparations and medical devices. This needs supervision from the Police in supervisingpharmaceutical preparations, this is done by Satreskrim Solok City Police, who havereceived a Police Report from the community on December 13, 2016. This research is adescriptive analytical study. Adapaun the results of research on law enforcement at thelevel of investigation of perpetrators of criminal acts of distribution of pharmaceuticalpreparations without permission in the city of Solok occurred in the report on December13, 2016, after the report was received, Satok District Police issued LP / 89 / A / XII /2016-SEKTA, then Investigation, Investigation, Examination of witnesses, Information ofExperts, Suspects and determining the elements of the Criminal Act which are suspected ofbeing violated by the suspect. Secondly, the obstacle encountered by Solres Kota police inlaw enforcement against criminal acts circulating pharmaceutical preparations withoutpermission in Solok City: a) Limited budget funds; b) Number of Investigators who are notbalanced with the breadth of work area; c) Modus Operandi carried out by the perpetratoris always changing; d) Other agencies that are less cooperative; e) expert witnesses aredifficult to bring; and f) Difficulties in bringing and presenting witnesses concerned withcases of pharmaceutical preparations without permission to eat the old procedure, becausethere are several witnesses who do not want to come or even not be asked to be questionedby members of the auxiliary investigators who examine. Third, efforts to overcome theobstacles in law enforcement against criminal acts circulating pharmaceuticalpreparations without permission in the city of Solok, by making repressive efforts andPreventive efforts.

Abstract

The investigation was carried out to gather sufficient evidence that a crime had indeedtaken place. In the Mentawai area there are cases of decency crime with child victimsresolved by giving customary sanctions to the perpetrators. This research is legal researchwith analytical descriptive specifications. Investigation of decency crime by SatreskrimMentawai Islands Resort Police is carried out by receiving reports from victims and / ortheir families, victims placed in Special Service Rooms (RPK), then inspected, cooperatedwith psychiatrists, and providing shelter for victims Regarding the case of decency towardsthe child that has been reported and the investigation begins if it has been resolved bycustom, the parties will ask the investigator to stop the investigation. The obstacles ininvestigating the Mentawai Islands geographical factors which consist of many islands andthe difficulty of inter-island transportation have led to investigations sometimes having tobe carried out for a long time. was stopped because it had been resolved by custom andrequested by the local government to be stopped by the investigation process.

Abstract

Sistem pengupahan tenaga kerja alih daya yang ada di RSUD M. Zein Painan harus dilindungi sesuai dengan hukum di Indonesia, yaitu Pasal 65 ayat (1) Undang-undang Nomor 13 Tahun 2003 tentang Ketenagakerjaan dan Undang-undang Republik Indonesia No.40 Tahun 2004 tentang Sistem Jaminan Sosial Nasional. Masalah yang muncul pada tenaga kerja alih daya di RSUD dr. M. Zen Painan diantaranya pembayaran upah gaji yang tidak sesuai, tidak adanya tunjangan-tunjangan (kesehatan, masa kerja), kontrak yang tidak diperpanjang karena perusahaan tidak memenangkan tender pada tahun berikutnya. Permasalahan yang dikemukakan dalam tesis ini meliputi, pertama, Bagaimanakah pelaksanaan sistem pengupahan tenaga kerja alih daya pada RSUD dr. M. Zein Painan? Kedua, Bagaimanakah pelaksanaan perlindungan hukum tenaga kerja alih daya dalam sistem pengupahan pada RSUD dr. M. Zein Painan? dan Ketiga Apakah kendala dalam pelaksanaan perlindungan hukum tenaga kerja alih daya dalam sistem pengupahan pada RSUD dr. M. Zein Painan? Penelitian ini bersifat deskriptif analitis dengan pendekatan yuridis normatif didukung dengan pendekatan yuridis empiris. Analisis dan pembahasan hasil didapatkan sebagai berikut: (a) Pelaksanaan sistem pengupahan tenaga kerja alih daya pada RSUD dr. M. Zein Painan yaitu diberikan upah pokok yang jumlahnya sama, tunjangan, upah diberikan tanggal 30 setiap bulan langsung kepada tenaga kerja. Upah diberikan sesuai dengan UMR yang berlaku di Provinsi Sumatera Barat, (b) Pelaksanaan perlindungan hukum tenaga kerja alih daya dalam sistem pengupahan pada RSUD dr. M. Zein Painan yaitu surat perjanjian antara perusahaan dengan tenaga kerja alih daya. Didalam perjanjian, pihak perusahaan akan tetap memberikan upah jika tenaga kerja jika tidak masuk kerja sesuai dengan Undang-undang. Namun dalam pelaksanaannya, perusahaan melakukan pemotongan upah tenaga kerja jika tidak masuk kerja. Hal ini menunjukkan perlindungan hukum sistem pengupahan Undang-Undang Nomor 13 Tahun 2003 tentang Ketenagakerjaan belum dijalankan oleh perusahaan dan (3) Kendala dalam pelaksanaan perlindungan hukum tenaga kerja alih daya dalam sistem pengupahan pada RSUD dr. M. Zein Painan adalah kurangnya pengawasan dari pihak yang berkompoeten. Tenaga kerja tidak memiliki kekuatan hukum untuk menuntut hak mereka terhadap upah, karena belum ada pihak yang dapat menengahi.

Abstract

The problems in this research are: First , how are the roles of Regional Disaster Management Agency and Fire Department (BPBDPK) of Padang City in fire prevention in Padang City ? Second, what are the obstacles faced by BPBDPK Padang in fire prevention in Padang City? Third, what are the efforts made by BPBDPK in the fire prevention in Padang City?The approach method used in this research is the normative juridical approach as the main approach and supported by the empirical juridical approach. Sources of data used are secondary data and primary data. Data collection techniques used were field studies through interviews for primary data and library studies to find secondary data. Then the data is analyzed qualitatively and described in the form of analytical descriptive.From the research results obtained conclusion; Firstly , BPBDPK Padang has a strategic role because BPBDK Padang is an institution that is given authority and responsibility to handle fire problem in Padang City which is manifested in the role of organizer, role as coordinator, supervisor role, role as facilitator and role as a planner. All these roles are well underway and have been fully implemented in accordance with the main tasks and functions owned by BPBDPK Padang. Secondly, in the fire prevention in Padang City , BPBDPK of Padang City faces a number of obstacles such as: (a) The lack of water source in Padang city to support the fire handling process in Padang City; (b) Many obstacles to fire fleet units during the trip to the fire scene; (c) Lack of public awareness of the existence and working system of fire-fighters; and (d) Non-fulfillment of Fire Management Area (WMK) in every sub-district in Padang City. Third, natural d fire prevention in the city of Padang, the efforts made by BPBDPK Padang is: (a) education and training of personnel BPBDPK Padang; (b) Increasing community participation; (c) Improving institutional coordination ; and (d) Simulation of fire response time.

Abstract

Pengadilan Internasional (International Court of Justice) mewakili salah satu organ utama Perserikatan Bangsa-Bangsa. Ini bisa menyelesaikan perselisihan yang terjadi antara anggota Perserikatan Bangsa-Bangsa. Pengadilan Internasional karena peradilan internasional memainkan banyak peran dalam membantu menyelesaikan perselisihan Bangsa-Bangsa. Sampai sekarang, Pengadilan tetap eksis dan dipilih oleh Negara karena keputusan dari Mahkamah Internasional yang kuat, mengikat secara hukum dan tidak dapat diajukan banding. Selain itu, hakim terdiri dari hakim yang memiliki reputasi tinggi dan ahli internasional sehingga perselisihan jaminan akan selesai dengan adil dan sesuai dengan prinsip Hukum Internasional.
