Abstract

The aim of this research is to find out about the simple evidentiary regulations in Law Number 37 of 2004 concerning Bankruptcy and PKPU. In addition, to find out the formal evidence as well as the judge's legal considerations in the decision to postpone the payment of debt obligations that ended in bankruptcy at PT. Sarana Yeoman Sembada. This research uses normative legal research. The results of this study are that the simple evidence referred to in the determination of bankruptcy is also contained in the PKPU arrangement in Article 222 of the Bankruptcy Law and PKPU. In addition, the Bilyet Giro submitted in the PKPU application against PT. Sarana Yeoman Sembada is invalid as evidence because it does not meet the formal requirements of the Bilyet Giro and violates the provisions contained in the Bankruptcy Law and PKPU, so that the bankruptcy decision given by the Panel of Judges to PT. Sarana Yeoman Sembada was declared wrong because the application which was granted by the Panel of Judges came from an application submitted by the Petitioner who had no legal standing.

Abstract

COVID-19 creates uncertainty on business. SMEs in Indonesia need to take a loan to survive. Sharia banks could give credit financing based on Islamic law. This study has a purpose to observe if the total value of credit financing issued by sharia bank in Indonesia affects the total financing of agriculture, forestry, and aquaculture sectors. This study uses secondary data taken from ojk.co.id as the sample. The independent variable is credit financing use for capital venture and investment. Dependent variables are the total financing in the agricultural, forestry, and aquaculture sectors. Data is analyzed using the linear regression method. The data of each variable was also tested using a T-test to analyze if there were significant changes during the COVID-19 pandemic. Result showed that financing of capital venture has a moderate impact on the total of credit financing for agriculture and forestry sector, while investment is none. Moreover, the COVID-19 pandemic has no effect in changing the number of credits issued by sharia banks nor credit received by agriculture, forestry, and aquaculture sectors. Sharia bank implemented two pillars of maqashid, which are the protection of life and wealth in issuing credit financing. The total of credit issued by sharia banks in Indonesia affected Agriculture & forestry sectors for capital, but not for investment. Abstract

The aims of this reseach to determine the effect of institutional ownership, audit committee, audit quality, and independent board of commissioners on tax avoidance in manufacturing companies in the consumer goods industry sector listed on the Indonesia Stock Exchange in 2017-2019. The method used in this research is quantitative. The sampling technique used random sampling method, based on the established criteria obtained a sample of 33 companies. The results of research on institutional ownership, audit committee, audit quality and independent board of commissioners have no partial effect on tax avoidance.

Abstract

The purpose of writing this thesis is to analyze employee performance in the Era of the Covid-19 Pandemic in Public Services for making E-KTP and Family Cards at the Rantau Pulung District Office. The research focus in this thesis discusses the quality of work results, quantity of work results, initiatives, job satisfaction, work knowledge. Data collection techniques used by making observations, in-depth interviews and documentation, for informants taken using purposive sampling techniques, this type of research is descriptive and will be analyzed qualitatively. The results of the study obtained by the author that the quality of the work of employees of the Rantau Pulung District Office in making E-KTP and Family Cards in Rantau Pulung was not in accordance with the SOP during the pandemic and there were errors in this writing. The quantity of work results has not reached the target to be achieved. The initiative of still employees is lacking in providing services for making E-KTP and Family Cards. Employee job satisfaction is already good, as can be seen from the friendly attitude of employees. Job knowledge is quite good, it can be seen from the education and ability of each employee. Supporting factors for employee performance include ability and knowledge as well as factors inhibiting employee performance, namely the lack of sophisticated technology, unstable internet networks and the lack of infrastructure available at the Rantau Pulung District Office.

Abstract

These days, smartphone seems to be inseparable from everyone’s lives, with increasing usage by adolescents in Indonesia. Besides its numerous benefits in one’s life, smartphone usage might lead to smartphone addiction. This cross-sectional study was conducted to obtain empirical evidence of smartphone addiction and smartphone usage behavior in early adolescents, aged 12-15 years old during Covid-19 pandemic. This study was conducted in November 2020, through an online platform (Google Form). Smartphone addiction was assessed by Smartphone Addiction Scale – Short Version (SAS-SV) in Bahasa Indonesia. Smartphone usage behavior was assessed using an alternate-choice format question about activities with their smartphone and the duration. There were 120 participants obtained using convenient sampling. These participants were mostly aged 14 (55%), from West Java (85.8%), female (60%), and owned a smartphone (95%). Based on the cut-offs, 56.7% of the participants had smartphone addiction (male 22.5%, female 34.2%). This finding implies that an intervention program is needed to reduce or prevent smartphone addiction for early adolescents in Indonesia. Dominant dimensions of smartphone addiction were positive anticipation, daily-life disturbance, and overuse. Duration of smartphone usage per day was mostly 3,5-6 hours per day, those who were addicted tend to spend more time with their smartphone. There was also no significant difference in gender (t(118)=-0,78; p=0,44). The limitation of this research is the limited generalizability of results due to the sampling method used. For future research, we suggest using probability sampling techniques and use duration report from smartphone application to measure it more objectively.

Abstract

Indications of the Indonesian economy are reflected in the growth of the middle class of society in Indonesia. One sector that drives Indonesia's economic growth is the automotive industry sector. The growth of economic level and income has a direct impact on the level of car ownership, especially in big cities. The development of the internet and also the growth of mobile device users open up alternative opportunities for online purchases, including the purchase of automotive or car products. Changes in consumer behavior and technology are accelerating digital innovation, the emergence of online digital media is the preferred source of information for people who have the intention of buying a car and the emergence of digital automotive platforms that provide and enable consumers to buy new cars online. However, in another study, e-commerce for new and second-hand car sales did not have a significant contribution to sales growth and from this study it was found that there is a digital transformation gap for buying new cars online in Indonesia. This study will examine whether digital advertising media and Youtube media can be a bridge for the development of online car sales e-commerce. Testing this hypothesis involved 100 correspondents as a sample and analyzed using SmartPLS3.3.2 software. and has passed the valid and reliable test. The results of this test can be concluded, the e-commerce platform has no effect on purchasing decisions, Youtube media has no effect on purchasing decisions, digital advertising media has no effect on purchasing decisions, Youtube media has no effect on mediating e-commerce platforms on the occurrence of purchasing decisions, digital advertising media influential in mediating e-commerce platforms on the occurrence of purchasing decisions, e-commerce platforms influencing Youtube media, e-commerce platforms influencing digital advertising media.

Abstract

This study aims to determine the role of the public prosecutor in the application of PERJA Number 15 of 2020 concerning Termination of Prosecution Based on Restorative Justice against criminal cases of theft and to determine the role of the prosecutor in the future in implementing Restorative Justice against criminal acts of theft whose losses have been recovered exceeding Rp 2,500,000,- (Two Million Five Hundred Thousand). This type of research is empirical juridical legal research, where the data is obtained from the field and described following the actual reality. The results of the study show that (1) cases that were settled based on PERJA Number 15 of 2020 concerning Termination of Prosecution Based on Restorative Justice must prioritize a peace agreement between the two parties by taking into account three main elements, namely the suspect is the first time to commit a crime, a crime only threatened with imprisonment of not more than 5 (five) years, and the loss of a crime not more than Rp 2,500,000,- (two million five hundred thousand rupiah). (2) The Public Prosecutor is considered to be too rigid in interpreting the phrase in Article 5 paragraph (1) letter c in which the loss of a criminal act cannot be more than Rp 2,500,000,- (two million five hundred thousand rupiah), even though there has been an agreement peace between the two parties, and the victim's losses have been restored to their original state, with an additional Rp 12,000,000,- (twelve million rupiahs). The application of Restorative Justice by the Public Prosecutor is not always fixed on the nominal limit according to the PERMA of Rp 2,500,000- (two million five hundred thousand rupiah) to realize the original condition, which is intended so that the victim who initially felt aggrieved due to the suspect's actions feels restored to his condition so that a peace agreement can be created between the victim and the perpetrator.

Abstract

This study aims to determine the factors causing the crime of destruction of company assets owned by PT. SEKO POWER PRIMA related to the hydropower development plan in the Seko sub-district and to find out the efforts that the authorities can take in dealing with the crime of destroying company assets belonging to PT. PRIMA POWER SEKO. This research was conducted in North Luwu Regency, especially North Luwu Police Station and Seko District. The research method used in data collection is field research and library research. The study's results indicate that (1) the factors causing the crime of destruction of company assets owned by PT. Seko Power Prima is related to the hydropower development plan in Seko District generally due to several factors, namely the fear of losing cultural sites, provocation factors, lack of security factors, fear of population relocation, economic and educational factors, and coercion of will (2) Countermeasures carried out by the authorities law enforcement is a repressive effort as well as a pre-emptive effort.

Abstract

Abstract Malang is one of the cities that are still in the 10 Creative Cities in Indonesia. The growth development of creative industry startups in Malang is very rapid considering the many supporting factors such as the number of demographics of productive age, market potential as far as support infrastructure, so that it is interesting to investigate further, especially regarding financial performance which is influenced by financial literacy. The purpose of this study is to investigate the role of financial literacy on the financial performance of creative industry startups in Malang. The research approach used is quantitative using smart PLS. The findings of this study are that financial knowledge has a significant positive effect on financial performance, as well as financial attitude has a significant positive effect on financial performance. In addition, financial behavior plays a role in mediating between financial knowledge on financial performance and financial attitude on financial performance. Abstract

This study aims to analyze the implementation of the SI-CANTIK application as an employee management innovation in the Bogor Regency Government. The research method used is descriptive qualitative with data collection techniques using observations, interviews, and literature studies. The results show that implementing the SI-CANTIK application has effectively impacted local governments and ASN. In an implementation, there are still problems such as: (1) the SI-CANTIK application has not been integrated with other personnel service applications. (2) ASN individuals have other smartphones and leave them for attendance. (3) Attendance data for employees who do not come to work without information on the application have not been followed up by their direct supervisor. (4) the input of the team member's daily work reports has not been able to describe the achievement of organizational performance. To overcome these problems, several strategies can be carried out: (1) integrating the SI-CANTIK application with other applications to make the implementation of personnel management more comprehensive. (2) It is necessary to revise Bogor Regent Regulation Number 42 of 2019, which regulates superiors who do not take action against disciplinary violators, and the disbursement of TPP is postponed. Another thing that needs to be regulated is categorizing the behavior of leaving smartphones for attendance as a form of disciplinary violation, subject to disciplinary sanctions, and not being given TPP within a specific time, (3) the SI-CANTIK application's development by considering the organizational performance targets contained in the RPJMD and the organization's Strategic Plan associated with team member performance targets.
