Abstract

Artikel ini membahas tentang peranan Mahkamah Konstitusi dalam menegakkan asas presidensialisme di Indonesia. Artikel ini berargumen bahwa meskipun Mahkamah Konstitusi tidak secara jelas mendukung kebijakan legislatif dalam rangka penyederhanaan partai politik, namun Mahkamah Konstitusi secara kuat mendukung asas bahwa sistem presidensial harus mengatasi kontestasi politik. Argumen tersebut dihasilkan dari analisis putusan-putusan Mahkamah Konstitusi dalam menguji konstitusionalitas undang-undang. Upaya Mahkamah Konstitusi dalam mempertahankan asas presidensialisme nampak dalam kasus ambang batas elektoral, ambang batas parlemen, pemilu presiden dan ambang batas pencalonan presiden. Isu utama dari kasus-kasus tersebut memunculkan kebutuhan untuk melakukan reformasi terhadap sistem kepartaian yang sesuai dengan sistem presidensial sebagai asas konstitusi di Indonesia.

Abstract

The National Land Law, regulated in Law No. 5 of 1960 concerning Basic Regulations on Agrarian Principles, was formed from the Indonesian customary law as the original character of the Indonesian people. From 1960, the principles in the national customary law, which are suitable with the Indonesian features, have contributed to the National Land Law development. One of its Principles is the Principle of Horizontal Separation. This Principle is not absolute as the Principle of vertical accesssie may be applied as well. This research observed the application of the Principle of Horizontal Separation and the Principle of vertical accessie in the National Land Law.

Abstract

Ruislag is a legal act conducted by the Local Government to optimize its assets, in which one of its forms is exchanging its assets with private assets. In practice, ruislag involves a foundation that owns assets, for instance, land ownership, as a party in ruislag. This article prescribes two main points that shall be noticed by the Local Government and the Foundation regarding the legitimate ruislag conduct. Those two main points highlight the organization of the foundation issue and the administrative aspects of legal documents of the land owned by the foundation, particularly the land that was obtained by a grant. This article uses a conceptual approach and a statutes approach in its analysis.

Abstract

International trade law is part of international law. Therefore, various imperfections or weaknesses of international law are also affected in the field of international trade law. This article will explain why the state in conducting international trade needs to comply with international trade law. This article argues that the reason for the states to obey international trade law is due to the belief that obedience will benefit the interests of the country itself. The next reason is that there are fundamental principles within the scope of international treaties, which are the source of law from international trade law, namely the principle of good faith. A state that is bound in the international trade agreement shall implement the provisions of the treaty by contents, soul, purpose, and purpose of the treaty itself, respecting the rights and obligations of each party.

Abstract

The object of fiduciary security represents how important the principle of trust of the creditor is. Under the Fiduciary Law, creditors own rights to sell fiduciary collateral objects if the debtor is in breach of contract. Unfortunately, the Constitutional Court Decision No. 18/PUU-XVII/2019 reduced this right by granting the terms of the agreement of breach of contract and the debtor’s willingness to surrender the object of collateral. This paper reviewed the Decision highlighting material rights and their implications for the insurance institution. A normative juridical method using a statutory and conceptual approach was applied to conclude that the Decision is incompatible with the principle of material rights, especially the principle of droit de suite, droit de preference, and separate executive. It affects the time, cost, and the addition of new burdens in the execution of the collateral object execution. As a long-term recommendation, legislators need to amend the Fiduciary Law by affirming the executive power in fiduciary guarantees. Additionally, a change in the agreement deed clause and an effort to optimize the simple lawsuit mechanism are needed as a short-term recommendation.

Abstract

Hakim sebagai garda utama bagi pencari keadilan harus mampu melampaui batasan positivisme hukum dan dapat membuka diri terhadap akal budi (natural reason) yang selama ini menjadi ruang kosong dalam proses penetapan hukum di pengadilan. Fokus artikel ini membahas bagaimana putusan pengadilan seharusnya dibuat dengan mempertimbangkan aspek-aspek yang logis sesuai dengan akal budi, berdasarkan prinsip equity sebagai dasar pertimbangan putusan dalam menyelesaikan perkara pidana perempuan. Kajian ini berkesimpulan bahwa penerapan prinsip equity dalam peradilan pidana merupakan salah satu upaya untuk mencari keadilan di saat tidak ada aturan perundang-undangan yang dapat menjamin hak-hak perempuan sebagai korban tindak pidana. Penerapan prinsip equity dalam hukum pidana ini dapat disamakan dengan prinsip ex aequo et bono dalam hukum perdata, yaitu “menurut keadilan” sehingga majelis hakim dapat berpendapat lain dari ketentuan yang telah ada dan menjatuhkan putusan yang seadil-adilnya bagi perempuan korban tindak pidana/kekerasan seksual.

Abstract

The agreement contains the rights and obligations of the parties in carrying out their respective achievements, if they do not make an achievement then it is considered to have committed default. But there is an excuse as regulated in article 1245 of the Civil Code. The Covid-19 outbreak is designated as a non-natural national disaster (Presidential Decree No.12 of 2020), has a very broad impact including the scope of financing companies which resulted in many debtors experiencing defaults. Presidential Decree No.12 of 2020 is very relevant to article 1244 and article 1245 of the Civil Code. Therefore it is not a category of default. However, good faith (Article 1338 paragraph 3) and the principle of appropriateness (Article 1339) of the Civil Code must underlie the application of Article 1245. The impact of the stipulation of Presidential Decree No. 12 of 2020 is that debtors who failed to pay should receive relaxation, payment relief by exempting from interest payment, as stated in Article 1245 of the Civil Code.
