Jurnal Verstek is a peer-reviewed journal published by Procedural Law Department, Faculty of Law, Universitas Sebelas Maret three times a year in April, August, and December. This Journal aims primarily to facilitate undergraduate students paper over current developments on procedural law issues in Indonesia as well as to publish innovative legal researches concerning Indonesian procedural laws and legal system. It provides immediate open access to its content on the principle that making research freely available to public support a greater global exchange of knowledge. The scope of the articles published in this journal deal with a broad range of topics in the fields of Procedural Law, included but not limited to legal construction of procedural law, critical construction of procedural law in practice, trends and changes in procedural law, and the technical challenges faced in proedural law.

Abstract

Artikel ini menganalisis lelang online yang dilakukan di Kantor Pelayanan Barang Milik Negara dan Lelang Surakarta. Tujuan artikel ini adalah untuk mengetahui pelaksanaan lelang dengan penawaran tertulis tanpa kehadiran penawar melalui Internet (Studi Kasus di KPKNL Surakarta), kendala yang dialami KPKNL Surakarta dalam melakukan lelang online, dan solusinya bahwa KPKNL Surakarta harus mengatasi kendala tersebut. Metodologi dalam penelitian ini adalah penelitian hukum empiris yaitu melihat realitas Pelaksanaan Lelang Internet berdasarkan Peraturan Menteri Keuangan Nomor 213/PMK.06/2020. Jenis data yang digunakan adalah data primer dan data sekunder. Teknik pengumpulan bahan hukum adalah wawancara dengan pertanyaan terbimbing kepada Pejabat Lelang dan Fungsional KPKNL Surakarta. Penelitian ini menggunakan teknik analisis pendekatan kualitatif dengan pola penalaran silogistik yang terdiri dari premis mayor dan premis minor. Dari penelitian ini diperoleh hasil pelaksanaan lelang online di KPKNL Surakarta melalui beberapa prosedur bagi calon pembeli untuk melihat penawaran barang melalui Aplikasi Portal Lelang Indonesia, kemudian membuat akun dan melengkapi data dan persyaratan yang dibutuhkan seperti KTP, NPWP, dan nomor rekening bank, ajukan penawaran melalui website lelang online yang telah disediakan, setelah batas waktu penawaran lelang berakhir, semua peserta (menang/kalah) akan menerima notifikasi yang dikirimkan ke alamat email masing-masing peserta. Kendala dalam pelaksanaan lelang antara lain kurangnya Pegawai Negeri Sipil di KPKNL, beberapa proses bisnis lelang yang masih manual, dan pemohon baru yang perlu mempelajari tata cara pelaksanaan lelang online. Solusinya adalah dengan menambah pegawai, mengefisienkan proses bisnis lelang dari manual menjadi digital, serta memberikan sosialisasi dan pengetahuan kepada masyarakat tentang lelang online KPKNLKata Kunci: Lelang; Internet; Kantor Pelayanan Kekayaan Negara.This article analyzes the online auction conducted at the Surakarta State Property and Auction Services Office. The purpose of this article is to find out the implementation of an auction with written bids without the presence of bidders via the Internet (Case Study at the Surakarta KPKNL), the obstacles experienced by the Surakarta KPKNL in carrying out online auctions, and the solutions that the Surakarta KPKNL has to overcome these obstacles. The methodology in this study is empirical legal research, namely looking at the reality of Internet Auction Implementation based on Minister of Finance Regulation No. 213/PMK.06/2020. The types of data used are primary data and secondary data. The technique for collecting legal materials is interviews with guided questions to the Auction and Functional Officers at the Surakarta KPKNL. This study uses a qualitative approach analysis technique with a syllogistic reasoning pattern consisting of a major premise and a minor premise. From this research, the results of online auction implementation at KPKNL Surakarta were obtained through several procedures for prospective buyers to view bids for goods through the Indonesian Auction Portal Application, then create an account and complete the required data and requirements such as KTP, NPWP, and bank account numbers, submit offers through the website online auction that has been provided, after the auction bidding deadline ends, all participants (win/lose) will receive a notification sent to each participant's e-mail address. Obstacles in carrying out the auction include the lack of Civil Servants at the KPKNL, several auction business processes that are still manual, and new applicants who need to learn about the procedures for conducting online auctions. The solution is to add employees, streamline auction business processes from manual to digital, and provide socialization and knowledge to the public about KPKNL online auctionsKeywords: Auction; Internet; Office of the State Property Service and Auctions.

Abstract

Artikel ini bertujuan untuk menganalisa alasan banyaknya kegagalan mediasi dengan mediator hakim dan untuk mengetahui perspektif hakim selaku mediator dalam proses mediasi sengketa tanah di Pengadilan Negeri Sukoharjo. Dalam penelitian ini menggunakan penelitian hukum empiris yang bersifat deskriptif. Jenis data yang digunakan merupakan data primer yaitu hasil wawancara dengan Bapak Candra Nurendra A., SH.,KN, M.Hum., selaku hakim mediator di Pengadilan Negeri Sukoharjo dan data sekunder berupa studi putusan perkara Nomor 74/Pdt.G/2018/Pn Skh dan studi putusan Nomor 14/Pdt.G/Pn Skh serta studi kepustakaan. Teknik untuk pengumpulan data adalah wawancara dan studi kepustakaan dengan teknik analisis data kualitatif. Berdasarkan penelitian ini memperoleh hasil bahwa penyelesaian sengketa tanah di Pengadilan Negeri Sukoharjo adalah para pihak yang saling emosi, kuasa hukum yang menghambat proses mediasi karena ada beberapa kuasa hukum yang memilih memenangkan perkara di Pengadilan, ketidak hadiran salah satu pihak dalam proses mediasi, masyarakat banyak yang tidak paham akan manfaat mediasi, kedua belah pihak yang memiliki kepentingan yang saling bertentangan dan memiliki ambisi untuk menang. Perspektif hakim selaku mediator, menurutnya cara untuk menengahi para pihak yang bersengketa harus memahami terlebih dahulu apa yang menjadi keinginan para pihak bisa dengan cara kaukus serta mengajak para pihak untuk berfikir dengan kepala dingin, tenang, dan menjaga ketertiban pada saat mediasi berlangsung serta menunjukan sikap yang lemah lembut agar para pihak dapat meredam emosi sehingga seorang mediator harus bisa meyakinkan kepada kedua belah pihak yang bersengketa dalam bentuk komunikasi verbal, selain itu seorang mediator harus bersikap sabar dengan situasi yang ada.Keywords: Perdata; Mediasi; Sengketa Tanah; Litigasi.This article aims to analyze the reasons for the many failures of mediation with judge mediators and to find out the perspective of judges as mediators in the land dispute mediation process at the Sukoharjo District Court. In this study using descriptive empirical legal research. The type of data used is primary data, namely the results of interviews with Mr. Candra Nurendra A., SH., KN, M.Hum., as a mediator judge at the Sukoharjo District Court and secondary data in the form of a study of case decisions No. 74/Pdt.G/2018/ Pn Skh and study of decision No. 14/Pdt.G/Pn Skh and study of literature. Techniques for collecting data are interviews and literature studies with qualitative data analysis techniques. Based on this research, it was found that the settlement of land disputes at the Sukoharjo District Court were parties who were mutually emotional, attorneys who hindered the mediation process because there were several attorneys who chose to win cases in court, the absence of one of the parties in the mediation process, many people who do not understand the benefits of mediation, both parties have conflicting interests and have the ambition to win. From the perspective of the judge as a mediator, according to him, the way to mediate between the disputing parties is to understand in advance what the parties wish to do, by caucusing and inviting the parties to think with a cool head, be calm, and maintain order during mediation and show a positive attitude. gentle so that the parties can reduce their emotions so that a mediator must be able to convince both parties to the dispute in the form of verbal communication, besides that a mediator must be patient with the existing situation.
