Abstract

Humans are destined with the nature of zoon politicon, they always live in groups in a group called society. Living alone without other people somewhere is not human nature as a creature, even if there are people who live alone, it's a bedtime story and in the middle of the story they will definitely be met and get along with each other as an absolute necessity. It is human nature to live side by side with other humans and try to carry on offspring by means of marriage. Marriage is a physical and spiritual bond between a man and a woman as husband and wife with the aim of forming a happy and eternal family (household) based on the One Godhead. with the aim, among other things, to get offspring who will continue and replace the generation that gave birth to them. The purpose of this study was to find out how the rights and obligations of parents towards children based on Article 45 of Law Number 1 of 1974 concerning Marriage. Based on Article 45 and Article 46 of Law no. 1 of 1974, the obligation of parents to care for and educate their children until they marry and can stand alone. This also means that even if the child is married if, in fact, it cannot stand alone, it is still the obligation of parents to take care of their children, wives, and grandchildren. This is different from what is regulated in the Civil Code that the obligation does not only extend to adult children (aged 18 years) but until they are able to stand on their own even though the marital ties of their parents are broken. Children must respect their parents and obey their goodwill. If the child is an adult, he is obliged to take care of his parents and family in a straight line up according to his ability, if they need his help

Abstract

The purpose of this research is to describe the authority of district/city governments in managing government affairs in the education sector. As a consequence of the implementation of regional autonomy using the concurrent principle, there is a division of governmental affairs both at the central government and regional governments. This study focuses on the distribution of government affairs in the education sector. Because the study of government affairs in the education sector is small, the authors examine this matter. The research method is normative juridical research using statutory and conceptual approaches. The results of this study are because education is part of human rights, and the government is responsible for protecting, guaranteeing, and fulfilling the right to education for citizens. Then because of the consequences of implementing autonomy, then in terms of administering government affairs in the education sector, there is a division of functions. District/City Governments are tasked with overseeing the running of the education system in which local governments manage Early Childhood Education, Elementary Schools, and non-formal education as stipulated in laws and regulations.

Abstract

Management of resources in an area always requires licensing, where a permit is needed to take the first steps in managing resources or the environment in an area. This has actually been regulated in the UUPPLH and the Job Creation Law, but in these two regulations, the permits are different, where the UUPPLH is more on the environmental document process (Environmental Impact Analysis/Amdal) while the Job Creation Law simplifies the licensing process by integrating environmental permits into Business Permits. These two regulations have their respective impacts if an environmental violation of the permit occurs, the first will result in consequences for environmental permits while the second will have consequences for business permits. The Job Creation Law classifies business permits that provide warnings and high levels of care for health, safety, the environment, and resources. For this reason, The Job Creation Law remains in the public eye of various parties, even criticized and protested. Because This law is thought to only be concerned with corporations and investment, it even possibly compromises environmental law enforcement. This paper examines environmental permits in the UUPPLH and the Law on Job Creation to compare where the differences in environmental permits from the two laws are. And the author will also provide opinions regarding environmental permits from the two laws. The method used in writing this time is the Law on Job Creation main materials are legal journals that discuss licensing, the UUPPLH, and the Job Creation Law. We anticipate that this conversation will offer knowledge and understanding to the wider community about the importance of an environmental permit when it comes to managing natural resources in an area as well as an understanding of the differences in permits in the two laws.

Abstract

A form of insurance that guarantees loss and damage due to fire or the risk of its expansion affecting the object of coverage Objects that can be insured is in the form of your property in the form of residential buildings, shop houses, warehouses, factories, office buildings, hotels, household furniture, home appliances, machinery, merchandise, inventory of raw materials or finished goods, and so on in accordance with the Indonesian Fire Insurance Standard Policy (PSAKI). This insurance is also known as All Property Risk Insurance. In the law or insurance agreement, there is the principle of honesty. the principle of honesty is the principle for every insurance agreement that is in the provisions of the Civil Code. Article 251 of the Commercial Code also regulates good faith or honesty, this is because insurance agreements have special characteristics, compared to other agreements in the Civil Code. The Insured must be aware that it has an obligation to provide true, honest and complete information regarding the condition of the insured object. Article 251 emphasizes that the principle of good faith or honesty is only for the insured. Insurance is one type of special agreement regulated in the Commercial Code as an agreement, so the provisions of the legal terms of an agreement in the Civil Code also apply to insurance agreements. The legal terms of an agreement are regulated in Article 1320 of the Civil Code, there are 4 valid conditions for an agreement, namely the agreement of the parties, the authority to act, certain objects, and lawful causes.

Abstract

UU PPLH menyediakan ruang bagi masyarakat yang keberatan dengan dokumen Amdal untuk dapat mengajukan keberatan atau upaya hukum, sedangkan dalam UU Ciptaker tidak diatur mengenai mekanisme keberatan atas Amdal. UU Ciptaker menghapus ketentuan mengenai mekanisme keberatan tersebut, yaitu dengan menghapus ketentuan mengenai komisi penilai Amdal yang dalam diatur dalam Pasal 29, Pasal 30 dan Pasal 31 UU PPLH. Ketiadaan mekanisme keberatan ini memantik perdebatan dimasyarakat karena mekanisme ini dianggap sangat penting untuk memastikan kelestarian lingkungan. Penelitian ini akan membahas tentang bagaimana pengajuan gugatan AMDAL berdasarkan UU. No 32 tahun 2009 dan bagaimana pengajuan gugatan AMDAL berdasarkan UU No. 11 tahun 2020 pasca adanya putusan Mahkamah Konstitusi Nomr 91/PUU-XVIII/2020. Penelitian ini menggunakan pendekatan yuridis normatif yaitu melakukan studi kepustakaan (Library Research) terhadap hal-hal yang bersifat teoritis yaitu suatu pendekatan yang dilakukan dengan mempelajari asas-asas hukum dalam teori/pendapat sarjana dan peraturan perundang-undangan yang berlaku. Abstract

Teknologi internet mempunyai pengaruh yang sangat besar terhadap perekonomian dunia. Internet membawa perekonomian dunia memasuki babak baru yang lebih populer dengan istilah digital economics atau perekonomoan digital. Makin banyak kegiatan perekonomian dilakukan melalui media internet. Misalnya, semakin banyak mengandalkan jual beli sistem online atau yang mana bisa disebut dengan (e-commerce) sebagai media transaksi. Melalui penelitian ini dikaji bagaimanaperbandingan mekanisme transaksi online dalam aplikasi Gojek dengan Bukalapak dalam memberikan pertanggungjawaban hukum terhadap pengguna transaksi online dan bagaimana Upaya Hukum yang dapat ditempuh oleh pelaksana dan konsumen pengguna transaksi online yang merasa dirugikan Aplikasi Gojek dan Bukalapak. penelitian ini menggunakan metode pendekatan Social legal research, dimana peneitian ini melakukan wawancara langsung dengan subjek hukum serta sumber tambahan dari bahan hukum premier yaitu perundang undangan dan buku terkait penelitian. teori yang digunakan adalah teori pertanggungjawaban hukum atas penggunaan transaksi online aplikasi Bukalapak dan Gojek. serta adanya hubungan teori pertanggungjawaban hukum tersebut untuk memberikan penyempurnaan hak terhadap perlindungan hukum konsumen sebagai pelaku transaksi online. Selain itu dalam penelitian ini menjelaskan bahwa adanya perbandingan metode transaksi yang dilakukan oleh aplikasi Bukalapak dan Gojek. kemudian dalam hal terjadinya perselisihan upaya hukum pelapak/agen maupun konsumen dalam transaksi. Aplikasi Bukalapak maupun Gojek terjadi perselisihan, sebelum beralih ke alternatif lain, Pengguna wajib terlebih dahulu menghubungi penyedia Aplikasi yang digunakan secara langsung agar dapat melakukan perundingan atau musyawarah untuk mencapai resolusi bagi kedua belah pihak.

Abstract

Seiring perkembangan zaman kompleksitas masalah kenegaraan melahirkan banyak lembaga negara independen. setelah reformasi 1998 lembaga negara independen mulai mendapatkan tempat. UUD 1945 hasil amandemen memberi pengakuan atas lembaga negara independen diantaranya Komisi Yudisial dan Komisi Pemilihan Umum. Umumnya lembaga negara independen hadir karena kinerja lembaga yang ada dianggap tidak memuaskan. Namun, pertumbuhan lembaga negara independen yang tidak terkendali menimbulkan masalah baru seperti tumpang tindih kewenangan dan membebani anggaran negara. Lembaga negara independen lahir tanpa cetak biru yang jelas. Tidak ada konsep ketatanegaraan yang komprehensif tentang apa dan bagaimana lembaga negara independen. Setiap muncul masalah nasional atau membentuk peraturan perundang-undangan urusan tertentu saat itu lahir lembaga negara baru. Akibatnya lembaga-lembaga negara yang lahir tidak memiliki pola yan jelas. Lembaga negara independen berada di luar struktur pemerintah. Akan tetapi keberadaannya bersifat publik. Sumber pendanaan lembaga negara independen berasal dari negara, dan bertujuan untuk kepentingan publik. Munculnya lembaga negara independen didorong oleh tuntutan masyarakat atas prinsip demokrasi dalam penyelenggaraan pemerintah melalui lembaga akuntabel, independen, dan dapat dipercaya.

Abstract

Penelitian ini bertujuan untuk menganalisis dasar penolakan keputusan medis pasien dewasa kompeten. Melalui penelitian yuridis normatif, penelitian ini mengkaji penerapan norma–norma atau kaidah–kaidah dalam hukum positif. Hasil Penelitian penolakan tindakan medis adalah hak yang dimiliki oleh pasien berdasarkan Undang-Undang Praktik kedokteran No. 29 Tahun 2004 pada Pasal 52 poin (d) yang berisi tentang hak menolak tindakan medis dan Undang-Undang Kesehatan No. 36 Tahun 2009 Pasal 56 poin (a) juga mengatur hak pasien yaitu pasien berhak menolak tindakan medis. Namun, hak tersebut tidak berlaku pada penderita penyakit menular kedalam masyarakat yang luas, keadaan seorang yang tidak sadarkan diri dan gangguan mental berat. Apabila pasien mempergunakan haknya dalam memberikan penolakan terhadap suatu tindakan medis dan pasien telah mendapatkan informasi yang cukup maka segala konsekuensi atas penolakan tersebut menjadi tanggung jawab pasien itu sendiri. Apabila pasien menggunakan haknya dalam menolak suatu tindakan medis maka pasien telah melepaskan hak hukumnya terhadap dokter. Sedangkan akibat hukum penolakan tindakan medis terhadap dokter apabila dokter telah menjalankan kewajibannya maka dokter terlepas dari segala akibat hukum yang timbul setelah penolakan tersebut baik pada aspek hukum perdata maupun aspek hukum pidana.

Abstract

This study aims to analyze accountability for discrepancies in the application of the principle of justice which is carried out simply, quickly and at low cost in civil cases in general courts. Through the normative-empirical juridical method, this study was carried out in two stages of study, namely the study of the applicable normative law and its application in concrete events to achieve the stated goals. The results of the study explain that the principle of justice is contained in Article 2 paragraph (4) of Law Number 48 of 2009 concerning Judicial Power, namely that it must be carried out simply, quickly, and at a low cost which must be carried out efficiently and effectively and does not neglect thoroughness and scrupulousness in seeking truth and justice. Meanwhile, accountability for discrepancies in the application of the principle of justice for those who do not carry out their obligations to provide services or do not comply with provisions regarding the principles of justice can be subject to sanctions ranging from a verbal warning to dishonorable discharge as a civil servant.

Abstract

The rampant practice of prostitution in Indonesia needs to get serious attention considering that so far the practice of prostitution has not have a clear rule of law. So far, positive law in Indonesia only provides punishment for service providers (pimps) only. Meanwhile, commercial sex workers and service users cannot be ensnared by law. The impact of this causes the practice of prostitution to continue to thrive among the community. The research method that the author uses is the normative juridical method, meaning that the data used consists of primary, secondary, and tertiary legal materials. As for the results of the study,that the criminalization of commercial sex workers through online according to positive law in Indonesia by referring to the rules regarding online prostitution outside the Criminal Code is found in Article 2 paragraph (1) of Law no. 21 of 2007 concerning the Crime of Trafficking in Persons, Article 30, Article 33, Article 35 of Law No. 44 of 2008 concerning Pornography, and Article 27 of the ITE Law, but absolutely the commercial sex workers can be held criminally liable using the ITE Law.
