Abstract

The right to control from the state over land originates from the right of the Indonesian nation to land, which in essence is an assignment to carry out the duties of the nation's authority which contain elements of public law. PT. Kereta Api Indonesia (Persero) may diversify its business by utilizing its land in collaboration with third parties to support its main business. The purpose of this research is to determine the implementation procedure, the form of land lease agreements to the settlement of land lease defaults managed by PT. Kereta Api Indonesia (Persero) Operation Area 4 Semarang. This research is a sociological juridical research. The results of this research indicate that the implementation of the land lease agreement managed by PT. Kereta Api Indonesia (Persero) is carried out by submitting an application to the Executive Vice President of Daop 4 Semarang. If the contents of the contract have been agreed upon by both parties, the contract is made in 2 (two) copies and signed by both parties on a stamp duty. The form and content of the lease agreement is standard in nature, the contents of which are an agreement of two or more parties or a reciprocal standard agreement. Efforts made by PT. Kereta Api Indonesia (Persero) if there is default, but the contract period has expired and does not make an extension if 2 (two) months before the due date the tenant has not made an application letter for contract extension, the Asset Management Manager makes a notification letter to the tenant that the contract will end and concerned in order to complete the contract extension process.

Abstract

The position of Notary as a profession that cannot be separated from the development of existing technology. The wave of technology in the Industrial 4.0 and Society 5.0 era requires Notaries to be able to move quickly, especially in carrying out their duties. Major changes in technological developments have encouraged the Indonesian nation as a modern democracy to transform its electronic system for the public interest. The term Cyber Notary emerged in this case, which was discussed as being able to speed up the work of a Notary as a public servant in terms of making a Notary deed. If it is based on the values that shape it, technology and politics are of course different, technology thrives in scientific knowledge and objective facts while law is made in the public domain which demands technical regulation in the reciprocal relationship between culture, politics and technology. This is concretized by Act No. 14 of 2008 concerning Public Information Disclosure (UU KIP) and Act No. 11 of 2008 concerning Information and Electronic Transactions (UU ITE) in conjunction with Act No. 19 of 2016.

Abstract

The fact that occurs as a form of disciplining students so that they are more disciplined gets a dilemma with accusations of violence against students where parents do not directly compromise or solve problems but directly report to the police where the teacher is always the victim and the object of the sufferer. it is very ironic that the existence of a teacher as a hero without merit and from a science teacher is very weak. On the one hand, it must realize the goals of national education, on the other hand, in carrying out its authority it is considered to violate the law. This activity involved partners from the Semarang Regency Education, Culture, Youth and Sports Office. The problems faced by the first partner, Has the teaching profession in the district have implemented conflict management as a form of legal protection for the second teaching profession, What is the impact of conflict management legal counseling on the teaching profession in Semarang Regency. in handling and resolving conflicts The implementation of community service activities is carried out using a participatory approach method. meaning that the participants are required to actively participate during the activity. From the results of the first community service activities, the teaching profession in Semarang district does not understand conflict management as a legal protection in applying discipline to students so as not to have an impact on legal issues, secondly seeing the pre-test and post-test conducted on 36 participants marked by indicators of increasing knowledge participants on how to resolve conflicts between the teaching profession and students, as well as increasing knowledge about the application of the Law

Abstract

Morocco is a constitutional, democratic and social monarchy. The King is the Supreme Representative of the Nation and the Symbol of the unity thereof. He is the guarantor of the perpetuation and the continuity of the State. As Defender of the Faith, he ensures the respect for the Constitution. He is the Protector of the rights and liberties of the citizens, social groups and organizations. System Barriers to Pro Bono work result from the social environment of the judiciary and, more specifically, from the current practice of law in Morocco. The population generally has a low regard for the legal and judicial sector, and expects corruption in the judiciary. In Morocco, legal information is also not adequately disseminated to the public.[1] In addition, the low literacy rate 52.3% for the total population (39.6% for women, 65.7% for men) renders access to justice all the more difficult. A substantial proportion of the population is therefore vulnerable and may fall prey to unethical behavior. The Bar Association has great difficulty in supervising “homeless” lawyers, who are lawyers with no fixed business address and operate with a cellular telephone from undisclosed premises. Abstract

This research aims to correct understanding of the nature of death will make us Muslims strive to prepare ourselves for death. The research method of implementing legal counseling was carried out by using lectures, discussions and training in retrieving the bodies of women by simulating how to bath and shroud. If death has approached us, what then is the duty of the living human, one of those obligations is to collect the corpse. The obligation to collect the corpse is 4 things, namely bathing, shrouding, praying and burying. This grooming obligation is based on Bukhari in HR Bukhari no. 1315 and Muslim no. 944. The procedure for gathering the bodies of women and men is essentially the same and Prophet Muhammad has taught us about the procedures for gathering corpses. There are pillars and sunnah that can be done. For hawa/women to carry out cleaning related to three things, it is sufficient, namely bathing, shrouding and praying for the corpse. As for the adam/man, if they can carry out the four of them, the reward is very large.

Abstract

Indonesia is a country that is very rich in the diversity of its natural resources. Both in terms of flora and fauna. However, Indonesia is an emerging country for the circulation of endangered animals that have been protected by law. The Animal Market is one of the places where several protected animals are circulated. In this study, the authors found a unique incident in the practice of buying and selling endangered animals that have been protected by this law, where the practice of buying and selling rare animals is carried out in markets managed by the government, namely under the auspices of the Department of Agriculture, Fisheries and Food. The focus of this research is to find out how the practice of buying and selling endangered animals in the Animal Market and how the review of Islamic law and Act No. 5 of 1990 concerning the Conservation of Biological Natural Resources and Their Ecosystems. Through qualitative research methods and through a juridical normative approach, the researcher tries to uncover the focus of the problem above by going directly to the field to find facts which then leads to an analysis of Islamic law and Act No. 5 of 1990 concerning Conservation of Biological Natural Resources and Their Ecosystems. Data were taken through documentation, observation, and interviews. The data that has been obtained is presented in the form of a description in order to obtain conclusions. The results of the study explain that the sale and purchase of endangered animals protected under Islamic law is a sale that does not bring benefits, contains najis, does not belong to the seller wholly, causes damage to nature, and contains fraud. Meanwhile, when viewed from Act No. 5 of 1990 concerning the Conservation of Natural Resources and Their Ecosystems, the practice of buying and selling endangered animals that are protected illegally is a criminal act of wildlife crime in which the legal consequences of this crime are a maximum criminal sanction of ten years in prison and a fine of between 100 million and IDR 200 million rupiahs.

Abstract

Narkoba sangat berbahanya bagi tubuh kita karena dampak yang ditimbulkan akibat penyalahgunaannya dapat merusak fungsi sel-sel syaraf. Peredaran dan penyalahgunaan narkoba di Indonesia semakin meningkat, terutama di kota besar, termasuk Kota Semarang. Perlu diberikan pemahaman kepada masyarakat khususnya generasi muda tentang bahaya narkoba. Pengabidan kepada masyarakat dengan penyuluhan hukum ini bertujuan untuk memberikan pengetahuan dan pemahaman tentang jenis-jenis narkoba, akibat penyalahgunannya, modus peredarannya, dan bagaimana cara pencegahannya. Sebagai mitra adalah Bhabinkamtibmas Polek Genuk, Karang Taruna, Rt, dan RW Desa Gebangsari, Kecamatan Genuk, Kota Semarang. Peserta antusias mengikuti kegiatan terlihat dari pertanyaan dan tangggapan yang disampaikan kepada pemateri. Hasil yang dicapai dari kegiatan ini adalah masyarakat lebih mengetahui dan memahami bahaya penyalahgunaan narkoba dan modus peredarannya sehingga dapat melakukan pencegahan.

Abstract

This reasearch purposes to socialize the impact of violating health protocols during the COVID-19 pandemic in Indonesia. The implementation of the Health Protocol in dealing with the spread of the COVID-19 virus in Indonesia is a crucial thing to be socialized. Violations of health protocols have legal consequences and the quality of public health. The Head of Wonoplumbon Sub-district, Mijen Sub-district, hopes that there will be socialization of the legal consequences and quality of public health for violating health protocols. The method used in this activity is the Participatory Learning Methods method. The result of this activity is that violations of health protocols can have the impact of increasing the number of patients exposed and dying, as well as high hospital occupancy, resulting in an increase in the number of health workers who are also exposed and die. Violators of health protocols, especially social distancing, can be subject to criminal sanctions in accordance with applicable laws.

Abstract

The state guarantees the right of everyone to form a family and continue their offspring through legal marriage, and the state also guarantees the right of children to survive, grow and develop as well as the right to protection from violence and discrimination. The Marriage Law requires the age of marriage to be 19 years. However, the marriage law does not explicitly prohibit the practice of early marriage, because the marriage law also provides dispensation facilities if the prospective bride or groom is still a minor. This causes many people to carry out underage marriages or early marriages, including in Bulusari Village, Bulakamba District, Brebes Regency. The reasons are due to pregnancy out of wedlock, economic factors, and cultural factors. The solutions offered are providing understanding to the public about marriage, increasing public legal awareness about the risks of early marriage, both social and health risks, and providing assistance to children and parents who undergo early marriage.

Abstract

Pembangunan sistem Lalu Lintas dan Angkutan Jalan di indonesia selama ini sering mendapat kritik karena selalu menekankan pada segi fisik, dan dianggap kurang memperhatikan sisi pembangunan pranata aturan lalu lintas dan pengembangan Sumber Daya Manusia pada diri aparatur pemerintah bidang Lalu Lintas dan Angkutan Jalan. Jembatan timbang belum berperan dengan baiksaat ini, tapi bukan berati keberadaanya tidak diperlukan ataupun dihapuskan. Upaya penanganan yang perlu dilakukan saat ini adalah usaha penegakan hukum dengan memberikan sanksi hukum untuk pelanggar muatan yang melebihi batas Muatan Sumbu Terberat yang telah ditentukan oleh pemerintah. Tujuan dari penelitian ini adalah mengetahui dan menganalisis mengenai pelanggaran kelebihan muatan, kendala yang terjadi dalam pelaksanaan pengukuran muatan dan upaya mengatasi kendala tersebut di area  jembatan timbang Kabupaten Blora. Metode Penelitian yang digunakan dalam penelitian hukum ini adalah metode pendekatan yuridis sosiologis.  Hasil dari penelitian ini adalah Tinjauan hukum terhadap pelanggaran kelebihan muatan di jembatan timbang Kabupaten Blora antara lain apabila ada kelebihan muatan barang di jembatan timbang Sambong Blora kurang atau sama dengan 5 %,  maka pihak petugas jembatan timbang Sambong Blora masih memberikan toleransi dan tidak dianggap melakukan pelanggaran, sedangkan apabila ada kelebihan muatan barang diatas 5% di jembatan timbang Sambong Blora maka termasuk pelanggaran dan dihitung sesuai kategori yang diberlakukan di Jembatan Timbang Sambong Blora. Terdapat kendala dalam pelaksanaan pengawasan kelebihan muatan di area jembatan timbang Kabupaten Blora, antara lain Masih banyaknya pengemudi atau pengusaha angkutan muatan barang yang belum sadar hukum (kesadaran hukum para pengemudi yang masih rendah untuk mentaati peraturan kelebihan muatan). Terkait dengan infrastruktur timbangan, diiperlukan upaya revitalisasi infrastruktur gudang atau lahan kosong di sekitar jembatan timbang yang ada.
