processes to processes outside criminal justice. Diversion was only implemented in 2014, two years after the enactment of Law No. 11 of 2012 concerning the Child Criminal Justice System. The purpose of implementing diversion is to create restorative justice in the juvenile justice system. Restorative justice is believed to be able to overcome the high rate of child crime in Indonesia. In fact, in Yogyakarta, even though diversion has been implemented, the number of children committing crimes is still high. Based on this, the authors are interested in examining two things, namely examining the related implementation of diversion in Yogyakarta Police towards all criminal offenses that meet the requirements of attempted diversion and to see its implementation in terms of the objectives of the Child Criminal Justice System.This research uses a jurisdictional-empirical approach by looking at the suitability between the Law and the reality at the Yogyakarta Police. This research is descriptive analysis by conducting interviews and observations as data collection techniques.The results of this study, the authors conclude that not all child crimes in Yogyakarta Police are attempted diversion according to the mandate of the Child Criminal Justice System Act, even though the criminal offense of the child has fulfilled the requirements for diversion. This is because in practice, in addition to using diversion solutions, Yogyakarta Police also has another solution called "ADR". From the results of this study, the authors conclude that not all forms of restorative justice that are the objectives of the juvenile justice system are achieved. Of the 5 (five) points of the objectives of the juvenile justice system, three of them are achieved, namely: resolving child cases outside the judicial process; Avoid children from deprivation of independence; and Encourage the community to participate. While the other two, achieving peace between victims and children and instilling a sense of responsibility for children, has not been achieved.

Abstract

The delegation of Land and Building Tax (PBB) from the central tax to regional taxes has an impact on the regions to carry out PBB collection and impose administrative sanctions on taxpayers who are not timely in paying the PBB. This research is an empirical and qualitative research type with an analysis based on the Regional Regulation of Tasikmalaya City Number 4 of 2011 concerning Regional Taxes. The results of the research obtained by the author are the Regional Government of Tasikmalaya City in handling the problem of collection and enforcement of land and building tax law delegated to the Regional Tax and Retribution Management Agency (BPPRD) of the City of Tasikmalaya using active and passive methods. Efforts made to impose sanctions on taxpayers are to provide administrative sanctions accompanied by actions to collect and apply alternative sanctions in the form of social sanctions.

Abstract

The world of broiler farming business in CV. Mitra Sejati Abadi Wilayah Magelang uses collateral in business cooperation. Business cooperation built with a partnership system with farmers in the production process is a risk principle (loss / profit). The principle is applied with the aim if the loss is a shared responsibility and if profit is shared satisfaction. The point of balance of profit / loss depends on the national market price. This research data collection technique by conducting interviews with CV. Mitra Sejati Abadi in Magelang Region and 3 (three) partner farmers who have different guarantees, cases and sub-districts. The nature of this research is descriptive-analytical, namely research that aims to describe the practice of cooperation between CV Mitra Sejati Abadi and the farmers in the Magelang region. The research approach used is juridical empirical, which analyzes reality based on the Civil Code and data collected from CV. Mitra Sejati Abadi Magelang region and partner farmers in several sub-districts in the Magelang regency. This research shows that there are some errors in the agreement which will be discussed further.

Abstract

The agreement is a legal relationship regarding the ties between parties that cause legal consequences and must be fulfilled. In classical fiqh, agreements only involve parties who make and do not apply to other parties. However, at certain limits due to contract law it can also involve third parties. With respect to the object of the contract, transfer of ownership can be carried out if the provisions in the form of the scope of the contents of the agreement, the binding capacity of the agreement and the responsibilities of the agreement have been fulfilled.

Abstract

Policy (discretion) is needed to overcome rapid changes. In theapplication of discretion of public officials, it is often considered to violate thelaw and be identified as criminal. While on the other hand, this kind of policyis needed, in times of emergency, so that it makes a blunder of officials. Thispaper attempts to look at how the legal position of discretion in governmentadministration is. The results of this writing are that the legal position ofdiscretion in the administration of government is an "exception" from theprinciple of legality (wet matigheid van bestuur), which means that the stateadministration is given the freedom to and on its own initiative to carry outactions to resolve certain urgent problems and the settlement rules do not yetexist, namely that they have not been made by the state body that is formallyassigned to formulate legislation.

Abstract

Law number 1 of 1974 has governed marriage rules in Indonesia. The marriedage limit for 19-year-old and 16-year-old girls. But the reality in the field thereare still people who do underage marriage. Indramayu district had become one ofthe District with the largest number of early marriages in West Java Province,the PTA West Java recorded in 2015 in Indramayu district reached 450, in2016 as many as 347. Juntinyuat District is one area in Indramayu thatextends on the coast North and East Indramayu District. The formulation ofthe problem in this study about, what are the factors causing Early Marriage inDistrict Juntinyuat, what the efforts of the KUA and related Instantsi partiesin order to minimize and even prevent Early Marriage in Juntinyuat District,and how the sociology of Islamic law against the factors and efforts to preventmarriage early in Juntinyuat District, Indramayu District. Law seen from theperspective of sociology, law and enforcer can not be released with the object orsociety correlation that will not be separated, other than because society is the object, sociology perspective considers that effective law is the law that lives in society.

Abstract

This research presents there are at least, three differences due to Human Rightsimplemention in this two verdicts; the lawsuit object and the interpretation model ofConstitution and constitutional courts tends to apply contextual understanding in the order of MK No. 46/PUU-VIII/2010 and tends to apply textual understanding in the order of MK MK No. 8/PUU-XII/2014. While there are 5 indicators ofHuman Rights implementation. First, the interpretation of constitution should give a maximum protection to minorities. Second, it must accomodate a relevant international covenant and it’s not yet regulated in legislation. Third, it must protect it constitutional rights of civilian. Fourth, to recover the violated constitutional rights. Fifth, it should be formed by technology developments, economic aspect, global socio-cultural that is not contradicted to fundamental principles of Pancasila.

Pasal 66A Undang-undang Jabatan Notaris menyatakan bahwademi kepentingan hakim, jaksa, penyidik yang hendak mengambilminuta akta ataupun dokumen lain yang berkenanan dengan itu, makawajib meminta persetujuan dari Majelis Kehormatan Notaris, lalukemudian hal lain yang muncul adalah ketika Notaris keberatan atasdikeluarkannya surat persetujuan oleh Majelis kehormatan Notaris,upaya apa yang dapat dilakukan oleh Notaris yang bersangkutan?Penelitian ini bersifat penelitian pustaka (library research), denganmenggunakan pendekatan yuridis normatif. Hasi penelitian ini adalahMajelis Kehormatan dalam kedudukan sebagai Badan atau Jabatan TataUsaha Negara mempunyai kewenangan untuk membuat ataumengeluarkan Surat Keputusan atau Ketetapanyang berkaitan denganhasil pengawasan, pemeriksaan atau penjatuhan sanksi yang ditujukankepada Notaris yang bersangkutan. Terhadap keputusan MajelisKehormatan Notaris berdasarkan ketentuan Pasal 66 UUJN-P, jikaNotaris yang bersangkutan merasa dirugikan, atas putusan tersebut tidakada upaya keberatan administratif atau keberatan administratif, tapiNotaris yang bersangkutan dapat langsung menggugat MajelisKehormatan Notaris ke Pengadilan Tata Usaha Negara.

Abstract

Penelitian ini bertujuan untuk mengetahui kepastian hukum akad syariah yang dibuat dalam bentuk akta Notaris yang ditinjau dari Undangundang Nomor 02 Tahun 2014 Perubahan Atas Undang-undang Nomor 30 Tahun 2004 tentang Jabatan Notaris (UUJN-P). Penelitian ini merupakan penelitian normatif yang menggunakan metode pendekatan Yuridis, sedangkan dari segi sifat laporannya adalah penelitian deskriptif-kualitatif dengan menggunakan pendekatan konseptual (conceptual approach), pendekatan perundang-undangan (juridicalapproach) dan pendekatan data (date approach). Dalam penelitian ini, sebagian besar data diperoleh dari studi pustaka dan dilengkapi data-data sekunder. Data yang diperoleh dari penelitian kepustakaan selanjutnya dianalisis secara kualitatif dengan penyajian secara deskriptif. Berdasarkan penelitian ini, penulis menyimpulkan. Pertama, bahwa akad syariah yang dibuat dalam bentuk akta notaris, dalam segi format masih terdapat Notaris yang tidak sesuai dengan ketentuan UUJN-P, khususnya Pasal 38, seharusnya notaris dapat membuat akad syariah tersebut sesuai Pasal 38 UUJN-P karena tidak ada satupun aturan hukum baik itu hukum positif maupun hukum Islam yang mengamanatkan bahwa akad syariah harus ada lafadh Bismillahirrohmanirrohim atau lain sebagainya diletakkan sebelum awal akta, dengan tidak adanya aturan hukum mengenai peletakan lafadh Bismillahhirrohmanirrohim atau lain sebagainya di awal akta, Notaris tidak ada alasan untuk tetap meletakkan lafadh tersebut dalam awal akta dan tetap mengedepankan aturan hukum yang ada dalam pembuatan akta autentik. Sedangkan dalam segi substansinya akad syariah yang dibuat dalam bentuk akta notaris masih terdapat akad yang tidak sesuai dengan prinsip-prinsip syariah. Terdapat banyak ketidaksesuaian aturan hukum yang berlaku, dan juga terdapat beberapa akad syariah yang dibatalkan oleh Pengadilan Arbitrase. Sehingga hal ini menjadikan ketidakpastian hukum akad syariah tersebut bagi para pihak dan bisa sangat merugikan Notaris itu sendiri dan para pihak yang menghendaki adanya akad syariah tersebut. Kedua, perlindungan hukum untuk para pihak sangatlah minim sekali karena tidak ada aturan yang mengatur mengenai perlindungan hukum para pihak dalam pembuatan akad syariah yang dibuat dalam bentuk akta notaris, dan perlindungan hukumnya hanya Notaris yang dapat melakukannya, yaitu dengan cara memperbaharui akad syariah yang sudah dibuat namun tidak sesuai dengan ketentuan UUJN-P khususnya Pasal 38 dan melanggar peraturan hukum yang berlaku, dan bagi notaris yang akan membuat akad syariah harus disesuaikan dengan ketentuana UUJN-P beserta ketentuan aturan hukum yang berlaku

Abstract

Penelitian ini membahas mengenai problematika eksekutorial putusanMahkamah Konstitusi perihal pengujian undang-undang. Metodepengumpulan data melalui studi pustaka (library research) yang kemudiansemua data dihimpun dan dianalisis secara kualitatif. Hasil penelitian inimenunjukkan bahwa pergeseran sifat dasar putusan MK dilandasi karenakewenangan MK untuk menguji berhak melakukan penafsiran terhadapundang-undang dasar (the final interpretator of constitution). Hal iniberimplikasi pada putusan MK yang memunculkan posisi sebagai positivelegislature yang dapat terlihat dari adanya varian putusan dengan sifat non-selfexecuting. Adapun bentuk-bentuk ketidaksesuaian dalam pelaksanaanputusan MK yang bersifat non self-executing adalah ketidaksesuaianpenggunaan produk hukum; disobedience putusan MK; menghidupkankembali norma yang telah diuji; dan pembiaran terhadap Putusan MK.Maka dari itu diperlukan terobosan hukum untuk mengatur implementasiputusan non self executing supaya setiap norma hukum yang terbentukmenghasilkan kepastian, keadilan, dan kemanfaatan. Terobosan hukumtersebut melalui upaya pemberian kewenangan judicial order yang terbataskepada MK.
