Abstract

Penelitian ini mendeskripsi penggunaan aplikasi shopee ditinjau kuhperdata dan hukum fiqh terhadap trend transaksi jual  beli on line. Tujuan penelitian ini sebagai edukasi dan advokasi kepada khalayak pembaca bahwa jual beli dimassa modern tidak hanya dilakukan secara tatap muka namun bisa dilakukan secara on line yang berbasis pada pemanfaatan teknologi.  Jenis penelitan ini ialah  penelitian hukum kualitatif dan penelitian hukum normatif yaitu kita kenal dengan sebutan penelitian hukum kepustakaan yakni artikel hukum yang dilakukan dengan cara meneliti berdasarkan bahan-bahan yang bersumber dari pustaka. Sumber data yang digunakan oleh penulis  pada artikel ini antara lain bahan hukum primer yaitu peraturan perundang-undangan yang berlaku yang memberikan deskripsi mengenai bahan hukum primer berupa tafsir, buku-buku umum, jurnal, dokumen dan referensi-referensi lain yang berhubungan dengan artikel ini lalu dikompilasikan dengan teknologi digital.  Dari hasi penulisan artikel ini  maka: Pertama, dalam persfektif hukum fiqh  diperbolehkan karena dalam sistem jual beli ini tidak mengandung unsur   penipuan, barang yang dijual sesuai dengan informasi yang telah ada pada  website yang disediakan oleh penjual. Kedua, apabila terjadi keterlambatan maka pihak yang terikat/terlibat harus segera mengkonfirmasi agar tidak terjadinya kesalahpahaman dalam bertransaksi.  Ketiga, pihak yang terikat/terlibat haruslah bersikap tanggung jawab khususnya bagi para pelaku usaha boleh mengambil keuntungan dalam jual beli namun hak pembeli harus tetap dihormati sesuai dengan prinsip etika bisnis Islam.  Keempat, hukum Negara khususnya sesuai dengan peraturan perundang-Undang-Undangan yang berlaku yaitu sesuai dengan KUHPerdata Pasal 1457 dan Pasal 1458. Karena dengan adanya dasar tersebut maka diharapkan penjual dan pembeli melakukan transaksi jual belinya dengan baik dan sesuai dengan aturan yang diberlakukan sehingga kecurangan serta penipuan juga semakin bisa diminimalkan agar penjualan bisa dilakukan tanpa kendala jarak dan pembelian juga menjadi lebih aman

Abstract

This study examines interfaith marriage from the perspective of fiqh law and positive law. Marriage is the result of affection between a man and a woman, so limiting marriage to religion is one of the conflicts that often occurs, interfaith marriage is something that is difficult to separate, especially those who adhere to the teachings of pluralism in Indonesia. So from here the researcher considers it important to raise the problems that occur in interfaith marriages. In this study the researchers used normative legal research, namely what we know as library law research, namely legal articles carried out by researching based on materials sourced from libraries. Sources of data used by the author of the article in this writing include primary legal materials (binding legal materials). Data collection techniques using library research techniques. The selection of literature is carried out as carefully as possible by considering the author's authority in the field under study. This study also examines in detail the law of interfaith marriage in terms of Islamic law following the as-Syafi'i school, and also links civil law and positive law in Indonesia, as well as the MUI fatwa.

Abstract

The formulation of the research problem is how ethical leaders communicate to the public. How effective is the effectiveness of the ethics of communication between leaders and the community in Meunasah Tutong Village, Montasik District, Aceh Besar District. The purpose of this research is to find out the ethics of leaders in communicating with the community and want to know the effectiveness of the ethics of communication between leaders and the community. The methodology used is a qualitative method with a descriptive approach with data collection techniques using observation and interview methods. The number of respondents interviewed was five people consisting of one hamlet head, two members of the community, one tuha peut, the youth leader and the gampong keuchik. The results of the study show that the ethics of leaders communicate with the community in Meunasah Tutong Village, Montasik District, Aceh Besar District. A village built by leaders who lack ethics in communication so that it is clear that changes to the welfare of the community have occurred without having to be assessed from another point of view. Because every human being has a feeling of wanting to be appreciated and wanting to appreciate. When the feeling of wanting to be respected is ignored, the sense of respect cannot be realized so that divisions occur within one community group. Seriousness can be seen based on research results. Not solely because of that, but the way of a good leadership is when the feedback received is in accordance with the expectations desired by a community which is a common goal. the effectiveness of the leader's communication ethics towards the community, namely ineffective communication ethics will have an impact on the social inequality of the community, a sense of togetherness and cooperation will no longer work and this will make a village immoral and dignified.

Abstract

Zakat dan wakaf berpotensi besar sebagai instrumen pembangunan ekonomi dan nasional. Akan tetapi, untuk menggapai hal tersebut ada banyak kendala. Tulisan ini bertujuan untuk menjawab sejumlah problematika zakat dan wakaf sebagai instrumen pembangunan ekonomi dan sosial. Terdapat 4 aspek yang harus dijadikan pendekatan; hukum, ekonomi, sosial. Dalam kesimpulan tulisan ini, secara ekonomi kurang optimal dalam mendapatkan kepercayaan masyarakat serta tidak ada sanksi bagi para pembangkang zakat. Sedangkan dalam sosiologi, kesadaran dan empati harus ditingkatkan. Secara politik, zakat dan wakaf seharusnya sama menjadi perlu mendapatkan perhatian.
