Abstract

Participatory supervision is an initiative activity outside the supervisory agency to ensure the stages of the general election run by collecting data, information, and making an inventory of the results of cases relating to the holding of general elections and/or regional head elections conducted by independent and non-governmental groups or community organizations. partisan. This concept seems to contain efforts to realize the value of community sovereignty. Where this process becomes the basic foundation of democratic practice. The concept of Islamic law has offered such protection efforts which are then packaged in the concept of Fiqh Siyasah. This continues to be developed in the maqashid syariah theory. The value of benefit is the point of study of Maqāṣid ash-Syarīʻah. Benefits and/or sovereignty need to be implemented in the practice of holding simultaneous regional head elections in 2020. Basically, the practice of holding regional head elections is the implementation of maintaining community sovereignty. This research is a qualitative research with a sociological juridical approach to be further presented as analytical descriptive data. This research took place at the Bawaslu of Kendal Regency. This study aims to determine the practice of participatory supervision of simultaneous regional head elections in 2020 and the practice of analyzing maqashid syariah as a theory of implementing the value of the benefit of participatory supervision carried out in the election of regents and deputy regents of Kendal district for the 2020-2024 period.

Abstract

Village regulations are a manifestation of Indonesia as a state of law. Its existence in the world of regional legal products is arguably still new and its existence is the answer to the challenges of the social conditions of society which always change from time to time. As a result of the issuance of Law number 12 of 2011 concerning the Formation of Legislation (UU PPPU), it shifted the hierarchy of the position of village regulations. This has an impact on the uncertainty of the juridical basis of village regulations. This has led to the neglect of this type of regional legal product, especially since it is still relatively new, often in the process of formation it is not in sync with the procedures contained in Minister of Home Affairs Regulation (Permendagri) Number 111 of 2014 and does not pay attention to the rules and principles of the formation of laws and regulations. From these problems, two problem formulations emerged, namely: 1) What is the Process of Formation of Village Regulations according to Permendagri Number 111 of 2014?, 2) How is Siyasah Duturiyah's Review of the Process of Formation of Village Regulations according to Permendagri Number 111 of 2014?. This research is library research in a qualitative form. To explore the data and analyze the data using a juridical-normative approach and Siyasah fiqh (Siyasah Duturiyah). The first results of this study are; the formation of village regulations must pay attention to 3 very fundamental and absolute rules or principles, namely the principle of lex superior derogate lex inferiori, principle of lex specialis derogate lex generalis, and principle of lex posterior derogate lex priori. The formation of village regulations according to Permendagri Number 111 of 2014 must go through 6 (six) stages, namely planning, preparation, discussion, determination and promulgation, dissemination, as well as evaluation and clarification. Second; based on the review of the dusturiyah siyasa on the substance of the process of forming village regulations, the principles of Islamic law have been realized, such as the application of the principles of deliberation and democracy. Because each stage does not leave the principle of amar ma'ruf nahi munkar. Even though in practice there are often legal defects and are used for personal and group interests only.

Abstract

Aparatur Sipil Negara atau yang lebih dikenal dengan ASN bertugas memberikan pelayanan kepada masyarakat secara profesional, jujur, adil dan merata dalam melaksanakan tugas negara, pemerintahan, dan pembangunan. Dalam pemilu, ASN harus dituntut untuk netral dari pengaruh semua golongan dan partai politik serta tidak didiskriminasi dalam memberikan pelayanan kepada masyarakat. Tindakan condong ke salah satu pihak ini melanggar Undang-Undang Nomor 5 Tahun 2014 tentang Aparatur Sipil Negara berdasarkan Pasal 2 Huruf bahwa setiap pegawai ASN tidak memihak pada pengaruh apapun dan tidak memihak pada kepentingan siapapun. Penelitian ini merupakan penelitian hukum empiris dengan menggunakan metode pendekatan perundang-unndangan. Rumusan masalah (1) bagaimana implementasi Undang-undang Nomor 5 tahun 2014 dalam hal netralitas ASN di pemilihan kepala daerah Demak tahun 2020? (2) bagaimana tinjauan fiqih siyasah dusturiyah terhadap netralitas ASN pada pilkada Kabupaten Demak tahun 2020? Dari hasil pembahasan maka dapat disimpulkan, bahwa fakta dilapangan banyak ASN yang tidak berlaku netral dalam pilkada namun hanya sedikit yang dikenai sanksi administratif. dan aturan yang harus di kerjakan oleh para pejabat negara dalam memimpin suatu negara yang baik, bahwa pemimpin atau pejabat haruslah bisa tanggung jawab, adil, jujur, dan amanah, namun tanggung jawab itu tidak di jalankan sama saja pemimpin /pejabat itu tidak amanah dan tidak bertanggung jawab.

Abstract

This research is an attempt to explain the problem of the role of deliberation on development plans in absorbing the aspirations of the people of the Tangkil-Tengah Village, the implementation of the Musrenbang certainly has an effects on increasing village development. The formulation of the problem in this research is how the role Musrenbang in absorbing the aspirations of the village community and what are the supporting and inhibiting factors for the implementation of the Musrenbang. The purpose of the research is to find out the role of the Musrenbang in absorbing aspirations and what are supporting and inhibiting factors the Musrenbang. Type research is field research with qualitative approach. Technical analysis is a kualitative descriptive analysis technique.

Abstract

In the 2020 simultaneous elections during the COVID-19 pandemic, this will certainly have an impact on weakening supervision so that in anticipating the risks that will arise, optimal monitoring is needed. The formulation of the problem in this research is; 1) How is the implementation of Law Number 6 of 2020 in the implementation of the duties and authorities carried out by the Sub-district Panwaslu in Pekalongan Regency in the 2020 Pilkada? 2) what are the obstacles for the Pekalongan Sub-district Panwaslu in carrying out their duties and functions. This type of research is library research, using an empirical legal study approach. The results of the study concluded that the implementation of the duties and authorities of the Sub-district Panwaslu as the election supervisor had carried out supervision from the implementation of supervision, the stages of holding elections, then submitting the findings of alleged violations, to the follow-up process for any alleged violations. Obstacles experienced but the Sub-district Panwaslu in Pekalongan Regency carried out its duties and authorities in accordance with applicable regulations.

Abstract

Pekalongan City Investment and One Stop Integrated Service (DPMPTSP) Office launched an online-based licensing system called Sistem Perizinan Online, Ringkas, dan Ekonomis (SAKPORE) so that the people of Pekalongan City can take care of their business licensing online. Previously, licensing services still used a manual system which was feared to create increasing risk on data storage, such as corrupted data. The public also required to come to the office to obtain information about what requirements needed when submitting an application, which costs a lot of money, and to make it worse, lack of information about the processing timeframe are still persist in the whole process. Therefore, this study aims to determine the licensing services using the SAKPORE system. The type of research is empirical juridical with a qualitative approach. The data analysis method that being used is data reduction, data presentation, and drawing conclusions. The results conclude that the ease of applying for online licensing using the SAKPORE system at the Pekalongan City Investment and One Stop Integrated Service (DPMPTSP) can shorten service procedures, service completion time frame, and service completion costs.

Abstract

There is often excess capacity in detention centers. One of them is in the Class IIA Pekalongan Prison. In dealing with the spread of Covid-19 in prisons, the government makes policies in the form of assimilation and integration for prisoners to reduce the rate of Covid-19 transmissions. The formulation of the research problem (1) how is the implementation process of providing assimilation and integration during the Covid-19 pandemic at the Class IIA Pekalongan Prison? and (2) what is the perspective of fiqh siyasah regarding the provision of assimilation and integration during the Covid-19 pandemic at the Class IIA Pekalongan Prison?. This research is a field research using a qualitative approach. The result of this research is that the process of implementing assimilation and integration in the Class IIA Pekalongan detention center has been running in accordance with the Regulation of the Minister of Law and Human Rights. The application of assimilation and integration in the perspective of siyasa fiqh can be said to be not the same. Thus, the process of assimilation and integration in the Class IIA Pekalongan prison has not been fully in accordance with the instructions of Islamic law. Meanwhile, in the Permenkumham perspective, the provision of assimilation and integration in prisons is in accordance with the Minister of Law and Human Rights Regulation No. 10 and 32 of 2020.

Abstract

Penelitian ini memiliki tujuan untuk memperoleh informasi mengenai tinjauan Undang-Undang Nomor 2 Tahun 2014 mengenai Jabatan Notaris terhadap putusan no 235/G/2019/PTUN.JKT. Jenis penelitian ini adalah penelitian hukum normatif yang memakai pendekatan kasus atau Case Approach. Menggunakan sumber data sekunder yaitu bahan hukum primer, bahan hukum sekunder, dan bahan hukum tersier yang dikumpulkan dengan teknik dokumentasi. Analisis data memakai teknik deskriptif. Putusan Sidang Nomor 235/G/2019/PTUN.JKT merupakan sebuah putusan yang didasari atas gugatan yang dilayangkan oleh Saudara Muhammad Irsan, S.H., Sp.N terhadap Menteri Hukum dan HAM atas pencabutan Saudara Muhammad Irsan, S.H., Sp.N sebagai Notaris secara tidak hormat; dan terbukti secara sah dan meyakinkan bahwasannya “Objek Gugatan” telah memenuhi unsur Pasal 53 Ayat 2 (dua) a dan b Undang-Undang Nomor 9 Tahun 2004 mengenai Perubahan atas Undang-Undang Nomor 5 Tahun 1986 mengenai Peradilan Tata Usaha Negara. Selain itu ada beberapa Undang-Undang Nomor 2 tahun 2014 yang dilanggar.

Abstract

Public political education is one of the roles that must be carried out by political parties as stated in Law No. 2 of 2011 concerning Political Parties. The problem is how the implementation of public political education by political parties in Batang Regency is in accordance with the provisions in Article 34 paragraph (3b) of Law Number 2 of 2011 concerning Political Parties. This type of research is field research, data collection using observation, interview, and documentation techniques. This research approach is a qualitative approach. The data analysis technique used in this research is qualitative data analysis method and then the researcher uses inductive thinking logic in drawing conclusions. The results of the study show: first, that political parties in Batang Regency have carried out their role in the political education of the people in Batang Regency. In practice this political education takes the form of activities in the form of community gatherings, seminars, consolidation, party cadre schools, and recesses interspersed with political education. Second, Political Parties in Batang Regency have implemented Article 34 paragraph (3b) of Law Number 2 of 2011, but in its implementation it has not been able to qualitatively realize the objectives contained in the Law so that public political education is less perceived by the wider community and has less impact. the results for increasing public political awareness, especially increasing the active participation of the community in general elections and local elections

Abstract

Political participation is the activity of a person or group of people to be actively involved in politics, namely choosing the leadership of the state together directly or indirectly. These activities include making choices during elections, attending political party campaigns and becoming a member of politics or mass organizations. General Election Commissions (KPU) of Pekalogan City in carrying out its duties to increase public political participation in the 2019 presidential and vice presidential elections is in accordance with what is described in the General Election Commission Regulation of the Republic of Indonesia Number 10 of 2018 concerning Socialization, Voter Education, and Community Participation in the Implementation of General Elections. The formulation of the problem: (1) How did the General Election Commission (KPU) of Pekalongan City in the 2019 Presidential and Vice Presidential Elections achieve the target of 84.02% public participation? (2) What are the supporting and inhibiting factors for public participation in the 2019 Presidential and Vice-Presidential Elections? This study uses field research, using a qualitative approach. This type of research uses empirical juridical. The results of this study indicate that the efforts of the Pekalongan KPU can be said to be successful in achieving the target of community participation. One of the factors influencing the increase in participation is strategy. The strategy carried out consists of a short-term strategy and a long-term strategy.
