Abstract

The Concept of Amânah in Informed Consent. The Appeal Decision of the Supreme Court of the Republic of Indonesia Number 365K/Pid/2012 granted the appeal request of Public Prosecutor of Manado State Public Prosecutor’s Office. The Supreme Court annulled the Manado State Court Decision that imposed 10 (ten) months criminal imprisonment to each defendant. The Indonesian Doctors Association argued that the contract between doctor and patient is a contract of process, not a contract of result. At the very least, this Appeal Decision provided an opportunity for legal experts to test and evaluate the concept of informed consent both philosophically and juridically. This paper argues that informed consent should be built on the framework of amânah which is an important concept in Islamic law.DOI: 10.15408/ajis.v14i1.1240

Abstract

هذه الدراسة تبرِزُ القيمَ التربوية من آيات الميراث لأهميتها في حياة الناس، حيث نشأت مشكلة من تصوُّر بعض الناس أن تقسيم الميراث فيه ظلم لبعض الفئات وعدم مساواة، فاقتضى تبيين المقاصد الشرعية المتعلقة به، والجواب عن التساؤل المتوقع وهو: ما هي القيم التربوية التي تتضمنها آيات المواريث .واعْتَمَدَتِ الدراسةُ على منهجية الاستقراء والتحليل والاستنباط، بالرجوع إلى المصادر المعتمدة من نصوص القرآن الكريم، والتفاسير المختلفة وخاصة ما يهتم منها بالأحكام الفقهية في القرآن، وكتب الحديث النبوي الشريف، والأبحاث الحديثة التي تتناول الموضوع أو موضوعات مشابهة. وتعتمد الدراسة على نظرية أن الأحكام الشرعية لا تخلو من قصد تربوي يظهر في أثناء النصوص التي تفرض تلك الأحكام.عرّفت الدراسة الميراث لغةً واصطلاحًا، وبينّتْ أهميته، واستخلصت مجموعة من القيم التربوية في ميراث الفروع والأصول وميراث الزوجين والإخوة والأخوات لأم وميراث الإخوة والأخوات الأشقاء أو لأب، فتوصَّلت إلى نتائج أهمها: أَنَّ آيات الميراث تتضَمَّنُ قيمًا تربوية هامة، لها آثارها الإيجابية على الفرد والمجتمع، وأنَّ تطبيق هذه المبادئ من شأنه أنْ يرسخ قواعدَ المحبةِ والترابطِ في المجتمعات، وأنَّ تقسيمَ الميراث مبنيٌّ على مبدأ العدل، الذي يعتمد على إيصال الحقوقِ إلى أهلها على قدْرِ مَا يستحق عليهم من تكاليفَ وواجباتٍ.  AbstrakPenelitian ini  mengkaji nilai pedagogis pada ayat tentang waris dalam Al-Quran. Anggapan bahwa ketetapan pembagian waris dalam al-Quran tidak adil dan tidak berprinsip kesetaraan menjadi permasalahan sampai sekarang. Penelitian ini didasarkan pada kajian komprehensif terhadap ketentuan waris dalam Al-Quran, hadis, fikih, dan berbagai penelitian mutakhir yang mengkaji topik ini  dengan berpegang pada prinsip bahwa setiap ketentuan syariah memiliki nilai pedagogis. Penelitian ini menemukan bahwa ayat-ayat waris memiliki unsur pedagogis yang dapat memberikan dampak positif bagi individu dan masyarakat. Pembagian waris berprinsip pada keadilan yang bergantung pada pemenuhan hak yang didasarkan pada beban kewajiban yang dimiliki oleh setiap individu.

Abstract

Shura and the Phenomenon of Local Elections in Indonesia. Shura and the elections are social institutions in the political arena in Indonesia. In Islam, choosing a leader is a necessity. Direct election is a mechanism that has been exemplified by the Companions of the Prophet, for instance, when choosing Abu Bakr R.A. as the leader of the Muslims after the Prophet passed away. There was no will for this election. Based on divine guidance and the instinct of the Companions about Abu Bakr’s personality, Muslims did shura and directly selected Abu Bakr to be the first Caliph.DOI: 10.15408/ajis.v16i2.4454

Abstract

Abstrak: Isu-isu Kontemporer Seputar Kriminalisasi dalam Poligami. Dalam ushûl al-fiqh, setiap perbutan yang dapat merugikan orang lain adalah berdosa. Hal ini didasari pada prinsip bahwa menghindari penyebab kerugian (mafsadât) dianggap lebih baik daripada mencari keuntungan untuk diri sendiri. Oleh karena itu, dengan alasan bahwa poligami menyebabkan kerugian lebih banyak bagi istri dan atau anak-anak—dan hal itu tidak mendatangkan keuntungan bagi mereka, maka itu dikategorikan sebagai sesuatu yang berdosa. Dalam konteks ilmu fikih, poligami termasuk dalam kejahatan jarîmah ta’zîr. Namun hal ini dirusak oleh kurangnya konsensus tentang apakah setiap poligami harus dikriminalisasi. Sementara dalam konteks hukum positif di Indonesia, praktik poligami membatasi sanksi pidana karena melanggar batas ini tidak jelas. Artikel ini berpendapat bahwa poligami adalah kejahatan baik dari segi fikih—pada beberapa kondisi luar biasa—maupun hukum positif. Namun agar hal tersebut mendapatkan legitimasi hukum dengan benar, maka hukum positif perlu memastikan bahwa ada sanksi yang jelas dan secara langsung pada tindakan poligami, sehingga praktik tersebut secara efektif dapat dikategorikan sebagai tindakan kriminal.Kata Kunci: kriminalisasi, poligami, takzir, fikihAbstract: Contemporary Issues Facing the Criminalization of Polygamy. According to ushûl al-fiqh, any act that disadvantages others is considered sinful. This is based on the principle that avoiding causing such disadvantages (mafsadât) is considered better than seeking advantages for oneself. Therefore, on the grounds that polygamy causes more disadvantages to wives and or children that it does advantages to those people, it can be categorised as a sinful act. In the fiqh context, polygamy is a jarîmah ta’zîr crime. But this is undermined by a lack of consensus about whether polygamy should be criminalised at all. Meanwhile, in the context of positive law in Indonesia, while the practice of polygamy is restricted the criminal sanctions for violating these restrictions are not clear. This article argues that polygamy is criminal both in terms of fiqh and positive law’ However, in order for it to be properly stamped out, positive law needs to ensure that there are clear sanctions in place that directly correspond to acts of polygamy, such that the practice can be effectively criminalized.Keywords: criminalization, polygamy, ta’zîr, fiqhDOI: 10.15408/ajis.v12i1.960

Abstract

The positivisation of National Sharia Board (DSN) fatwa about mudaraba into Financial Service Authority (OJK) regulation is an effort which conducted by OJK in running it’s regulating such as arranged in the Law Number 21 of 2011 regarding OJK. With this positivisation, DSN fatwa has legal and binding power because getting inside regulation such as arranged in the Law Number 12 of 2011 regarding the Establishment of Legislation (P3). However, there are gap and the difference content between the provisions in DSN fatwa above with OJK regulation by dint of positivisation pattern. Moreover, although there is DSN fatwa content which has not been asorbed in to OJK regulation, but it still has legal and binding power in shari’a financial industry in case reviewed from the perspective of H.L.A Hart’s legal theory.

Abstract

This article provides answer to the MUI statements that BPJS is inconsistent with the principles of sharia economics.  First, a solution to avoid Gharar, where participants pay a monthly premium, but it is unclear how much they will receive.Second, the solution to avoid the element of gambling, where financial calculations can be profit or loss. Third, the solution of usury, when claims were received by participants of BPJS greater than the premium paid; therefore, it contains elements of usury and usury Fadl category. Meanwhile, when there is a delay of participants to pay premiums, BPJS establishes fines that is also included nasi'ah usury.DOI: 10.15408/ajis.v15i2.2859

Abstract

Transnational corporations trading power has been challenged human right condition in Indonesia. There are many small trader (read:traditional market) have been marginalized. This paper conceptualize right ofsmall traders to justice market by means seeing traditional market cases. This paper is using qualitative method research by statute approach and also use primair data at the field by means interview trader at tradition market. This study shows that Indonesian law market doesn’t opimize yet to protect and maintain traditional market Indonesia. The regulations give the local leaderto make the policy about it. Abstract

Government  Policy  on  Islamic  Financial  Institutions  Reform  Era. Government  policies  on  Islamic financial institutions in the New Order were backgrounded in political accommodation, namely the accommodation of the Islamic academic elite within the state structure. This was used by the Islamic academic elite to broach ideas and opinions to conceive one of ideas as Islamic banking. Factors driving the process of policy formation of Islamic financial institutions was the support of policy makers, community banking, socio-cultural and juridical. Now, it so happens, that the inhibiting factors were that the policy makers were un-aspirational, public confidence in the conventional banks was still high and the lack of human resources and socialization. Abstract

Under the Nigerian legal classification, shari‘a, the Islamic legal system is classified as customary law. It is on these premises that the Muslims’agitations for full-fledge shari‘a applications and declassification from being a customary law are always thwarted and termed “unconstitutional” by the shari’a antagonists. Meanwhile, the Muslims and protagonists viewed the problems as judicial misinterpretations and legal incongruity. In this study, with the adoption of an analytical approach, shari‘a and customary law are assessed from the provisions of the Nigerian Constitutions and some judicial precedents to unravel the actual position of shari‘a. It was then discovered that, despite the classification under the Nigerian legal system, shari‘a could not have been a customary law due to some factors which include its sources, divinity, permanency, and universality.AbstrakDalam hukum Nigeria, hukum Islam atau syariah diklasifikasikan sebagai hukum adat.  Premis itulah yang menjadi agitasi upaya penerapan syariah secara penuh oleh umat Islam. Usaha untuk pendeklasifikasi  hukum adat selalu digagalkan dan dianggap  “inkonstitusional” oleh penentang syariah.  sementara  sebagian Muslim dan pendukung syariah memandang masalah tersebut sebagai salah tafsir yudisial dan ketidaksesuaian hukum. Dalam penelitian ini, dengan  memakai pendekatan analitis, syariah dan hukum adat dinilai untuk mempertegas dalam  ketentuan Konstitusi Nigeria berdasar  beberapa preseden yudisial untuk mengungkap posisi syariah yang sebenarnya. Kemudian ditemukan bahwa, meskipun klasifikasi di bawah sistem hukum Nigeria, syariah tidak bisa menjadi hukum adat karena beberapa faktor yang meliputi sumbernya, keilahian, keabadian,  dan universalitas.

Abstract

Abstract: The Implementation of Total Quality Management in Waqf Management of the Dompet Dhuafa. This article raises issues about the total quality management (TQM) in waqf management. TQM is a major issue in management, especially for large companies, in a framework to increase the quality of product output and to satisfy customers. TQM nowadays is not only adopted by profit oriented companies but also non-profit institutions. For example, the Dompet Dhuafa has achieved Quality Management System ISO 9001:2008 certification. This article concludes that the implementation of TQM in waqf management of the Dompet Dhuafa is relatively advanced since it gives serious attention to customers, both external dan internal. Similarly with process improvement and total involvement, Dompet Duafa  points to enthusiasm of planned and structured improvement as well as involving all elements of the organization comprehensively.Keywords: waqf, total quality management, waqf managementAbstrak: Implementasi Total Quality Management dalam Pengelolaan Wakaf  di Dompet Dhuafa. Tulisan ini mengangkat isu tentang total quality management (TQM) dalam pengelolaan wakaf. TQM merupakan salah satu terobosan manajemen yang umumnya dilakukan oleh perusahaan besar dalam rangka meningkatkan kualitas produk yang pada muaranya dapat memuaskan konsumen.  TQM tidak hanya diadopsi oleh lembaga-lembaga yang berorientasi pada keuntungan material (profit oriented) namun juga lembaga-lembaga yang berbasis non profit (non-profit oriented). Salah satunya adalah Dompet Dhuafa yang telah berhasil meraih sertifikat Sistem Manajemen Mutu ISO 9001:2008. Tulisan ini menyimpulkan bahwa Implementasi nilai TQM dalam pengelolaan wakaf di Dompet Dhuafa dapat dikatakan relatif maju karena perhatian lembaga ini kepada pelanggan, baik eksternal maupun internal, cukup bagus. Begitu pula dalam hal perbaikan proses dan keterlibatan total, Dompet Dhuafa menunjukkan semangat perbaikan yang terencana dan terstruktur serta melibatkan semua elemen organisasi secara komprehensif.Kata Kunci: wakaf, total quality management, manajemen wakafDOI: 10.15408/ajis.v12i1.983
