Abstract

Islamic Credit Cards and Consumptive Behaviour of Society. The credit card as one means of payment utilising cards, is a payment system that is growing rapidly, brought about by the security and risk of carrying cash in large amounts, efficiency, speed and ease of transaction that is offered. Islamic banks are glancing consumer funding products as one of the products services to be offered. There is a very important limitation that must be realized for Islamic banks, namely the provisions of the shari’a principles regarding the provision of credit card and influence on consumer  behaviour  society,  particularly  the  Muslim  community.  It  is  not  impossible  for  the  existence  of  Islamic credit cards that are presented for the ease of transacting to become a card for the ease of indebtedness and cause a consumptive/wasteful attitude that is definitely forbidden in Islamic economic concept.DOI: 10.15408/ajis.v14i2.1287

Abstract

This article is a result of field research about the culture of inheritance of migrating Besemah people in Jakarta. The research questions raised in this article are do migrating Besemah people adopt their customary law of inheritance or do they adapt to the regime prevailed in the Jakarta? This article found that Besemah people living in Jakarta have been adapting to the urban way of inheritance which gives similar share between men and women and gives a strong position to wife. Another important finding is that only a small number of migrating Besemahers still maintain the old value and customs of their region of origin. DOI: 10.15408/ajis.v17i2.6236

Abstract

Abstract: Analysis of a Text and Context Approach within the Formulation of Islamic Inheritance Distributions. For about fourteen centuries Islamic inheritance law has always been regarded as a qat‘î doctrine which covers for ijtihad and should be taken for granted. However, changes and developments over time, the existence of Islamic inheritance in the Quran have started to be claimed. To some liberalists and feminist activists, the law on Islamic inheritance is a product of salaf scholars to be regarded as rules that tend to be discriminative—just like the discrediting and prejudicing the rights of women—and not oriented towards human justice. Therefore, the provisions of Islamic inheritance need to be reviewed, even deconstructed by considering the social development of society.Keywords: Islamic law, justice, inheritance, tafsîrAbstraksi: Analisis Pendekatan Teks dan Konteks dalam Penentuan Pembagian Waris Islam. Selama lebih kurang empat belas abad hukum kewarisan Islam selalu dianggap sebagai doktrin yang bersifat qat‘î yang menutup rapat ruang ijtihad dan harus diterima secara taken for granted. Namun seiring perubahan dan perkembangan zaman, eksistensi hukum kewarisan Islam dalam Alquran mulai digugat. Oleh sebagian pemikir liberal dan aktivis feminisme, hukum kewarisan Islam produk ulama salaf dianggap sebagai aturan yang cenderung diskriminatif—semisal mendiskreditkan dan merugikan hak-hak perempuan—dan tidak berorientasi pada keadilan manusia. Abstract

Trade transactions conducted to gain an advantage in bad ways is prohibited by Islamic Law. It is a sin or despotic practice when someone saves a commodity not to be sold and reduced the availability of existing goods market and cause the expensiveness of shortages. Then prices could also be rising because of increasing demand on certain commodities, even there is no scarcity.Someone is allowed to store his belongings to the extent desired time and then sell when the price is already more expensive in order to make a profit.DOI: 10.15408/ajis.v15i2.2870

Abstract

Muslim scholars have mainly considered the maqāṣid al-sharī‘ah within three categories: ḍarūriyyāt (the essentials), ḥājiyyāt (the complementaries) and tahsīniyyāt (the desirables or the embellishments). The concept of maṣlaḥah is meant to protect the maqāṣid al-sharī‘ah (the higher objectives of sharī‘ah), which consist of seven essential values, namely religion, life, intellect, lineage, wealth, honour and state, all of which promote the people’s welfare and prevent all kind of evils. They are considered essentials because neglecting them would cause total social disruption and anarchy. Even though classical scholars considered the darūriyyāt to be six in number, this article suggests that the value of “state” be added to this list. The values in the darūriyyāt category must be upheld and protected from any real or unexpected threats either by maintaining the essentials or removing the disruption. The concept of state is just as essential as the other six values, for without it, all of them would be endangered and considered incomplete. Therefore, the “state” value guarantees the continued existence of other values. In this paper, the author argues that this value should be regarded as a seventh essential value. Para cendekiawan Muslim  telah mempertimbangkan maqāṣid al-sharī‘ah dalam tiga kategori: ūarūriyyāt (esensi), ḥājiyyāt (pelengkap) dan tahsīniyyāt (keinginan atau hiasan). Konsep maṣlaḥat dimaksudkan untuk melindungi maqāṣid al-sharī'ah (tujuan yang lebih tinggi dari syariat), yang terdiri dari tujuh nilai esensial, yaitu agama, kehidupan, kecerdasan, garis keturunan, kekayaan, kehormatan dan negara. Semuanya bermaksud kesejahteraan rakyat dan mencegah semua jenis kejahatan. Mengabaikan hal itu akan menyebabkan gangguan sosial dan anarki total. Meskipun para sarjana klasik menganggap darūriyyāt berjumlah enam, penelitian ini menunjukkan bahwa nilai "negara" ditambahkan ke daftar ini. Nilai-nilai dalam kategori itu harus dijunjung tinggi dan dilindungi dari ancaman nyata atau tidak terduga, baik dengan mempertahankan esensi atau menghilangkan gangguan. Konsep negara sama pentingnya dengan enam nilai lainnya, karena tanpa itu, semuanya akan terancam dan dianggap tidak lengkap. Oleh karena itu, nilai “negara” menjamin keberlanjutan keberadaan nilai-nilai lain. Peneliti  berpendapat bahwa nilai ini harus dianggap sebagai nilai esensial ketujuh.

Abstract

Abstract: The Concept and Application of Murâbahah Contracts in Syariah Banking in Indonesia. Murâbahah, which constitutes any type of amânat sale in Islamic law, is the predominant contract scheme utilized in Syariah banking practice in Indonesia. However, in practice, murabahah has undergone many modifications in comparison with the basic concept in classical muamalat fiqh. Ulamas do not object those modifications which do not contravene the basic principles of Islamic law. However, many models for modification have sparked debate, due to being done exclusively to fulfill formal judicial provisions, for the sake of reviewing the effectiveness and efficiency of banking administration. The following article will analyse a number of these models and their backgrounds, as well as their goals in altering the murâbahah scheme in classical fiqh to be practiced in syariah banking, while clarifying the usage of the murâbahah scheme for a number of models of syariah financing and banking.Kewords: murâbahah, murâbahah li al-âmir bi al-syirâ’, PPNAbstrak: Konsep dan Aplikasi Akad Murâbahah pada Perbankan Syariah di Indonesia. Namun dalam praktiknya, murabahah telah mengalami banyak modifikasi di bandingkan konsep dasarnya yang ada dalam fikih muamalat klasik. Modifikasi ini ada yang tidak menimbulkan persoalan dari sisi prinsip-prinsip dasar hukum Islam sehingga para ulama tidak merasa keberatan, tetapi tidak sedikit model modifikasi yang menimbulkan perdebatan karena dilakukan semata-mata untuk memenuhi ketentuan formal yuridis demi pertimbangan efektivitas dan efisiensi administrasi perbankan. Abstract

This study examines the Fatwās issued by the Indonesian Ulama Council (Majelis Ulama Indonesia/MUI) on Indonesian Muslim attitudes and practical procedures towards their religious behaviors and public demands on the government appreciation and recognition. The fatwās present logical reasoning which has attracted the government’s attention to adopting them and issue legal products based on them. With a normative legal research approach, this study is considered as qualitative research which using critical legal theory to analyze the important points in the Fatwās. As a result, this study finds four important cases in the fatwā on religious attitudes and behaviors during the COVID-19 pandemic: first, the fatwa on COVID-19 has logical reasoning which is in line with paramedical advice; second, the fatwa on COVID-19 is consistent with the government political interests concerning physical and social restrictions; third, the fatwa on COVID-19 ends the negative stigma on the political role of religious actors; and fourth, the fatwa shows the increasing role of Kiai (religious figures) from cultural brokers to actors of Islamic legal scientism.     AbstrakPenelitian ini menguji fatwā hukum yang dikeluarkan oleh Majelis Ulama Indonesia (MUI) tentang sikap dan prosedur praktis umat Islam Indonesia dalam beragama serta tuntutan publik atas penghargaan dan pengakuan pemerintah. Fatwā tersebut menghadirkan nalar logis sehingga menarik perhatian pemerintah untuk mengadopsi dan mengeluarkan produk hukum yang didasarkan pada fatwā tersebut. Dengan pendekatan penelitian hukum normatif, penelitian kualitatif ini menggunakan teori hukum kritis untuk menganalisis poin-poin penting dalam fatwā. Hasilnya, studi ini menemukan empat kasus penting dalam fatwā tentang sikap dan perilaku beragama selama pandemi COVID-19. Pertama, fatwā hukum tentang COVID-19 memiliki penalaran logis yang sejalan dengan nasihat paramedis; kedua, fatwā hukum tentang COVID-19 sejalan dengan kepentingan politik pemerintah mengenai pembatasan fisik dan sosial; ketiga, fatwā hukum tentang COVID-19 mengakhiri stigma negatif terhadap peran politik aktor agama; dan keempat, fatwā hukum menunjukkan semakin meningkatnya peran kiai dari calo budaya menjadi pelaku ilmu hukum Islam.

Abstract

The Mashlahah Consideration in Divorce Cases Caused by Domestic Violence in Religious Court. The focus of this study is the consideration of mashlahah in the judge’s verdict in the settlement of domestic violence divorce cases in the Religious Court in Kendari, North Sulawesi. The results of this study shows a significant number of divorce cases are caused by domestic violence. This study also finds that the judge provided the decision based on formal and material legal considerations, facts of the court session, as well as consideration of mashlahah. But in considering mashlahah altogether it is formulated generally which should require an indepth analysis, through the principles of maqâshid al-syarî’ah.DOI: 10.15408/ajis.v14i1.1247

Abstract

Islamic bank, as an alternative financial institution, is now widely accepted and has been established in various countries. In Indonesia, Islamic bank was first established in 1992 along with the revival of Islam in the country. Previously, the establishment of Islamic bank in Indonesia was hindered not because of economical reason but because of a political stigma associated with Islam especially during the 1970s. The purpose of this article is to explore how the bank makes innovations to increase its performance that makes its legitimacy high on the eyes of its stakeholders. Abstract

This article aims at discussing the integration of gender issues in Islamic legal education in Indonesia and Malaysia. In particular, this is to see how gender issues are taught to Islamic law students and integrated into the curricula to instil gender awareness. Based on empirical inquiries in the Department of Family Law of Faculty of Sharia and Law of State Islamic University Syarif Hidayatullah Jakarta and Faculty of Sharia and Law of Academy of Islamic Studies, University of Malaya, this study finds that the attempts to include gender issues in the curricula have been still very limited and insufficient. Courses that directly discuss gender issues and human rights issues are treated merely as elective courses. Except in Jakarta UIN, currently, the specific course on gender becomes a compulsory course. Moreover, the integration of gender discussion into general courses is not easy. This depends on the willingness and awareness of the lecturers to include the discussion. The significant challenge in integrating gender issues in Islamic legal education is related to lecturers and students’ previous norms, values, and ideology. Because of this, the introduction to gender discourse becomes mind-provoking. This study relies on data from the curricula, interviews with faculties’ key figures, and Focus Group Discussion with students from both institutions.  Tulisan ini membahas tentang integrase isu gender ke dalam pendidikan hukum Islam di Indonesia dan Malaysia. Fokus penelitian ini adalah untuk melihat bagaimana isu gender diajarkan kepada mahasiswa hukum Islam dan bagaimana isu gender diintegrasikan ke dalam kurikulum untuk menanamkan kesadaran gender. Melalui penelitian empiris di Program Studi  Hukum Keluarga, Fakultas Syariah dan Hukum, Universitas Islam Negeri Syarif Hidayatullah Jakarta dan Jabatan Syariah dan Undang-Undang, Akademi Pengajian Islam, Universiti Malaya, kajian ini menemukan bahwa upaya untuk memasukan isu gender dalam kurikulum pendidikan hukum Islam masih sangat terbatas dan belum cukup. Mata kuliah-mata kuliah yang secara langsung membahas isu gender dan hak asasi manusia kebanyakan hanya dijadikan mata kuliah pilihan. Kecuali di UIN Jakarta, baru-baru ini mata kuliah terkait gender menjadi mata kuliah wajib. Selanjutnya, integrasi pembahasan gender ke dalam mata kuliah umum tidak lah mudah. Tantangan paling besar yang dihadapi adalah norma, nilai dan ideologi terdahulu yang dimiliki oleh dosen dan mahasiswa. Hal tersebut menjadikan pengenalan terhadap isu gender menantang bagi pemikiran yang sudah mereka miliki. Data pada kajian ini berasal dari kurikulum, wawancara dengan tokoh-tokoh kunci pada dua fakultas dan Focus Group Discussion dengan mahasiswa dari dua institusi.
