Abstract

This study aims to estimate how the asymmetry of the agreement between the UK and Indonesia post-Brexit. A literature review on international trade agreements was carried out by tracing agreement data stored in the database of the Indonesian Ministry of Foreign Affairs in the 2010-2019 period. The result is that there is only one trade agreement between Indonesia and the UK, which is related to the Fourth Stage Multi-stakeholder Forestry Program (4th-MFP) project. In the same period, Indonesia also participated in a trade agreement with the European Union called the Voluntary Partnership Agreement - Forest Law Enforcement Governance and Trade (VPA-FLEGT). The VPA-FLEGT is asymmetric in favor of the European Union while the MFP is asymmetric in favor of Indonesia. After analyzing the two agreements, it was found that the tendency is that the UK will continue to encourage asymmetry due to its strict environmental laws and large demand for timber. The asymmetry will encourage Indonesia to continue supplying Britain with timber from legal sources post-Brexit.

Abstract

Asteroid mining is a proposed solution for mining elements that are commonly obtained from conventional mining as we know it today. However, until now there are no Indonesian laws and regulations, nor international agreements that directly regulate what rights miners of space resources will have. Without certainty about what property rights exist in extracted resources, the incentives to extract these resources will be greatly reduced. The research method in this journal uses a statutory approach, examining the statutory regulations concerned with the legal issues raised, and a conceptual approach, namely an approach based on legal concepts related to the legal issues at issue. Based on the facts found, it can be concluded that the concept of property rights exists and is recognized in the space law regime, even in the absence of territorial rights over celestial bodies, although its application to resource extraction remains a contentious issue.

Abstract

This article discusses the efforts of the Australian Human Rights Commission (AHRC) to reduce cases of racial discrimination in Australia 2015-2018. The AHRC's efforts are defined in five rules and procedures for resolving complaints of racial discrimination. Among them are socialization or early warning, complaints and investigations, compliance, continuation of legal action, and public hearings. The moment Australia ratified the United Nations Human Rights Commission (UNHRC) rules, namely the CERD rules on the International Convention on the Elimination of All Forms of Racial Discrimination which sparked the 1975 Racial Discrimination Act that could form the formation of the AHRC in 1986. In principle UNHRC is an organization known as the regime adopted in Australia in the form of the AHRC. This journal aims to discuss, describe, and find out the efforts of the Australian Commission on Human Rights in reducing cases of racial discrimination in Australia 2015-2018. Describes the rules and procedures for resolving racial discrimination complaints received by the AHRC through the five stages of resolution. After that it analyzes whether the five rules and procedures applied by the AHRC are implemented optimally to reduce cases of racial discrimination that occurred in Australia in 2015-2018.

Abstract

Poverty and economic growth are important indicators of a country’s development success. To achieve development, countries strive to optimize economic growth and reduce poverty. The purpose of this study was to determine the impact of population and unemployment on poverty and economic growth in South Sulawesi. Data from South Sulawesi Central Bureau of Statistics. This study utilizes a quantitative survey using the path analysis method. The results of this study show that demographic variables have a negative and significant impact on poverty. The unemployment rate variable has no significant positive impact on poverty. Variables such as population, unemployment and poverty have a negative and significant impact on economic growth. At the same time, population and unemployment have a large impact on poverty. At the same time, population, unemployment and poverty have a significant impact on economic growth.

Abstract

The meaning of the criminal policy of witchcraft is a formal offense. Witchcraft as a formal delict does not necessarily mean the death of someone who has been bewitched as a result, but the relationship between the witchcraft and the person who hired her. That relationship will be seen as a criminal act of conspiracy. Witchcraft offenses aim to prevent the emergence of new crimes in the form of fraud, extortion, or the emergence of victims as a result of people claiming to have supernatural powers. The delict of witchcraft is also intended to prevent the practice of taking the law into their own hands by members of the public against someone who claims to have supernatural powers and is capable of committing acts that can cause suffering to other people. Efforts to criminalize acts of witchcraft aim to increase the sense of security and justice for the community in relation to realizing the ideals of the nation as part of national development, so that it requires law enforcement and a legal culture. Abstract

The existence of law aims to provide security and order and guarantee the existence of welfare that is obtained by the community from the State as the umbrella of society. Rules of law in addition to human interests against the dangers that threaten them, also regulate the relationship between humans. A society that is developing rapidly within the state is influenced by the changing times, so that needs must be met according to the times. For this reason, contextual law is needed in the sense that it can accommodate social practices in society by being regulated by legal norms. Legal teachings that can be applied in order to create a correlation between law and society, namely social laws that are stronger and more advanced than teachings created by individual law. Abstract

The emergence of the liberation movement for the residents of the Surat-Ijo land is a form of response to the phenomenon of injustice that has surrounded and shackled some of the people of the city of Surabaya which has been going on for a long time. The emergence of the liberation movement was encouraged and facilitated by a situation that upheld the spirit of openness and freedom of expression, namely the spirit of reform that arose in the post-New Order era. One (of the many) factors that gave rise to the liberation movement for the residents of Surat-Ijo land is the difference in understanding of the applicable laws and regulations, especially the regional land laws and regulations. This difference in views has led to different perceptions between the two parties regarding the status of state land rights that are occupied by residents. The form of conflict resolution regarding the Surat-Ijo land can occur when there is a unified understanding between the residents of the Surat-Ijo land and the City Government of Surabaya regarding land laws and regulations, both national and local. Efforts to resolve the conflict require a bold breakthrough, not just to be handled legally which only involves the two parties to the dispute, but requires the involvement of at least three ministries, namely the Ministry of Home Affairs, the Ministry of Agrarian Affairs and Spatial Planning, and the Ministry of Finance. The settlement of the Surat-Ijo land conflict must be encouraged by the spirit of upholding justice and prosperity for all Indonesian people as the goal of the proclaimed Unitary State of the Republic of Indonesia (NKRI) in 1945.

Abstract

This study analyzes the influence of Accounting Information Systems, Application of Accounting Standards, and Competence of Human Resources on the quality of the financial reports of the Government of South Buton Regency. In addition, this study also explores the moderating role of the Internal Control System on the relationship between these factors and the quality of financial reports. Data is collected through a survey of respondents who are involved in the process of accounting and financial reporting. The results of the analysis show that these three factors have a significant and positive influence on the quality of financial reports. In addition, the findings also reveal that the Internal Control System has an important role as a moderating factor that can strengthen the positive relationship between these factors and the quality of financial reports. This study provides a holistic view of the factors that influence the quality of financial reports in local government and highlights the importance of information management, application of accounting standards, human resource development, and the role of the internal control system in ensuring the accuracy, relevance and integrity of financial reports.
