Abstract

This research was encouraged because I wanted to know the history of Islamic law in Iran, with a focus on studying the idea of ​​reforming the figure of Ayatullah Khomeini within the framework of the history of Islamic law in Iran. The development of Islamic law that occurred in Iran which was influenced by Ayatollah Khomeini could give encouragement to Islamic political thought throughout the world. The purpose of this study is to find out the history of Islamic law in Iran by examining how the idea of ​​renewing Ayatollah Khomeini leads the country of Iran with its clergy. This research is historical research (historical) with the method of collecting and disclosing the historical reality that occurred. in studying history, this research was carried out in a library research manner. Historical research, namely historical data is a source in the process of interpreting symptoms or ideas that arose in the past. The findings in this study, The culmination of major changes in the history of Islamic law in Iran occurred during the period after the great revolution in the collapse of the ruling regime named Muhammad Reza Pahlevi in ​​1979. The idea of ​​reforming Ayatullah Khomaeni, known by the al-Faqih area as the supreme power in the hands of a scholars who are pious, fair, capable of leading and approved by the majority of the people. The first wali al-faqih was the late Ayatullah Khomeini (1979-1989). Subsequently held by Ayatollah Ali Khomeeni. However, a Wali al-Faqih does not sit on the executive board, but rather acts as a guide or controller. For the executive branch, the supreme power is in the hands of the president who is directly elected by the people.

Abstract

In studying the history of Islamic economic thought in particular and the history of Islamic thought in general, it is necessary to straighten back and convey a historical fact of emergence, development, and policy. To deepen the study of the history of modern Islamic economic thought, it must also examine the previous economic figures. It is their economic thinking that has contributed to the current scientific repertoire of Islamic economics. One of the earliest economic figures who was brilliant in his time was Abu Yusuf who was famous for his book Kharaj during the time of Caliph Harun al-Rashid. This paper discusses the thoughts of Abu Yusuf, who was very concentrated on efforts to realize the welfare of the people. This paper starts from Abu Yusuf's biography, his works, then discusses thoughts on Islamic economics at the time of Abu Yusuf. The type of research used is descriptive qualitative literature research. The result of this research is Abu Yusuf has the full name Ya'qub bin Ibrahim bin Habib Khunais Bin Sa'ad al-Anshari al-Jalbi al-Kufi al-Baghdadi. During his lifetime Abu Yusuf had many works, such as kitab al-atsar, kitab Ikhtilaf Abi Hanifah wa Ibn Abi Laila, kitab ar-radd 'ala siyar al-auza'I, and kitab al-kharaj. Of some of his works, the most famous is the book of al-kharaj. Abu Yusuf's thought is in the form of state economic thought, which explores fiscal policy, which deals with state revenue. This can be seen from the content of his thoughts that map the mechanism of state revenue, expenditure detailed in Incidental Income, Permanent Income and several aspects that are closely related to government policy.

Abstract

This research is motivated by the practice of rubber plantation musaqah using a profit sharing system between both parties. This practice is in Lubuk Dagang Village, Sambas District. With the practice of rubber plantation musaqah which is based on the absence of a written agreement in Islamic law, it makes it easier for one of the parties to default on the agreement. This research method uses a type of qualitative research that is field research. Meanwhile, this research uses an empirical approach method, because it is qualitative research with an empirical approach that examines law which is conceptualized as real behavior in society to describe the conditions seen in the field, namely in Lubuk Dagang Village, Sambas District, in the practice of musaqah. To obtain data, researchers used interview and observation guidelines. Based on the research results obtained by researchers, it can be concluded that. 1) the practice of rubber plantation musaqah in Lubuk Dagang Village, Sambas District is carried out on the basis of mutual assistance carried out by both parties with mutual trust without any time limit set by the rubber plantation owner for the cultivator to work on it. Profit sharing that was agreed upon at the beginning of the agreement 4:6 and 3:7. 2) According to the Review of Islamic Law in the practice of rubber plantation musaqah in Lubuk Dagang Village, the time limit that is not determined by the rubber plantation owner is not in accordance with Islamic law and the terms of the musaqah contract.

Abstract

The government's procurement of goods and services entails inherent rights and responsibilities for all parties involved, including government entities, individual contractors, and organizations. Within the Department of Public Works and Spatial Planning in Sambas, delays in contract execution are a common occurrence, leading to the imposition of penalties on contractors. In Islamic jurisprudence, it is emphasized that lease agreements should explicitly specify both the duration and compensation at the outset of the contract, rather than after work has commenced. Deviations from these contractual terms are considered religiously impermissible. This research has two primary objectives: (1) to investigate the application of penalties for contract delays within the Department of Public Works and Spatial Planning in Sambas, and (2) to assess the conformity of these penalties with Islamic law. This study adopts a field research approach and employs a descriptive analytical method for data analysis. The study findings indicate that (1) the Department of Public Works and Spatial Planning in Sambas conducts thorough investigations, assessments, and surveys before imposing penalties for delays, in compliance with regulations outlined in Presidential Regulation No. 16 of 2018, Article 79, paragraph (4); (2) The penalties for contract delays do not entirely align with Islamic law, primarily due to disparities between the agreed-upon timeframe and the actual execution, potentially rendering contracts invalid in the context of construction service agreements and Ijaratul a’mal.

Abstract

The research results show that; Firstly, children prefer playing on the internet on YouTube compared to playing outside with their friends, because parents provide mobile phone facilities and freedom to children from a young age, so that parents can easily do their work without being disturbed, children are addicted to playing on mobile phones (playing YouTube ), and content on YouTube that attracts children's attention. Second, the role of complete parents and the role of single parents in providing religious education to children. There is not much difference between the role of a complete parent and the role of a single parent because in this study the researchers found that the role given by parents to children is to provide an example of good behavior, provide an example of worship, force children to worship so that they get used to it even though they are forced to do so. . There were not many differences that researchers found in this study, because basically parents have the same role between complete parents and single parents in providing education to their children

Abstract

This thesis discusses Teacher Strategies in Shaping the Disciplinary Character of Class V Students at MIS Bina Dharma Parit Rabu. This research has three research objectives including the following: First, to find out how the teacher's strategy in shaping the disciplinary character of grade V students at MIS Bina Dharma Parit Rabu Teluk Keramat District. Second, to find out how the disciplinary character of grade V students at MIS Bina Dharma Parit Rabu Teluk Keramat District. Third, to find out what are the supporting and inhibiting factors in shaping the disciplinary character of grade V students at MIS Bina Dharma Parit Rabu, Teluk Keramat District. This research uses a qualitative approach while this type of research is phenomenological research. There are three types of data collection techniques in this study, namely: Interview, Observation and Documentation. While data analysis techniques used data collection, data reduction, data display, conclusion drawing and verification. Then the data validity checking techniques used are triangulation (source triangulation) and member check. The results of the study are: First, the teacher's strategy in shaping the disciplinary character of students at MIS Bina Dharma Parit Rabu Teluk Keramat District for the 2022-2023 academic year uses several strategies, namely habituation strategies, exemplary strategies, supervision strategies, and punishment strategies. Second, the disciplinary character of grade V students at MIS Bina Dharma Parit Rabu Teluk Keramat District for the 2022-2023 academic year consists of several types of disciplines, namely self-discipline, social discipline, and national discipline. Third, supporting and inhibiting factors in shaping the disciplinary character of grade V students at MIS Bina Dharma Parit Rabu Teluk Keramat District for the 2022-2023 academic year are changes that arise Produce or cause a change or growth, maintain a close relationship between teachers and students, and there is good communication between parents, student teachers and the community environment and the example of teachers, parents and society.
