The subject covers various perspectives of Islamic economics, legal drafting and Islamic family law, Islam and humanitarian discourse, including conceptual thoughts, research reports, case reports, application of theory, critical studies and literature reviews. Authors who want to submit their manuscript to the editorial office of the Journal of Economics, Law, and Humanities should obey the writing guidelines. If the manuscript submitted is not appropriate with the guidelines or written in a different format, the editors will reject it before further review. The editors will only accept the manuscripts which meet the assigned form. The journal is published regularly twice a year, May and November.

Abstract

This field research with a qualitative approach through subjective assessment of the opinion of these scholars aims to determine the community's understanding of underage marriage, the reality of family couples who carry out underage marriages, and the household conditions of underage marriage actors in three villages located in Slahung District, Ponorogo Regency. Data collection methods use in-depth interviews, observation, documentation, and analysis with Creswell's theory. The results of the study show that: 1) Public understanding regarding underage marriage is still lacking due to the low level of education; 2) The reality of family couples who, after an underage marriage, do not have a job, still depend on their family (father and mother) for the economy of their new family; 3) The condition of the household of the underage marriage actor is still fine, it will be more clearly seen in the next 3 (three) or 5 (five) years so that it will be known that the condition of the underage married couple's household can run harmoniously according to with the goal of marriage or even end in divorce.

Abstract

The current potential of cash waqf can be a solution to education problems in Indonesia. with the collection of cash waqf it can provide new hope for people who are unable to take education up to college. The purpose of this research is to look at the factors that influence the perception of waqf of cash waqf, especially in Jember Regency. This research uses descriptive quantitative research methods with logistic regression analysis tools, the intended factors include four variables namely education, understanding of waqf, religiosty, and access to media and information. Based on the results of the reasearch conducted, it found that two variables affect the perception of wakif on cash waqf. The variables that have an effect are the level of understanding of waqf and the religiosity with that significance are 0,035 and 0,023. While the variables of education adn access to media and information get the significance effect get the result 0,367 and 0.948.

Abstract

The position of a woman in marriage must obtain the approval of a guardian, namely her father or half-father. This research results from library research using descriptive analysis method and utilizing Khoiruddin Nasution's Holistic Thematic legal istinbath method. The purpose of this study is to analyze how the law of women as guardians of marriage according to Khoiruddin Nasution, what is the method of legal istinbath regarding women as guardians of marriage according to Khoiruddin Nasution, how is the relevance of thinking about women as guardians of marriage according to Khoiruddin Nasution in Indonesia. The results of this study indicate that women can become guardians. This opinion is based on the verses of the Qur'an and Hadith, which are the concepts of the rights of guardians of marriage and the rights of those close to the prospective bride and groom. Then the guardian of marriage can be male or female. Second, Khoiruddin uses the epistemological foundation of bilateral society by using a holistic thematic approach based on the bilateral paradigm and using developed sociological analysis. Third, following the development of the modern era, which is synonymous with advances in knowledge and technology that open up opportunities for women to play a role in the domestic and public sectors, Khoiruddin's thoughts about women as marriage guardians can be an alternative in the context of developing guardianship in Islamic law for this modern era.

Abstract

This research is motivated by the significant turnover obtained from the leading distributors and agents through digital marketing strategies. SR12 (Skin Relieve 12) Herbal Skincare only in Ponorogo. This study uses field research using a qualitative approach, with data collection techniques through observation and interviews. This writing aims to find out how to apply Islamic digital marketing strategies in increasing sales of SR12 Herbal Skincare products, how the results of implementing Islamic SR12 Herbal Skincare Islamic digital marketing strategies, and analysis of inhibiting and supporting factors of SR12 Herbal Skincare Islamic digital marketing strategies. The results showed the application of the Islamic digital marketing strategy SR12 Herbal Skincare in increasing their sales using digital social. While the development of implementing this Islamic digital marketing strategy is that SR12 Herbal Skincare is carried out with a design that includes segmenting, targeting, and positioning (STP). In carrying out the process, the company covers a wide range, while the inhibiting factors include using digital social media, each of which has obstacles.

Abstract

Jurisprudence prioritizes the right of divorce to be held by the husband. The purpose of this qualitative research with a literature study approach is to describe and analyze: 1) the concept of divorce, which can cause the breakup of marriage relations according to Wahbah Az-Zuhaili, Muhammad Jawad Mughniyah, and the Compilation of Islamic Law, and 2) what is the legal term used by Wahbah Az-Zuhaili, Muhammad Jawad Mughniyah, and the Compilation of Islamic Law (KHI) in determining divorce. The results of this study indicate whether the husband intends to become the legal ruler or not to divorce and prohibit divorce without any cause. The difference lies in the editorial divorce used and the witness in the divorce. As for instituting the law of Wahbah Az-Zuhaili, Muhammad Jawad Mughniyah both used the Al-Qur'an, Sunnah, and ijmak. The difference lies in the way of understanding sunnah and ijmak. Jawad does not use kiyas in determining the law but uses reason so that the relevance of the divorce provisions of the two figures, namely Wahbah Az-Zuhaili, Muhammad Jawad, and KHI, in determining the divorce issue lies in the procedure for its implementation. According to the two figures, divorce does not need to be done in front of the courtroom wherever the divorce is pronounced, so divorce falls at that moment because divorce is the husband's right. However, in Indonesia, divorce must be carried out before a court hearing because the husband cannot guarantee his right to divorce. Also, the wife gets protection and legal certainty.

Abstract

The successor heirs mentioned in Article 185 of the Compilation of Islamic Law (KHI) Inspres number 1 of 1991 result from the ijtihad of Indonesian mujtahids. From the Compilation of Islamic Law, the existence of grandchildren is recognized. He is a substitute for his parents, who have died first from the heir and legal protection for grandchildren as heirs and acknowledges the position of a substitute heir. As happened in the community in Slahung District, in practice, if a child dies first, then a parent, then the inheritance will be given to his grandson. This research is interesting because the local community does not know the terms related to the replacement heir. The people of the Slahung sub-district named it Turun Waris. The purpose of this research will produce findings to see how the people's thinking and practice of successor heirs in Slahung District with the theory of social construction perspective of Peter Berger and Luckman, which is methodically classified as research with data collected by in-depth interviews, observations and documentation using an externalization process, objectivation, and internalization.

Abstract

Cash On Delivery is a payment method provided to customers by online marketplace companies. However, various problems arose with continued shopping promotions with the Cash On Delivery payment method. The research was conducted using a descriptive method with a qualitative approach based on data sources from literature and observation. This study aims to provide an overview of the risks regarding the Cash On Delivery payment method from the point of view of online sellers and to analyze Shopee's policy on handling the risks associated with the Cash On Delivery payment method. The results showed that the factors behind unilateral cancellation of transactions using Cash On Delivery payments were caused by the buyer changing his mind, the buyer not having the money to pay, the buyer accidentally ordering or clicking checkout, the buyer could not be contacted (no response), and the order was not fit/damaged. The risks faced by sellers from this method are loss of human resources, risk of financial loss, loss of time, and risk of decreased store performance. Shopee has implemented several policies to minimize risk, but Shopee must improve the pay on the Delivery feature. Given that the unilateral cancellation of the customer is very detrimental to the seller.

Abstract

The concern in this study is about the judges' decisions, with 96% of decisions that legalize marriage dispensation applications. This fact contradicts the spirit of Supreme Court Regulation Number 5 of 2019, which seeks to minimize the number of underage marriages. Some of these problems become the researchers' anxiety in finding out about several things, including; 1) The paradigm of Ponorogo Religious Court Judges in handling marriage dispensation cases, 2) the effectiveness of the implementation of Supreme Court Regulation Number 5 of 2019 by Ponorogo Religious Court Judges in the case of marriage dispensation.

Abstract

I In Indonesia, there are many cigarette consumers, and entrepreneurs, especially those engaged in cigarette products. The large number of cigarette consumers is a business opportunity that has the potential to continue to grow. This can be seen from the increasing number of new cigarette brands launched in the market and supported by many people who smoke. The desire to consume Cigarettes, Healthy Medicine, and be Peaceful, can be influenced by various factors, such as culture. In this case, it is more cultural; social factors it is more to the group. The personal aspect is more to the lifestyle; psychological factors tend to motivation and belief. This study aims to analyze some of these factors on consumer behavior, which in this case is the consumer of Healthy Medicine Cigarettes Tentrem. This research was conducted in Ponorogo Regency. The research subjects are consumers of Healthy Medicine Cigarettes Tentrem. This study uses several consumer respondents of Healthy Medicine Cigarettes Tentrem as samples. The study used data obtained from interviews. The data obtained will then be analyzed between theory and data in the field. The study results show that these factors influence consumer consumption of Tentrem Healthy Medicine Cigarettes.

Abstract

This field of qualitative research aims to examine global Islamic online marketing strategies on Shopee. This study used data mining methods for examination, classification, verification, analysis, and conclusion. The research found that Shopee's strike price system for online selling and buying follows the Islamic business ethics axiom of unity ethics and free will. Marketing does not discriminate, and he has tried to boost sales as a businessman. Sellers play a drastic price game by raising the price before the strike price. That can hurt other markets and consumers. Online marketing using a promotional system to buy and sell on Shopee Marketplace does not violate the ethical principles of unity and free will. The promotion is not coercive because it applies to all consumers. It has reduced losses on its Shopee Marketplace products. Balance, accountability, and truth are incompatible with Islamic business ethics because this marketing relies on positive testimonials from consumers or delivery couriers. The Shopee marketplace's quality system of goods conforms to the ethical hypothesis of unity and free will because sellers use some goods for bonus systems or strike prices to reduce losses for all consumers such as violates balance, accountability, and truth because the product is nearly expired and doesn't match the promotion's description.
