Abstract

With the existence of the principle of monogamy adhered to by Law Number 1 of 1974 concerning Marriage, polygamy in Indonesia is only permitted during an emergency and if the requirements stipulated by the Law are fulfilled. However, the practice of polygamy that occurs in society is much wider and more diverse, including in the Cirebon Religious Court. One of them is case Number 910/Pdt.G/2019/PA.CN. The Petitioner was granted by the Religious Court to practice polygamy, even though the Respondent (first wife) was still able to carry out her obligations properly, had no disease or disability, and was able to give birth to offspring. According to Law Number 1 of 1974 concerning Marriage, the application must be rejected. The research method used in this study is qualitative with a descriptive-analytical approach. This research uses a type of normative legal research, namely doctrinal legal research or library research because this research is only aimed at written regulations. The results of the study show that the judge considers social justice with the consent of the first wife to be a legal consideration in granting the application for a polygamy permit as an effort to protect women's rights and in terms of civil order the Panel of Judges guarantees heirs and certainty of joint assets to save the rights of the first wife. The judge decided on a polygamy permit Number 910/Pdt.G/2019/PA.CN. granted through his suspicions and beliefs when exploring a case that was preceded by proof. By considering the benefits and harms that will arise from this polygamy and referring to the consent of the first wife, the application for a polygamy permit is appropriate to be granted even though the facultative conditions are not met in case Number 910/Pdt.G/2019/PA.CN.

Abstract

The implementation of the provision of legal aid to the underprivileged at the Legal Aid Institute (LBH) plays a very important role in providing legal assistance to underprivileged people who are seeking justice. To obtain legal assistance, submit a written application containing the identity of the applicant (KK or KTP), attach an SKTM (certificate of incapacity) and briefly describe the case, submit case documents, and survey the location of the house. The duties and powers of the Legal Aid Institute (LBH) provide legal assistance through litigation and non-litigation to people who can't afford it. The inhibiting factors in providing legal aid are that not all people know about legal aid institutions and lack of legal education. The view of Islamic law on the provision of legal aid to the poor in the Legal Aid Institute (LBH) has become an order from Allah SWT in upholding Islamic law with the principles of justice, equality, and mutual assistance, that is, everyone has the right to their rights and everyone has the same position before the law. Implementation of the provision of legal aid to people who cannot afford it is the application of the principle of mutual help in terms of kindness and piety. This act is a worship relationship between fellow beings to benefit the people.

Abstract

The divorce rate in indonesia continues to increase. One 0f the reasons is the lack of readiness of the husband and/or wife for marriage. Marriages that are carried out at a very early age result in a lack of readiness of the bride and groom to get married. The stipulation of the marriage age limit which was originally 19 years for men and 16 years for women was changed to 19 years for men and women in law number 16 of 2019. However, early marriages are still common in indonesia, so the divorce rate is still quite high. Then the question arises that whether the regulation of changing the age limit for marriage can change the value of marriage in indonesia for the better or is it just a meaningless regulation. But of course, a regulation is made to improve the existing situation and benefit the community. This study aims to find out what the purpose of law no. 16 of 2019 is by examining it with the value of maq?sid ash-syar?'ah. This study uses qualitative research methods, and the data collected comes from a literature review which was analyzed by descriptive analysis method. The results of this study are that the renewal of the marriage age limit in law number 16 of 2019 is in line with the values in maq?sid ash-syar?'ah namely hif? ad-d?n, hif? an-nafs, hif? al-aql, hif? an-nasal, and hif? al-m?l. Marriage at a more mature age will improve the quality of religion in the family, protect the physical and psychological health of family members, strengthen the family foundation in dealing with household problems, form quality offspring, and maintain family finances
