Abstract

Abstract: Studying the problems of women in various fields, especially marriage, always faces its own challenges. The lack of wife's rights in marriage gets some contradictions from a gender perspective. Did not rule out the possibility of connection with the wife's right to refuse reconciliation. This paper synergizes Islamic and gender perspectives on the issue of wife's right to refuse reconciliation. Efforts are being made to identify the shifts related to the classical fiqh formulation into a more egalitarian formulation according to the guidance of modern times. In addition, the next effort is to identify a new business of reasoning from the abstract domain to concrete rules. There are two steps that can be done, namely by analyzing the problem using the theory of equality and gender justice and the theory of maslahah from the perspective of several competent figures in their fields. From this, this paper confirms the similarity of perception between the aims of Islamic teachings (maqasid ash-shari’ah) and gender equality and human rights, that is the right for anyone to consider everything that will be done as long as it brings benefit.

Abstract

This study illustrates the paradigm of students at the Islamic boarding school Darussalam towards the target age of marriage. It is interesting to study when the target age is significantly analyzed in the perspective of female students. This is because, in general, marriages that occur among female students are known as arranged marriages. However, this paper explores the opinions of each female santri in determining the ideal marriage age limit for their perspective. Previously, it was reviewed in advance regarding the age regulation of maturity according to classical fiqh and the rules of legislation, in this case Law No. 1 of 1974 and compilation of Islamic Law (KHI). The final analysis is to analyze the results of a survey of about 30 female students of the Darussalam boarding school. Then proceed with classifying the age of marriage in four classifications, namely the age of marriage in an ideal level, sufficient, alert, and alert. The findings of this paper provide a clear picture that women's rights in determining the age of marriage are strongly influenced by their physical and mental maturity. Therefore, indirectly invalidated at least the age of 16 years for women regulated in the Act does not pay attention to the wishes of women themselves.

Abstract

The issue of the position of women is a matter that invites much debate among feminists and observers of gender equality. Different perspectives and paradigms of thinking lead to differences of opinion in resolving these problems. This paper examines the position of women in the Islamic marriage system by reflecting it on the marriage system in the pre-Islamic era through a historical approach to understanding the position of women in the marriage environment. History shows that the position of women in marriage in pre-Islamic times has an unfavorable position. This is due to the division of roles according to their respective gender, where in the end it creates inequality in social life. In Arabian society, men are tasked with defending and maintaining all family members, responsible for meeting all the needs of family members. Consequently men monopolize leadership at all levels. Patriarchal culture dominates, so marriage becomes more synonymous with a contract of sale where women are considered to be nothing more than an object being sold. In addition, the killing of female infants is a custom in Arab society and women who are caught in war are usually made into concubines. Islam came by renewing the Arab community’s marriage system. Various innovations introduced by the Koran to improve the dignity of women at that time were only the initial stages, which were in accordance with the patrilineal context. Therefore, patrilineal at that time was a situation which had to be consolidated by Islam, and not institutionalized. An understanding of the pre-Islamic marriage system is important in order to be able to see clearly how the position of women in the Islamic marriage system is actually far more advanced than before.
