Abstract

In line with the current development of the criminal offense, it is necessary to the development of the criminal justice system (SPP) with the involvement of other key components of the criminal justice system, namely DCIS component i i, ang carry out the functions of protection of witnesses and / or victims of crime. criminal By involving the intended protection function, the criminal justice system is no longer just oriented to the suspect / defendant but also oriented to witnesses and victims of crime. This will have implications for the development and strengthening of the criminal justice system into the criminal justice system is perfect, the criminal justice system a good, balanced and fair. So that in the future does not happen again the phenomenon of witnesses and / or victims with threats, pressure or occur engineering evidence statements of witnesses, even a waiver of the rights of witnesses and / or victims. Although now the presence of the Agency has given guarantees and assurances for the protection of witnesses and / or victims of crime, but the position of the Agency as a component of the criminal justice system has not been expressly recognized in the law of criminal procedure. Therefore it is very important to analyze the position of the Agency in the criminal justice system in Indonesia, namely by reviewing the Agency's role in the criminal justice system, and the concept of the position of the Agency as the state agencies in the criminal justice system in Indonesia. Abstract

In reality, development that does not pay attention to spatial planning causes problems, namely the use of space with unclear needs and designation, so that it creates problems related to the chaos of urban planning, prolonged disasters, also raises population problems, this is as a result of development permits issued which violate many spatial regulation, so that the development carried out is not in accordance with the function of spatial planning, whereas in the spatial regulation there are heavy sanctions for perpetrators of spatial violations, but in reality the sanctions imposed do not provide a deterrent effect for the perpetrators and also do not benefit a recovery of spatial functions. In response to this, this article aims to provide recommendations in the application of sanctions that have been regulated in the Spatial Planning Law. This article in its preparation used the normative juridical method, with a multidisciplinary approach, covering spatial law, state administrative law and criminal law and was analyzed in a qualitative juridical manner. With this recommendation, it is expected to provide spatial law reform in Indonesia, especially in collaborating sanctions regulated in the Spatial Planning Act for both private individuals and corporations, as well as for spatial licensing officials, in an effort to achieve legal certainty and legal protection Keywords: Strategy, Sanctions, Violations, Spatial Planning.

Abstract

It was undoubtedly  that  in  the modern state, Election is the entry point for the establishment of a democratic government. Within this framework , the principle of sovereignty has become the spirit for election in every move. The implementation of direct elections, public, free, confidential, honest and fair, is not an easy job. As it is mandated by the constitution , which is in essence a public policy in the fields of politics and governance, it is clear that the implementation will be influenced by various factors. One of the factor is organizing institution, thus it is must be carefully study by each of  election management official at various levels. Among the several types of elections that had been held, it appears that the election of Regent is the most interesting to observe. This is partly due to socio-political and socio-cultural setting that surrounded the multi-complex so that the potential for conflict in its even will be far greater than with other types of elections. Level of community participation in the elections, especially on polling and counting activities have become attention of many people. In some provinces, cities and districts that have conducted the election, it appears that the participation rate has decreased from one election to another. Because of the matter above, the writer is  interested  to write about  how to Optimize the Role of Institutional Commission in order to increased participation  of  community in the election.Keyword : Optimize; increased participation of community; the electionABSTRAKMerupakan suatu keniscayaan bahwa dalam negara modern, pemilu merupakan entry point bagi terbangunnya suatu pemerintahan yang demokratis. Dalam kerangka ini, prinsip kedaulatan rakyat menjadi roh bagi setiap gerak langkah penyelenggaraan pemilu. Terselenggaranya pemilu yang langsung, umum, bebas, rahasia, jujur dan adil, bukanlah pekerjaan yang mudah. Sebagai amanat konstitusi, yang pada hakikatnya merupakan kebijakan publik di bidang politik dan pemerintahan, sangat jelas bahwa implementasinya akan dipengaruhi oleh berbagai faktor. Salah satu faktor itu adalah institusi penyelenggara, sehingga dengan demikian hal inilah yang harus jadi kajian cermat dari setiap aparatur institusi penyelenggara pemilu pada berbagai level. Di antara beberapa jenis pemilu yang telah diselanggarakan, tampak bahwa pemilu Bupati dan Wakil Bupati  yang paling menarik untuk dicermati. Hal ini antara lain karena setting sosiopolitik dan sosiokultural yang melingkupinya yang multikompleks sehingga potensi konflik dalam penyelenggaraaannya akan jauh lebih besar dibandingkan dengan jenis pemilu lainnya. Tingkat partisipasi masyarakat dalam pemilu, khususnya pada kegiatan pemungutan dan perhitungan suara menjadi perhatian banyak kalangan. Di beberapa daerah provinsi, kota dan kabupaten yang telah melaksanakan pemilu, tampak bahwa tingkat partisipasi ini mengalami penurunan dari satu pemilu ke pemilu lainnya. Dengan itu penulis tertarik terhadap bagaimana Optimalisasi Peran Kelembagaan KPU dalam peningkatan partisipasi masyarakat dalam Pemilu.Kata kunci : Optimalisasi; Peningkatan Partisipasi Masyarakat; Pemilu

Abstract

The implementation of the opportunity principle is realized through the authority to waive criminal cases. In Indonesia, which is very limited and is the authority of the Attorney General for reasons of public interest. Public prosecutors are not authorized to waive the cases for certain reasons such as low crime rates, suspects too old / young, health conditions, compensation payments, and so on (vide the Dutch Criminal Procedure Code). This paper intends to analyse the practice of law enforcement that occurs on the limited authority given by the law to the public prosecutor. In addition, the author will also analyse the prospects of the regulation of public prosecutors authority in criminal cases waiver for certain reasons in the Criminal Procedure Code. The results show: 1) limited authority bring forth judicial processes that are not in accordance with the principle of due process of law. Small cases remain in court, because the public prosecutor does not have the authority to waive the criminal cases for certain reasons. In addition, the limited authority raises the paradigm that the current criminal policy tends to prioritize the means of punishment to eradicate crime which resulted in the occurrence of overcrowded prison. 2) RUU KUHAP regulates the authority to waive cases for certain reasons in article 43 paragraph (2) (3) (4) (5). The regulation is expected to create a criminal justice process according to the principle of due process of law. Public prosecutors are expected to be more thoughtful in prosecuting or not prosecuting someone based on human rights ​​and justice. The regulation is intended so that the public prosecutor can be the real controller in criminal cases handling as mandated by the universal principle of dominus litis. Abstract

The debate about the whereabouts of individuals as the subject of international law over time seems to get an answer. This is because after the first and second world wars, the international community's attention to human rights is increasing. The desire to bring the responsible perpetrators into account before the criminal court is increasing. Efforts to eliminate immunity against perpetrators for crimes committed encourage the establishment of international criminal tribunals ranging from the ad hoc nature to the permanent criminal court. Encouraging individuals as the holders of rights and obligations in international criminal law is getting stronger. It becomes more interesting because the individuals held accountable are citizens who actually have the sovereignty to enforce the law to their citizens. This paper will discuss the existence of individuals as subjects of international law and the effort to hold individuals accountable through international court mechanisms. Based on legal theory, legal principles, sources of international law and international treaties, the existence of individuals in international law can be seen from the granting of rights and obligations in international treaties. The Adhoc and Permanent International Criminal Court is established to demand the accountability of serious crimes against humanity. The existence of individuals as subjects of international law in the future will remain a polemic in its application. Keywords: Responsibility, Individual, International Criminal Law.

Abstract

Lately discovered a new phenomenon of corruption in Indonesia. Perpetrators of corruption consists of various groups who relatively young and regardless the gender. In this paper will discuss the students' perceptions of corruption in Indonesia. The scope of this study will be limited to one of the state universities in Indonesia, in this case in particular, Sriwijaya University law student. While the analysis used in the discussion of this paper is descriptive analysis. The method used in determining the sample is random sampling, with a set of approximately ten percent of the population. In the first part will discuss the position of corruption in Indonesia in the eyes of the world as well as regional level. Then, discuss the definition of perception and the factors that influence the perception and definition of corruption. The findings showed that almost all students understand what is meant by corruption, but the majority of their behavior consciously or unconsciously have contributed to the practice of corruption. Corruption is not due to inadequate salaries or boost the economy but the existing system opportunities corrupt behavior and the low morale of the nation in this respect among the younger generation who were respondents. It is very anxious about the future of the nation and the state. Keywords: perception; students; corruption.

Abstract

Violence refers to behavior deviation occurring in human relationship, whether individual or group, which is burdening, unpleasant and unfair. The effect of the violence should be physically, psychologically and spiritually painful. Woman in this case is mostly the victim of the domestic violence carried out by immediate relatives. Thus, legal protection has to be explicitly initiated that women who experience the domestic violence can be protected. There are some factors determined the legal protection, namely legal factors, legal upholder factors, legal facilities factors, community and cultural factors. Keywords: Violence, Protection, Women.

Abstract

It is such an irony that Indonesia, as one of the biggest archipelagic countries blessed with unique and vary geographical conditions along with great potential to develop high quality product combined with creativity, social and cultural factors, remains in struggle to formulate and develop local creativity and collectivity as the people’s economy pillars with significant benefits. In accordance with those facts, this research aimed to provide critical conceptual ideas for Geographical Indications utilization as the part of intellectual property rooted from locality but has been internationally accepted. The findings showed that Geographical Indication products posses utter potential to play the determinant role in creating trickle-down effect and bottom-up economic development instrument through the sharing of economic framework. Furthermore, digital disruption era offers an effective platform for product development and promotion in a collaborative space in generating income, creating job vacancy, poverty elevation, community empowerment and development. Abstract

The Indonesian archipelago has ratified the United Nations Convention on the Law of the Sea 1982 (UNCLOS 82) through Act No. 17 of 1985. As a result, Indonesia has established three archipelagic sea lanes, or ALKI (North - South), namely ALKI I, ALKI II and ALKI III, where ALKI II has a three-pronged Southern point III A, III B and III C. Indonesia should be able to control and secure the ALKIs by protecting the ALKI waters in the framework of sovereignty and law enforcement at sea.Because ofthe limited number and means to conduct sea patrols and air surveillance by Koarmabarin ALKI-I (Natuna Sea, Karimata Strait, the Java Sea and the Sunda Strait), there are strong indications of foreign vessels conducting intelligence operations, illegal surveying and other illegal activities. Given the variety of crimes that occurred in ALKI-I, there is therefore a need for an ideal security strategy in ALKI-I in order to ensure the sovereignty and laws of the sea there to the extent it is free from harassment and threats. This ideal security strategy ALKII is implemented through the “deployment” of naval forces permanently to exploit the potential of the central government and local governments, while “employment” is implemented by placing sea units at places where felony and misdemeanor are most likely to occur in order to enforce laws at sea.
