Abstract

This article aims to analyze genealogies of Muslim middle class in Indonesia. It can be traced from three primary sources such as bourgeoisies, pilgrimage trip (h}ajj) to Mecca and Medina, and education. These three sources have intertwined each other to build up Muslim middle class in social strata system that branch off in two model; bourguoises class and intellectual class. In this section, bourguoises tends to form trade alliance against Chinese domaniance and western traders who had been given privilieges from colonial regime. Meanwhile, intellectual class had focused to form ideal state for umat in Indonesia. Both classes are united altogether to form Islamic state as ultimate goals. High tension of political constellation in post colonial period had resulted in nationalist group as regulator class in Indonesia. Regarding political negotiation from nationalist, Indonesian Muslim middle class focused to establish Muslim society according to Medinan principles. Modern influence based on western style has affected Islamic values in grass roots level, and this resulted in the rise of modern Muslim society that embraced western style of life.

Abstract

This article seeks to reveal differences of religious attitudes between Muslim and Christian communities in North Sumatera and Frankfurt Am Main Germany. This article shows that the relation between Muslims and Christians can be understood to have taken place in two categories, positive and negative. Positive relation can be attested through integrating factors between the two religious communities, while negative relation can be attested through separating factors. In North Sumatera there exist local wisdoms which serve as adhesive factors of Muslim-Christian relation, such as the concept of ?marga? among Batakese society. Meanwhile, pig either as food or as pet is regarded as a dividing factor together with fanaticism and exclusivism. In Germany, as majority group the Christians are tolerant towards Muslims due to the rule of law in the country. This tolerance becomes an adhesive factor, while mutual suspicion among both Muslims and Christians is raeagrded as dividing factor.

Abstract

This article elaborates the phenomenon of fundamentalism and the future of Islamic political ideology. Islamic ideology represents religious views, ideas and movements which aspire to bring Islam into practice in state and societal affairs. One variant of Islamic ideologies is fundamentalism which endeavors to return religious practices back to the pristine Islam based on the Qur??n and al-Had?th. Fundamentalism rejects all modes of understand-ding which are not based on the Qur??n and al-Had?th, and refuses secular methodology in interpreting the Qur??n. This type of Islamic ideology found its momentum when Saudi Arabia regime officially adopted Wahhabism, and when Egyptian intellectuals were united to fight against modernity. Both Saudi Arabia and Egypt became seeding ground for fundamentalism. Some young muslim scholars who studied there became agents for the dissemination dan transmission of the fundamentalist ideology throughout the world. In Indonesia, this ideology have developed since independence and the drafting of the constitution. In the Indonesian context, resistence from traditionalist and nationalit groups were so strong that enable to dam up the spread of fundamentalis ideas. However, fundamentalist ideology remains an important challenge for the future of Indonesian Islam.

Abstract

This article deals with the educational ideas of Muhammadiyah and Nahdatul Ulama as representing the portrait of moderate Islamic education in Indonesia. The problems addressed includes whether both organizations have certain moderate ideas regarding education to seed their moderate character. Using actual philosophy approach, this study reveals that educational institutions of Muhammadiyah are characterized by a special subject matter called Al-Islam dan Kemuhammadiyahan. With the concept of objective identity of Muhammadiyah?s education, this subject matter is designed to be an instrument for Muhammadiyah to seed the moderate character of its students. Meanwhile, NU?s educational institutions are characterized by subject matter called Aswaja dan Ke-NU-an. Through the concept of SNP-Plus, this institution serves as an instrument for NU to seed the character of moderate Islam. Both organizations therefore share the same ideas to strengthen a moderate Islamic education in Indonesia on the basis of their own cultural traditions.

Abstract

This article deals with the Islamic legal thought of Abdullahi Ahmed an-Naim from the sociology of knowledge approach. According to this approach, knowledge (including religious interpretation and practices) is sociologically, economically and politically determined. This article aims to understand how an-Naim's Islamic legal thought is determined by his existence within social reality. This article concludes that an-Naim's thought is determined by (1) socio-political and legal reality in Sudan, (2) Mahmoud Mohamed Taha who influenced his ideas, (3) British milieu, and (4) American environment which is politically secular, Islamo-phobic, racist, discriminative and intolerant towards Afro-Americans. The maturity of an-Na?im?s thought is particularly influenced by the history of British colonialism in Sudan and his academic training in England, a place where human rights discourse develops as the result of post-enlightenment humanism and some major revolutions in Europe.

Abstract

This article discusses the concept of ijtihād (legal reasoning) and the typology of legal thought of Abd al-Ḥalīm Maḥmūd. According to Maḥmūd, ijtihad is devoting all abilities of a mujtahid to arrive at the essence and substance of a problem intended by the Prophet Muhammad. This definition is supported by the division of ijtihād into two: ijtihād istinbāṭī, the object of which is the texts of the Qur'ān or the Sunnah, and ijtihād taṭbīqī, the object of which is legal problems of the time. Mahmud maintains that a mujtahid should meet certain qualifications such as the abilities of understanding Arabic language, memorizing the Qur'ān, understanding asbāb al-nuzūl (causes of revelation), memorizing the Traditions of the Prophet related to legal matters, and the brilliance in making legal reasoning and conclusions. Maḥmūd belongs to moderate group that agrees with the formalization of private laws, while public laws in his view serve only as materials for national laws. Maḥmūd also gives an emphasis on the integration between naṣṣ (text) and maqāṣid al-sharī'ah (the objectives of law).

Abstract

This article seeks to discuss the economic empowerment of society through the optimalization of BMT?s function of intermediating and financing. Using a descriptive and qualitative approach, this article reveals that the success of economic empowerment should be supported by strategy, tactics and stepping. The program should also be implemented through segmentation and training of clients, providing human resources that understand the vision and mission of empowerment, optimizing BMT?s function of intermediating, and providing a coordinated tool of saving. Intermediation is conducted through developing economic potentials of Muslim community (ummah), improving the quality of human resources, mobilizing societal resources, bridging the relation between the rich and the poor and between the fund owners and users, coaching and balancing in terms of financial support.

Abstract

This study deals with dispute settlement between Bank Syarîah and its customers through the National Shari?ah Arbitration Board (BASYARNAS). It focuses to elaborate the procedures of dispute settlement between Bank Syarîah and its customers of financing from the perspective of Islamic law according to Bill No. 30/1999 above law No. 30 year 1999. Based on procedures as mentioned in the bill with regard to arbitration and alternative dispute resolution, Basyarnas, in proofing and resolving cases, has fulfilled the procedures and satisfied the conflicting parties with justice, so there is no need to appeal and reconsideration. This means that Basyarnas has conducted dispute resolution according to the existing procedures. The dispute settlement has also been in accordance with the Qur'an and other Islamic legal rules which consist of the principles of power and mandate applied by the arbitrator in deciding and resolving the dispute. The board?as an independent institution?has setttled the disputes on the basis of justice for all parties, rejected the act of bribery since the cost is measurable. In addition, Basyarnas also gives strong emphasis on the principle of equality, friendship, consistence and response-bility in resolving disputes.

Abstract

This article focuses on the meanings of had?th on waqf according to traditionalist and modern ulama in Gresik, East Java. The signification of Ḥadîth related to religious benefaction (waqf) certainly has various aspects in terms of the social and cultural contexts of the Prophetic traditions. Ḥadîth on waqf has been subject of different meanings reconstruction among Muslim jurists in contemporary context. According to tradisionalist ulama, waqf can be meant as sadaqah jâriyah. They maintain that waqf is turning over properties which have the value of benefit to administrators of waqf who are responsible to maintain the original form of properties. Meanwhile, modern ?ulama argue that waqf is turning over the ?existing? property either eternally or temporally to be used directly and its benefit can be taken continously for the sake of common good or public interest. Waqf is sadaqah jâriyah, the reward of which flows continously. The meaning of ?existing? is that the age of submitted property is determined by its economic value, or as it is written in the statement of waqf. Different meanings of waqf according to traditionalist and modern ?ulama are influenced by their educational backgrounds.

Abstract

This article deals with the viewpoint that the reading of the Qur'ân by a certain generation is subject to criticism by the following generation. The article seeks to offer, as an example, the deradicalization of interpreting the so-called ?radical? verses of the Qur'ân in Indonesian context. Islam in Indonesia always interact with various races, ethnicities, religions and beliefs, and therefore requires a type of exegesis different from other regions such as the Middle East. For the radicalization of interpretation, this article offers what is called the maqâṣid al-Qur'ân as its parameter. The maqaṣid al-Qur'ân consists of seven points: 1) Hifz al-dîn wa tatwîr wasâilih, 2) Hifz al-nafs wa tatwîruh?, 3) Hifz al-``aql wa tatwîruh, 4) Hifz al-mâl wa tanmîyat was?ilih, 5) Hifz al-ird wa tatwîr al-wasâil li al-husûl alayh, 6) Taḥqîq al-ḥuqûq al-insânîyah wa mâ yandarij tahtahû, 7) Hifz al-??lam wa ?im?ratuh?. As spirit and parameter, the maqâsid al-Qur'ân necessitates the dialectics of dynamic interpretation without any judgment of infidelity or heresy. If a certain reading of the Qurânic verses deviates from these seven maqâsid al-Qur'ân above, it deserves to be examined further, but not to be immediately suppressed.
