Abstract

It is an anomaly in the life of the Moluccas’ society that the majority of people who committed the criminal act of corruption are considered as religious people. Besides, they are categorized as diligent, obedient and even fanatic adherent of their religions. The act of corruption is an act not only against the law but also against moral and spiritual values. This article explores the role of religious institutions in spreading moral and spiritual values to prevent Molucca’s people from committing corruption. This article used a qualitative method of both: fieldwork and textual study. For fieldwork, in-depth interview and observation are used to gather data from the prisoners, officers, and workers at the prison (Lembaga Pemasyarakatan Klas IIa) in Ambon. All the data are presented using descriptive analysis. The research shows that the role, function, and accountability of religious institutions in the Moluccas are very weak in preventing and eradicating the criminal act of corruption among the prisoners and the police officers, prosecutors, judges, lawyers, and journalists who played along the criminal act of corruption. Those acts have violated their commitment to stand for justice for all people.

Abstract

Inter-religious dialogue is very important discourse in the context of many religions in Indonesia. Inter-religious dialogue is the efforts to solve the difficulty of a relationship among each other followers of religions in which some conflicts and strained situations often happened. This article is a theoretical study in the purpose to describe the matter of inter-religious dialogue and formulate the model of inter-religious dialogue for creating the tolerance, the harmony, the safeness, and the peace in the religious life. By using the librarian research, the resulting study discovered that any models of inter-religious dialogue can be categorized into two models of inter-religious dialogue that are ‘theological-spiritual dialogue’ and ‘social humanity dialogue’. Theologically and spiritually, all religions have a universal message and passing over spirit (out of the border of religions) in greatly committing to the human values. Anthropologically, the presence of all religion aims to bring the enlightenment and the enthusiasm of life among their adherents. It can be concluded that anthropological dialogue based on passing over spirituality is one of the interaction model in inter-religious dialogue, or positive and constructive communication which is oriented to create the safeness and the peace in the religious life, based on passing over spirituality, in which all religions have the initial spirit of the presence that religion plays a role to illuminate (illuminative), save (prophetic), liberate (liberative) and transform (transformative). Here, religion has a self-image as rahmatan lil ‘alamīn.

These are: firstly, with the religious pluralism which will show that there are some differences religions surround us to be respected each other’s. Secondly, there is the attitude to respect and appreciate or to be tolerant to other religions. Thirdly, there is the belief that all religions are good, but they still believe that the best and the true one is Islam. The most of students defined the religion plurality is to respect and appreciate another people beliefs and doctrines. It was needed to avoid horizontal conflict among the people in the grass roots. Abstract

The appearance of Yusuf al-Qaradawi, who is famous for his fatwas, seems to respond to the need of reform in Islamic legal thought in order for it to be more relevant. His works, such as Al-Ijtihad al-Mu’asir baina al-Indhibat wa al-Infirat, Al-Halal wa al-Haram fi al-Islam dan Min Hadyi al-Islam Fatawa Mu’ashirah, shows his contribution to the development of Islamic legal thought today. Al-Qaradawi says that the need for such a reform due to changes in almost all aspects of human life, where arise new issues that the legal status of which can not be found directly both in the scriptural texts and fatwas of religious scholars in the past. To reply the need of legal reform, al-Qaradawi propossed two methods, namly intiqai (tarjih of the existing fatwas) dan inshai (method to find out solutions for new issues that emerged in contemporary situation), with some requirements. In dealing with contemporary issues, his orientation of developing Islamic legal thought tends to be moderate between the two extreme ones, ifrat (excessive) dan tafrit (oversimplipying). He holds the principle of  ”taysir (to provide comvenience)” and of ”integration between legal views that are salafiah (scriptural) and renewal”, which considers the social change not as a threat to the alienation of Islamic legal tought in the mids of public lives, but as a grace. In his legal perpective, the progress of science and technology that drive the various changes is synonymous with ease.

Abstract

The position of hadith as the source of Islamic law has brought about a problematic long debate between the denial and the defender of hadith. The problemes surrounding the hadith's position concerns the hadith in the aḥad category which is contrasted with the mutawtir category. This study aims to analyze the position of hadith as a source of Islamic law. This researcāh uses qualitative research method through literature study by using a content analysis methode to obtain a conclusion. The discussion of this study presents the arguments surrounding hadith as the source of Islamic law among its denials and defenders. The denial of the hadith takes the ijtihād rather than positioning the aḥad hadith as the source of Islamic law. Thus, the defenders of hadith from the experts of hadith still insist on asserting hadith as the source of Islamic law even though it is a category of aḥad by developing a systematic methode of hadith research. This study concludes that the problemes surrounding the position of hadith as a source of Islamic law have given rise to positive dynamics for the development of the methodology of hadith research.

Abstract

Feminist exegesis (tafsir) is a unique genre emerges in contemporary era when gender issue become a global concern. The paradigm of this tafsir started from the asumpsion that the Qur’anic principle of male-female relationship should be based on justice (al-‘adalah), equality (al-musawah), appropriateness (al-ma’ruf), and conssensus (syura). Thus, any exegesis produced in classical period which violate all those principles are considered unacceptable, especially in relation to the current situation which differ from that of previous time. Feminist tafsir employs gender analisys as a tool to differentiate between God given condition that is unchangeable to gender as social construction that is changeable. In addition, hermeneutics is considered an appropriate approach chosen in feminist tafsir along with thematic method to interprete verses about gender relation in the Qur’an. With this methodology, its aim is to produce tafsir with more intersubjective and critical insight related to gender relation.
