Abstract

Indonesian people are shocked by the case of the Chinese Fisheries (KM) with the name KM Kway Fey 10078 which is categorized as a Foreign Fish Boat (KIA) fishing around the Natuna Islands waters which are the territorial waters of the Indonesian EEZ. The concept of historical traditional fishing ground towards waters in the Natuna sea region which in fact is still an Indonesian EEZ area needs to be further analyzed. The formulation of the problem in legal research are: (1). Theoretical and regulatory regarding Historical Traditonal Fishing Ground based on UNCLOS 1982. (2). The provisions of IUU Fishing are based on UNCLOS 1982 and Indonesian legislation is applied in the case of Historical Traditonal Fishing Ground which catches fish in Indonesian (EEZ) waters. Legal research methods are used with statute approaches and conceptual approaches. The results of this research are (1). If without a bilateral agreement, it is in accordance with the UNCLOS 1982 Historical Traditions of Fishing Ground is categorized as one of the IUU Fishing and violations of jurisdiction and territorial integrity of Indonesia, where Indonesian legal authorities have the right to take action on every fisherman who claims to have traditional fishing rights in accordance with Indonesian legal mechanisms. (2). Needs support from countries to implement policies, programs, and practices from these countries to make this rule implementable, so that there is an impact of remedy for countries that are considered to do IUU Fishing under the pretext of using historical traditional fishing right, then fish commodities arrested was prohibited from being traded on the international market, because the commodity was captured from a process of violation of international marine law and violation of jurisdiction and sovereignty of the State.

Abstract

The General Election Commission of the Republic of Indonesia (KPU-RI) has determined 270 regencies / cities to hold simultaneous regional elections in 2020. With the agenda for the registration period of candidate pairs held from 4th September 2020 to 6th September 2020, and Campaign Period Stages to be held from 26th September 2020 to 5th December 2020. The direct implementation of Regional Head Election had brought changes to the culture of government at the regional level in terms of bureaucratic and political relations. The Election Hazard Index (IKP) noted that was in Regional Head Election in 2020. The neutrality problem of the State Civil Apparatus became the biggest problem, namely 167 regencies / cities out of 270 regions running the Regional Head Election (PILKADA) that was as the role of General Election Supervision (BAWASLU) Agency supervised the neutrality of the State Civil Apparatus, members of the Indonesian National Army, members of the Indonesian Police. The factors of the non-neutrality of the State Civil Apparatus were historical and socio-cultural factors, kinship relations, ambitions for career positions, ambiguous regulations (multiple interpretations), weak law enforcement, and low public awareness of legal culture. The government needed to review the Election Law regarding Civil Service Officers that minimized the occurrence of Corruption, Collusion and Nepotism in appointments and transfer of State Civil Apparatus (ASN) employees. Abstract

ABSTRAKNegara dan konstitusi merupakan dua lembaga yang tidak dapat di pisahkan satu dengan lainnya. Akan tetapi, untuk dapat dikatakan secara ideal sebagai Negara konstitusional maka konstitusi negara tersebut harus memenuhi sifat-sifat dan ciri-ciri dari konstitusionalisme. Lalu berdasarkan kepentingan dan wilayah tempat tinggalnya, mereka hidup dalam keterbatasan interaksi antar sesama manusia dalam peraturan yang ada yaitu pembatasan sosial agar bisa memutus rantai penyebaran virus covid-19. Secara historis pengertian negara senantiasa berkembang sesuai dengan kondisi masyarakat yang ada pada saat itu. Pada zaman Yunani Kuno para ahli filsafat negara merumuskan pengertian negara secara beragam. Aristoteles yang hidup pada tahun 384-322 S.M., merumuskan negara dalam bukunya Politica, yang disebutnya sebagai negara polis. Konstitusi mencerminkan kehiupan politik didalam masyarakat sebagai suatu kenyataan. merupakan suatu kesatuan kaidah yang hidup dalam masyarakat yang selanjutnya dijadikan satu kesatuan kaidah yang hidup dalam masyarakat yang selanjutnya dijadikan suatu kesatuan kaidah hukum konstitusi dalam hal ini sudah mengandung pengertian yuridis. atau undang-undang dapat dianggap sebagai perwujudan dari hukum tertinggi yang harus ditaati oleh negara dan pejabat-pejabat negara sekalipun. Hal ini sesuai dengan dalil Goverment by law, not by men. Kesehatan merupakan salah satu kebutuhan manusia yang sangat vital dan telah menjadi bagian dari Hak Asasi Manusia khususnya di Indonesia. Karena merupakan bagian HAM, maka untuk menunjang pemeliharaan kesehatan tersebut dibutuhkanlah sarana dan prasarana berupa Fasilitas Kesehatan atau pelayanan kesehatan yang baik dan layak. Sebagaimana yang termaktub dalam Pasal 28H Undang-Undang Dasar Negara Republik Indonesia yang berbunyi: “Setiap orang berhak hidup sejahtera lahir dan batin, bertempat tinggal, dan mendapatkan lingkungan hidup yang baik dan sehat serta berhak memperoleh pelayanan kesehatan”.

Abstract

Legal research aims to solve the problems that arise in connection with the application of the principle of distinction (distinction principle) in terms of the protection of civilians in international armed conflict between Israel and the Palestinians. The object of study in legal research is devoted to applying the principle of distinction against the civilian population as a victim of war under international humanitarian law in armed conflict international. To solve these problems, they need to be supported by the data in the form of legal material.  The data was obtained through the study of literature and via the Internet. From this legal research to achieve results that provide answers to the problems that exist, the Israeli aggression on Palestine has violated international humanitarian law provisions and has caused misery for the Palestinian population. As a result of these actions, the Israelis may be subject to liability in the form of sanctions or punishment according to international humanitarian law provisions applicable in the international community

Abstract

Kesenjangan sosial memang menjadi masalah tahunan yang terjadi di negara berkembang seperti Indonesia. Adanya kesenjangan tersebut dipengaruhi oleh beberapa faktor seperti ketidaksiapan masyarakat terhadap pandemi, kebijakan Pemerintah, dan pengaruh globalisasi. Dengan adanya kesenjangan tersebut bisa menimbulkan kecemburuan sosial yang berdampak pada kehidupan masyarakat. Kecemburuan sosial juga bisa menyebabkan tindak kriminal, timbulnya kelompok si kaya dan si miskin, standar gizi buruk pada balita, banyak anak putus sekolah dan masih banyak lagi. Kesenjangan sosial erat kaitanya dengan kemiskinan. Kemiskinan sendiri menjadi masalah yang seakan akan terus ada dari dulu meskipun telah dilakukan berbagai upaya untuk menangani kemiskinan. Adanya pandemi Covid 19 menambah beban perekonomian negara khususnya rakyat kecil karena segala aktivitas sangat dibatasi sudah hampir dua tahun belakangan ini. Rakyat kecil semakin menjerit karena lapangan pekerjaan yang dipersempit sehingga mencari sesuap nasi bagi mereka pun sulit. Pasal 34 ayat (2) UUD 1945 menyebutkan bahwa Negara mengembangkan sistem jaminan sosial bagi seluruh rakyat dan memberdayakan masyarakat yang lemah dan tidak mampu sesuai dengan martabat kemanusiaan. Tentunya Negara juga terus mengupayakan berbagai upaya untuk menangani hal tersebut, salah satunya mengurangi jumlah kemiskinan. Anehnya banyak beberapa pejabat justru mengalami kenaikan jumlah kekayaan selama pandemi. Hal tersebut menjadi sebuah ironi mengingat masyarakat sedang kesusahan mencari pundi-pundi rupiah tetapi aset pejabat malah naik. Hal diatas mengindikasikan bahwa keadilan sosial di Indonesia masih belum sepenuhnya terlaksana.

Abstract

This writing discusses the tolerance of living in harmony with various ethnic groups in Surabaya in the history of social interactions that have occurred between the people of Suarabaya. Surabaya has so far lived in a multicultural manner, between residents no longer discriminatively discriminate on issues of ethnicity, religion and level of social welfare among fellow citizens, can live in harmony and side by side with one another. This condition is due, among other things, to long historical factors and a willingness to accept differences as an inevitability of social life. Surabaya values diversity and equality. According to Fikser, in this city, all kinds of ethnicities, tribes or races can be found. Starting from the Javanese, Batak, Karo, Papua, Madura, Dayak, Bugis, and so on. In addition, there are also Chinese, Arab, Indian and Korean communities. The attitude of respect for differences and diversity shown by the people of Surabaya is very compatible with the spirit of multiculturalism that has developed in the last few decades. As is known, multiculturalism is an understanding that recognizes differences in equality, both individually and in groups, within a cultural framework.

Abstract

Buying and selling online is an option that is in great demand by the public because it has many conveniences and advantages. With the increasing sophistication of online buying and selling transactions, there are also many choices of payment methods for these transactions, one of which is Cash On Delivery or what is commonly referred to as (COD). However, along with its development, many sellers have suffered losses from the Cash On Delivery payment method. This paper aims to find out how legal protection is for sellers in online buying and selling transactions with the Cash On Delivery payment method and also what legal remedies can be used by sellers. This paper uses a normative juridical research method by applying a statutory approach, namely by means of an analysis of statutory regulations and provisions in accordance with the problems being handled. The results of this paper explain that legal protection for sellers in carrying out online buying and selling transactions with the Cash on Delivery payment method is contained in Article 6 of Law Number 9 of 1999 concerning Consumer Protection. In addition, to protect the rights of the seller, there are also legal remedies that can be taken, namely by way of settlement out of court through Alternative Dispute Resolution. In this case the settlement of disputes through the courts is expected to be the final effort that will be taken by the seller and the buyer after other methods do not result in an agreement.

Abstract

The existence of material law is very important in a social life. With the existence of material law all objects can be regulated so as to create a life that respects each other regarding material possessions and power over their owners. Of course material rights are based on statutory provisions so that they are binding. So that its existence provides things that need to be obeyed by the community in order to achieve a welfare state or a welfare state in accordance with the ideals of the state. With this basis, the principle of individuality can certainly be realized in society through material law because it is based on existing laws. The effectiveness of the principle of individuality can be realized on the basis of the existence of applicable laws and regulations, as stated in Law Number 12 of 2011. With the existence of applicable material law, it certainly has a full effect on people's lives, where people must obey and submit and comply with all rules. law especially in the implementation of statutory regulations that have been stipulated. So that the enforcement of the law of objects based on the principle of individuality can run in accordance with existing provisions. This principle makes it easier for the community to claim their ownership rights to an object because according to this principle the rights to objects can be determined individually. The right to own an object means the right to enjoy an object freely and regarding this property right is very necessary for the community so that problems do not occur in the future. The research contribution is expected that these guarantees will later become two parts, namely material (material) guarantees in the form of absolute rights to an object and can be maintained and transferred and immaterial (individual) guarantees which only cause direct relationships to certain individuals. This research method uses normative juridical, using a journal literacy approach using materials in the form of legal principles, related basic laws as primary or principal legal materials in completing this research. The systematic application of object law based on the principle of individuality can be carried out because it has been determined and ratified by the legislature with the approval of the president, of course.
