Abstract

Upload the death penalty for the perpetrators of terrorism that the government efforts to get a lot of doubt about its effectiveness. For the government, giving the death penalty to the perpetrators of terrorism makes other terrorism networks feel fear and a deterrent to doing the same. In some cases that exist so far, quite the opposite, the perpetrators of terrorism consider death through punishment for committing acts is an honor and heroism by the network community. Empirical research is processed descriptively. Data collection is carried out through field research at the Class I Surabaya Prison through a phenomenological approach, interpretive paradigm, and analysis tarjih{ maqa@s}idiy. The study concluded that the death penalty for terrorism is a more significant benefit (mas}lah}ah arjah}) than allowing the ideologists of terrorism who are still radicalized and without remorse with life sentences. Preventing the process of radicalism from ideologists takes precedence over taking and waiting for the indiscriminate benefit of the life of convicts who do not feel guilty.

Abstract

إن السؤال المركزي في هذا البحث العلمي تتمحور حول الرحلة الإلهية بين نبينا إبراهيم عليه السلام و قصة حي بن يقظان في رسالة ابن طفيل. استعمل الباحث في هذه الدراسة تعتمد على التحليل المقارن في البحث عن الحق بين إبراهيم عليه سلم وابن طفيل واعتمد الباحث على الاستقراء والتمثيل في بعض الكلمة المأخوذة من القرآن الكريم عن تاريخ إبراهيم و كتاب حي بن يقظان الذي ألفه إبن طفيل. هذا من ناحية، ومن ناحية الأخرى، لإكتشاف تعبيرهما، استعمل الباحث في دراسة النص التراثي بطريقة غادامير (Hans Georg Gadamer) لفهم ما تحيط بالرحلة الإلهية من خلال تعبير القرآن الكريم والرسالة الفلسفية، من المعروف، هرمينيوطيقا غادامير هو طبيعة "الفهم"، والمصطلح الألماني هو Verstehen, وغادامير يشدد على صلة هذا المفهوم الوثيق بـ"Verstandigung"، "أي بلوغ تفهم لشخص آخر"، و"الوصول إلى اتفاق مع شخص آخر"، وكذلك على الصلة الوثيقة بـEitverstandnis (الفهم، الإتفاق، الإجماع). هذا من ناحية، ومن ناحية أخرى، فتش الباحث ما وراء النص التراثي الذي كتبه ابن طفيل وقصة ابراهيم عليه السلام في القرآن الكريم من أبعد التاريخ مأثرا لهما التعبير الفني. إضافة إليه، لا تُفهم "نظرته" فحسب، إنما تُأخذ بعين اعتبار ما إذا كانت الطريقة في النظر إلى الموضوع ذات مشروعية لنا أيضا. بهذا المعني فحتي "الفهم الذاتي Sichversthehen" لا يعني عن غادامير أن ينقل المرء نفسه باتجاه موضوع ما، إنما، بحسب الصيغة الألمانية، أن "يعرف المرء سبيله" في مساءلة معينة. لذا، يجب على الباحث أن يتكشف تعبير الرحلة الإلهية في القرآن الكريم في قصة إبراهيم عليه السلام و حى بن يقظان في رسالة ابن طفيل لأن هذه المشروعية مهِمّا جدّا لمن أتي بعده في بحث عن حقيقة الإلهية.

Abstract

In the context of fostering national law, Islamic law is now dealing with Western law and customary law. This research is a library research (Library Research), which is research that is directed and focused on the study and discussion of library materials that are related to the issues being studied, especially regarding the KHI discourse in the political and legal landscape in Indonesia. This research is descriptive-analysis in nature, that is, this research seeks to describe or explain how the KHI discourses in the political and legal landscape in Indonesia. The fiqh movement in Indonesia is a continuation of the orientation of Sufism which has been so strong and has emerged earlier. This is a logical consequence of the historical process that for the merits of the Sufilah Islam spread throughout the archipelago. The struggle to legalize Islamic law began to show its results, when finally Islamic law received constitutional juridical recognition. Various laws and regulations, most of the material taken from fiqh books which are considered representative, have been passed by the Indonesian government. Social fiqh presents itself as social ethics which is manifested in an institution called the state, an institution that kills the creativity of civil society and also the old pattern of thinking which is considered conservative.

Abstract

Tulisan ini bertujuan menyemarakkan arus wacana gender yang akhir-akhir ini cukup menggema di balantika intelektual, baik nasional maupun internasional. Karenanya, sebuah keniscayaan jika menguatnya tradisi patriarkhi yang menjadi lawan dari wacana feminisme salah satunya disebabkan oleh pemahaman keagamaan yang dinilai “timpang”. Pembebasan dan kesetaraan perempuan atas hak dan kewajiban dalam berbagai aspek—termasuk keagamaan—nampaknya menjadi sebuah tujuan yang tidak bisa ditawar. Secara utuh konstruk metodologi model Nurun Najwah pada dasarnya melakukan takhrij hadis. Teori yang ia gunakan dalam melakukan takhrij hadis mengekor pada model takhrij hadisnya Mahmud Thahhan. Setelah itu, kajian historis yang berhubungan dengan tema tertentu (baca: spiritualitas perempuan)—baik mikro maupun makro—diulas guna melihat kondisi real pada saat hadis tersebut terucap dari Nabi. Dalam hal ini, konteks mikro-makro yang dilihat oleh Nurun hanya di wilayah jazirah Arab. Sedangkan aspek trans-konteksnya penulis sama sekali tidak melihat ulasannya Nurun. Padahal tidak bisa dipungkiri jika konstruk pemahaman suatu masyarakat juga dipengaruhi oleh masyarakat sekitarnya. Selain itu, langkah ini ditempuh dalam rangka mencari—meminjam bahasanya Fazlur Rahman—ideal-moral (maqashid al syari’ah) atau—meminjam bahasanya Nasr Hamd Abu Zayd—maghza dari konstruksi hukum yang telah dibangun oleh Syari’ (pembuat hukum), yang dalam hal ini Allah dan Nabi-Nya. Langkah terakhir yang dilakukan oleh Nurun dalam mengupas persoalan di atas adalah kontekstualisasi.. Di mana, Nurun tidak serta merta melupakan aspek ruang di mana buku itu disusun dan dikonsumsi. Adapun konteks ke-Indonesiaan yang dimaksud adalah konstruksi pemahaman yang mengakar pada masyarakat Indonesia secara umum dan beberapa aturan hukum yang telah dibangun oleh beberapa institusi, baik yang bersifat kepemerintahan maupun swasta

Abstract

The debate over the implementation of Tabarruk is something that still raises a lot of debate among the Muslims of the world. The majority of Muslims are very enthusiastic about carrying out this practice, while others still consider tabarruk an act of heresy and even shirk. In this literature study, the author will try to re-present the concept and understanding of tabarruk from the perspective of Sunni and Shia scholars as active adherents of tabarruk practice which will be represented through the thoughts of the two figures in this group, namely Zainal Abidin al-Ba'lawi and Ja 'far Subhani. From this concept, the author will relate the implementation to the impact of tabarruk practices in building the character of Muslims. The research used in this study is a comparative approach with a qualitative description in which the thoughts of these two figures will be coordinated and compared so as to produce a neutral and impartial. The results of this study state, that the Ahlussunnah and the Shiah have mutually agreed, that the practice of tabarruk is a legal practice and can be carried out by all Muslims in the agreed measure and rules. Therefore, these results are used as a response to criticism from parties who oppose the practice of tabarruk with accusations of polytheism and are considered to be detrimental both financially and morally for Muslims. In addition, the practice of tabarruk carried out in accordance with the Shari'ah has a positive impact on the character building of Muslims. Among the kinds of tabarruk in religious practice are: reading the Qur'an, visiting graves, seeking knowledge, and tabarruk with Sayyidina Husein's turban.

Abstract

This study discusses the relationship between the state and society in the review of maqasid al-shari‘ah construction of T{ahir Ibn ‘Ashur. The method used in this study uses qualitative through content analysis by T{ahir Ibn ‘Ashur. The data finding obtained from the relationship between state and society in the perspective of maqasid al-shari‘ah are two inseparable entities. The relationship between the two is an interesting theme discussed in the study of the state system. T{ahir Ibn ‘Ashur offers a conception of the basic values of building a society and the structure of religious state. The religious state can be achieved if each individual community holds fast to the Islamic religion because the basis of this religion besides teaching theological values also instills an ethic of social interaction simultaneously. As for the state’s position in the of T{ahir Ibn ‘Ashur belongs to the social category governed by the Islamic community

Abstract

Abstract

This article aims to describe the implementation of the Contextual Teaching and Learning (CTL) approach in class VIII Aswaja learning at MTs Miftahul Huda Semanding Tuban. This article uses a case study approach, and is a type of qualitative research. Methods of data collection using interviews, observation, and documentation. Data analysis used the Mathew Miles and A Michael Hubermen model, namely data reduction in presenting data and drawing conclusions (verification). The results of the research from the implementation of CTL in Aswaja Subjects are quite good starting from the preparation of lesson plans, implementation which includes a) learning according to the reasonableness of students' mental development b) forming study groups c) providing an environment that supports independent learning d) considering the diversity of students e) paying attention to multi-intelligence students f) using questioning techniques and g) applying authentic assessment, and the obstacles in this approach 1) The proportionality of educational linearity is not appropriate 2) lack of teaching hours, lack of Aswaja teachers 3) developing learning media namely IT (electronic) media 4 ) The Covid-19 pandemic and 5) the public's view of the administrators working at Muhammadiyah while the impact of the CTL approach 1) high student enthusiasm 2) students can think critically 3) providing adequate learning media.

Abstract

This article aims to describe and analyze the implementation of multiculturalism-based Islamic religious education for the development of students' social attitudes in the school environment. This research uses a qualitative type with a case study method approach. The use of three data collection techniques, namely, observation, interviews, and documentation. Data analysis was carried out in four stages according to Huberman and Miles, namely, data collection, data reduction, data presentation, and drawing conclusions. As well as the validity of the data used triangulation. The findings of this article show: First, multicultural-based Islamic Religious Education is well implemented in accordance with the Free Learning Curriculum which contains Pancasila Student Profiles in it according to the vision and mission of the Ministry of Education and Culture. The teacher uses 3 learning components according to Degeng, taking into account the conditions, methods, and learning outcomes then internalizing by planning, implementing, and evaluating learning. Second, through instilling and understanding Islamic values in learning activities inside the classroom and outside the classroom, multicultural-based Islamic Religious Education in the development of social attitudes has shown a positive outlook, such as by responding and responding through activeness, harmony, and togetherness.

Abstract

Angka kekerasan dalam rumah tangga terus meningkat disetiap tahun faktor penyebab kekerasan dalam rumah tangga yaitu ekonomi,budaya patriarki dan rendahnya pendidikan. Dalam kasus kekerasan pendidikan yang bermuatan agama memiliki peran penting sebagai upaya pencegahan yaitu untuk dapat mengubah pola pikir dan memperbaiki relasi antara laki-laki dan perempuan. Permasalahan pokok dalam penelitian ini yaitu pendidikan yang bermuatan mubadalah sebagai upaya pencegahan kasus kekerasan dalam rumah tangga di provinsi Lampung. Sedangkan tujuan dari penelitian ini untuk melakukan analisis proses bagaimana nilai-nilai pendidikan Islam prespektif mubadalah sebagai upaya preventif KDRT yang dilaksanakan oleh Pengurus Wilayah RPA Provinsi Lampung. Penelitian yang digunakan dalam studi ini adalah kualitatif dengan pendekatan studi kasus. Studi ini dilaksanakan di Rumah Perempuan dan Anak Provinsi Lampung. Pengumpulan data yang dilakukan yaitu dokumentasi, wawancara dan observasi. Sumber data dari hasil wawancara ketua dan pengurus RPA provinsi lampung. Studi ini menujukan hasil bahwa Upaya Preventif Pengurus Wilayah RPA Provinsi Lampung dalam kasus KDRT bentuk dari upaya tersebut adalah Melalui Pendidikan pencegahan kekerasan terhadap perempuan dan anak. RPA lampung menggunakan pendidikan islam perpektif mubadalah tersebut memuat niai-nilai pendidikan Islam yaitu Nilai Akidah/Tauhid, nilai Syariah, nilai Akhlak dan nilai kemasyarakatan. Dari keempat nilai diharapkan mampu membentuk akhlak dan menjadi kebiasaan masyarakat yang adil gender yaitu laki-laki dan perempuan memiliki kesempatan yang sama berperan dalam kehidupan,sosial kemasyarakatan, politik dan sebagainya.
