Abstract

Perhimpunan Advokat Indonesia (PERADI) adalah organisasi profesi yang didirikan berdasarkan Undang-Undang Republik Indonesia Nomor 18 Tahun 2003, dengan orientasi pelayanan yang bersifat sosial yaitu membantu memberikan perlindungan hukum (legal services) bagi setiap warga negara yang tersandung masalah hukum baik di dalam maupun di luar pengadilan. Seorang Advokat dalam menjalankan profesinya sebagai Advokat harus memenuhi persyaratan yang ditentukan dalam undang-undang dan harus menjunjung tinggi nilai-nilai Pancasila dan kemampuan profesionalnya, tidak hanya dalam lingkup peradilan tetapi juga di luar lingkup peradilan. Profesionalisme tidak hanya dimaksudkan untuk menjaga kepentingan asosiasi profesi, tetapi harus berujung pada penjagaan kepentingan masyarakat. Tujuan penelitian ini adalah untuk menjelaskan pengelolaan hukum Persatuan Advokat Indonesia (PERADI) menurut hukum, untuk mengetahui bagaimana dampak dualisme pengelolaan Perhimpunan Advokat Indonesia (PERADI) terhadap penegakan hukum dan masyarakat serta bagaimana peran dan upaya pemerintah untuk mengembalikan dualisme kepengurusan Perkumpulan. Advokat Indonesia (PERADI) menjadi organisasi tunggal yang mandiri dan kuat.

Abstract

In an effort to realize the principles of the rule of law in social and state life, the role and function of an advocate as a free, independent and responsible profession is important, in addition to the judiciary and law enforcement agencies such as the police and prosecutors. Through legal services provided, Advocates carry out their professional duties to uphold justice based on the law for the benefit of justice seekers, including efforts to empower people to realize their fundamental rights before the law. Advocates as one element of the justice system is one of the pillars in upholding the rule of law and human rights. The purpose of this study was conducted to explain the legal management of the Indonesian Advocates Association (PERADI) according to the Law, to find out how the dualism of the management of the Indonesian Advocates Association (PERADI) on law enforcement and society and how the role and efforts of the government to restore dualism management of the Association Indonesian Advocates (PERADI) became a single, strong organization.This study uses normative and empirical research methods which consist of research on legal observation and research on legal effectiveness. This study uses an interrelated concept of data collection through a qualitative approach and adjusted to applicable regulations.

Abstract

The Indonesian National Police Institution is a State institution established based on LawNumber 2 of 2002 which functions as one of the functions of the state government in thefield of maintaining security and public order, law enforcement,protection, shelter, andservice to the community, as stated in Article 2 Law no. 2 of2002. This means thatthe police are fully responsible for providing security and order guarantees to allmembers of the community. In its development and practice, in general, this function hasnot been felt by all people, especially justice seekers who experience legal problems,either directly or indirectly, so that satisfaction with the police services cannot becategorized as adequate.Although in terms of implementation and implementation in thefield, it has been regulated in such a way as the basis or what is called StandardOperating Procedure (SOP) in this case, one of which is related to the Regulation of theNational Police Chief No. 12 of 2009 concerning the supervision and control of thehandling of criminal cases within the Indonesian National Police. This study aims todetermine how the procedure in handling a police report at the investigation level is andhow long the period of time in handling a police report is. This study will explore andlegally analyze the duration of handling a police report associated with the reportNumber STTLP/ 2298/ K/ X/2018/ SPKT Medan Polresta based on the National PoliceChief Regulation No. 12 of 2009 concerning the supervisionand control of the handling ofcriminal cases within the police.This study uses normative and empirical researchmethods consisting of research on legal observations and research on legal effectiveness.This study uses an interrelated concept, namely data collection through a qualitativeapproach and adapted to the applicable regulations. Then the data is selected bycollecting various information about the process of handling a case and the duration ofits handling at the investigation level. Abstract

Crime of corruption is a social phenomenon which is the reality of human behavior in social interactions that are deemed to be deviant, things that are already commonplace, are no longer even common knowledge in the midst of the lives of nations and countries in particular, even throughout the world in general. In the country of Indonesia itself since the days of independence this has become an activity that is attached to stakeholders in the government body in particular, so that when talking about corruption is not a new thing anymore. But along with the times, that this seems to be an unstoppable culture, so it really needs serious attention for the government in terms of eradication. Considering that corruption is a despicable act, it is necessary to see and know what are the causal factors and the consequences of criminal acts of corruption on development in the city of Medan reviewed based on Law No. 20 of 2001 amendment to Law No. 31 Year 1999 concerning corruption. Therefore the author conducted a study in the Medan corruption court which was formed on May 28, 2011 ago.

Abstract

Law is a tool in a country to regulate the joints of state life such as life between one legal subject and another legal subject, both in Public Law and Private Law. This research was conducted to answer the problem, namely how to study the law of a state administrative decision that is legally flawed, the case study of PTUN No.10/G/2019/PTUN-MDN and how is the legal responsibility of state administrative officials for a decision that is legally flawed. By using descriptive normative research method consisting of research on legal observations and research on legal effectiveness. The results of this study state that a state administrative decision that is legally flawed such as a SHM with legal defects, both physical and juridical data should not occur due to negligence or intentional negligence of state administrative officials, because such problems cause conflicts and losses in the community, also have lost trust. the public towards government services and the actions of state administrative officials who are negligent or intentionally commit unlawful acts in this case issuing a certificate of ownership of a plot of land that is not based on the applicable laws and regulations, then the official, both on his position and personally, can be held accountable at the before the law and can be prosecuted criminally or civilly

Abstract

Pengadaan barang/jasa pada hakikatnya adalah upaya pihak pengguna untuk mendapatkan atau mewujudkan barang/jasa yang dibutuhkannya, dengan menggunakan metode dan proses tertentu agar dicapai kesepakatan spesifikasi, harga, waktu, dan kesepakatan lainnya. Agar tujuan dari pengadaan barang/jasa tersebut dapat dilaksanakan sebaik-baiknya, maka kedua belah pihak yaitu pihak Pengguna dan Penyedia haruslah selalu berpatokan kepada filosofi pengadaan barang/jasa, tunduk kepada etika dan norma pengadaan barang/jasa yang berlaku, mengikuti prinsip-prinsip, metode dan proses pengadaan barang dan jasa yang baku. Berdasarkan uraian diatas, sangat perlu dilakukan penelitian secara mendasar tentang Bagaimana prosedur/ tahapan- tahapan pelaksanaan Pengadaan Barang dan Jasa oleh Pemerintah, serta Bagaimana Upaya hukum yang dapat ditempuh para pihak apabila terjadi pelanggaran hukum dalam pelaksanaan pengadaan barang dan jasa yang bertujuan agar semua pihak yang terlibat dalam pengadaan barang dan jasa dapat memahami tahapan-tahapan pengadaan barang dan jasa dan upaya hukum apabila terjadi penyimpangan, untuk mencapai tujuan tersebut menggunakan metode Yuridis Normatif, sehingga mendapatkan kesimpulan bahwa regulasi tentang Pengadaan Barang dan Jasa cukup bagus, namun dalam prakteknya terdapat penyimpangan oleh oknum pejabat pemerintah, dan setiap segketa yang diputus oleh pengadilan berkaitan dengan pengadaan barang dan jasa hendaknya dilaksanakan oleh pihak terkait.

Abstract

Land procurement for public interest based on Law No. 2 Year 2012 Activities held land by giving compensation decent and fair for those who are eligible, the land acquisition is an activity undertaken by the private sector and the government in order to get a piece land allocated for the implementation of a specific development. This research is descriptive analysis with normative juridical approach, ie an approach to legislation related to land acquisition, so as that at issue in this study is how the rule of law to the public shareholders Certificate of Ownership (SHM) is a land in the consignment policy associated with state authority in the procurement of land for public purposes under Law No. 2 In 2012, What are the factors inhibiting the provision of land and how to overcome obstacles facing the government in the procurement of land for public purposes and how the legal protection of individuals (people) who have policies consignment on a piece of land without their prior agreement. Based on research that land procurement for public interest implemented by the government must have legal certainty for holders of land rights, the rule of law in this case means that the government can not impose its authority to waive or revoke ownership rights of a holder of rights on land allocated for public use without first taking care of right holders in terms of social aspects and of the economic aspect, so that the individual holders of land rights can extend their life better than before its release or revoked, then the government must be able to guarantee legal protection for individuals/ communities experiencing problems law, particularly in the context of land acquisition for public purposes, which individuals/ communities of the poor do not have the power to block any government action that seemed to rape their human rights.

Abstract

Sebagai bukti pemberian wewenang atas praperadilan kepada Pengadilan Negeri berdasarkan KUHAP ditetapkan dalam Pasal 1 butir 10 yang diinterpretasikan terkait keabsahan proses penangkapan, ganti rugi, dan penyidikan. Prosedur praperadilan lebih dijelaskan pada Pasal 79-83 KUHAP, yang tentunya wajib menjunjung tinggi HAM, dengan tetap melihat situasi dan kondisi terutama. Pengadilan Negeri sebagai pemegang wewenang nantinya bisa memberi penilaian dan putusan terkait proses praperadilan. Sebagai permasalahan dalam penelitian ini yaitu mengenai tolak ukur tentang sah tidaknya Penangkapan, Penahanan dan Penetapan Tersangka dan terkait objektivitas majelis hakim Pengadilan Negeri dalam memeriksa dan memutus permohonan praperadilan. Tujuan penelitian ini untuk menganalisis tolak ukur tentang sah tidaknya Penangkapan, Penahanan dan Penetapan Tersangka dan objektivitas majelis hakim Pengadilan Negeri dalam memeriksa dan memutus permohonan praperadilan. Metode penelitian ini adalah Yuridis Normatif dan Deskriptif Analitis. Hasil penelitian menunjukkan bahwa tindakan penahanan hanya dapat dilakukan apabila syarat materil dan syarat formil dalam penangkapan terpenuhi, artinya apabila sebuah penangkapan dinyatakan cacat yuridis, maka dengan sendirinya tindakan penahanan cacat yuridis, penegakan hukum dilakukan dengan cara-cara melanggar hukum, maka tindakan tersebut merupakan tindakan ilegal dan tercela, Dalam Putusan No. 1/Pid.Pra/2022/PN.Blg tidak terlihat sedikitpun objektivitas majelis hakim dalam melihat kasus dengan pemahaman hukum yang seimbang.

Abstract

Village Funds are Funds sourced from the State Revenue and Expenditure Budget allocated for villages to be used to finance government administration, development implementation, community development, and community empowerment. Village government is required to carry out governance in a transparent and accountable manner. Laws and Government Regulations have provided a clear legal umbrella so that the BPD does not need to hesitate in carrying out its function of supervising the performance of village heads. This study used qualitative research methods. Data collection was carried out through observation, in-depth interviews and discussions with related parties through snowball techniques. Data collection was carried out through observation, in-depth interviews and discussions with related parties through snowball techniques. The results showed: Village Community Kec. Panombeian Panei participates in the management of the village fund budget. Management of the village fund budget in the Village of Panombeian District Panei. How ever, the management is still inadequate due to unwise decisions, no budget transparency and a lack of accountability for the expenditure of the village fund budget itself.

Abstract

Sistem pendaftaran tanah lengkap merupakan program yang diselenggarakan oleh pemerintah khususnya Kementerian Pertanahan dan Perencanaan Wilayah atau Kepala Badan Pertanahan. Hal ini bertujuan untuk meningkatkan jumlah pendaftar tanah yang menerbitkan sertifikat di Indonesia. Keputusan Pemerintah Nomor 24 Tahun 1997, menggantikan Keputusan Pemerintah Nomor 10 Tahun 1961, merupakan pelaksana amanat yang diatur dalam Pasal 19 Keputusan Pemerintah tersebut. Penelitian ini bertujuan untuk mengkaji proses pelaksanaan pendaftaran tanah sistematik lengkap serta kendala-kendalanya dan mengkaji upaya-upaya pelaksanaan pendaftaran tanah sistematik lengkap di Desa Jaranguda, Kecamatan Merdeka Kabupaten Karo. Metode yang digunakan adalah penelitian hukum empiris. Sumber data yang digunakan adalah data hukum primer dan sekunder, kemudian dianalisis melalui teknik interpretasi dan kualitatif. Hasil penelitian menunjukkan bahwa pelaksanaan pendaftaran tanah sistematis lengkap di Desa Jaranguda dilakukan untuk mencapai kepastian hukum kepemilikan hak atas tanah. Pelaksanaan program ini belum efektif dan belum dilaksanakan secara optimal karena rendahnya partisipasi dalam pengurusan sertifikat tanah di daerah tersebut.
