Abstract

Article 1 paragraph (1) of the 1945 Constitution of the Republic of Indonesia has explained the form of the Indonesian state. The concept of trias politica assumes that state power consists of three kinds of power, namely legislative power/making laws or usually referred to as parliament (rule making of function), executive power/power to implement laws (rule application function), and power judiciary / power to adjudicate for violations of the law (rule adjudication function). The three powers in these state institutions are closely tied to each other and cannot be separated or there are checks and balances, which means that each branch of government divides its power distribution to other branches in order to limit its actions. This paper aims to analyze the Presidential system with the Multi-Party System in Indonesia in the context of democracy and the administration of state power.

Abstract

Tujuan dari didirikanya negara Indonesia telah dijelaskan dalam alinea ke-4 Pembukana UUD 1945. Dalam kaitanya dengan kemajuan teknologi informasi dan komunikasi, maka tujuan bernegara Indonesia dapat diwujudkan dalam bentuk perlindungan data pribadi dari setiap penduduk atau warga negara Indonesia. Apalagi, pada masa pandemi covid-19 ini, telah terjadi peningkatan dalam penggunaan fasilitas-fasilitas online dalam kehidupan sehari-hari, seperti dalam pembelajaran jarak jauh atau daring, membeli kebutuhan sehari-hari dengan menggunakan situs jual beli online, penyimpanan data-data pribadi secara online, dan masih banyak lagi. Berdasarkan pasal 28 G ayat (1) UUD 1945 juga dapat disimpulkan jika perlindungan data pribadi sejatinya merupakan salah satu bentuk dari perlinduangan hak asasi manusia. Pengesahan terhadap RUU PDP pada dasarnya merupakan sesuatu yang sudah menjadi urgensi bagi bangsa Indonesia. Pada masa pandemi covid-19 ini, banyak masyarakat Indonesia yang membutuhkan adanya perlindungan data pribadi demi tercapainya jaminan, kepastian, dan juga perlindungan hukum dalam mewujudkan masyarakat yang aman, tenteram, damai, dan sejahtera. Tujuan dari penulisan karya tulis ini yaitu untuk menganalisis dan menelaah lebih lanjut mengenai urgensi pengesahan RUU PDP pada masa pandemi covid-19 seperti pada saat ini. Metode penelitian yang digunakan dalam penulisan / penelitian yaitu dengan menggunakan metode penelitian doktrinal, dimana merupakan penelitian hukum yang dilakukan dengan melakukan penelitian terhadap kajian bahan pustaka atau data sekunder pada asas – asas hukum yang terjaadi dengan melakukan penelitian pada studi kasus tertentu, serta dengan menggunakan metode penulisan deskriptif analisis.

Abstract

The accommodation of universal principles in the Miranda Principles into the Indonesian national legal system, as reflected in the formulation of articles of the Criminal Procedure Code such as Article 54, Article 55, Article 56 paragraph (1), and Article 114 of the Criminal Procedure Code, as well as in other legal products such as the Law No. 39 of 1999 and Law no. 12 of 2005, it is a necessity to enforce these principles, and one of them is through the provision of legal assistance. Although formally, the provision of legal assistance has been regulated in the Indonesian legal system, but the provision of legal assistance doesn't always run as it should in practice, especially during the current Covid-19 pandemic. The main purpose of this study focuses on an analysis related to the extent to which legal assistance is provided in upholding the Miranda Principles, as well as how to optimize the provision of legal assistance during the Covid-19 pandemic in the context of protecting citizens' constitutional rights. In this study, the method used is normative research using a statutory, conceptual, and case approach. The results of the study indicate that the enforcement of the Miranda Principles through the provision of legal aid assistance has not been optimal yet. So that, the repressive approach is still needed, such as giving administrative sanctions to lawyers who still haven't carry out their obligations optimally in providing legal assistance.

Abstract

Indonesia's demographic bonus from various studies and analyzes shows various potentials for the development of young people, but in the second phase of the demographic bonus, the elderly population is predicted to increase significantly. The peak of the demographic bonus enjoyed by Indonesia, from various government data and expert research is estimated to occur in 2028-2031. After that, the number of elderly people will grow. The increasing number of elderly population has the potential to provide many benefits if they are strong, healthy and remain productive. However, keeping the elderly population healthy, resilient and productive certainly requires a lot of preparation and support from all parties. Issues of nutritional quality, sanitation and support for a healthy environment have become a number of priorities that must be realized, as is the preparation of the quality of the productive age population. Even the National Institute on Aging (NIA) underlines that elderly people are the fastest growing proportion of the world's population. People are living more advanced, but that does not mean they are healthier. The increase in the aging population brings with it many opportunities but also a number of public health challenges that we need to prepare for. One of the challenges faced is the problem of health and poverty. In fact, according to research by the Center for Aging Society (CAS) of the University of Indonesia, based on BPS data in 2019, the number of elderly people in Indonesia has reached 25 million people. The majority of the elderly live in villages which generally have low education or only elementary school. He also noted that there were around 2.4 million elderly people who were neglected. This service program is intended to increase understanding of the right of alienation for the elderly in Kedungkelor Tegal Village by collaborating with the Kedungkelor Tegal Elderly Healthy House (RUSELA) partner. This service program is expected to not only increase the understanding of the rights of the elderly, but also increase family awareness in maintaining both mental and physical health of parents, and also as a form of responsibility for a child. This program is expected to be able to encourage positive behavior of children towards their parents and be able to improve the welfare of the elderly.

Abstract

The emergence of the Covid-19 virus has certainly taken the whole world by storm. The Covid-19 virus first entered Indonesia in March 2020. With the Covid-19 virus, it certainly resulted in significant changes to all aspects of life, one of which was in the education aspect. Basically, education is the constitutional right of every Indonesian citizen as explained in Article 31 of the 1945 Constitution of the Republic of Indonesia which states that every citizen has the right to education, and every citizen is obliged to attend basic education and the government is obliged to finance it. Besides that, education is also basically a part of human rights, as stated in Article 28C Paragraph (1) and Article 28E Paragraph (1) of the 1945 Constitution of the Republic of Indonesia During the COVID-19 pandemic, the Indonesian government has taken various ways as one of the optimizing learning in Indonesia during this covid-19 pandemic. With the implementation of distance or online learning in Indonesia, it is one of the government's alternatives to continue to carry out learning activities during the pandemic. Online learning in Indonesia is also of course by utilizing advances in information and communication technology in the era of the industrial revolution 4.0. However, with the existence of online learning activities, this will certainly lead to new problems in its implementation. During online learning, of course, there will be positive and negative impacts in it. The purpose of this paper is to provide analysis as well as criticism and suggestions to the Indonesian government while implementing online learning during this covid-19 pandemic. The research method used in writing or research is by using doctrinal research methods, which are legal research conducted by conducting research on the study of library materials or secondary data on legal principles that occur, as well as by conducting research on certain case studies using descriptive analysis writing method.

The obligations of children in parental care are clearly regulated, both in Article 46 paragraph 1 of Law Number 1 of 1974 concerning Marriage and Article 321 of the Indonesian Civil Code. These two rules emphasize the obligation of children (mature) to care for and provide for their parents. However, the implementation of this rule is still not uniform. One of the contributing factors, apart from the economic level (poverty) is also the unequal perception and level of education in understanding this right which is still low. This research is a community service program funded by the Universitas Negeri Semarang. This program is located on Kedungkelor Village, Wanureja District, Tegal Regency, Central Java. This program aims to determine the level of change in understanding of the right of alimentation for the elderly group in Kedungkelor Village through the Legal Counseling Approach method. This method is a combination of methods of education, socialization, and legal assistance for residents. This program showed a pattern of significant changes in the level of understanding of the alimentation rights of the elderly. Of the 50 people surveyed showed an increasing trend of understanding. This program includes three important stages, namely: planning, advice, and legal action. In the legal action stage, this program involves the Youth Counseling Information Center (Pusat Informasi Konseling Remaja, PIKR) and the Elderly Health House (Rumah Sehat Lansia, RUSELA) in Kedungkelor Village in maximizing this level of understanding.
