Abstract

Indonesia pada dasarnya memang merupakan negara hukum. Penegakan hukum dalam perkara-perkara sengketa Tata Usaha Negara juga harus berlandaskan hukum. Akan tetapi dalam suatu perkara tertentu terdapat adanya perbenturan antar kompetensi di dalam sistem peradilan dan sistem hukum di Indonesia. Salah satunya adalah dalam perkara nomor 533/K/TUN/2017 di mana melibatkan unsur pidana dan unsur tata usaha negara. Kesalahan (schuld) dari terpidana menyebabkan aparatur sipil negara terkena pemecatan. Prosedur pemecatan yang kurang tepat menjadi unsur keberatan dalam pemecatan dalam sengketa tata usaha negara ini sekalipun unsur kesalahan (pidana) secara jelas terbukti. Tujuan penelitian ini untuk mengetahui dan menganalisis dasar penentuan kaidah dalam sistem peradilan. Penentuan kaidah memerlukan analisis mendalam terhadap filsafat hukum. Melalui metode penelitian yuridis-normatif maka akan dijelaskan pemilihan atau dasar argumen Mahkamah Agung lebih menekankan aspek substantif daripada formil di dalam menyelesaikan perkara ini. Kaidah hukum substantif lebih menjadi landasan lebih tinggi dari kaidah hukum formil dan dipertegas kembali dalam SEMA Nomor 1 Tahun 2017. Melalui teori tiga nilai dasar Gustav dapat diketahui bahwa pemilihan kaidah substansi ini memiliki pertimbangan aspek keadilan (filosofis) dengan memperhatikan peristiwa konkret (sosio-empiris) sehingga bermanfaat bagi negara dan masyarakat.

Abstract

The electronic ID card program has only been launched in the last few years. This aims at the effectiveness and efficiency of public services and minimizes illegal immigrants entering the country. In its implementation, the last few years have had many unexpected obstacles, such as cases of e-ID card corruption and lack of blanks. In this research, the aim is to know directly the function of e-KTP which in its implementation is given by one person and one database. The method used is qualitative to be able to know thoroughly. The results have been seen from this study are that the e-KTP function has actually been running but has not met the expectations of the community. Income is very much needed from improving individual personal data which is summarized in the e-KTP of each resident. Making e-KTP also plays a role in the follow-up process, namely data collection. That’s a government job and the provision of public services or public services so that an accurate and credible database can be created

Abstract

This study aims to analyze the implementation of Gender Responsive Planning and Budgeting (PPRG) in Batu City. Analytical techniques use qualitative methods with a focus on general budgets, which incorporate gender assumptions and distribute budget allocations that take account of their gender impact. Data obtained through in-depth interviews with purposive sampling on staff and employees who know and engage in budgeting. Furthermore, to study strategic policy document of Batu City, that is; RPJMD documents, RKPD documents and APBD documents by 2016. The results of research on gender responsive planning and budgeting process in the Regional Government Work Units (SKPD) have not been fully implemented due to the fact that the Regional Regulation (Perda) has not yet been established as the basis of Gender Equality Gender (PUG) . There is no PUG Working Group at city and Focal Point level in SKPD. Budgeting also does not use gender analysis in the form of Gender Analysis Pathway (GAP) and Gender Budget Statement (GBS). In fact, these instruments become formal evidence of the existence of gender responsive planning and budgeting in Batu City Local Government.DOI: https://doi.org/10.26905/pjiap.v3i1.2275

Abstract

The research aim was measuring perception of students to equality of opportunity to get higher education at Tribhuwana Tunggadewi University. To meet the aim and collect the primary data, a questionnaire survey was held to 326 Tribhuwana Tunggadewi active students in the year of 2019 by simple random sampling. Data validation was with construct validity and Alpha Cronbach. The analyzed data was with a quantitative technique by Microsoft Excel and IBM SPSS 22. The research results measured from the prospects that most students perceived “yes” the admission pathways were diverse (M = 6); the admission phases were enough (M = 6); the information and requirements were clear (M = 6); the campus promotion got to school (M = 5); most students perceived admission opportunity to all class (M = 6); and most students perceived “no” ethnic discrimination when registering (M = 4). From the means equality, most students perceived “yes” the admission test was acceptable for all registrants (M = 6); the general test informed the score to the registrants (M = 6); the registration rules equal for all registrants (M = 6); the general test informed schedule before (M = 6); the admission considered achievements, interests, and talents (M = 6); and the applicants passed the general test accepted (M = 6). The research results had a measurement score if it was true significant that the mean of perception equals to 6 of the undergraduate students perception.

Abstract

Indonesia is a country with rich and diverse natural resources. Batu is a city in Indonesia which popular because of its tourism potential. In the effort to develop the tourism, the Government of Batu designed several tourism policies. In tourism development, Government of Batu refer to sustainable development. This article tries to describe and analyze the role of Government of Batu to implement the tourism development policy based on the sustainable development paradigm. Research method used is descriptive qualitative using primary and secondary data. Data gathered through observation, interview, and documentation. This research found that the implementation of tourism policy in Batu has met the principles of sustainable development namely, economic welfare, sustainable environment, social justice, and living environment oriented. The Government of Batu plays significant role in creating the policy in general and regulating permissions, implementing prosociety policy and controlling private sectors investment in Batu.

Abstract

Malang City as one of the developed cities in Indonesia has a lot of development potential. Development in the city certainly has its own obstacles. Malang City is experiencing growth and an increase in population. This certainly affects all regional developments in this city. One of the obstacles to this development is a legal vacuum in the provision of a cemetery for the public interest which is carried out by local governments based on the Regional Government Law. This study aims to find out the gaps in the authority of local governments in land acquisition through the agenda of Reserve Funds and land acquisition in the public interest. This study used a normative legal method that takes regulatory data from the central to regional governments and analyzed it using legal theory and social analysis. This study concludes that the procurement of cemeteries by the local government can be carried out by means of a limited area of 5 hectares and can be submitted through a reserve fund. A reserve fund is established because large-scale developments cannot be completed in one fiscal year.

Abstract

Abstract : The purposes of this research were to know the strategy used in improving clean water service in Batu and to know the supporting and inhibiting factors that influence the improvement of clean water service in Batu. This research used qualitative research method. The location of this research was in Regional Water Company (PDAM) of Batu located on Jl. Kartini No. 10. The strategy used by PDAM of Batu in improving the quality of clean water and clean water service for the population with minimum coverage of 80% was by developing the clean water sector institution then, PDAM of Batu could increase the income and improve the efficiency so that PDAM of Batu could benefit by increasing the quantity and quality of clean water services and maintain the carrying capacity of the surrounding environment. People of Batu were quite satisfied with the service provided by PDAM of Batu so far. On the other hand, PDAM of Batu has added more pipes to cover all Batu areas. Penelitian ini mengunakan metode penelitian kualitatif. Lokasi penelitian ini adalah Perusahaan Daerah Air minum ( PDAM) Kota Batu terletak di Jl. Kartini No. 10 Kota Wisata Batu. Strategi yang digunakan oleh PDAM Kota Batu dalam meningkatkan kualitas air bersihadalah meningkatan pelayanan air bersih bagi penduduk dengan cakupan minimal 80% dengan mengembangkan kelembagaan sektor air bersih maka, PDAM Kota Batu dapat meningkatkan pendapatan dan meningkatkan efisiensi sertaPDAM Kota Batu dapat memperoleh keuntungan dengan cara meningkatkan kuantitas dan kualitas pelayanan air bersih dan menjaga daya dukung lingkungan sekitar. bahwa masyarakat Kota Batu merasa cukup puas atas pelayanan yang diberikan oleh PDAM Kota Batu selama ini. Di lain sisi PDAm Kota Batu juga melakukan penambahan pipa-pia untuk menjangkau pelayanan hingga pelosok Kota Batu. Kata Kunci : Strategi PDAM, Peningkatan Kualitas Air Bersih, Pembangunan Kota Batu

Abstract

Abstract: Community empowerment in handling waste with waste bank based is one of the responsibilities of the local government. The problem of handling waste cannot be resolved by the government only but it involves the community. This type of research used a qualitative descriptive. The technique of determining informants used a snowball sampling with a chain technique. The data was collected through observation, interviews, documentation. While the data analysis used data reduction, data presentation, conclusions, and testing the validity of data through triangulation techniques. The results of the study showed that the community empowerment efforts in handling waste with waste bank based were carried out by the Batu Environmental Agency in form of socialization and training through village and kelurahan officials who have waste banks. The socialization was carried out in formal and non-formal ways to the community to provide an understanding of waste bank-based management. The supporting factors in empowering community in handling waste with waste bank-based in Batu were waste scales, forming communities, conducting socialization and training. While the inhibiting factor were the technical challenge for the government and a lack of community participation.Keywords: Community Empowerment, Waste BankAbstrak: Pemberdayaan masyarakat dalam penanganan sampah berbasis bank sampah adalah salah satu tanggung jawab pemerintah daerah. Permasalahan penanganan sampah tidak dapat diselesaikan oleh pemerintah harus ada keterlibatan masyarakat. Jenis penelitian menggunakan deskriptif kualitatif. Teknik penentuan informan menggunakan snowball sampling mengambil teknik berantai. Teknik pengumpulan data melalui observasi, wawancara, dokumentasi. Teknik analisa data dilakukan dengan reduksi data, penyajian data, kesimpulan, dan menguji keabsahan data melalui triangulasi teknik. Hasil penelitian membuktikan bahwa upaya pemberdayaan masyarakat dalam penanganan sampah berbasis bank sampah yang dilakukan oleh Dinas Lingkungan Hidup Kota Batu seperti sosialisasi dan pelatihan melalui perangkat desa dan kelurahan yang memiliki bank sampah. pelaksanaan sosialisasi dilakukan dalam bentuk  formal maupun non formal kepada masyarakat untuk memberikan pemahaman dalam penanganan sampah berbasis bank sampah,   Faktor pendukung dalam upaya pemberdayaan masyarakat dalam penanganan sampah berbasis bank sampah di Kota Batu adalah alat timbang bank sampah, membetuk komunitas,  mengadakan sosialisasi dan pelatihan. Sedangkan faktor penghambat adalah secara teknis juga menjadi tantangan bagi pemerintah dan kurangnya partisipasi masyarakat. Kata Kunci: Pemberdayaan Masyarakat, Bank Sampah

Abstract

Abstract: Village Information System (SIK) is a Data Bank from the village that after processing it becomes a Data Base which later in the service will simplify and accelerate the service process itself. The method of this research uses qualitative research by using informant determination snowball sampling techniques. Based on the results of the research that the Effectiveness of the Urban Information System (SIK) in Improving Public Services is quite good, it can be seen from the indicators of effectiveness measurement, namely understanding the program, being on target, on time, achieving goals and real changes. Factors that support the implementation of the village Information System (SIK) in improving public services in Sisir City, Batu City are good cooperation and communication between the village and civil records as well as increased human resources and adequate servers, adequate and suitable computers and competent friendly staff or service personnel. The inhibiting factor is in the form of internet network disruption which results in the system so that it switches to manual services and there is a difference in the number of residents so that data updates need to be held every month. Keywords: Effectiveness, Village Information Systems (SIK) and Public ServicesAbstrak : Sistem Informasi Kelurahan (SIK) merupakan Bank Data dari kelurahan yang setelah diolah maka  menjadi Data Base yang nantinya dalam pelayanan akan mempermudah dan mempercepat proses layanan itu sendiri.Metode penelitian ini menggunakan penelitian kualitatif dengan menggunakan teknik penentuan informan snowball sampling. Berdasarkan hasil penelitian bahwa Efektivitas Sistem Informasi Kelurahan(SIK) Dalam Meningkatkan Pelayanan Pubik sudah cukup baik, dapat dilihat dari indikator pengukuran efektivitas yaitu pemahaman program, tepat sasaran, tepat waktu, tercapainya tujuan dan perubahan nyata. Faktor yang mendukung dalam pelaksanaan Sistem Informasi Kelurahan (SIK) dalam meningkatkan pelayanan publik di Kelurahan Sisir Kota Batu ialah adanya kerjasama  dan komunikasi yang baik antara kelurahan dan catatan sipil serta SDM yang sudah meningkat serta adanya server yang mencukupi, komputer yang memadai dan layak pakai serta staf atau petugas pelayanan yang ramah berkompeten. Pada  Faktor penghambatnya merupakan berupa gangguan jaringan internet yang berakibat pada sisitem tersebut sehingga beralih ke pelayanan yang bersifat manual serta adanya selisih jumlah penduduk sehingga perlu diadakan update data di setiap bulan.Kata Kunci: Efektivitas, Sistem Informasi Kelurahan (SIK) dan Pelayanan Publik

Abstract

Abstract: The ideal development of the region requires a substantial fund, in which the funds are in addition to taxes, also obtained through investment. Investment related policies are implemented through Local Regulation no. 1 year 2015. Thus need to do research related to the implementation of local regulations on the level of investment in the city of Malang. The research method used qualitative research, data collecting technique such as observation, interview, and documentation, type and data source include primary data and secondary data. The research instruments include the researcher himself, the interview guide, and the field notes. Sampling technique includes purposive sampling with innforman include DPMPTSP government. Data validity using triangulation technique. Analysis with Reduction, Presentation, and Conclusions. The development of investment flows in the poor city in recent years experienced tidal conditions marked by an increase and decrease in the number of investments. Therefore, the participation of investors and the public is very important in improving the progress of Malang. Keywords: Public Policy, Implementation, Procedure, and Investment Abstrak: Pengembangan wilayah yang ideal membutuhkan suatu dana besar, dimana dana tersebut selain diperoleh dari pajak, juga diperoleh melalui bidang investasi. Kebijakan terkait investasi di implementasikan melalui Perda No. 1 tahun 2015. Dengan demikian perlu dilakukan penelitian terkait implementasi Perda terhadap tingkat penanaman modal di Kota Malang. Metode penelitian mengunakan jenis penelitian kualitatif, teknik pengumpulan data antara lain observasi, wawancara, dan dokumentasi, jenis dan sumber data meliputi data primer dan data sekunder. Instrumen penelitian meliputi peneliti itu sendiri, panduan wawancara, dan catatan lapangan. Teknik sampling meliputi purposive sampling dengan innforman meliputi pemerintah DPMPTSP. Keabsahan data menggunakan teknik triangulasi. Analisis dengan Reduksi, Penyajian, dan Penarikan kesimpulan. Pengembangan arus investasi di Kota malang dalam beberapa tahun ini mengalami kondisi pasang surut ditandai penaikan dan penurunan jumlah penanaman modal. Karena itu, partisipasi investor dan masyarakat sangat penting dalam meningkatkan kemajuan Kota Malang. Kata kunci: Kebijakan Publik, Implementasi, Prosedur, dan Penanaman Modal
