Abstract

The Domestic Violence Law stipulates an alternative for judges to impose additional penalties in the form of referrals for counseling aiming at providing protection to victims, either as preventive measures or preventive ones. There are three important principles that should frame the assistance provided to the victims by the law enforcers, health workers, social workers, companion volunteers, and spiritual counselors namely: (1) protection to the victims, (2) Sensitivity to the interests of the household, (3) leads to household unity and harmony. This research is designed as a normative research based on documentary research, while the analysis of the collected data is carried out and presented in a qualitative-descriptive manner. This study concludes three important things. First, additional punishment in the form of orders for perpetrators of domestic violence crimes to attend counseling so that the perpetrators can be aware of their actions and willing to change not to commit acts of violence again. Second, the implementation of counselling the perpetrators of domestic violence should take into consideration judicial and sociological requirements when providing counselling as an additional penalty in the form of orders. Third, study finds that attending counseling benefits the family in maintaining the unity of the family and that the children can be raised in a more conducive atmosphere. The weakness of the approach is that the process is time consuming and requires the deployment of more resources.

Abstract

Kupang District is ranked 5 with the highest number of infant mortality in East Nusa Tenggara Province. The total infant mortality 86 and 96 cases in 2018 and 2019, respectively. The purpose of this study was to analyze the risk factors influencing infant mortality in West Kupang Subdistrict. This study used a case-control study design and the respondents were mothers who had babies aged one year old in 2020 with a sample size of 42 people. Data collection used a questionnaire from each variable under the study. The data were analyzed using the chi-square test to see the OR value in order to determine the risk of exposure. The results showed that there was a significant relationship between maternal age during pregnancy (OR= 351; p= 0.000), socioeconomic status (OR= 10.8; p= 0.006) birth weight (OR= 8.2; p= 0.005), premature abnormalities (OR=36; p= 0.000), parity (OR= 5.4; p=0.033), congenital diseases or disorders (OR= 6.6; p=0.000), birth spacing (OR= 8.3; p=0.008), participants in the family planning program (OR= 7.5; p=0.01), antenatal check-up (OR= 8.3; p=0.008), delivery complications (OR= 15; p= 0.000 ), husband's support (OR= 3.8; p= 0.01) with infant mortality. Education and information communication strategies should be improved to create behavior supporting the health of pregnant women and to prevent infant mortality.

Abstract

Stunting toddlers have a risk of decreased intellectual ability, productivity, and an increase in degenerative diseases in the future. The results of the 2018 Riskesdas show that East Nusa Tenggara Province is the province with the highest proportion of of short and very short nutritional status of children under five, which is 42.4%. The purpose of the study was to analyze the risk factors for stunting in children under five in the working area of the Batakte Health Center. The research design was a case-control study. The research subjects were toddlers aged with the case group being stunted toddlers while the control sample was normal toddlers with a ratio of 1:1 as many as 48 toddlers and mothers of toddlers as respondents. Data analysis used the chi-square test and OR calculation to assess risk factors. The research was conducted in the working area of the Batakte Health Center from August-October 2021. Research variabels are history of infectious disease, low birth weight, maternal education, parenting style,maternal occupation age at pregnancy and gestational age. The results showed that there was a relationship between a history of infectious disease (OR=5,000; 95% CI 1,165-21,459), low birth weight (LBW) (OR=5,909; 95% CI 1,546-22.580), maternal education (OR=4,491; 95% CI 1,260-16,006) and parenting style (OR= 6,000; 95% CI 1,711-21,038) with stunting in children under five, while maternal occupation, age at pregnancy and gestational age were not associated with stunting in children under five in the region Batakte Health Center

Abstract

Kejaksaan Negeri Timor Tengah Utara merupakan salah satu unit kerja Kejaksaan Republik Indonesia yang berkedudukan di Kabupaten Timor Tengah Utara yang melalui seksi Intelejennya secara nyata telah melakukan usaha pemberantasan tindak pidana korupsi di wilayah hukumnya. Meskipun demikian dalam pelaksanaannya tidak mudah bagi Intelejen Kejaksaan Negeri Timor Tengah Utara untuk mendapatkan temuan-temuan tindak pidana korupsi dan masih terdapat dugaan-dugaan tindak pidana korupsi yang belum tuntas diselesaikan. Penelitian ini merupakan yuridis empiris yakni penelitian yang mengacu pada efektifitas hukum. Jenis dan sumber data yang diperoleh adalah melalui wawancara sebagai data primer dan didukung dengan data sekunder yang berasal dari buku, peraturan perundang-undangan dan lain-lain. Data yang diperoleh akan diolah dan dianalisis secara dekskriptif-kualitatif. Hasil penelitian ini menunjukan bahwa (1) Kejaksaan merupakan satu landasan dalam pelaksanaan tugas dan wewenangnya di bidang penuntutan, tidak ada lembaga lain yang berhak melakukan penuntutan kecuali yang berada di bawah kendali Jaksa Agung sehingga dimanapun jaksa berada baik jaksa yang dikaryakan Komisi Pemberantasan korupsi (KPK) maupun jaksa yang ditugaskan di daerah merupakan bagian yang tidak terpisahkan dari lembaga kejaksaan. (2) Melakukan kegiatan penyelidikan, pengamanan, dan penggalangan untuk melakukan pencegahan tindak pidana guna mendukung penegakan hukum dan memberikan dukungan intelejen kejaksaan bagi keberhasilan tugas dan kewenangan kejaksaan, melakukan koordinasi serta pemantapan kesadaran hukum masyarakat. (3) Melakukan kegiatan penyelidikan sejak dikeluarkan surat perintah dimulainya penyelidikan kemudian hasil temuan dari penyelidikan diolah dan dianalisis kemudian diberikan kepada pimpinan untuk dipelajari.

Abstract

Along with the development of criminal acts more prevalent time occurs not only adults but also children can also be perpetrators and victims of criminal acts. This is because every child has a different condition from adults, children have physical and mental immature and are very easily influenced by other parties. Forms of legal protection from the government for children who are victims of criminal acts include compensation, compensation, and restitution. Restitution is the payment of compensation charged to the perpetrator based on a court decision with permanent legal force for material and/or immaterial losses suffered by the victim/his heirs. In this writing, the main focus will be restitution. Based on the case, the researcher formulated the main problems, namely: (1) How is the process of giving restitution to children as victims of sexual violence based on the decision of the judge in the Atambua District Court? (2) What are the supporting and inhibiting factors in the process of giving restitution to children as victims of sexual violence based on the decision of the judge in the Atambua District Court? This study uses empirical legal research methods that researchers conduct interviews with the parties concerned. Aspects of the study examined the process of restitution and the factors supporting and inhibiting the application of restitution. The results found that: (1) in terms of efforts to fulfill the right of restitution to children victims of sexual violence, law enforcement officers and victims have a role in pursuing the right of restitution. The investigator and the public prosecutor are obliged to inform the victim about the rights obtained by the victim. The victim can apply for restitution which can be done during the investigation process, prosecution, or after a decision with permanent legal force is read. (2) there are two factors that become obstacles in its implementation, namely legal factors and community factors.
