Abstract

The right to health is part of human rights. Health is closely related to everyday human life. The availability of health services and medicines, a clean and healthy environment, and other matters related to health are vital factors for human survival. In the COVID-19 pandemic situation, health is a basic need for all levels of society. The problems are, how the state's responsibility to fulfill the right to health in the conditions of the COVID-19 pandemic for the Indonesian people and how to fulfill the right to health for the Indonesian people in implementing the COVID-19 Test in terms of the International Covenant On Economic, Social , And Cultural Rights (ICESCR).This research uses Juridical-Normative by using the type of normative legal research data which is divided into primary legal materials, secondary materials and tertiary legal materials. The research analysis of this writing uses Descriptive-Qualitative and in collecting research data this research is obtained through library research and data access through journals, and the Internet.The results of this research are, first, the State has shown forms of responsibility in fulfilling the right to health in the conditions of the COVID-19 pandemic to the Indonesian people. providing test kits to detect the transmission of COVID-19 from several countries at varied and unaffordable rates for the public, issuing a package of rules as formal legitimacy for handling COVID-19, and giving orders to all people to comply with 3M, namely wearing masks, Wash your hands and keep your distance. Second, the fulfillment of the right to health for the Indonesian people in implementing the COVID-19 test has not been fulfilled by the State. The application of the nominal cost of the COVID-19 test is expensive, varied, and unaffordable for every element of society.

Abstract

Aircraft Interception is an action in which an aircraft moves towards another aircraft in an effort to intercept an aircraft entering national airspace without a flight plan, and an aircraft experiencing communication failure or cannot be identified. Interception actions are allowed in order to protect the sovereign territory of a country, as stated in Article 1 of the 1944 Chicago Convention which recognizes that every sovereign state has complete and complete sovereignty. However, the purpose of interception is limited to determining the identity of the aircraft, directing the aircraft beyond the boundaries of national airspace, directing it away from restricted, restricted or dangerous areas or ordering it to land at a designated airport.. The identification of the problem in this research is, How is the regulation of the interception of civil aircraft by state military aircraft reviewed based on the 1944 Chicago Convention? and What are the legal consequences of the actions of the Belarusian Military Aircraft against the interception of the Ryanair FR4978 Civil Aircraft?This research was conducted using a normative juridical research method. The data collection technique was carried out by literature study and the analysis used in this paper is qualitative analysis by describing or explaining the subject or object of research.The results of this study are first, the regulation of interception actions on civil aircraft is specifically regulated in Article 3 bis of the Chicago Convention 1944 as well as in additional arrangements in Annex 2 to the Convention on International Civil Aviation Rules of the Air which contains instruments or procedures for interception. . Second, the legal consequences received by Belarus for unlawful acts that threaten the security of civil aviation are the imposition of sanctions by the international community in the form of flight restrictions and restrictions on the economic sector, as well as the summons of the Belarusian Ambassador to the European Union

Abstract

Kondisi Hutan Mangrove di Pulau Panjang Kabupaten Serang saat ini dalam kondisi yang memprihatinkan, banyak diantaranya telah mati dan dalam kondisi yang buruk, keadaan tersebut mengakibatkan Pulau Panjang sering terkena abrasi dan banjir rob yang masuk pada wilayah pemukiman masyarakat. Penyebab kondisi tersebut oleh aktifitas penebangan mangrove oleh masyarakat sekitar. Bahwa kurangnya rasa memiliki masyarakat terhadap hutan mangrove yang ada pada wilayahnya karena faktor kebutuhan terhadap kayu mangrove dan pola fikir tentang keuntungan dari mangrove tersebut. Penulis melihat bahwa permasalahan itu perlu adanya terobosan pada masyarakat agar memiliki rasa memiliki terhadap mangrove dan berkeinginan untuk terus melestarikan keberadaan mangrove di lingkungannya. Terobosan berupa pemberian insentif bagi masyarakat yang melestarikan mangrove. Ketentuan pelestarian mangrove telah banyak diatur oleh hukum positif, termasuk dalam Peraturan Daerah di Kabupaten Serang, namun Kabupaten Serang belum menerapkan peraturan atau regulasi tentang pemberian insentif pelestarian mangrove sehingga masyarakat cenderung melihat secara umum mangrove tidak memberikan keuntungan pada mereka. Dalam penulisan ini dilakukan dengan metode yuridis normatif, yaitu mengkaji faktor-faktor peraturan yang mengatur objek penulisan yang kemudian pengumpulan data melihat keadaan faktual yang kemudian menyimpulkan permasalahan tersebut

Abstract

Between states definitely need one another. Because of these needs, countries create a relationship and it is diplomatic relations. Therelationship was not always good between those countries who met with expulsions, officials commonly referred to as non grata that people often met. The identification of the problem in this research is, Is the Russian Government's Countermeasures Against US Diplomatic Officials Justified by the 1961 Vienna Convention? Is Russia's Application of the Persona Non Grata Principle to US Diplomatic Officials a Violation of the 1961 Vienna Convention?Is Russia's Application of the Persona Non Grata Principle to United States Diplomatic Officials a Violation of the 1961 Vienna Convention? This research uses the Theory of State Sovereignty and the Principle of Reciprocity. The method used in this research is normative juridical method which uses secondary data. Uses descriptive analytics, and further of data collection technique using library research which analyses with qualitative analysis by describing or explaining the subject or object of research. The results of this research are first, Russia's countermeasures carried out by the Russian government against United States diplomatic officials cannot be justified by the 1961 Vienna Convention. Because countermeasures in the form of persona non grata are specifically regulated in Article 9 that states are allowed to carry out persona non grata without any reason and this must be done based on the sovereignty of the country and the principle of reciprocity. Second, the declaration of persona non grata by Russia to United States Diplomatic Staffs lies in several violations of the 1961 Vienna Convention, because in declaring persona non grata stated by Article 9 in means without reason, a state must pay attention to other provisions stipulated in the 1961 Vienna Convention. Basically, Russia abuses the declaration of persona non grata against a sending country because a sending country must be based on several criteria for violating actions and paying attention to other provisions of the Convention in order to maintain relations between countries and international peace.

Abstract

The International Convention on the Protection of the Rights of All Migrant Workers and Members of Their Families, established in 1990, provides general regulations for the legal protection of migrant workers. Indonesia has adopted this convention by ratifying it through Law No. 6 of 2012 on the Ratification of the International Convention on the Protection of the Rights of All Migrant Workers and Members of Their Families. Further specific regulations on the protection of Indonesian migrant workers are outlined in Law No. 18 of 2017 on the Protection of Indonesian Migrant Workers. The protection of Indonesian migrant workers involves three stages: pre-employment protection, protection during employment, and post-employment protection. These stages require direct involvement from the state in providing adequate protection. The International Law Department of the Faculty of Law at Universitas Sultan Ageng Tirtayasa, in collaboration with the Pabuaran and Sindangsari Villages in Serang Regency, Banten Province, conducted a community service program that offered legal services to villages that serve as sources of migrant workers within the Untirta Sindangsari campus.

Abstract

As the fishermen must have permissions when they are going to do the fishing in the sea. Permission is a thing that must be owned by the fishermen so that they are not categorized as the theft of fish (illegal fishing) so that they may incur sanctions based on the applicable law.Based on the condition, need to be pursued and extension activities of the law to the fishermen community so that they can manage the marine resources, particularly fish resource with responsible and sustainable or at least fishing activities that they did not illegal.Coastal Community development is an integral part of the management of coastal and marine resources for the prosperity of society that it needs to be used an approach where the community as an object as well as the subject of development.Coastal Community Development Strategy, is seen not only as social and cultural issues but more as an integral part of the problem, therefore, resolution need to be done through a comprehensive strategy by placing the social-economic system and cultural values that are inherent in the community as a factor driving the changes.
