Abstract

Tujuan: Artikel ini bertujuan untuk mengetahui dan menganalisis pembiayaan proyek yang dilakukan menggunakan sukuk tabungan seri ST-003 underlaying asset proyek dalam APBN Tahun 2019. Penggunaan sukuk dalam pembiayaan proyek akan berdampak pada kemudahan dalam berusaha di Indonesia dan lebih dikenal dengan EoDB. Metodologi: Metode yang digunakan dalam penelitian ini termasuk penelitian yang melakukan kegiatan kajian literatur. Sedangkan dalam penyusunan artikel ini menggunakan metodologi pendekatan yuridis normatif, yaitu penelitian hukum yang menitikberatkan pengkajian terhadap data dari mengumpulkan dan mempelajari buku-buku, dokumen-dokumen resmi, hasil-hasil penelitian yang berwujud laporan dan seterusnya guna mendapatkan data sekunder. Temuan: Adanya Peraturan Pemerintah No. 56 Tahun 2011 tentang Pembiayaan Proyek Melalui Penerbitan Surat Berharga Syariah Negara dan di ikuti dengan peraturan pelaksana dalam Peraturan Menteri No. 113/PMK.08/2013 guna mendorong pertumbuhan ekonomi melalui sektor investasi dan pembangunan infrastruktur. Pembangunan infrastruktur yang baik akan berdampak pada kemudahan dalam berusaha di Indonesia. Ease of Doing Buisness (EoDB) atau yang lazim dikenal dengan kemudahan dalam berusaha di suatu negara merupakan patokan terhadap suatu negara bagi investor yang akan menanamkan modalnya di negara tujuan investasinya. Lancarnya suatu pembiayaan proyek tidak terlepas dari alokasi risiko yang baik. Kegunaan: Penelitian ini bermanfaat dalam mengalokasikan risiko dalam pembiayaan proyek yang dilakukan menggunakan sukuk tabungan seri ST-003 underlaying asset proyek dalam APBN Tahun 2019. Kebaruan/Orisinalitas: Risiko dalam pembiayaan proyek merupakan bentuk dari prinsip kehati-hatian dalam pengelolaan dana dalam investasi yang di sediakan oleh pemerintah guna pembangunan infrastruktur. Dana yang dikeluarkan dari sukuk merupakan dana yang dihimpun dari masyarakat dan negara sebagai pengelola dirasa perlu berhati-hati dalam pengelolaannya. Abstract

Digital assets in the broadest sense can be interpreted to cover all electronic assets including social media accounts. Nowadays, besides being used to interaction, social media accounts can also be utilized to gain income or material benefits. In addition, social media accounts are generally handled by influencers with abundant followers. One of the social media used by influencers on the internet is YouTube. The social media actors on YouTube are referred to as YouTubers or content creators. This research is a normative juridical legal research with the descriptive method of analysis. The result of the study shows that YouTube accounts as digital assets in practice can be used as assets in business activities. This is proven by the existence of a YouTuber or content creator who sells his account for charity or commercial purposes. In the future, YouTube accounts can potentially be a digital asset that can be used as a collateral object due to its economic value. Nevertheless, based on the property of law in Indonesia, YouTube social media accounts as a digital asset cannot be qualified as an asset yet, therefore a redefinition, a reconceptualization and a reform of the property of law are considered necessary.

Abstract

Pengalaman krisis tahun 2008 menunjukkan bahwa permodalan yang kuat tidak menjamin Bank mampu bertahan menghadapi krisis. Kesulitan yang dihadapi sebagian besar Bank pada saat itu disebabkan antara lain oleh ketidakmampuan Bank dalam memenuhi standar terkait prinsip dasar pengukuran dan penerapan manajemen risiko likuiditas. Oleh karena itu kerangka Basel III yang dikeluarkan oleh Basel Committee on Banking Supervision (BCBS) menyempurnakan kerangka permodalan yang ada (Basel II). Berdasarkan ketetntuan Basel III setiap Bank diwajibkan memenuhi Net Stable Funding Ratio (NSFR) yang diharapkan dapat memperkuat sisi kesehatan dan daya tahan individual bank dalam menghadapi krisis. Sebagai tindak lanjut kewajiban penerapan NSFR, OJK telah menerbitkan POJK No: 50/POJK.03/2017 Tentang Kewajiban Pemenuhan Rasio Pendanaan Stabil Bersih yang bertujuan mengurangi risiko likuiditas terkait sumber pendanaan untuk jangka waktu yang lebih panjang dengan mensyaratkan bank untuk mendanai aktivitas dengan sumber dana stabil yang memadai dalam rangka memitigasi risiko kesulitan pendanaan pada masa depan. tulisan ini akan mengkaji dan mengalisis aspek hukum terkait kewajiban pemenuhan NSFR sebagai upaya pengelolaan likuiditas Bank dan implikasi yuridisnya terhadap pengawasan Bank sebagai upaya menciptakan perbankan yang sehat. Penelitian bersifat deskriptif analitis, yaitu membuat pencandraan secara sistematis, faktual dan akurat mengani fakta-fakta. Penelitian ini merupakan penelitian yuridis normative dengan pendekatan Undang ? Undang (Statue approach) dan pendekatan konsep (Conceptual Approach). Kewajiban pemenuhan NSFR sebagai upaya pengelolaan likuiditas ini merupakan bagian dari pengawasan mikroprudensial yang menjadi kewenangan OJK, yang juga berkaitan dengan kebijakan makroprudensial yang menjadi kewenangan Bank Indonesia. Dalam hal Bank mengalami kesulitan likuiditas, maka Bank Indonesia sebagai lender of the last resort.

Abstract

Applicability of the Financial Services Authority Regulation (POJK) No. 51 of 2017 on Sustainable Finance will gradually require banks to apply the principles of sustainable finance. One of the banking commitments to realize sustainable banking is carried out through the implementation of social and environmental responsibility (CSR) that integrates economic, social, environmental and governance aspects. The legal issue in implementing CSR is the change like regulation, which is all voluntary rules to become obligatory rules. Also, banking CSR practices require adjustments to accommodate sustainable financial principles to realize sustainable banking. The approach method used in this study is a normative juridical approach with descriptive, analytical research specifications, using secondary data in the form of primary, secondary and tertiary legal materials analyzed qualitatively juridically. The results of the study indicate that the regulations governing CSR as a commitment of banks to realize sustainable banking still require more detailed arrangements, specifically the determination of the amount and source of CSR funds and sanctions for violations of CSR. Also, banks have not been optimal in using CSR as a means to accelerate the realization of sustainable banking. The effort that must be made by banks is to include CSR as part of the company's value and change the view that CSR is a good practice of banking that will generate long-term benefits for all stakeholders.

Abstract

Tujuan Penelitian: Salah satu hambatan untuk meningkatkan likuiditas transaksi Bursa adalah keterbatasan sumber dana bagi Anggota Bursa untuk memfasilitasi pendanaan transaksi Efek. Kehadiran Lembaga Pendanaan Efek (LPE) diharapkan dapat menjadi solusi untuk mengatasi keterbatasan pendanaan tersebut. Penelitian ini bertujuan untuk mengkaji keberadaan LPE dari perpektif hukum, khususnya aspek hukum perjanjian dan hukum jaminan.  Metode Penelitian: Kajian dilakukan dengan menggunakan pendekatan yuridis normatif yang menitikberatkan pada studi literatur dan peraturan perundang-undangan terkait likuiditas transaksi bursa dan pertumbuhan pasar modal melalui pendanaan transaksi efek. Temuan: Berdasarkan kajian diperoleh hasil bahwa LPE dibentuk  untuk mengatasi keterbatasan pendanaan dalam meningkatkan likuiditas transaksi dalam rangka mendorong pertumbuhan pasar modal.  Kegunaan: Hasil penelitian ini dapat digunakan sebagai bahan atau literatur dalam mengembangkan regulasi di pasar  modal.  Novelty: Aspek hukum jaminan dalam pendanaan transaksi Efek masih memerlukan kajian lebih lanjut, mengingat POJK LPE tidak secara tegas menyebutkan pranata jaminan yang digunakan, namun mengingat objek jaminan adalah Efek atau dana, dapat disimpulkan jaminan yang digunakan adalah gadai. Namun demikian, terdapat beberapa ketentuan dalam POJK yang perlu disesuaikan dengan pengaturan gadai dalam KUHPerdata.

Abstract

The application of business licensing as a part of the ease of doing business has shifted the obligations present for business actors. One of the forms of said change is the absence of an obligation to conduct EIAs as a basic requirement to acquire a business license. This could boost investment in Indonesia. On the other hand, it also can prompt legal risks that are the revocation of business licenses towards actors that had failed to fulfill business license through OSS RBA. This provision impacts the application of the sustainable finance principle. Without the requirement of EIAs as the prerequisite of business licenses, banks gain the challenge of adjusting their approach towards the gaining of profits from long-term investments depends on a sustainable future on administering of credits by banks. The article aims to analyze the legal implications of changing regulation upon EIAs requirement on business licensing through Online Single Submission towards the application of the sustainable finance principle and the juridical consequences of the use of licenses based on commitments in the approval of bank credit. This research uses a normative juridical approach specifying in the descriptive analysis of primary and secondary law sources. The changed regulation upon EIAs requirement on business licensing through Online Single Submission has legal consequences for the bank to adjusting lending based on the debtor’s business activity stages and requiring EIA as the basis to provide credit on the applications of sustainable finance principle. Sustainable principle pushed out the alteration of banks' approach in the initiation of sustainable economic development with the gaining of profits from long-term investments dependant on future sustainable policy frameworks. The bank must take that approach is through policy frameworks that support sustainable economic development by crystallizing EIAs as a tool for credit decision.

Abstract

The main principle in banking activities is the prudential banking principle, which is regulated by Act No. 10/1998 on Amendment of Act No. 7/1992 concerning Banking as well as in Law No. 21/2008 concerning Sharia Banking. This prudential banking principle in practice is often normally interpreted, i.e only related to the provision of bank credit, or sometimes misinterpreted, resulting in a misperception of how and when this principle is applied in banking activities. This research uses the normative juridical approach with analytical descriptive research specification. Data were analyzed by qualitative juridical. Based on the research result, prudential banking principle must be applied starting from an institutional level, banking process, and services, including in banking credit. Banks are required to ensure compliance with regulations, including standard operating procedures issued by banks.

Abstract

Indonesian sharia banking industry’s growth chart shows a rising, albeit decelerating. Data published by the FSA indicates that Islamic banking accounted for 4.81% of market share to achieve the growth assets 11.97% as of June 2016. At the global level, the Islamic financial services sector including banking, control of 3% and together with Qatar, Saudi Arabia, Malaysia, United Arab Emirates and Turkey became the driving force of Islamic finance in the future. Based on the data above, efforts are needed to accelerate the growth of Islamic banking in both the national and global level to take advantage of opportunities that are still open. One of the strategic issues faced and the impact on the growth of national banks is understanding and awareness is still low, causing public misperception among others, relating to the terms, covenants and transparency of the product; as well as costly. The problem will be discussed is how the implementation of sharia governance can be used as a means to increase public confidence in the Islamic banking and ultimately encourage the growth of Islamic banking. Regulation on governance in Islamic banking mandated in Article 34 of Law No: 21 of 2008 concerning Islamic Banking which requires Islamic banks and Sharia implement good governance which include the principles of transparency, accountability, responsibility, professional and fairness in conducting its business activities with regard sharia principles in the form of a ban on business ac-tivities that contain elements of usury, maysir, gharar, zhulm, tabdzir, risywah and maksiyat. Besides Islamic bank based spiritual footing, which is committed to conducting business based on principles of halal and Tayib, so the function of Islamic banking can as an intermediary that is capable of pros-pering the people and sustainable. Therefore, Sharia Supervisory Board is obliged to ensure that banking activities comply with sharia and sharia governance principles.
