Abstract

The concept of wilâyat al-faqîh from Imam Khomeini was one of the products of Islamic thought. It has revive discourse on Islamic studies in various parts of the Islamic world. It is not only become a threat to the status quo of the Muslim rulers, in fact it has been raising the academic and scholarly discussion in the forums of national, regional, and international levels. The influence of the concept of wilâyat al-faqîh from Imam Khomeini to contemporary Islamic thought in Indonesia looked on discourse about the relation between religion and state. Indeed, the debate on religion-state relations have long occurred in Indonesia, but in academic discourse becomes increasingly crowded since the concept of wilâyat al-faqîh serve as the basis for the establishment of the Islamic State of Iran by Imam Khomeini. Effect the concept of wilâyat al-faqîh in contemporary Indonesian Islamic thought encouraged by the publication of books by/about Imam Khoemini and about Shia in general and the development of Shi'i institutions in Indonesia.

Abstract

By using reflective methods, this article seeks to elaborate the methods of interpretive learning in Islamic boarding schools. In developing methodological learning, it seems that the munâzharah method is the most appropriate, because this method can bring up bold and critical thinking on something that is already considered standard, so that creativity and innovation will develop brilliantly. The material being studied at pesantren is the interpretation of the Koran which is textualized in the classical books (al-turâts) which are now popularly known as the kitab kuning. From this book, the students absorb and draw religious knowledge to be developed and applied in society. With the development of modern scientific studies and the rapid growth of science and technology and economy accompanied by various social problems, the development of teaching methods and interpretation studies in pesantren must be renewed and refined, such as the munâzharah. With this method, teaching interpretations can stimulate the active involvement of students, both intellectually and emotionally, so that brilliant ideas emerge.

Abstract

Scientific and technological development creates so many kinds of new products concerning the telecommunication, automotive industry as well as medicine, technology of food and beverage and cosmetics, that this can cause the changes of social interaction among the society, and consequently, response is needed to face a challenging time and the changes of social life. Meanwhile, the number of texts (nash) of Alquran and hadis (prophetic saying) are limited to give the solution the new problems that appear. Based upon a reality, so this will encourage the attempt to grow and develop the Islamic law through Ijtihad (exerting individual as well as collective effort) being is more dynamic for the sake of the people welfare, fair human right protection, and improvement of the people’s standard of living. The writing tries to describe many kinds of factors of social changes responding to the law needed immediately, and are then followed by a great effort to reform the Islamic law suitable for all the time through ijtihad being more accurate and responsible.

Abstract

This article seeks to elaborate on the relationship between law, power, and justice from the Koran perspective. This study makes the Quranic texts its primary source. The study results show that from the perspective of the Koran, a legal system, including an Islamic legal order, must have the spirit to create justice. The realization of social justice is the spirit that underlies the stipulation of law. State power, through the legislative body, which is the institution that is authorized to stipulate law, is obliged to make the principle of justice one of a country’s legal pillars. State power through its judiciary must make “considerations for the sake of realizing justice” in every decision on a legal case.

Abstract

This study aims to compare the inheritance law in Egypt with the existing inheritance law in the compilation of Islamic law in Indonesia. More specifically, this comparative study focuses on the issue of mawani’ irtsi (barrier of inheritance) and inheritance of dzaw arham (relatives of male or female). This is a qualitative research based on library research. The content analysis method is used to describe mawani’ irtsi and dhaw arham in the inheritance laws of Egypt and Indonesia. The results of this study indicate differences between the inheritance laws of Egypt and Indonesia; first: the compilation of Indonesian inheritance law always adjusts to the times, while the Egyptian inheritance law is still traditional by maintaining the views of classical scholars. This is evident when it explained one barrier to inheritance namely religious differences; second: Indonesian inheritance legal material explored classical books, studied modern legislation, and observed local traditions. This can be seen when it explained that men and women get the same share as long as the basis of their agreement. While Egyptian inheritance laws do not take into account modern legislation and do not adopt local traditions; third: the material description in the compilation of inheritance law in Indonesia is concise and sometimes general in nature while the description of the material inheritance law of Egypt is more detailed. This is seen when it explained one of the barrier of inheritance is intentionally killing an heir. In the inheritance law of Egypt, it is explained in detail about types of killings which are a barrier to inheritance, while in the compilation of Indonesian inheritance law is explained in general.

Abstract

The objective of this work is to expound upon Shiite philosophy and constitutional theory by drawing upon the views and ideology of Imam Khomeini. In addition, this research endeavours to compare the constitutional ideas of Shiite and Sunni factions. This study employs the methodology of literature review. Several primary and secondary sources pertaining to the research objectives were thoroughly reviewed, analysed, and compared. The study's findings indicate that within Shiite ideology, the power and control over authority are exclusively attributed to God. Allah is the ultimate arbiter of all natural phenomena and every entity within it. God possesses supreme authority, possesses dominion, and bestows legislation. According to this philosophical understanding of existence, it is necessary for human civilization to be guided by a leadership that is of divine nature. In Shi'a thought, Muhammad's role as a prophet and messenger of Allah entails not only the responsibility of communicating divine law (al-qanūn al-ilāhi), but also the duty of putting that law into practice.

Abstract

One of the triggers for the spread of the COVID-19 virus is a crowd of people, while several Muslim religious ritual activities are carried out in the form of a crowd (congregation). To avoid crowds of people, the Indonesian Ulema Council issued religious fatwas so those ritual activities would not become a cluster for the spread of COVID-19. This study analyzes the Indonesian Ulema Council’s (MUI) fatwas during the COVID-19 pandemic using the legal maxim perspective. This study uses the literature review method. Some primary and secondary literature on MUI fatwas are analyzed critically to obtain a complete, detailed, clear, and systematic picture of MUI fatwas. The study results show that the entire MUI fatwa is based on the Islamic legal maxim theoretical framework, which aims to keep Muslims away from harm, eliminate difficulties and difficulties, and endeavor to benefit as many people as possible. Besides, the entire Fatwa refers to authoritative Islamic sources, namely the Koran, the Prophet’s Hadith, scholars’ opinions, and experts' views. This study’s results can be applied as a guideline for Muslims and Muslim medical personnel in implementing Islamic teachings in the era of the COVID-19 pandemic.
