Abstract

Studi ini dimaksudkan untuk mengkaji Strategi Keamanan dan Pertahanan di Selat Sunda, Hal ini dilakukan berdasarkan analisa dan evaluasi penanganan berbagai gangguan keamanan laut seperti perompakan, illegal fishing, illegal logging, penyelundupan, kecelakaan laut, pencurian harta karun dan lain-lain di perairan selat sunda. Selain itu, aparat penegak hukum juga wajib menjalankan kewajiban untuk melakukan pengamanan dan melaksanakan amanah Pasal 44 Konvensi Hukum Laut tahun 1982Penelitian ini menggunakan metode yuridis normatif dan bersifat deskriptif analitis, yaitu menganalisis identifikasi masalah dengan menggunakan data sekunder, kemudian dianalisis secara yuridis kualitatif. Hasil penelitian menunjukkan bahwa Solusi dalam memelihara keamanan di perairan selat sunda adalah Pengembangan Terobosan Kreatif berupa singkonisasi dan koordinasi dengan Dinas Maritim Provinsi Banten dalam hal pengukuran Kapal, Perumusan Peraturan Daerah terkait dengan pelayanan terhadap nelayan dan rencana pembuatan samsat perairan; Selain itu, Strategi dalam meminimalisir kejahatan di perairan selat sunda adalah mengoptimalisasi dukungan Pemda, Akademisi guna mengatasi situasi, kebutuhan dan pengimplementasian terobosan kreatif dalam rangka melindungi, mengayomi, melayani masyarakat, serta penegakkan hukum di wilayah perairan dapat di wujudkan melalui tindakan Preemtif, Preventif dan Edukatif serta kerjasama yang berkelanjutan Strategi dalam meminimalisir kejahatan di perairan selat sunda adalah mengoptimalisasi dukungan Pemda, Akademisi guna mengatasi situasi, kebutuhan dan pengimplementasian terobosan kreatif dalam rangka melindungi, mengayomi, melayani masyarakat, serta penegakkan hukum di wilayah perairan dapat di wujudkan melalui tindakan Preemtif, Preventif dan Edukatif serta kerjasama yang berkelanjutanStrategi dalam meminimalisir kejahatan di perairan selat sunda adalah mengoptimalisasi dukungan Pemda, Akademisi guna mengatasi situasi, kebutuhan dan pengimplementasian terobosan kreatif dalam rangka melindungi, mengayomi, melayani masyarakat, serta penegakkan hukum di wilayah perairan dapat di wujudkan melalui tindakan Preemtif, Preventif dan Edukatif serta kerjasama yang berkelanjutan.

Abstract

The overall objective underlying the establishment of the UN Security Council was to “save succeeding generations from the scourge of war” (Preamble to the UN Charter) which used as the official campaign by the Indonesia Foreign Ministry, Indonesia stated itself as ‘A True Partner for World Peace’. By that, Indonesia expresses the gravity of its membership by aiming towards ascertaining collaborations between the regional organizations in maintaining stability in the regional area (ASEAN). Indonesia’s goals for bridging UNSC hegemony on the global level and bringing the stability of the ASEAN area is going to be effortful. The challenge of establishing the UN resolution as a legal instrument in municipal law becomes one of the biggest challenges. The two years of tenure also grow into a barrier toward Indonesian contributions. This study aims to analyze Indonesia role as the non-permanent member of UNSC globally and in the ASEAN Region. The final results were presented in a descriptive manner, which gives an overview of how Indonesia’s role in the UNSC, and how Indonesia’s aimed toward synergized ASEAN.

Abstract

The United Nations Security Council (UNSC) is one of the six principal organs of the United Nations (UN), charged with ensuring international peace and security, recommending the admission of new UN members to the General Assembly, and approving any changes to the UN Charter. Its powers include establishing peacekeeping operations, enacting international sanctions, and authorizing military action. The UNSC is the only UN body with the authority to give a binding resolution on member states. This research shows that the Security Council as the major of the United Nations has the main task of maintaining international peace and security as mandated in the United Nations Charter. Actions that can be taken by the Security Council are to investigate any dispute that is deemed to be a threat to international peace and security, provide recommendations on method of how to dispute contention, and take action against aggression. In carrying out its functions, the Security Council need to move accordingly to the provisions of the United Nations Charter and applying the international law principles in particular, the principle of peaceful and fair settlement of a dispute. With the existing resolution, each country must adopt every resolution to regulate it in their country include Indonesia.

Abstract

University is required to adapt the teaching method, creativity, and innovation during the covid outbreak. The learning method used in Learning Management System (LMS) is mixed with online methods by utilizing both synchronous and asynchronous multimedia. This study developed into several steps; the first step is identifying the problem in class participation before applying LMS and comparing it with the class participation afterward. Problem identification is carried out with a learning survey currently being carried out at the International Humanitarian Law class in Universitas Sultan Ageng Tirtayasa while applying mobile LMS to enhance class participation. Untirta's bold LMS (SPADA Untirta) can be upgraded to a more practical level by implementing SPADA mobile LMS applications as a valuable embodiment of LMS;

Abstract

This study aims to identify the principles of CEDAW and analyze them to determine the effectiveness of these principles in reducing gender-based violence during the outbreak. The study was carried out using normative legal research methods that included a conceptual and statutory approach. A literature research will be used to acquire legal materials, and the legal materials will be assessed using CEDAW principles. The study's findings reveal that there are three foundational principles of the CEDAW these are non-discrimination, substantive equality, and state obligation. The principles are effective on plummeting gender-based violence in pandemic outbreak. The full application of the CEDAW principles remains a significant challenge.

Abstract

The development of information and communication technology makes it easier for humans to access everything without being limited by time, space, and distance so that they are connected in one space. Given cyberspace's borderless and anonymous characteristics, it encourages the emergence of criminal activities, namely cybercrime. Therefore, as a measure to prevent future damage, it requires not only regulatory laws and regulations but also international cooperation between countries is needed. These cooperation efforts can be implemented through the forum of regional organizations, namely ASEAN. Until now, many efforts have been made to encourage the improvement of cybersecurity through its various programs. Therefore, it is hoped that this increase in cooperation will further strengthen cybersecurity in the region to maintain security stability.

Abstract

Berdasarkan data Direktorat Perlindungan Warga Negara Indonesia Badan Hukum Indonesia (PWNI-BHI) Kementerian Luar Negeri RI, per tahun 2017 Indonesia merupakan pengirim pekerja migran terbesar di ASEAN, di mana jumlah Pekerja Migran Indonesia (PMI) di ASEAN sebesar 1.490.768 jiwa, mayoritas bekerja pada sektor informal/domestik. Data BNP2TKI mencatat bahwa pada tahun 2019 pada quartal pertama ada 32.915 PMI yang bekerja pada sektor informal dan 564 PMI berasal dari provinsi Banten (Data Penempatan dan Perlindungan PMI periode Maret 2019) Penelitian ini diajukan untuk memberikan kajian akademis terhadap polemik perlindungan tenaga kerja Indonesia di luar negeri. Bagaimana kebijakan dan peran pemerintah, serta aplikasi nyata ketika terjadi kasus-kasus tertentu. Sejak 2015, Pemerintah Indonesia telah melakukan moratorium terhadap pengiriman tenaga kerja Indonesia ke Timur Tengah. Moratorium di laksanakan untuk memastikan perlindungan yang lebih baik terhadap pekerja-pekerja Indonesia. Di lain pihak, usaha-usaha yang telah di lakukan tidak cukup untuk memberikan perlindungan minimum (standard minimum protection) terhadap tenaga kerja Indonesia. Migrant Care menyebutkan setidaknya 6 PMI di eksekusi mati dalam 10 tahun terakhir (Tempo online, 31 Oktober 2018). Apakah pemerintah dapat memberikan kepastiaan dan perlindungan hukum bagi para pekerja? Tujuan yang ingin dicapai dari penelitian ini adalah mengetahui fungsi dan proses perlindungan terhadap PMI di luar negeri yang diberikan pemerintah sebagai wujud peran pemerintah dalam melaksanakan tanggung jawabnya. Target khusus yang ingin dicapai adalah mengetahui kebijakan yang doable dalam perlindungan tenaga kerja Indonesia di luar negeri, mengetahui peranan pemerintah Indonesia dalam kasus-kasus yang dihadapi tenaga kerja Indonesia, kemudian memformulasikan kebijakan baru yang supportive terhadap tenaga kerja Indonesia. Metode pendekatan yang digunakan dalam penelitian ini adalah menggunakan metode yuridis empiris sebagai medode utama dan yuridis normative sebagai metode pendukung, dengan pendekatan efektivitas hukum, Spesifikasi Penelitian ini dikategorikan sebagai penelitian deskriptif analitik, yaitu mencari data atau gambaran seteliti mungkin mengenai objek dari permasalahan. Hasil analisis tersebut kemudian disajikan secara deskriptif yaitu memberi gambaran tentang perlindungan hukum yang aplikatif terhadap tenaga kerja Indonesia di luar negeri serta peran Indonesia dalam melindungi para pekerja sebagai tanggung jawab negara sebagai wujud dari implementasi sistem perlindungan terhadap pekerja Indonesia di luar negeri.

Abstract

The regulations concerning the protection of Indonesian migrant workers are outlined in Law No. 18 of 2017 on the Protection of Indonesian Migrant Workers (PMI). According to Article 7, the protection of prospective migrant workers must be provided in three stages: pre-employment protection, protection during employment, and post-employment protection. It is the responsibility of the state to ensure the provision of these protections. To facilitate services for prospective Indonesian Migrant Workers (CPMI) during the pre-departure stage, as well as for returned migrant workers and their families, the Ministry of Manpower initiated the establishment of Productive Migrant Villages (Desmigratif). Lempuyang Village, located in the Tanara District of Serang Regency, Banten Province, is one of the significant PMI-sending villages and is also among the targeted "Desa Binaan" villages of Untirta. This community service program adopts a community education approach through counseling sessions aimed at enhancing the understanding of Desmigratif. Additionally, training sessions are provided to CPMI in Lempuyang Village.

Abstract

Journal Nurani Hukum: Journal of Legal Studies, also known as Nurani Hukum, is a peer-reviewed journal focused on legal studies. The journal aims to publish high-quality research across various areas of legal scholarship, including but not limited to law and history, legal philosophy, sociology of law, socio-legal studies, international law, environmental law, criminal law, private law, Islamic law, agrarian law, administrative law, criminal procedural law, commercial law, constitutional law, human rights law, civil procedural law, and adat law. Published by the Faculty of Law, Universitas Sultan Ageng Tirtayasa in collaboration with the Asosiasi Pengelola Jurnal Hukum Indonesia (APJHI), the journal is released biannually in June and December. Each issue is made available on the website and further distributed in hardcopy format.The current edition, Volume VI Issue 1, June 2023, covers a wide range of legal and scientific fields, including civil, criminal, constitutional, and international law.
