Abstract

Akta Notaris mempunyai peranan penting dalam setiap hubungan hukum dalam kehidupan masyarakat, terutama dalam hubungan bisnis, kegiatan di bidang perbankan, pertanahan, kegiatan sosial, dan sebagainya. Kewenangan pembuatan akta tersebut juga tidak terlepas dari fungsi notaris yang harus disesuaikan dengan Undang- Undang Nomor 30 Tahun 2004 tentang Jabatan Notaris sebagaimana telah diubah dengan Undang-Undang Nomor 2 Tahun 2014. Sehingga, untuk mendukung akuntabilitas dan pengawasan terhadap kinerja Notaris yang ada di seluruh Indonesia, pemerintah telah menetapkan adanya Majelis Pengawas Daerah Notaris yang berada di setiap Kabupaten/Kota. Akan tetapi, meskipun telah terbentuk namun pelaksanaan fungsi pembinaan dan pengawasan yang dilakukan tidak selalu berjalan dengan baik, salah satu contoh adalah Majelis Pengawas Daerah (MPD) Notaris Kota Batam yang masih menghadapi berbagai kendala. Penelitian ini menggunakan metode yuridis empiris dengan jenis data primer dan data sekunder. Analisis data dilakukan secara kualitatif yang selanjutnya dilakukan pembahasan menggunakan Teori Hukum Pembangunan oleh Mochtar Kusumaatmadja dan Teori Perlindungan Hukum oleh Phillipus M Hadjon. Dari hasil penelitian yang penelitian lakukan terdapat beberapa kesimpulan, diantaranya Peran MPD Notaris Kota Batam belum dilaksanakan sesuai dengan UU No.30 Tahun 2004 dan Peraturan Menteri Hukum dan Hak Asasi Manusia Nomor 25 Tahun 2014. Adapun yang menjadi kendalanya antara lain, belum adanya kesesuaian waktu antar anggota MPD dalam melaksanakan pengawasan dan pemeriksaan rutin, minimnya anggaran serta fasilitas, dan lain-lain. Solusi yang dapat diberikan antara lain anggota MPD perlu menetapkan penjadwalan ulang untuk melaksanakan pemeriksaan rutin serta perlu adanya fasilitas e-government.

Abstract

Saat ini terjadinya suatu polemik antara Warkopi dengan Warkop DKI mengenai pelanggarannya suatu merek. Terjadi peniruan dari Wakopi terhadap Warkop DKI. Hal ini disebut pelanggaran karena Warkop DKI telah mendaftarkan mereknya ke Direktorat Jenderal Kekayaan Intelektual Kementerian Hukum dan HAM Republik Indonesia. Artikel ini bertujuan untuk membahas mengenai pengaturan terhadap merek di Indonesia dan mengetahui bentuk perlindungan merek bagi pemilik merek tersebut. Metode penelitian yang digunakan berupa yuridis normatif. Pengaturan terkait merek di Indonesia diatur secara jelas di Undang-Undang No. 20 Tahun 2016 tentang Merek dan Indikasi Geografis, yang mencakup tentang pengertian merek itu sendiri, permohonan pendaftaran terhadap merek yang bisa didaftarkan serta jangka waktu perlindungan atas merek yang didaftarkan. Merek harus didaftarkan terlebih dahulu untuk mendapatkan perlindungannya (sistem konstitutif). Bentuk perlindungan hukum atas hak merek terdiri atas dua yaitu perlindungan preventif dengan artian perlindungan sebelum terjadinya sengketa (pencegahan) dan perlindungan hukum represif dengan artian perlindungan hukum saat telah terjadinya sengketa dengan tujuan untuk memberikan efek jera terhadap pelaku, dan menindak pelaku terhadap norma yang telah dilanggarnya.

Abstract

At the end of 2019, it was reported that there was an outbreak of a disease that spread very quickly and was still the Corona Virus Disease 2019 (COVID-19). China officially reported the presence of the corona virus to the World Health Organization (WHO) on December 31, 2019, but a team from Harvard University, by analyzing satellite photos of traffic around a number of hospitals in Wuhan, Hubei Province, China experienced an increase starting last month. August 2019, this may indicate that the corona virus appeared in the city earlier than the reported time frame. As for the problems that will be researched in order to achieve clear and systematic goals and objectives and as desired, the authors limit the problems to be researched so that can answer the question of how the immunity of State Officials in regulating financial policies is reviewed through PERPU 1/2020 in handling Covid-19 and how the influence of PERPU No. 1/2020 and the Constitution against abuse of the authority of state officials in determining financial policy? This research is directed to examine the extent to which PERPU no. 1/2020 can ensure financial stability and the financial system remains safe from threats to the country's economy in the context of handling Covid-19, which is increasingly making the world economy, including Indonesia. The influence of state officials' immunity and state financial policies in preventing KKN during the covid-19 period is very important to be able to help this nation to become a nation that is far from KKN actions and that can be done if the state officials have honesty, truth and justice so as to produce good morality. against state official.

Abstract

The high impact of COVID-19 requires the Government to issue a policy on limiting the number of prisoners. This study aims to find out the rules regarding the mechanism for accepting new prisoners by the Batam Detention Center due to the Covid-19 Pandemic, the impact of delays in accepting new prisoners by the Detention Center due to the Covid-19 Pandemic, the extent of readiness of law enforcement officers and policy concepts and solutions for accepting prisoners during endemic times. covid-19 by the Batam Rutan. This research method is normative juridical, with the results of receiving prisoners during the covid pandemic referring to the Decree of the Minister of Law and Human Rights, there have been restrictions on movement of prisoners, there has been a buildup of prisoners and during endemic times, Batam Detention Center only accepts registration and administration from the prosecutor's office and the police and started to enforce normal policies.

Abstract

Protection of personal data is a human right that must be given legal protection. However, Indonesia does not yet have special rules governing the protection of personal data and the Personal Data Protection Supervisory Agency. As for when compared to Germany, which has special rules regarding the protection of personal data in full to the Institution that oversees the implementation of the rules for protecting Personal Data. The research method used by the author is a legal comparison method with the type of research being normative research. The author uses secondary data to analyze the results of the data, namely, primary materials, secondary materials, and tertiary materials. The analytical method used by the author is a qualitative method. Similarities and differences in personal data protection between Indonesia-Germany and the legal contributions of personal data protection that he can adopt or apply in Indonesia such as special arrangements for personal data protection, data classification, one of which is the deletion of personal data, and the establishment of a Personal Data Protection Supervisory Agency and the rules that govern it

Abstract

The Attorney General's Office issued Regulation of Attorney General Number 15 of 2020 concerning Termination of Prosecution Based on Restorative Justice (hereinafter written RAG No. 15/2020). According to this regulation, the Public Prosecutor has the right to stop prosecuting the accused in certain cases, if the victim and the defendant have agreed to an amicable agreement. The existence of RAG No. 15/2020 which gives the Prosecutor's authority to stop prosecutions based on restorative justice is a breakthrough in the settlement of criminal acts. Restorative justice is an approach in resolving criminal acts which is currently being voiced again in various countries. Through a restorative justice approach, victims and perpetrators of criminal acts are expected to achieve peace by prioritizing win-win solutions, and emphasizing that the victims' losses are replaced and the victims forgive the perpetrators of the crime in condition that is committed with the value of the evidence or the value of the loss caused by the crime of not more than 2.5 million rupiah. Referring to the principle of fast, simple, and low-cost justice, RAG Number 15 of 2020 has been accommodated for settlement through an out-of-court process, namely a peace process between the victim and the perpetrator. The peace process is carried out by the parties voluntarily, with deliberation for consensus, without pressure, coercion, and intimidation. In the peace process, the Public Prosecutor acts as a facilitator, which means that he has no interest or connection with the case, the victim, or the suspect, either personally or professionally, directly or indirectly.

Abstract

Thorough COVID-19 pandemic considered done in Indonesia, In terms of surveillance and detection, countermeasures are carried out by examining COVID-19 specimens by the network of COVID-19 examination laboratories. The gold standard for COVID-19 examination is to carry out an RT-PCR (Real Time Polymerase Chain Reaction) test from samples taken with nasopharyngeal and oropharyngeal swabs. Batam City so far has had several laboratories for examining COVID-19 specimens that examined COVID-19 specimens with the RT-PCR test. The number of positive COVID-19 in Batam City until April 18, 2022 was 30,960 people obtained from the results of examinations by the COVID-19 examining laboratory. Arrangements are needed to ensure that all laboratories that carry out testing of COVID-19 specimens have standards and work in maximum capacity so that fast and valid COVID-19 specimen examination results are obtained. This study analyzes the effectiveness of the Decree of the Minister of Health (Kepmenkes) of the Republic of Indonesia Number HK.01.07/MENKES/4642/2021 concerning the Implementation of the Corona Virus Disease 2019 (COVID-19) Examination Laboratory in the development of the COVID-19 examination laboratory in Batam City. Laboratory development is carried out by the Environmental Health and Disease Control Engineering Center (BTKLPP) Class I Batam. This study uses an empirical juridical method with a qualitative approach using secondary data. From the results of the research carried out, it was found that to get fast and valid results, the laboratory for examining COVID-19 specimens must have a standard that is a reference which refers to the Decree of the Minister of Health (Kepmenkes) RI Number HK.01.07/MENKES/4642/2021 concerning Organizing the Corona Virus Disease 2019 (COVID-19) Examination Laboratory and supervisory laboratory in carrying out guidance and supervision of the implementation of the examination of COVID-19 specimens in each of the laboratories for examining COVID-19 specimens in Batam City.

Abstract

Investment apps have become an important part of the investment culture throughout the world and have helped democratize investment opportunities for many people. The utilization of investment apps in Indonesia has opened many doors for Indonesians to invest their wealth and obtain many different kinds of assets, posing cybersecurity risks that threaten the interests of their users. This study aims to analyze and provide literature for possible future legislation that affects the utilization of investment apps. Using the normative legal research method, this study analyzes the intersection of investment law and consumer protection law in Indonesia in the context of the utilization of investment apps. Through the statutory approach, this study finds that the normative restrictions within the respective laws make it difficult to properly define legal liability for many kinds of problems that can arise from cybersecurity risks in the context of the utilization of investment apps. The findings of this article serve as a contribution to the constantly expanding literature for Indonesian legal development, specifically on the quest to adapt to the changes brought about by the latest technologies.Aplikasi investasi telah menjadi bagian penting dari budaya investasi di seluruh dunia dan telah membantu mendemokratisasi peluang investasi bagi banyak orang. Penggunaan aplikasi investasi di Indonesia telah membuka banyak pintu bagi masyarakat Indonesia untuk menginvestasikan kekayaan mereka dan mendapatkan berbagai jenis aset, yang menimbulkan risiko keamanan siber yang mengancam kepentingan penggunanya. Penelitian ini bertujuan untuk menganalisis dan menyediakan literatur untuk kemungkinan legislasi di masa depan yang mempengaruhi pemanfaatan aplikasi investasi. Dengan menggunakan metode penelitian hukum normatif, penelitian ini menganalisis persinggungan antara hukum investasi dan hukum perlindungan konsumen di Indonesia dalam konteks pemanfaatan aplikasi investasi. Melalui pendekatan perundang-undangan, penelitian ini menemukan bahwa pembatasan normatif dalam masing-masing undang-undang menyulitkan untuk mendefinisikan pertanggungjawaban hukum secara tepat untuk berbagai jenis masalah yang dapat timbul dari risiko keamanan siber dalam konteks penggunaan aplikasi investasi. Temuan dari artikel ini berfungsi sebagai kontribusi terhadap literatur yang terus berkembang untuk pengembangan hukum di Indonesia, khususnya dalam upaya untuk beradaptasi dengan perubahan yang dibawa oleh teknologi terbaru.

Abstract

The aim of this legal research is to analyze the legal regulations governing the crime of child trafficking in Indonesia and their rights to restitution. The research methodology employed in this study is a juridical-normative research method. This approach involves analyzing the issues using primary legal materials, which include statutory regulations as the primary source (primary legal materials), as well as various secondary legal sources such as legal literature, law books, academic publications, and scholarly articles discussing the regulation and enforcement of criminal sanctions against child traffickers and their rights to restitution. Human trafficking is a cruel act that violates human rights and harms individuals, especially children. Within the framework of Indonesian law, human trafficking has been comprehensively regulated with a strong constitutional basis. Law Number 21 of 2007 on the Eradication of Human Trafficking serves as a concrete foundation for combating human trafficking, aligning with international commitments such as the Palermo Protocol. However, the protection of child victims of human trafficking remains a challenge, addressed in Law Number 35 of 2014 on Amendments to Law Number 23 of 2002 on Child Protection. Legal protection for these children consists of three stages: during the commission of the crime, during the trial of human trafficking perpetrators, and post-judgment. In the post-judgment stage, child victims have the right to seek restitution, which is the responsibility of the perpetrators of the crime. While legal protection is available, the process can be complex and requires meticulous legal procedures to secure the rights of child victims. In summary, Indonesia is committed to eradicating human trafficking, protecting victims, and punishing perpetrators of this crime. The country also actively participates in international efforts to address this issue on a global scale.
