Abstract

People’s representatives are elected through general elections to represent the people fighting for the people's interests and aspirations. However, in practice, muslim politician who became people's representatives often represent themselves and their groups rather than represent those who have chosen them. This research was conducted to reveal how muslim politician who became people's representatives' actions the correlation between clientelism politics in managing the budget function. This descriptive qualitative research method collects data through direct observation in the field and in-depth interviews with various informants related to the research. The theory used in this research is political clientelism theory. From the research results, muslim politician who became people's representatives fight for the community's aspirations to escort a grant program to community groups, social assistance, and empowerment. The program is directly related to the winning team and supporters of voters in the previous elections. The program is intended to maintain the people's voting base and the granary in the next election. This is how the people's representative uses the parliament's existence and potential for electoral interests.

Abstract

Penelitian ini membahas transformasi akad tabarru’ menjadi akad mu’awadhat khususnya pada akad hiwalah dan kafalah di Lembaga Keuangan Syariah (LKS). Artikel ini menggunakan metode deskriptif analisis yang bersifat kepustakaan. Penelitian bertujuan untuk menemukan fakta akan perubahan pada status akad tersebut dan kedudukannya dapat diketahui dengan melihat dan menganalisis praktiknya di lapangan khususnya di LKS. Artikel ini menggunakan metode penelitian kualitatif yang bersifat kepustakaan (library research). Teknik analisis data yang digunakan adalah reduksi data, penyajian data, dan penarikan kesimpulan. Hasil analisis menunjukkan bahwa terdapat transformasi akad tabarru’ (hiwalah dan kafalah) menjadi akad mu’awadhat (hiwalah bi al-ujrah dan kafalah bia al-ujrah di LKS dan telah diatur dalam fatwa DSN/MUI. Penetapan fatwa tersebut berlandaskan kepada kebutuhan masyarakat (LKS dan Nasabah) dengan memperhatikan ketentuan nash, pendapat para ulama dan tingkat kemaslahatan yang tidak bertentangan dengan prinsip ekonomi syariah.Kata Kunci: Transformasi Akad, Hiwalah, Kafalah, Lembaga Keuangan Syari’ah.

Abstract

Penelitian ini dilatarbelakangi oleh kedudukan fatwa DSN-MUI yang mengalami transformasi yang awalnya sebagai legal opinion menjadi legal binding, sehingga memiliki kekuatan hukum mengikat. Secara tidak langsung, substansi fatwa diadopsi oleh peraturan perundang-undangan. Namun, apakah substansi fatwa mengenai penyelesaian sengketa ekonomi syariah juga diadopsi oleh peraturan perundang-undangan atau fatwa yang mengadopsi peraturan perundang-undangan. Maka dari itu, penelitian ini akan memaparkan penyelesaian sengketa ekonomi syariah menurut fatwa DSN-MUI. Dengan menggunakan metode deskriptif kepustakaan melalui pendekatan yuridis normatif, penelitian ini mengungkapkan fakta bahwa dalam substansi penyelesaian sengketa ekonomi syariah, DSN-MUI mengadopsi peraturan perundang-undangan yang memberikan kewenangan kepada sebuah lembaga untuk memeriksa dan memutus perkara ekonomi syariah. Sehingga memberikan pilihan penyelesaian sengketa yang beragam dengan memposisikan jalur musyawarah mufakat sebagai jalur penyelesaian sengketa utama yang harus ditempuh terlebih dahulu sebagai ciri khasnya, sebelum para pihak memilih jalur penyelesaian sengketa yang lain. (This research is motivated by the position of the DSN-MUI fatwa which underwent a transformation which was originally a legal opinion to become legal binding, so that it has binding legal force. Indirectly, the substance of the fatwa is adopted by legislation. However, whether the substance of the fatwa regarding the settlement of sharia economic disputes is also adopted by laws and regulations or the fatwa that adopts laws and regulations. Therefore, this study will describe the settlement of sharia economic disputes according to the DSN-MUI fatwa. By using the descriptive literature method through a normative juridical approach, this study reveals the fact that in the substance of sharia economic dispute resolution, DSN-MUI adopts laws and regulations that authorize an institution to examine and decide on sharia economic cases. Thus providing various dispute resolution options by positioning the deliberation and consensus path as the main dispute resolution path that must be taken first as a characteristic, before the parties choose another dispute resolution path.)

Abstract

Pemaknaan hadis terus menggeleding dan menjadi isu sentral. Tujuan reinterpretasi makna hadis adalah guna menghidupkan kembali pesan-pesan Rasulullah s.a.w. dan mengimplementasikan hadis sesuai dengan makna semestinya. Syuhudi Ismail berusaha menggambarkan bahwa tafsir hadis bisa dilakukan secara tekstual dan kontekstual. Tekstual mengindikasikan terapan makna hadis berlaku secara universal. Sementara terapan makna kontekstual mengindikasikan makna secara lokal dan temporal. Kajian demikian harus memahami bagaimana peran dan fungsi Rasulullah s.a.w. dalam memberikan hadis. Perbedaan latar belakang posisi dan fungsi Rasulullah s.a.w. dalam memberikan hadis dapat mempengaruhi aktualitas dan generalisasi hadis. Nilai historisitas hadis menjadi kunci bagaimana semestinya arah makna hadis perlu dibawa. Buku Syuhudi Ismail menyuguhkan berbagai macam ciri apakah hadis itu perlu ditafsiri secara tekstual atau kontekstual. Beliau memaparkannya langsung dengan memberikan contoh-contoh terkait yang relevan dan kualitas sanad hadisnya telah teruji. Secara umum buku beliau menghadirkan sesuatu yang baru bagi pengkaji hadis agar memahami makna yang terkandung dengan memperhatikan berbagai macam aspek agar dapat menuju makna hadis berikut terapannya sesuai apa yang diharapkan oleh Rasulullah s.a.w.

Abstract

Indonesian people who have religious and cultural diversity are considered capable of showing religiosity in conflict resolution between religious communities and being a peacemaker that occurs on social media. However, it cannot be denied that, in reality, during a peaceful society with various religions, conflicts still occur with various causes and effects. So, in the end, the conflict can become a negative side and a threat to the religiosity factor. This article aims to discover how one’s religiosity can affect conflict resolution on social media. This article uses a library research method. Sources of data obtained by materials that are library. The data analysis technique used is data condensation, data presentation, and conclusion drawing. The results show that the religiosity of the Indonesian people will be better if conflict resolution is built on the teachings of religion itself. Every religion does not teach conflict because if there is a high level of religiosity, everyone will feel safe, comfortable, and peaceful.

Abstract

This article aims to analyze the phenomenon of arranged marriage traditions in the Islamic boarding school world from the perspective of the KUPI fatwa trilogy. The KUPI fatwa trilogy, namely the ma’rūf (kindness), mubādalah (reciprocity), and true justice approaches, is used to investigate the phenomenon of arranged marriage traditions in the world of Islamic boarding schools. This article uses a library research method with a phenomenological approach which is analyzed using the KUPI fatwa trilogy. Therefore, the nature of this research is descriptive-analytical. Then data collection techniques come from primary and secondary materials. Meanwhile, the analysis technique uses Miles and friends’ qualitative data analysis techniques, which consist of data condensation, data presentation, and drawing conclusions. The research results show that the tradition of matchmaking in the Islamic boarding school world has given rise to two characters and models of matchmaking in the Islamic boarding school world, firstly the one-way matchmaking tradition which is coercive, and secondly the two-way matchmaking tradition which is not coercive. Salafi Islamic boarding schools which are still conservative still carry out the tradition of one-way matchmaking which is coercive and one-sided, by denying women the opportunity to participate and hear their opinions regarding matchmaking. This results in injustice and tyranny towards women, so the tradition of this type of arranged marriage is contrary to the KUPI fatwa trilogy, because women are positioned as objects rather than equal subjects. However, it should be noted that not all Islamic boarding schools follow the custom of one-way arranged marriage, instead, there is a more egalitarian custom known as two-way arranged marriage, where women are treated as subjects with the same rights and freedoms as men. This is in line with the KUPI fatwa trilogy, because the practice of matchmaking like this is a tradition of fair matchmaking and supports women in order to give birth to ma’rūf (kindness), mubādalah (reciprocity), and true justice. The Miftahul Huda II Bayasari Ciamis Islamic Boarding School is one of the Islamic boarding school institutions that perpetuates the tradition of two-way matchmaking which is non-coercive and in accordance with the spirit of the KUPI fatwa trilogy.
