Abstract

This research was conducted in the area of Tulang Bawang Regency, Lampung Province, where it was found that there were still very many people who only had a Land Certificate (SKT) or a Statement of Physical Ownership and Control of a Land Sector (Sporadic) as proof of land ownership and they wanted to get credit facilities by guaranteeing Land Certificate (SKT) or Statement of Ownership and Physical Control of the Land Sector (Sporadic). The subject matter examined is the legal protection in the imposition of mortgage rights of objects that have not been registered as collateral. This type of research is empirical research. Abstract

Organ perseroan lainnya, selain Rapat Umum Pemegang Saham (RUPS), dan Direksi, ialah dewan Komisaris. Organ tersebut, telah memiliki fungsi dan tugasnya masing-masing sesuai dengan apa yang diatur didalam Undang-Undang Nomor 40 Tahun 2007 tentang Perseroan Terbatas. Tulisan ini akan membahas mengenai dewan Komisaris selaku organ perseroan yang berfungsi, dan bertugas untuk melakukan pengawasan sesuai dengan anggaran dasar serta memberi nasihat kepada Direksi. Tulisan ini berargumen bahwa dewan Komisaris yang tidak melaksanakan fungsi pengawasannya dengan baik, akan bertentangan dengan pasal 108 undang-undang perseroan terbatas. Dewan Komisaris yang tidak melaksanakan fungsi pengawasannya dengan baik akan dibebani tanggungjawab hukum atas tindakan maupun kegiatan yang mereka lakukan.

Given the limited funds of regional development, it is expected that CSR activities can be usedas an instrument in the regional development. This requires commitment from both parties forcorporate and government to formulate a clear policy, in accordance with the competenciesthey possess. Abstract

To improve land registration in Indonesia, the government is determined to register all land in the territory of the Republic of Indonesia no later than 2025 through a land program which is primarily the Complete Systematic Land Registration (PTSL). This research is a survey research that aims to describe the benefits and implementation of the PTSL land certification program in Bintan Regency. The survey results show that there are several main benefits of the PTSL land certification program that are felt by the community, including providing a sense of security over land, changes in land use that are more useful, and increasing land value. In its implementation, land certification through the PTSL program is  considered easy by the community. However, community participation in extension is still low, which results in low understanding of the participant about the land certification process and its benefits in their lives. There are still people who do not take care of their own land certificates in the PTSL program.Keywords: PTSL, Security, Land Value, Land Use. Intisari: Untuk mempercapat pendaftaran tanah di Indonesia, pemerintah bertekad untuk mendaftarkan seluruh tanah di wilayah Republik Indonesisa paling lambat tahun 2025 melalui program pertanahan yang utamanya Pendaftaran Tanah Sistematis Lengkap (PTSL). Penelitian ini merupakan penelitian survei yang bertujuan untuk mendeskripsikan manfaat dan implementasi sertifikasi tanah program PTSL di Kabupaten Bintan. Hasil survei menunjukkan terdapat beberapa manfaat utama dari sertifikasi tanah program PTSL yang dirasakan oleh masyarakat, yaitu memberi rasa aman atas tanah, perubahan penggunaan tanah yang lebih bermanfaat, dan peningkatan nilai tanah. Pada implementasinya, proses pengurusan sertifikat tanah melalui program PTSL dianggap mudah oleh masyarakat. Namun, keikutsertaan warga dalam penyuluhan masih rendah, yang mengakibatkan rendahnya pemahaman masyarakat tentang proses sertifikasi tanah dan manfaatnya dalam kehidupan mereka. Masih terdapat masyarakat yang tidak mengurus sendiri sertifikat tanahnya pada program PTSL.Kata Kunci: PTSL, Rasa Aman, Nilai Tanah, Perubahan Penggunaan Tanah.

Abstract

A business decision is very important to determine the quality of the Board of Directors in carrying out their duties professionally and responsibly as expected by Good Corporate Governance (GCG). The effectiveness of the Board of Directors is the center of the implementation of Good Corporate Governance. Bank Business is very risky (such: credit risk, reputation risk, etc.). The Board of Directors in making a business decision, will always face unpredictable condition. In Banking practice, the Head of Branch Office Bank is the extension of Director, if the Head of Branch Office Bank signs credit agreement out of the rules (plafond). His action has categorized as ultra vires, so the consequence is the Head of Branch Office Bank can be held responsible for his action. In this case, the Board of Directors has not taken responsibility for the action of the Head of Branch Bank, based on Business Judgment Principle, the Director has not taken its responsibility for ultra vires act which is done by the Head of Branch Office Bank, as along as Director has managed the Company in good faith, carefully and does not against the law. Therefore, Business Judgment Principle gives legal protection to the Director in making a business decision

Abstract

Penelitian ini dilakukan di daerah Kabupaten Tulang Bawang Provinsi Lampung, dimana ditemukan masih sangat banyak masyarakat yang hanya memiliki Surat Keterangan Tanah (SKT) atau Surat Pernyataan Pemilikan dan Penguasaan Fisik Bidang Tanah (Sporadik) sebagai bukti kepemilikan tanah dan mereka ingin mendapatkan fasilitas kredit dengan menjaminkan Surat Keterangan Tanah (SKT) atau Surat Pernyataan Pemilikan dan Penguasaan Fisik Bidang Tanah (Sporadik) tersebut. Pokok permasalahan yang dikaji adalah bagaimana kepastian hukum dalam pembebanan hak tanggungan objek yang belum terdaftar yang dijadikan jaminan. Jenis penelitian adalah penelitian empiris. Hasil penelitian menunjukan bahwa kepastian hukum mengenai objek yang belum terdaftar yang dijadikan jaminan disini yaitu objek yang belum terdaftar tersebut dapat diikat dengan Surat Kuasa Membebankan Hak Tanggungan (SKMHT), hal ini diatur dalam Pasal 3 Peraturan Menteri Negara Agraria/Kepala BPN Nomor 22 Tahun 2017 Tentang Penetapan Batas Waktu Penggunaan Surat Kuasa Membebankan Hak Tanggungan Untuk Menjamin Pelunasan Kredit Tertentu dan nantinya harus dilanjutkan dengan pemasangan Akta Pemberian Hak Tanggungan (APHT) setelah pendaftaran objek tersebut selesai

Abstract

The home marketing strategy that is currently being used is home sales in the form of images (pre-project selling). The transaction is set out in the form of Bonds for Sale and Purchase (PJB) which in practice raises various problems, both in terms of PJB content and the quality of work results. PJB for developers is often used to break the law and legislation such as by disguising the actions of company directors for and on behalf of themselves, consumers are required to pay excess land prices that were not previously agreed and thought of, down payments that originally increased from the price offered, the construction of the house is not in accordance with the specifications and general standards, the delay in the submission of the certificate, the fasum problem, which should be the responsibility of the developer. From the description above, the problem examined was how to implement the sale and purchase of houses through the built-in message system at PT. Pratama Griya Makmur Regency of West Pasaman and how to protect the rights of consumers. This study uses an empirical juridical approach. The results of the study show the implementation and legal protection for consumers in buying and selling houses through a built-in message system at PT. Pratama Griya Makmur, West Pasaman Regency has been carried out by breaking the rules, namely parties representing companies in making PJB are directors, acting for and on behalf of themselves, in PJB the building specifications are not included, sanctions for cancellation of agreements, rights and obligations of the parties are not included implicitly.

Abstract

Village Owned Enterprise is an important part of the form of empowerment economic community at the village. Given, the urgency of the existence of Village Owned Enterprise, the government through the Regulation of Ministry of Villages, Disadvantaged Regions and Transmigration No. 5 of 2015 stated that one of the priorities of the use of village funds is for the establishment and development of Village Owned Enterprise. While the mechanism of establishment of Village Owned Enterprise is based on the result of village consultative meeting involving element of village government, element of village consultative body, and elements of community figures. The result of the village consultative meeting is implemented in form Village Regulation. However, it causes anomaly related to the status of Village Owned Enterprise, because it does not have to be legal entity in Regulation of Ministry of Villages meanwhile it has to be legal entity in Regulation of Minister of Home Affairs No. 39 of 2010 on Village Owned Enterprise.

Abstract

The provision of the Law Number 40 of 2007 concerning Limited Company on Corporate Social Responsibility has changed the nature of such responsibility from voluntary into mandatory. Similarly, it strengthened welfare state (verzorgings staat) concept as commanded by Article 33 (3) and (4) of the 1945 Constitution of the Republic of Indonesia. Denaturing of this Corporate Social Responsibility is progressively assured by the Decision of Indonesian Constitutional Court, so that responsibility must be performed as legal responsibility or mandatory.

Abstract

One of the government's efforts to resolve consumer disputes through non-litigation is through the Consumer Dispute Resolution Agency (BPSK). In addition, the Financial Services Authority (OJK) also mandates the establishment of institutions to resolve financial service sector consumer disputes, namely the Alternative Consumer Dispute Resolution Institute (LAPS). The study was conducted normatively. The study emphasizes the authority to resolve consumer disputes at financial institutions between BPSK and LAPS. The results show that BPSK has the authority to settle final consumer disputes, the authority exercised by BPSK is regulated in the Decree of the Minister of Industry and Trade of the Republic of Indonesia Number: 350 / MPP / Kep / 12/2001 concerning the Implementation of the Duties and Authorities of the Consumer Dispute Resolution Board and the Republic of Indonesia's Minister of Trade Regulation Indonesia Number 06 / M-DAG / PER / 2/2017 concerning the Consumer Dispute Resolution Board. It's just that the decisions issued by BPSK related to the case of financial institutions, especially those containing elements of the credit agreement are often canceled by the Supreme Court because BPSK considered not authorized to settle disputes that contained the agreement element. The authority of LAPS is regulated in POJK Number 1 / POJK.07 / 2014 concerning Alternative Institutions for Settlement of Financial Services Sector Disputes. LAPS divides financial services sector dispute resolution institutions into 6 institutions, the establishment of which is carried out by the OJK in collaboration with Financial Services Institutions. LAPS which has the authority to settle consumer financing company disputes is BMPPVI (Indonesian Ventura Medication, Financing, And Capital Mediation Agency).
