Abstract

Pasca pencabutan UU No. 7 Tahun 2004 oleh Mahkamah Konstutusi dan berlakunya kembali UU Pengairan, pembatalan Perda tentang pengelolaan air tanah oleh Kemendagri, adanya alih kewenangan dengan berlakunya UU Pemda 2014, berdampak pada tidak adanya kepastian hukum dan muncul berbagai permasalahan dalam pengelolaan air tanah. Untuk mengatasi “kevakuman regulasi” dan berbagai permasalahan pengelolaan air tanah di daerah tersebut, pemerintah daerah hendaknya segera mempersiapkan pembentukan regulasi baru sebagai dasar hukum dalam pengelolaan air tanah. Tujuan kajian ini yaitu untuk mendeskripsikan isu hukum tentang dasar pertimbangan dalam pembentukan peraturan pengelolaan air tanah di daerah, dan materi muatan pengaturan pengelolaan air tanah di daerah secara berkeadilan dan berkelanjutan. Metode kajian menggunakan pendekatan secara yuridis normative dan analisis bahan hukum dilakukan secara yuridis kualitatif. Hasil kajian menunjukkan bahwa pertama, pengaturan pengelolaan air tanah di daerah harus didasarkan atas pertimbangan filosofis, sosiologis, danyuridis; kedua, bahwa materi muatan pengaturan pengelolaan air tanah harus didasarkan atas konsep konstitusionalisme pengelolaan air tanah, norma kewenangan, dan substansi ruang lingkup pengaturan. Urgensi hasil kajian ini yaitu bahwa pengaturan pengelolaan air tanah di daerah ke depan (ius constituendum), harus memberikan jaminan kepastian hukum, berkeadilan, dan memberikan kemanfaatan secara berkelanjutan bagi rakyat.

Abstract

Taman Wisata Alam Pantai Panjang-Pulau Baai di Kota Bengkulu merupakan kawasan hutan konservasi yang tujuan utamanya dimanfaatkan untuk kepentingan pariwisata alam dan rekreasi. Ekosistem pantai dan mangrove dengan segala kekayaan dan keindahan alamnya merupakan obyek daya tarik wisata kawasan ini. Pengelolaan kawasan wisata ini menghadapi permasalahan, yakni konflik hak atas lahan sehingga terjadi alih fungsi pemanfaatan lahan hutan. Penelitian ini bertujuan untuk menganalisis tipologi konflik tenurial dan alternatif penyelesaiannya. Kajian dilakukan dengan memetakan penggunaan lahan dan mengidentifikasi para pihak yang memanfaatkan kawasan taman wisata ini. Pendekatan sejarah dan yuridis digunakan untuk menentukan alternatif penyelesaian konflik tenurialnya. Hasil penelitian menunjukkan bahwa kawasan taman wisata alam ini belum ditetapkan sebagai kawasan hutan. Penetapan kawasan hutan tetap harus segera dilakukan agar dapat melakukan kepastian hukum dalam pengelolaan. Didalam kawasannya terdapat berbagai penggunaan lahan di luar bidang kehutanan. Tipologi konflik tenurial yang terjadi adalah : konflik pengelola dengan masyarakat, konflik pengelola dengan pemerintah, dan konflik pemerintah dengan perusahaan negara. Resolusi konflik yang ditawarkan adalah perubahan sebagian peruntukan kawasan hutan melalui skema revisi Rencana Tata Ruang Wilayah (RTRW) Provinsi Bengkulu dan kolaborasi pemanfaatan kawasan hutan taman hutan wisata dengan pengelola. Evaluasi kesesuaiaan fungsi taman wisata alam harus dilakukan dengan melibatkan semua pihak yang berkonflik didalamnya. Hasil evaluasi ini menjadi dasar dalam penetapan kawasan hutan taman wisata alam agar memiliki kekuatan hukum yang tetap.

Abstract

Internal audit is significant to guarantee and ensure the enforcement of laws and regulations as well as to prevent power abuse by civil servants or government officials that may cause financial loss for the country. The purpose of this study is to provide an overview of the authority of internal audit, to describe how this authority is regulated, to depict the authority to prevent power abuse, and to illustrate the protection over and enforcement of administrative law on allegation of power abuse. This study is a normative juridical study analyzing primary and secondary legal material relevant to the subject under study. The result of the study reveals that the authority of internal audit has been set in various legal products. The operating procedures for legal protection over allegation of arbitrary behavior against civil servants or government officials are filing an objection or an appeal against the discovery of the internal audit. If the case is not a subject of investigation of law enforcement officers the accused may contest the finding to Administrative Court and request the judge to review the finding. If the accused is proven to be guilty of abusing power that causes financial loss for the state and, thus, be sentenced for the alleged conduct (inkracht), he or she shall be immediately dismissed from his/her position. The regulation posits that officer who ignores the verdict and continues to keep the defendant on his/her position shall be penalized.

Abstract

The occurrence of CCN in the procedure of issuing natural resources licensing is partly caused by the weakness of supervision aspect. In fact, the purpose of supervision is basically intended to prevent the occurrence of CCN. This paper is intended to examine the legal issue of how the regulation of the authority of the government’s internal supervisor (GISA) is in performing the supervisory function based on the prevailing provisions, and how GISA’s authority relates to the supervisory function in the natural resource licensing governance to prevent and eradicate CCN. This is a normative juridical study analyzing the primary and secondary legal materials. The analysis is conducted by qualitative juridical. The result of the study shows that the authority of GISA in performing the function of general and technical supervision has been regulated in various regulations. However, related to appointment in position and responsibility mechanism of execution of task and function of GISA there is still a weakness, as it is done not in stages the results of performance are potentially not objective. The authority of GISA which specifically relates to supervisory functions in natural resource licensing has not explicitly been regulated in the existing regulations. However, GISA remains authorized to monitor the governance of natural resource licensing. Therefore, the issuance of all permit decisions including natural resource licensing is the implementation of government functions, while internal control in the administration of government functions belongs to GISA’s authority.

Abstract

The purpose of this study is to analyze and to describe the implementation of administrative bureaucratic reform at Bengkulu regional office of Ministry of Law and Human Rights of Bengkulu based on Presidential Regulation Number 81 of 2010 concerning the Grand Design of Bureaucratic Reform of 2010-2025, and to analyze the obstacles in the implementation of administrative bureaucratic reform at Bengkulu regional office of Ministry of Law and Human Rights. This research was a normative legal research. The analysis of legal materials was carried out in a qualitative juridical manner. The results of the study show that: Firstly, the implementation of administrative bureaucratic reform at the Bengkulu Regional Office of the Ministry of Law and Human Rights has been carried out for the needs of Bureaucratic Reform. Secondly, there are obstacles in the implementation of administrative bureaucratic reform at the Bengkulu Regional Office of the Ministry of Law and Human Rights, namely: The juridical obstacles consist of the absence of technical legislation for performance improvement and the absence of Standard Operating Procedures (SOPs) that can build a common perception, commitment, involvement in program implementation and bureaucratic reform activities at all levels of employees. Technical obstacles, namely the limited quantity and quality of Human Resources (HR) and facilities and infrastructure. By establishing an organizational structure based on the Regulation of the Minister of Law and Human Rights of the Republic of Indonesia Number 30 of 2018 concerning the Organization and Work Procedure of the Regional Office of the Ministry of Law and Human Rights, it can be a solution to achieve efficiency and effectiveness in the implementation of the tasks of the government bureaucratic apparatus.

Abstract

Coal mining license is a juridical instrument for businessmen to carry out coal mining activities. Coal mining license is also a preventive instrument to prevent coal mining activities from causing environmental damage and pollution. In the process of issuing and implementing coal mining licenses according to Law Number 32 of 2009 concerning Environmental Protection and Management, one must consider the precautionary principle, which is implemented by integrating environmental considerations, in making coal mining licenses decisions. However, coal mining activities carried out by 9 coal mining companies in the Watershed of Air Bengkulu, showed that there was environmental destruction and pollution seen along the Watershed of Air Bengkulu. This study aimed to determine the application of the precautionary principle to coal mining licenses and the legal consequences of coal mining license decisions that did not apply the precautionary principle. This research was conducted using juridical empirical/socio-legal research, and data analysis was carried out using a qualitative juridical approach. The results of this research showed that the government of Bengkulu Province has not applied the precautionary principle in the process and implementation of coal mining license in the Watershed of Air Bengkulu of Central Bengkulu Regency. The legal consequence of not applying the precautionary principle in the decision to issue 9 (nine) coal mining licenses which was an essential and material requirement in a decision to issue a permit was null and void (nietig van rechtwege) and could be canceled (vernietig baar), the government of Bengkulu Province has the authority to cancel the licenses decision because it is a State Administration official.

Abstract

Government of Bengkulu Province is strongly committed to improve the quality of the bureaucratic reform of Apparatus Resourcesparticularly apparatus resources reform at the environment of Local Government of Bengkulu Province. Based on Attachment 1 of Regulation of the Head of the Civil Service Agency No. 21 of 2010 concerning the Implementing Regulations of Government Regulation No. 53 of 2010 on Discipline of Civil Servants, it is known that the employee dismissal procedures that violate discipline begins by calling the concerned continued with the establishment of inspection team. The results of the examination if proven to do violation, then the competent authorities impose disciplinary punishment. There have been many advances experienced by the government in the field of employment, which previously civil servants performance was rated based on patronage system where the presentation and work are preferred switched to merit systemin which the competence and performance of employees are preferred. However, there are still some violations occurred both violations of discipline and criminal.

Abstract

The issuance of Law Number 5 of 2014 concerning state civil apparatus (Further will be referred as ASN) provides a new paradigm in the world of employment in Indonesia with the presence of the term Government Employee with a Work Agreement (Further will be referred as PPPK). However, the legal relationship of PPPK is unique because there is a point of contact between public law and private law so that legal protection for PPPK is still very weak. This study discussed how the law position of the PPPK and the law effort that can be taken by the PPPK in the event of a Termination of Employment Contracts (Further will be referred as PHPK). The research method used was normative juridical law research by using a statutory approach and analyzing various statutory regulations that cover it. The results of this study indicated that the law position of PPPK as ASN is felt to be very weak and in the case of PHPK normatively, it also does not provide law certainty for PPPK. In this case, the government and the House of Representatives (Further will be referred as DPR) should make changes or revoke the ASN Law to abolish the regulatory provisions regarding PPPK and also to provide clarity regarding the provisions of the civil service court in the event of PHPK for PPPK. In this case the ASN Law must also be followed by fundamental changes in the provisions of the State Administrative Court and the on Government Administration Law.

Abstract

To actualize the implementation of governance and development based on the principles of good governance dan clean good government, Law Number 30 of 2014 concerning government administration is the legal basis needed to base the decisions and/or actions of government officials to meet the legal needs of the public in governance. However, it is highly risky for corruption or abuse of authority possessed by government officials. The enactment of Law Number 30 of 2014 concerning Government Administration has changed the perspective of Law Number 20 of 2001 concerning the Eradication of Criminal Acts of Corruption, which has been carried out by the Police from an enforcement approach to an administrative approach by the Government Internal Supervisory Apparatus (henceforth APIP - Aparat Pengawas Internal Pemerintah). The addition of bureaucratic systems in eradicating criminal acts of corruption occurred due to the existence of this APIP. This research discusses the authority of police in handling criminal acts of corruption by civil servants (henceforth PNS – Pegawai Negeri Sipil) who are suspected of abuse of authority based on Law Number 30 of 2014 concerning government administration. The method used in this research was normative juridical law research with a statutory approach. The results of the research showed that police, in handling complaints or reports of the handling criminal acts of corruption by PNS who are suspected of committing acts of abuse of authority, must be submitted to the APIP first. The involvement of APIP makes the Police unable to act immediately and it is feared that this procedure will prolong the investigation process. Efforts are being made so that the handling of criminal acts of corruption can be effective in preventing state financial losses, namely by coordinating with APIP, the Financial and Development Supervisory Agency, (henceforth BPKP - Badan Pengawas Keungan dan Pembangunan -), and other external institutions.
