Abstract

Tujuan penelitian guna pendukunan penanaman modal asing; peran hukum sangat dibutuhkan untuk menciptakan kepastian hukum untuk mengundang investor asing masuk ke wilayah Indonesia. Metode penelitian menggunakan kajian pustaka dengan Jenis penelitian normatif dan empiris tentang produk perilaku hukum. Sumber data primer menggunakan bahan hukum secara otoritas. Sumber data sekunder diantaranya buku, thesis, jurnal, serta dokumen terkait. Hasil penelitian ini menunjukkan bahwa Keimigrasian berperan sebagai penegak hukum dalam penyelenggaraan keimigrasian yang berperan sebagai pengawas terhadap penggunaan izin tinggal yang digunakan oleh investor selama berada di Indonesia. Hal ini dianggap penting mengingat hingga saat ini masih terjadi penyalahgunaannya perizinan tinggal dari WNA dengan menggunakan izin tinggal sebagai investor, namun pada kenyataannya orang asing tersebut melakukan praktik perdagangan yang melanggar aturan yang telah ditetapkan sebelumnya. Dengan demikian, peran Imigrasi sangat dibutuhkan sebagai penegak hukum terhadap kegiatan yang dilakukan oleh orang asing, terutama sebagai investor. Dibutuhkan syarat ketat serta selektif untuk orang asing dengan pemberian visa untuk menjadi investor asing dan penegakan hukum yang optimal dalam mengatasi penyalahgunaan izin tinggal oleh investor asing Indonesia.

Abstract

Makalah ini membahas kasus tata kelola imigrasi menanggapi kebijakan migrasi Indonesia selama wabah Covid-19. Hal ini mengindikasikan kebijakan imigrasi di Indonesia yang dengan cepat berubah setiap bulannya menjadi isu yang serius, misalnya tentang tumpang tindih kewenangan di perbatasan, kebijakan yang terfragmentasi, sengketa penegakan hukum di perbatasan, dan kebingungan tentang kebijakan visa dan izin tinggal. Makalah ini menerapkan metodologi penelitian kualitatif studi kasus tunggal dengan pendekatan kerangka teori. Studi ini menemukan bahwa kebijakan dan tata kelola migrasi di Indonesia dalam pandemi Covid-19 telah memasukkan teori tata kelola dengan lima proposisi seperti yang dijelaskan dalam Stoker (1998). Namun, tanggung jawab penutupan stasiun lintas batas kabur yang mengindikasikan tidak adanya koordinasi antar lembaga perbatasan, dan ini bisa mengarah pada menyalahkan dan mengkambinghitamkan. Kebijakan imigrasi di perbatasan Indonesia menggambarkan proses pembuatan kebijakan yang ketat namun tidak konsisten dimana instrumen kebijakan direvisi dan diperpanjang setiap bulan. Kebijakan tersebut belum dirancang untuk situasi setelah krisis Covid-19 di Indonesia dinyatakan selesai oleh otoritas yang berwenang.

Abstract

In preventing the Covid-19 pandemic, immigration has a security function which is carried out by selecting the intentions and objectives of foreign nationals to Indonesian territory by examining visa applications, including in handling detainees in the detention room. The problem in this study is whether the arrangements for handling detainees in the detention room of the Class 1 Immigration Office for Non TPI, South Jakarta can be implemented during the covid-19 pandemic. How to optimize the handling of detainees during the covid-19 pandemic in the detention room of the Class 1 Immigration Office for Non TPI, South Jakarta. This research method is empirical normative using primary data and secondary data. The results of the study stated that the arrangements for handling detainees in the detention room of the Class 1 Immigration Office for Non TPI, South Jakarta, could not be fully implemented during the Covid-19 pandemic. This is because until now there is no regulation specifically for the Class I Immigration Office for Non TPI related to the handling of detainees in the detention room, thus causing the absence of standard operating procedures for officers. Optimization of the handling of detainees during a pandemic in the detention room of the Class 1 Immigration Office for Non TPI Special South Jakarta is through the issuance of the Regulation of the Director General of Immigration regarding the handling of detainees during a pandemic in the detention room at the Immigration Office Class 1 Special for Non TPI South Jakarta.

Abstract

Indonesia as a country which did not ratify UN Convention 1951 on Status of Refugees and Protocol 1967, issued a Presidential Decree No.125/2016 on Handling Overseas Refugee in addressing the issues of foreign nation subject who intend to seek refuge by passing through Indonesian territory, generally aiming to seek refuge in Australia. These foreign nation subject introduced as “refugee” by media although the subject is unrecognized by Indonesian immigration law system. Indonesian immigration law only recognize subject as a person who enter or leave Indonesian territory by legal or illegal means. The definition of Refugee on Presidential Decree No.125/2016 is the first definition of the subject in Indonesian legal system, refers to both Refugee and Asylum Seekers in UN Convention 1951, which supposed to have different handling methods. Therefore, the implementation of Presidential Decree No.125/2016 leads to different understanding in immigration and foreign policy perspective on Refugee subject.

Abstract

The increasing migration of Nigerian citizens in Indonesia has a mixed impact. Not only the economic sector, but also the increasing number of violations and immigration crimes. The Immigration Office of West Jakarta, which is the jurisdiction of the distribution of Nigerian residences, faces quite difficult problems. The formulation of the problems to be examined in this paper are as follows: (1) How do immigration actions carried out by Immigration Office of West Jakarta in resolving cases of Nigerian citizens who exceed the immigration residence permit time limit and (2) What are the obstacles faced by Immigration Office of West Jakarta in resolving the case. The research method used is qualitative empirical legal research. Based on the results of the discussion, the following legal facts are obtained. The efforts made by Immigration Office of West Jakarta in overcoming abuse of immigration permits by Nigerian citizens are divided into 2 (two) parts, namely preventive efforts and repressive efforts. Preventive efforts carried out by the Immigration Office of West Jakarta are well underway and in accordance with existing regulations. The preventive efforts are realized in 2 (two) systems, namely administrative supervision and field supervision. In addition, these preventive efforts have proven effective with quite a number of Nigerians who abuse immigration permits by the Immigration Office of West Jakarta. Then the existing repressions are felt to require changes in the granting of actions / punishments against Nigerian people who abuse immigration permits. The change is in the form of providing legal action for investigating the violators to take precedence. Because all this time what happened in the field of giving immigration action was prioritized in giving action to Nigerian people who misused immigration permits. Even though the provision of immigration actions does not give a deterrent effect to these actors. So that the impact of these actors will do the same thing again. In practice, in the field of supervision and repression of Nigerian citizens who abuse immigration residence permits carried out by the Immigration Office of West Jakarta, there must be various problems. These problems are divided into 2 (two) factors, namely from the outside and from within. The external factor itself consists of the motives of some Nigerian citizens who came to Indonesia. Then there is a fictitious sponsor that increasingly makes it difficult to trace the perpetrators of abuse of immigration permits. Furthermore, the imbalance between the area of ​​West Jakarta's work area and the number of personnel and equipment that does not support this. Then from the point of view of internal factors which are the obstacles is the lack of supporting factors in carrying out supervision and repression of Nigerian citizens who abuse immigration permits. Finally, the attitude of the immigration officers was less assertive in giving action to Nigerian citizens who committed abuse of immigration permits.

Abstract

As a state of law, in carrying out state life, of course, it must always be based on the basis of law. The same applies to financial management, particularly to the management of state revenue sources, both through taxes and non-taxes. The high number of needs for money due to the current economic paralysis in Indonesia has encouraged several sectors to be able to contribute to the recovery of the economic paralysis. Immigration has a role in providing income for the state through the Non-Tax State Revenue (PNBP) sector, which is obtained through immigration services, both for Indonesian citizens and foreign citizens. In order to support an increase in income through the economic sector, especially through Non-Tax State Revenue (PNBP), an innovation is needed that can increase income for the Indonesian state. One of them is through prevention and deterrence for foreigners. Regulations regarding prevention and deterrence are contained in Article 91 of Law Number 6 of 2011 concerning Immigration. The high number of violations related to immigration regulations that occur today can be used by the Immigration Office in terms of increasing Non-Tax State Revenue, this is done for the sake of the stability of the country's economy for the sustainability of the welfare of the Indonesian people. As a developing country, Indonesia continues to strive in terms of increasing economic development. This is useful for improving the country's economy. In this case, a consistent government role is needed regarding increasing economic growth.
