Abstract

Kejahatan terhadap harta kekayaan merupakan kejahatan yang dapat pula terjadi dalam lingkup keluarga. Kejahatan terhadap harta kekayaan dalam lingkup keluarga sendiri secara materiil merupakan tindak pidana yang memiliki aturan yang lebih khusus dan spesifik dalam Pasal 367 dan Pasal 376 KUHP, dimana Kejahatan yang dilakukan dalam lingkup keluarga tersebut merupakan delik aduan. Kedudukannya sebagai delik aduan telah secara khusus menempatkan keluarga sebagai korban sebagai acuan terhadap proses penegakan hukum kejahatan terhadap harta kekayaan. Pentingnya keluarga selaku korban dan pengadu sebagai aspek penting yang ditetapkan hukum materiil tersebut nyatanya tidak dianut hukum formil dalam penegakannya. Berbeda dengan KUHP yang menempatkan keluarga sebagai aspek penting dalam kekhususan kejahatan terhadap harta kekayaan dalam lingkup keluarga, Pasal 168 KUHAP justru memberikan ancaman terhadap nilai pembuktian keterangan yang diberikan oleh saksi yang memiliki hubungan keluarga dengan pelaku. Antinomi yang ada diantara hukum materiil dan formil ini selanjutnya melandasi dua masalah hukum, yaitu mengenai kedudukan keterangan saksi dalam pembuktian hukum pidana di Indonesia dan kedudukan keterangan korban terkait kejahatan terhadap harta kekayaan dalam lingkungan keluarga di Indonesia.

Abstract

This article discusses the problems encountered in the preliminary court proceeding of gross human right violation cases in Indonesia.  Identified are two state institutions, i.e. the National Human Right Commission and the Attorney General, who possess the authority to initiate investigation and subsequent successful prosecution of gross human right violation cases. Good cooperation and relation between these two agencies is therefore a must.  This article looks into the problems encountered by these two institutions in doing the preliminary process and discusses possible redistribution of these two state agency authorities. To do this a doctrinal approach will be used.

Abstract

Nowadays, using GPS as a navigator from smartphone is increasing, but it turns out there is a legal issue. This is related to the concept of driving with full concentration in Article 106 paragraph (1) of Law Number 22 Year 2009. In the explanation of Article 106 paragraph (1), there is an ambiguity in the interpretation between being able to use GPS, as long as it does not cause a concentration disturbance in driving or it is prohibited from using a cellphone at all, which means, using GPS via a smartphone is not allowed. This research is a study using normative law, with primary legal materials is legislation related to the use of GPS through smartphones during driving, such as, Law Number 22 Year 2009 concerning Road Traffic and Transportation and Constitutional Court Decision No. 23 / PUU-XVI / 2018, while materials Secondary law consists of books, journals, and other sources that are relevant. Based on the results of this study, it was found that the Constitutional Court provided an interpretation, that using GPS via a smartphone during driving was permitted, but it should not cause a concentration disturbance while driving and the application of such sanctions was casuistic. Abstract

Dalam perkembangannya, dapat dilihat bahwa gugatan pembatalan perjanjian akibat tidak adanya kesepakatan di dalam Syarat pertama Pasal 1320 BW, tidak terbatas hanya di dalam Pasal 1321 BW, seperti kekhilafan, paksaan, dan penipuan, namun dalam perkembangannya lahir alasan baru yaitu penyalahgunaan keadaan (misbruik van omstandigheiden). Namun, dalam praktiknya, menimbulkan pertanyaan terkait dengan dalurasa pengajuan gugatan pembatalan perjanjian akibat adanya penyalahgunaan keadaa. Penelitian ini bertujuan untuk menganalisa eksistensi dalurasa gugatan pembatalan perjanjian akibat adanya penyalahgunaan keadaan. Rumusan masalah dalam penelitian ini adalah, Pertama, penyalahgunaan keadaan sebagai alasan pembatalan perjanjian dan Kedua, dalurasa gugatan pembatalan perjanjian akibat adanya penyalahgunaan keadaan. Penelitian ini adalah penelitian normatif dengan pendekatan peraturan perundnag-undangan dan konseptual. Berdasarkan penelitian ini, ditemukan bahwa Pertama, penyalahgunaan keadaan merupakan alasan baru dalam pembatalan perjanjian yang merupakan cacat kehendak modern, Kedua,  dalurasa gugatan pembatalan perjanjian akibat adanya penyalahgunaan keadaan berdasarkan analogi Pasal 1454 BW adalah lima tahun sejak diketahui adanya penyalahgunaan keadaan dalam membuat perjanjian tersebutKata kunci: Analogi, Daluarsa, Pembatalan Perjanjian, Penyalahgunaan Keadaan

Abstract

In Indonesia, there is a debate regarding the repatriation of former ISIS citizens. One of the main issues is related to the legal protection that will be provided by the state to them, especially their citizenship status. Based on this background, the formulation of the problem in this article is legal protection for Indonesian Ex- ISIS. This article uses a legal research method with a statutory and conceptual approach. Based on the results, it was found that several Indonesian laws and regulations and several international legal instruments expressly recognize the existence of citizenship as a fundamental right for everyone, and no one can arbitrarily revoke or be denied the right to change their citizenship. Sanctions for revocation of one's citizenship status cannot be applied equally to someone whose involvement is only limited to believing in theories, doctrines, or understanding terrorism under the guise of a certain religion. Elimination of citizenship rights by a country is an act that is not taken for granted. The decision-making on the Indonesian Ex- ISIS must still refer to the principle of protecting Human Rights (HAM) and several other international legal instruments.

Abstract

Abstract— The electronics industry has been a key driver of economic growth and employment in many developing countries, including Indonesia. Participating in global electronics supply chains can  have  several  benefits,  including  the  growth  of  domestic  industries  as  competitors  and suppliers, and increasing exports.  This study uses a normative legal research method with the statutory approach, conceptual approach, and case approach. Abstract

Article 171 section c the Compilation of Islamic Law which was ratified through the Presidential Instruction of the Republic of Indonesia Number 1 of 1991 stressed that one of the conditions for heirs in Islamic inheritance law is Mulsim. In its development, the requirement of the Islamic religious obligation is deemed not to provide justice, this can be seen from the many complaints filed by the community to the court. Based on this background, the formulation of the problem in this study is Firstly position of Non-Muslim Inheritance of Islamic Inheritance Inheritance according to positive law in Indonesia Secondly, to find out the position of Non-Muslim Inheritance Against Islamic Inheritance Inheritance from various court decisions in Indonesia. This research is a juridical research, with a statutory, conceptual, and case approach. The results of this study indicate, that First, according to positive law in Indonesia, Non-Muslim Heirs are not entitled to Islamic Inheritance. Secondly, in its development, to fulfill the sense of justice in the community, the judge in Indonesia, decided that the Non-Muslim heirs, although not entitled to become heirs, were still entitled to the inheritance of the Islamic heirs through the obligatory wills. This can be seen from the various court decisions that exist, such as Supreme Court Decision Number 368 K/AG/1995, Supreme Court Decision Number 51 K/AG/1999, Supreme Court Decision Number 16 K/AG/2010, and Supreme Court Decision No. 331 K/Ag/2018
