Abstract

Hukum Islam di Indonesia telah menjadi jati diri rakyat di Indonesia, hukum Islam telah tumbuh dan berkembang sebelum Negara tersebut berdiri dan telah mengakar dalam segala aspek kehidupan masyarakatnya. Sekalipun Indonesia bukan Negara Islam hal tersebut bukanlah menjadi penghalang pemberlakuan hukum Islam di Indonesia. Hal ini dikarenakan nilai-nilai yang terkandung dalam hukum Islam tersebut merupakan nadi dalam setiap aspek kehidupan masyarakat Indonesia. Selain itu, nilai tersebut tidak jarang nilai-nilai tersebut diinterpretasikan ke dalam norma oleh para ahli hukum kontemporer. Hukum Islam di Indonesia menggunakan suatu parameter kemaslahatan mengenai perlu atau tidaknya suatu hukum dalam suatu persoalan tertentu. Sebagai tambahan, peran utamanya adalah untuk memastikan bahwa setiap hukum Islam yang dinormakan tersebut tidak bertentangan dengan nash yaitu Al-Quran dan Sunnah.  Dengan mengaplikasikan hukum Islam ke dalam setiap upaya pembuatan atau pun penafsiran suatu hukum, maka dapat dipastikan hukum tersebut telah memenuhi standar untuk di aplikasikan ke dalam masyarakat Indonesia. Dengan demikian hal ini tidak dikhawatirkan hukum tersebut akan menimbulkan persoalan baru atau menimbulkan konflik norma dalam pengaplikasiannya.

Abstract

Gold mining in south-east Sulawesi Bombana is one of the potential natural resources in Indonesia. But nowadays the condition is due to lack of responsibility of the mining business to conduct post-mining reclamation in Bombana area, even though the mining activity has been carrying out mining business license. Post-mining activities are very important and must be done by the mining company, because it can minimize the destruction of natural environment in the mining site. The purpose of this research is to find out the mining conditions in the Bombana area as well as arrangements related to post-mine reclamation in the Bombana area. This study was written using the normative from data obtained by library research. Then related to the implementation of post-mining reclamation in Bombana is currently not carried out maximally, it is due to the uncertainty of regulations related to the post-mine reclamation obligations and the sanctioned rules that will be applied in the future still depend on local government regulations but the implementation is still not able to work effectively. So the steps that need to be taken in this case to avoid damage to the environment surrounding the mining site is necessary cooperation between the Government, the mining business actors and the community using soil conservation technology such as post-mining reclamation, which is regulated in a clear, transparent, accountable legislation.

Abstract

Economic activity is a vital point not only for a person but also a nation, this is caused by the urgency of economic aspect to increase fund and wealth as well, the source of economic activity is a trade, because trade will make money roll faster and it will give benefit in every aspect include public and privat aspect, in this era trade activity not only based on nation or continent but it is expanded into inter-nation and inter-continent or in the other word is international, the great scale in trade activity is create a new issue, because a few people is try to violate the other person in trade activity especially in great scale like inter-nation, in this case due process of law is needed to ensure trade activity is going good as well and to reduce jeopadize in international economic activity. Key Note : Due process of law in export import activity

Abstract

 Trade is becoming the more important activity in this era, because the vital foundation of  economic aspect is a trade, but to realize that sometimes is more fund or capital is needed to expand trade limit, that not was an easy task because fund not come so freely it will take some refund from debitor to creditor in this situation fiducia will be the best choice of that, because is not take hard and long procedure and the guarantee still at creditor hand, so the creditor can used to expand his trade activity, but thats not the problem because the right issue is how can a goverment to make sure that process will be succes and dont jeopadize each subject, Act No 42 Year 1999 about Fiducia is established to resolve that issue to regulating the process of fiducia to help someone who need more fund with easy refund. Key Note : Fiducia in persfective of Act No 42 Year 1999

Abstract

The development of currency trading is not only using the cash as a payment instrument for a transaction. For example is the emergence of non-cash payments such as negotiable instruments. That type of instrument offers a more effective and safer way than using the cash. Along with the development of the technology, a non-cash payment innovation emerged, which characteristics, at a glance, similar to negotiable instruments, such as credit cards, debit cards, and electronic money products which gives a safer and more efficient way than using the cash for a transaction. Based on this, led to the view that non-cash payment instruments such as credit cards, debit cards, and electronic money products can be classified as negotiable instruments. However, that classification must be done by reviewing the relevant regulations, such as Commercial Code and else and also observing the doctrines in the perspective of the science concerned, to state that the development of such instruments can be classified as negotiable instruments or not.Keywords:    Negotiable instruments, Letter of Value, Credit Cards, Debit Cards, Electronic Money Products, Classification.

Abstract

The specific task of the commercial banks are as follows: the bank must distribute most of the credit for developing the activities of the cooperatives and entrepreneurs economically weak or small entrepreneurs, the public banking that provides credit in foreign currency required to distribute some the foreign currency credit to finance the activities of non-oil exports and required to perform an assessment of the fulfillment the terms of the feasibility of the debtor's business. In carrying out its functions, the bank must still run banking principles contained in the articles contained in the Banking Act. It is often in distribute the credit, the bank requires the third party, such as the insurance companies. The purpose of insurance companies is to minimize the risks that may be experienced by the bank as debtors failed to pay. The bank is very concerned with their insurance company. There are various types of loans that cannot be separated by the insurance, this study focuses on consumer credit in PT. Bank Jatim. In practice, especially consumer credit lending cannot be separated from the role of the insurance companies. But in operating the bussiness, the insurance companies should also continue to apply the principles of general insurance. The application of the insurance principle is intended that no aggrieved parties. Generally speaking, there will be a conflict of interest between the application of the principles of insurance carried by the insurance company as an insurer with the business aspect of the field of insurance and banking.

Abstract

This study aims to provide insights on the Constitutional Court Decision Number 97 / PUU / XIV / 2016 on filling-in the space for religion or belief in the Identity Card (KTP) has maslahah value for the community. This can be declared true after an analysis of the objectives and their enforcement in Indonesia has been carried out. Maslahah values are manifested by the certainty of the beliefs contained in the KTP. So that in socializing, the people may know for sure one’s religion or belief to guarantee or minimize the occurrence of interfaith and belief marriages. This study uses a normative method with a statutory and conceptual approach. The results of the study conclude that the Constitutional Court's decision has maslahah principles in Islamic thought as it provides recognition of rights, recognition of access to rights to public services, public services on marriage registration as a form of certainty, is an order in the Marriage Law, legal certainty creates rights and obligations for spouses, marriage registration creates protection, the state is obliged to provide protection for its citizens

Abstract

Perkembangan industri asuransi di Indonesia makin berkembang, hal ini dapat dilihat dari makin meningkatnya kesadaran masyarakat untuk ikut berasuransi. Menangkap peluang tersebut, maka saat ini banyak perusahaan asuransi bermunculan dengan menawarkan banyak produk dan jenis asuransi yang kompetitif. Asuransi syariah menjadi salah satu pilihan masyarakat yang dianggap sangat diminati karena dianggap lebih baik daripada asuransi konvensional. Dalam praktiknya perusahaan asuransi tidak semuanya memahami prinsip-prinsip dasar asuransi syariah sehingga pada praktiknya tidak sesuai dengan prinsip-prinsip tersebut. Untuk itu perlu ada kajian yang lebih dalam terkait dengan teknis dan prinsip asuransi syariah yang saat ini dijalankan oleh perusahaan-perusahaan asuransi syariah. Maka perlu diketahui pula oleh para nasabah, calon nasabah dan terutama perusahaan asuransi syariah mengenai prinsip General Takaful System (GTS). Diharapkan perusahaan tersebut benar-benar menjalankan prinsip asuransi syariah sesuai dengan Al-Quran, Hadist dan Peraturan Perundang-undangan yang berlaku di Indonesia agar tercapai kesejahteraan bersama.The development of insurance industry in Indonesia is growing, it can be seen from the increasing awareness of the public to participate in insurance. Capturing these opportunities, then the current many insurance companies have sprung up to offer a lot of products and competitive insurance types. Takaful be one of the people who are considered highly desirable because it is considered better than conventional insurance. In practice, insurance companies do not all understand the basic principles of Islamic insurance so that in practice is not in accordance with these principles. For that there needs to be a deeper study related to the technical principles of Islamic insurance which is currently run by insurance companies’ sharia. Then it needs to be known also by its customers, prospective customers and especially the Islamic insurance company regarding the principle of General Takaful System (GTS). It is expected that the company is actually running the principles of Islamic insurance in accordance with the Al-Qur’an, Hadist and legislations in force in Indonesia in order achieve common prosperity.

Abstract

In Law No. 28 of 2014 concerning Copyright, copyright can be granted to photography and painting as works of art produced by human creativity and initiative. Problems arise in realism works of art in the form of painting or photography containing nudist elements. By applying normative juridical research approaches of legislation (statute approach) and conceptual approach, this study examined restrictions based on the meaning of one article that works being the object of copyright protection must comply with morals, religion, morality, public order or national defense and security. The findings revealed that copyright objects in the form of works of art containing nudist elements, as long as they follow the culture of the local community and are not intended to arouse sexual arousal, are entitled to copyright protection.

Abstract

One alternative to accelerate infrastructure development in Indonesia is by involving the private sectors in the financing and development. In principle, Public Private Partnerships (PPP) can be classified into two, namely: a partnership project which idea came from the initiation of the government (solicited) and partnership project which idea came from the initiation of the business entities (unsolicited). To facilitate the implementation of the Public Private Partnership (PPP), the financing instruments that exist currently may be used to support the implementation of the Public Private Partnership (PPP). The importance of involving a third party other than investor and the government is related to the fulfillment of capital requirements and risks sharing in the event of loss. Although the rules clearly have been enacted, the infrastructure projects in Public Private Partnership (PPP) seem less attractive to investors. One of the causes is that the capital required by investors is too great with very high risk when investment in infrastructure is slow yielding. It is important to propose the scheme of sustainable financing which may allocate the PPPs’ risks proportionally.Until now, the government is too fixated with large cooperation projects with the private sectors, while the scheme offered is a Build-Operation-Transfer (BOT) scheme. This scheme is sometimes burden the investors, because the greatest risk is in the hands of investors. Regarding the financing of the Public Private Partnership (PPP), conventional financing such as a bank guarantee or sharia financing (‘kafalah’) can be carried out. Two such financing can be used in the Public Private Partnership (PPP), so it will increase the interest of investors to build infrastructure using Public Private Partnership (PPP). It is because such financing can overcome the difficulties of gaining large capital and also reduce the burden of risk borne by investors.
